            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">AMENDMENTS TO FLOOD INSURANCE ACT OF 1968 </heading>
            <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tI/s107" styleType="OLC">
                <num style="-uslm-dtd:enum" value="107">SEC. 107. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4101">42 U.S.C. 4101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GEOSPATIAL DIGITAL FLOOD HAZARD DATA. </heading>
                <content style="-uslm-dtd:text" class="block">For the purposes of flood insurance and floodplain management activities conducted pursuant to the National Flood Insurance Program under the National Flood Insurance Act of 1968 (42 U.S.C. 4001 et seq.), geospatial digital flood hazard data distributed by the Federal Emergency Management Agency, or its designee, or the printed products derived from that data, are interchangeable and legally equivalent for the determination of the location of 1 in 100 year and 1 in 500 year flood planes, provided that all other geospatial data shown on the printed product meets or exceeds any accuracy standard promulgated by the Federal Emergency Management Agency.</content>

            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tI/s109" styleType="OLC">
                <num style="-uslm-dtd:enum" value="109">SEC. 109. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4101">42 U.S.C. 4101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REITERATION OF FEMA RESPONSIBILITY TO MAP MUDSLIDES. </heading>
                <content style="-uslm-dtd:text" class="block">As directed in section 1360(b) of the National Flood Insurance Act of 1968 (42 U.S.C. 4101(b)), the Director of the Federal Emergency Management Agency is again directed to accelerate the identification of risk zones within flood-prone and mudslide-prone areas, as provided by subsection (a)(2) of such section 1360, in order to make known the degree of hazard within each such zone at the earliest possible date.</content>

