<num style="-uslm-dtd:enum" value="8162">Sec. 8162. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s8903">40 U.S.C. 8903 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Dwight D. Eisenhower Memorial. </heading><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress finds that—</chapeau>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/a/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the people of the United States feel a deep debt of gratitude to Dwight D. Eisenhower, who served as Supreme Commander of the Allied Forces in Europe in World War II and subsequently as 34th President of the United States; and</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/a/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an appropriate permanent memorial to Dwight D. Eisenhower should be created to perpetuate his memory and his contributions to the United States.</content>
</paragraph></subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/b" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Commission.—</heading><content style="-uslm-dtd:text">There is established a commission to be known as the “<quotedText style="-uslm-dtd:quote">Dwight D. Eisenhower Memorial Commission</quotedText>” (referred to in this section as the “<quotedText style="-uslm-dtd:quote">Commission</quotedText>”).</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/c" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Membership.—</heading><chapeau style="-uslm-dtd:text">The Commission shall be composed of—</chapeau>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/c/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">four persons appointed by the President, not more than two of whom may be members of the same political party;</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/c/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">four Members of the Senate appointed by the President Pro Tempore of the Senate in consultation with the Majority Leader and Minority Leader of the Senate, of which not more than two appointees may be members of the same political party; and</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/c/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">four Members of the House of Representatives appointed by the Speaker of the House of Representatives in consultation with the Majority Leader and Minority Leader of the House of Representatives, of which not more than two appointees may be members of the same political party.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/d" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Chair and Vice Chair.—</heading><content style="-uslm-dtd:text">The members of the Commission shall select a Chair and Vice Chair of the Commission. The Chair and Vice Chair shall not be members of the same political party.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/e" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Vacancies.—</heading><content style="-uslm-dtd:text">Any vacancy in the Commission shall not affect its powers if a quorum is present, but shall be filled in the same manner as the original appointment.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/f" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Meetings.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/f/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Initial meeting.—</heading><content style="-uslm-dtd:text">Not later than 45 days after the date on which a majority of the members of the Commission have been appointed, the Commission shall hold its first meeting.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/f/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Subsequent meetings.—</heading><content style="-uslm-dtd:text">The Commission shall meet at the call of the Chair.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/g" styleType="OLC">
<num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Quorum.—</heading><content style="-uslm-dtd:text">A majority of the members of the Commission shall constitute a quorum but a lesser number of members may hold hearings.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/h" styleType="OLC">
<num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">No Compensation.—</heading><content style="-uslm-dtd:text">A member of the Commission shall serve without compensation, but may be reimbursed for expenses incurred in carrying out the duties of the Commission.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Duties.—</heading><content style="-uslm-dtd:text">The Commission shall consider and formulate plans for such a permanent memorial to Dwight D. Eisenhower, including its nature, design, construction, and location.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/j" styleType="OLC">
<num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Powers of the Commission.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/j/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Powers.—</heading><chapeau style="-uslm-dtd:text">The Commission may—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">make such expenditures for services and materials for the purpose of carrying out this section as the Commission considers advisable from funds appropriated or received as gifts for that purpose;</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">solicit and accept contributions to be used in carrying out this section or to be used in connection with the construction or other expenses of the memorial;</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A/iii" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">hold hearings and enter into contracts;</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A/iv" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">enter into contracts for specialized or professional services as necessary to carry out this section; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/A/v" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">take such actions as are necessary to carry out this section.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/j/1/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Specialized or professional services.—</heading><chapeau style="-uslm-dtd:text">Services under subparagraph (A)(iv) may be—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">obtained without regard to the provisions of title 5, United States Code, including section 3109 of that title; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/1/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">may be paid without regard to the provisions of title 5, United States Code, including chapter 51 and subchapter III of chapter 53 of that title.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/j/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Gifts of property.—</heading><content style="-uslm-dtd:text">The Commission may accept gifts of real or personal property to be used in carrying out this section, including to be used in connection with the construction or other expenses of the memorial.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/j/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Federal cooperation.—</heading><content style="-uslm-dtd:text">At the request of the Commission, a Federal department or agency may provide any information or other assistance to the Commission that the head of the Federal department or agency determines to be appropriate.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/j/4" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Powers of members and agents.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/j/4/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">If authorized by the Commission, any member or agent of the Commission may take any action that the Commission is authorized to take under this section.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/j/4/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Architect.—</heading><chapeau style="-uslm-dtd:text">The Commission may appoint an architect as an agent of the Commission to—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/4/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">represent the Commission on various governmental source selection and planning boards on the selection of the firms that will design and construct the memorial; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/j/4/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">perform other duties as designated by the Chairperson of the Commission.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/j/4/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Treatment.—</heading><content style="-uslm-dtd:text">An authorized member or agent of the Commission (including an individual appointed under subparagraph (B)) providing services to the Commission shall be considered an employee of the Federal Government in the performance of those services for the purposes of chapter 171 of title 28, United States Code, relating to tort claims.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/j/5" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Travel.—</heading><content style="-uslm-dtd:text">Each member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/k" styleType="OLC">
