PROLIFERATION OF WEAPONS OF MASS DESTRUCTION AND THEIR DELIVERY SYSTEMS 
DECLARED BY EXECUTIVE ORDER 12938 ON NOVEMBER 14, 1994, AS AMENDED, IS 
 TO CONTINUE IN EFFECT BEYOND NOVEMBER 14, 2005, PURSUANT TO 50 U.S.C.

To the Congress of the United States:
    Section 202(d) of the National Emergencies Act (50 U.S.C. 
1622(d)) provides for the automatic termination of a national 
emergency unless, prior to the anniversary date of its 
declaration, the President publishes in the Federal Register 
and transmits to the Congress a notice stating that the 
emergency is to continue in effect beyond the anniversary date. 
In accordance with this provision, I have sent to the Federal 
Register for publication the enclosed notice, stating that the 
emergency posed by the proliferation of weapons of mass 
destruction and their means of delivery declared by Executive 
Order 12938 on November 14, 1994, as amended, is to continue in 
effect beyond November 14, 2005. The most recent notice 
continuing this emergency was signed on November 4, 2004, and 
published in the Federal Register on November 8, 2004 (69 FR 
64637).
    Because the proliferation of weapons of mass destruction 
and the means of delivering them continues to pose an unusual 
and extraordinary threat to the national security, foreign 
policy, and economy of the United States, I have determined the 
national emergency previously declared must continue in effect 
beyond November 14, 2005.

   Continuation of National Emergency Regarding the Proliferation of 
                      Weapons of Mass Destruction

    On November 14, 1994, by Executive Order 12938, President 
Clinton declared a national emergency with respect to the 
unusal and extraordinary threat to the national security, 
foreign poliy, and economy of the United States posed by the 
proliferation of nuclear, biological, and chemical weapons 
(weapons of mass destruction) and the means of delivering such 
weapons. On July 28, 1998, the President issued Executive Order 
13094 amending Executive Order 12938 to respond more 
effectively to the worldwide threat of weapons of mass 
destruction proliferation activities. On June 28, 2005, I 
issued Executive Order 13382 which, inter alia, further amended 
Executive Order 12938 to improve our ability to combat 
proliferation. Because the proliferation of weapons of mass 
destruction and the means of delivering them continues to pose 
an unusal and extraordinary threat to the national security, 
foreign policy, and economy of the United States, the national 
emergency first declared on November 14, 1994, must continue in 
effect beyond November 14, 2005. In accordance with section 
202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I 
am continuing for 1 year the national emergency declared in 
Executive Order 12938, as amended.
    This notice shall be published in the Federal Register and 
transmitted to the Congress.