        </title>
        <title style="-uslm-dtd:title" identifier="/us/sComp/108/264/tII" styleType="OLC">
            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">MISCELLANEOUS PROVISIONS </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s201" styleType="OLC" role="definitions">
                <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">In this title, the following definitions shall apply:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s201/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Director</term>” means the Director of the Federal Emergency Management Agency.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s201/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Flood insurance policy.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">flood insurance policy</term>” means a flood insurance policy issued under the National Flood Insurance Act of 1968 (42 U.S.C. et seq.).</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s201/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Program.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Program</term>” means the National Flood Insurance Program established under the National Flood Insurance Act of 1968 (42 U.S.C. 4001 et seq.).</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s202" styleType="OLC">
                <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SUPPLEMENTAL FORMS. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s202/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID7BE10680FBE043F780A9927975589679" class="footnoteRef">1</ref> the Director shall develop supplemental forms to be issued in conjunction with the issuance of a flood insurance policy that set forth, in simple terms—</chapeau><footnote id="ID7BE10680FBE043F780A9927975589679" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the exact coverages being purchased by a policyholder;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any exclusions from coverage that apply to the coverages purchased;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">an explanation, including illustrations, of how lost items and damages will be valued under the policy at the time of loss;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/a/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the number and dollar value of claims filed under a flood insurance policy over the life of the property, and the effect, under the National Flood Insurance Act of 1968 (42 U.S.C. 4001 et seq.), of the filing of any further claims under a flood insurance policy with respect to that property; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/a/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">any other information that the Director determines will be helpful to policyholders in understanding flood insurance coverage.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s202/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Distribution.—</heading><chapeau style="-uslm-dtd:text">The forms developed under subsection (a) shall be given to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">all holders of a flood insurance policy at the time of purchase and renewal; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s202/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">insurance companies and agents that are authorized to sell flood insurance policies.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s203" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACKNOWLEDGEMENT FORM. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s203/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID1D11BD22869C489B9B1755E5079885F0" class="footnoteRef">1</ref> the Director shall develop an acknowledgement form to be signed by the purchaser of a flood insurance policy that contains—</chapeau><footnote id="ID1D11BD22869C489B9B1755E5079885F0" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s203/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">an acknowledgement that the purchaser has received a copy of the standard flood insurance policy, and any forms developed under section 202; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s203/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an acknowledgement that the purchaser has been told that the contents of a property or dwelling are not covered under the terms of the standard flood insurance policy, and that the policyholder has the option to purchase additional coverage for such contents.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s203/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Distribution.—</heading><content style="-uslm-dtd:text">Copies of an acknowledgement form executed under subsection (a) shall be made available to the purchaser and the Director.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s204" styleType="OLC">
                <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FLOOD INSURANCE CLAIMS HANDBOOK. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s204/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="IDAF315FD65BD34350951CE9B4BF8169A4" class="footnoteRef">1</ref> the Director shall develop a flood insurance claims handbook that contains—</chapeau><footnote id="IDAF315FD65BD34350951CE9B4BF8169A4" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s204/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of the procedures to be followed to file a claim under the Program, including how to pursue a claim to completion;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s204/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">how to file supplementary claims, proof of loss, and any other information relating to the filing of claims under the Program; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s204/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">detailed information regarding the appeals process established under section 205.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s204/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Distribution.—</heading><chapeau style="-uslm-dtd:text">The handbook developed under subsection (a) shall be made available to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s204/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">each insurance company and agent authorized to sell flood insurance policies; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s204/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">each purchaser, at the time of purchase and renewal, of a flood insurance policy, and at the time of any flood loss sustained by such purchaser.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s205" styleType="OLC">
                <num style="-uslm-dtd:enum" value="205">SEC. 205. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">APPEAL OF DECISIONS RELATING TO FLOOD INSURANCE COVERAGE. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID6E44D115F3F14670B9ABB4AF21FA3969" class="footnoteRef">1</ref> the Director shall, by regulation, establish an appeals process through which holders of a flood insurance policy may appeal the decisions, with respect to claims, proofs of loss, and loss estimates relating to such flood insurance policy, of—</chapeau><footnote id="ID6E44D115F3F14670B9ABB4AF21FA3969" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s205/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any insurance agent or adjuster, or insurance company; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s205/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any employee or contractor of the Federal Emergency Management Agency.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s206" styleType="OLC">
                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STUDY AND REPORT ON USE OF COST COMPLIANCE COVERAGE. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">Not later than 1 year after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID92F45921A4EC419F956168864918F88D" class="footnoteRef">1</ref> the Director of the Federal Emergency Management Agency shall submit to Congress a report that sets forth—</chapeau><footnote id="ID92F45921A4EC419F956168864918F88D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s206/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the use of cost of compliance coverage under section 1304(b) of the National Flood Insurance Act of 1968 (42 U.S.C. 4011(b)) in connection with flood insurance policies;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s206/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any barriers to policyholders using the funds provided by cost of compliance coverage under that section 1304(b) under a flood insurance policy, and recommendations to address those barriers; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s206/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the steps that the Federal Emergency Management Agency has taken to ensure that funds paid for cost of compliance coverage under that section 1304(b) are being used to lessen the burdens on all homeowners and the Program.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/108/264/tII/s207" styleType="OLC">
                <num style="-uslm-dtd:enum" value="207">SEC. 207. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">MINIMUM TRAINING AND EDUCATION REQUIREMENTS. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">The Director of the Federal Emergency Management Agency shall, in cooperation with the insurance industry, State insurance regulators, and other interested parties—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s207/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">establish minimum training and education requirements for all insurance agents who sell flood insurance policies; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s207/2" styleType="OLC">

                <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s4011">42 U.S.C. 4011 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GAO STUDY AND REPORT. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s208/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Study.—</heading><chapeau style="-uslm-dtd:text">The Comptroller General of the United States shall conduct a study of—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s208/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the adequacy of the scope of coverage provided under flood insurance policies in meeting the intended goal of Congress that flood victims be restored to their pre-flood conditions, and any recommendations to ensure that goal is being met;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s208/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the adequacy of payments to flood victims under flood insurance policies; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/108/264/tII/s208/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the practices of the Federal Emergency Management Agency and insurance adjusters in estimating losses incurred during a flood, and how such practices affect the adequacy of payments to flood victims.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/108/264/tII/s208/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 1 year after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID9B662A4ED75E450CA72D6DDBFA8E5168" class="footnoteRef">1</ref> the Comptroller General shall submit to Congress a report regarding the results of the study under subsection (a).</content><footnote id="ID9B662A4ED75E450CA72D6DDBFA8E5168" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>

                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">Not later than 3 months after the date of enactment of this Act,<ref style="-uslm-dtd:footnote-ref" idref="ID2580515BB6A0425D8381B9B6DC900748" class="footnoteRef">1</ref> the Director shall submit a report on any changes or modifications made to the fee schedule or fee payment arrangements between the Federal Emergency Management Agency and insurance adjusters who provide services with respect to flood insurance policies to—</chapeau><footnote id="ID2580515BB6A0425D8381B9B6DC900748" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The date of enactment was June 30, 2004.</p></footnote>