<num style="-uslm-dtd:enum" value="k">(k) </num><heading style="-uslm-dtd:header">Reports.—</heading><chapeau style="-uslm-dtd:text">The Commission shall—</chapeau>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/k/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">report the plans under subsection (i), together with recommendations, to the President and the Congress at the earliest practicable date; and</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/k/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in the interim, make annual reports on its progress to the President and the Congress.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/l" styleType="OLC">
<num style="-uslm-dtd:enum" value="l">(l) </num><heading style="-uslm-dtd:header">Applicability of Other Laws.—</heading><content style="-uslm-dtd:text">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/m" styleType="OLC">
<num style="-uslm-dtd:enum" value="m">(m) </num><heading style="-uslm-dtd:header">Authority to Establish Memorial.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/m/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission may establish a permanent memorial to Dwight D. Eisenhower on land under the jurisdiction of the Secretary of the Interior in the District of Columbia or its environs.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/m/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Compliance with standards for commemorative works.—</heading><content style="-uslm-dtd:text">The establishment of the memorial shall be in accordance with the Commemorative Works Act (40 U.S.C. 1001 et seq.).</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/m/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Expiration.—</heading><content style="-uslm-dtd:text">Any reference in section 8903(e) of title 40, U.S.C. to the expiration at the end of, or extension beyond, a 7-year period shall be considered to be a reference to an expiration on, or extension beyond, September 30, 2017.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/n" styleType="OLC">
<num style="-uslm-dtd:enum" value="n">(n) </num><heading style="-uslm-dtd:header">Memorial Fund.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/n/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is created in the Treasury a fund for the memorial to Dwight D. Eisenhower that includes amounts contributed under subsection (j)(2).</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/n/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use of fund.—</heading><content style="-uslm-dtd:text">The fund shall be used for the expenses of establishing the memorial.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/n/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Interest.—</heading><content style="-uslm-dtd:text">The Secretary of the Treasury shall credit to the fund the interest on obligations held in the fund.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/o" styleType="OLC">
<num style="-uslm-dtd:enum" value="o">(o) </num><heading style="-uslm-dtd:header">Staff and Support Services.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/o/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/o/1/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Powers.—</heading><chapeau style="-uslm-dtd:text">The Commission may—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/1/A/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">make such expenditures for services and materials for the purpose of carrying out this section as the Commission considers advisable from funds appropriated or received as gifts for that purpose;</content>

<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/1/A/iv" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">enter into contracts for specialized or professional services as necessary to carry out this section; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/1/A/v" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">take such actions as are necessary to carry out this section.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/o/1/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Specialized or professional services.—</heading><chapeau style="-uslm-dtd:text">Services under subparagraph (A)(iv) may be—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/1/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">obtained without regard to the provisions of title 5, United States Code, including section 3109 of that title; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/1/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">may be paid without regard to the provisions of title 5, United States Code, including chapter 51 and subchapter III of chapter 53 of that title.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/o/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Gifts of property.—</heading><content style="-uslm-dtd:text">The Commission may accept gifts of real or personal property to be used in carrying out this section, including to be used in connection with the construction or other expenses of the memorial.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/o/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Federal cooperation.—</heading><content style="-uslm-dtd:text">At the request of the Commission, a Federal department or agency may provide any information or other assistance to the Commission that the head of the Federal department or agency determines to be appropriate.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/o/4" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Powers of members and agents.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/o/4/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">If authorized by the Commission, any member or agent of the Commission may take any action that the Commission is authorized to take under this section.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/o/4/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Architect.—</heading><chapeau style="-uslm-dtd:text">The Commission may appoint an architect as an agent of the Commission to—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/4/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">represent the Commission on various governmental source selection and planning boards on the selection of the firms that will design and construct the memorial; and</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/79/tVIII/s8162/o/4/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">perform other duties as designated by the Chairperson of the Commission.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/79/tVIII/s8162/o/4/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Treatment.—</heading><content style="-uslm-dtd:text">An authorized member or agent of the Commission (including an individual appointed under subparagraph (B)) providing services to the Commission shall be considered an employee of the Federal Government in the performance of those services for the purposes of chapter 171 of title 28, United States Code, relating to tort claims.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/79/tVIII/s8162/o/5" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Travel.—</heading><content style="-uslm-dtd:text">Each member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/p" styleType="OLC">
<num style="-uslm-dtd:enum" value="p">(p) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated such sums as necessary to carry out this section.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/79/tVIII/s8162/q" styleType="OLC">
<num style="-uslm-dtd:enum" value="q">(q) </num><heading style="-uslm-dtd:header">Appropriation of Funds.—</heading><content style="-uslm-dtd:text">In addition to amounts provided elsewhere in this Act, there is appropriated to the Commission $300,000, to remain available until expended.</content>
