Dear Mr. Speaker: I ask the Congress to consider the
enclosed request for the Equal Employment Opportunity
Commission (EEOC). This request would provide an additional
$18.3 million to the EEOC in FY 2003. It is needed for the EEOC
to avoid furloughing its entire workforce for as many as 19
days in FY 2003, which would significantly disrupt its ability
to conduct its enforcement responsibilities.
The details of this request are set forth in the enclosed
letter from the Director of the Office of Management and
Budget. I concur with his comments and observations.

Submitted for your consideration is a request for the Equal
Employment Opportunity Commission (EEOC).
This request would provide an additional $18.3 million to
EEOC in FY 2003. The request is needed for EEOC to avoid
furloughing its entire workforce for as many as 19 days in FY
2003, which would significantly disrupt its ability to conduct
its enforcement responsibilities. Your Administration
recognized late last year that certain costs, such as rent, and
compensation and related expenses were going to exceed the
levels requested for FY 2003. To address this issue, on January
7, 2003, you transmitted to the Congress a request for EEOC in
your proposal to amend the FY 2003 Budget. Unfortunately, the
Congress did not support that request in the FY 2003 Omnibus
Appropriations Act that was enacted on February 20, 2003.
I have carefully reviewed this proposal and am satisfied
that it is necessary at this time. Therefore, I join the Chair
of EEOC in recommending that you transmit the proposal to the
Congress.

SALARIES AND EXPENSES
For an additional amount for ``Equal Employment Opportunity
Commission, Salaries and Expenses,'' $18,321,000.
This request would provide an additional $18.3 million for
the Equal Employment Opportunity Commission (EEOC). The request
is needed for EEOC to avoid furloughing its entire workforce
for as many as 19 days in FY 2003, which would significantly
disrupt its ability to conduct its enforcement
responsibilities.
An estimated $16.3 million of the request would cover
compensation and benefits costs that exceed the levels financed
within the FY 2003 appropriation of $306.8 million, and is
necessary to avoid furloughs. Another $2.0 million of the
request would restore funding for other administrative and
program activities for which reductions were necessary due to
the across-the-board rescission.
