    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the provisions of title 5, United States Code, which are commonly referred to as the "Hatch Act", to scale back the provision forbidding certain State and local employees from seeking elective office, clarify the application of certain provisions to the District of Columbia, and modify the penalties which may be imposed for certain violations under subchapter III of chapter 73 of that title.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/230/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Hatch Act Modernization Act of 2012</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/230/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">PERMITTING STATE AND LOCAL EMPLOYEES TO BE CANDIDATES FOR ELECTIVE OFFICE. </heading>
            <content style="-uslm-dtd:text" class="block">Section 1502(a)(3) of title 5, United States Code, is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">if the salary of the employee is paid completely, directly or indirectly, by loans or grants made by the United States or a Federal agency, be a candidate for elective office.”</content>
            </paragraph></quotedContent>.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/230/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">APPLICABILITY OF PROVISIONS RELATING TO STATE AND LOCAL EMPLOYEES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">State or Local Agency.—</heading><content style="-uslm-dtd:text">Section 1501(2) of title 5, United States Code, is amended by inserting “<quotedText style="-uslm-dtd:quote">, or the executive branch of the District of Columbia, or an agency or department thereof</quotedText>” before the semicolon.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">State or Local Officer or Employee.—</heading><content style="-uslm-dtd:text">Section 1501(4) of title 5, United States Code, is amended by striking subparagraph (B) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">an individual employed by an educational or research institution, establishment, agency, or system which is supported in whole or in part by—</chapeau>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">a State or political subdivision thereof;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the District of Columbia; or</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">a recognized religious, philanthropic, or cultural organization.”</content>
                    </clause>
                </subparagraph></quotedContent>.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Exception of Certain Officers.—</heading><chapeau style="-uslm-dtd:text">Section 1502(c)(3) of title 5, United States Code, is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">‘<quotedText style="-uslm-dtd:quote">or municipality</quotedText>’ and inserting ‘<quotedText style="-uslm-dtd:quote">, municipality, or the District of Columbia</quotedText>’</quotedText>”; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">‘<quotedText style="-uslm-dtd:quote">or municipal</quotedText>’ and inserting ‘<quotedText style="-uslm-dtd:quote">, municipal, or the District of Columbia</quotedText>’</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Merit Systems Protection Board Orders.—</heading><content style="-uslm-dtd:text">Section 1506(a)(2) of title 5, United States Code, is amended by inserting “<quotedText style="-uslm-dtd:quote">(or in the case of the District of Columbia, in the District of Columbia)</quotedText>” after “<quotedText style="-uslm-dtd:quote">the same State</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Provisions Relating to Federal Employees Made Inapplicable.—</heading><chapeau style="-uslm-dtd:text">Section 7322(1) of title 5, United States Code, is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subparagraph (A), by adding “<quotedText style="-uslm-dtd:quote">or</quotedText>” at the end;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subparagraph (B), by striking “<quotedText style="-uslm-dtd:quote">or</quotedText>” at the end;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/e/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by striking subparagraph (C); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s3/e/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">services;</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">services or an individual employed or holding office in the government of the District of Columbia;</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s3/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Employees Residing in Certain Municipalities.—</heading><content style="-uslm-dtd:text">Section 7325(1) of title 5, United States Code, is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">“(1) </num><chapeau style="-uslm-dtd:text">the municipality or political subdivision is—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the District of Columbia;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">in Maryland or Virginia and in the immediate vicinity of the District of Columbia; or</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">a municipality in which the majority of voters are employed by the Government of the United States; and”</content>
                    </subparagraph>
                </paragraph></quotedContent>.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/230/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">HATCH ACT PENALTIES FOR FEDERAL EMPLOYEES. </heading>
            <content style="-uslm-dtd:text" class="block">Chapter 73 of title 5, United States Code, is amended by striking section 7326 and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
            <section style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7326">“SEC. 7326. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s7326">5 U.S.C. 7326</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Penalties </heading>
                <content style="-uslm-dtd:text" class="block">“An employee or individual who violates section 7323 or 7324 shall be subject to removal, reduction in grade, debarment from Federal employment for a period not to exceed 5 years, suspension, reprimand, or an assessment of a civil penalty not to exceed $1,000.”</content>
            </section></quotedContent>.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/230/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s1501">5 U.S.C. 1501 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">This Act and the amendments made by this Act shall take effect 30 days after the date of enactment of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/230/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s7326">5 U.S.C. 7326 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Applicability Rule.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s5/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (2), the amendment made by section 4 shall apply with respect to any violation occurring before, on, or after the effective date of this Act.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/230/s5/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exception.—</heading><chapeau style="-uslm-dtd:text">The amendment made by section 4 shall not apply with respect to an alleged violation if, before the effective date of this Act—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/230/s5/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Special Counsel has presented a complaint for disciplinary action, under section 1215 of title 5, United States Code, with respect to the alleged violation; or</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/230/s5/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the employee alleged to have committed the violation has entered into a signed settlement agreement with the Special Counsel with respect to the alleged violation.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
