UNANIMOUS CONSENT AGREEMENT
H.R. 5297 (ORDER NO. 435)
Ordered, That at 9:30 a.m. on Thursday, September 16, 2010, the
Senate resume consideration of H.R. 5297, an act to create the Small
Business Lending Fund Program to direct the Secretary of the Treasury to
make capital investments in eligible institutions in order to increase
the availability of credit for small businesses, to amend the Internal
Revenue Code of 1986 to provide tax incentives for small business job
creation, and for other purposes; provided, that all post-cloture time
be considered expired at 10:45 a.m.; provided further, that upon the
expiration of time, all pending amendments be withdrawn, except Amdt.
No. 4594, offered by the Senator from Nevada (Mr. Reid); further, that
for the duration of this agreement, no other amendments, motions or
points of order be in order except as noted in this agreement; further,
that the only motions in order be a Hatch motion to suspend the rules
with respect to R&D and a Grassley motion to suspend the rules with
respect to biodiesel; further, that the motions identified in this
agreement be those which have been submitted at the desk when this
agreement is entered into; further, that Senators Baucus, Hatch and
Grassley, or their designees, each control 15 minutes of debate.
Ordered further, That the votes with respect to the motions to
suspend occur in the order in which offered beginning at 10:45 a.m.;
provided, that after the first vote, the succeeding votes be limited to
10 minutes each; provided further, that prior to each vote, there be 2
minutes of debate equally divided and controlled in the usual form;
further, that upon disposition of the aforementioned motions, the Budget
Committee's pay-go letter be read into the Record, and that the
substitute amendment be agreed to; further, that the time until 12:00
noon be equally divided and controlled between the Leaders or their
designees, and that at 12:00 noon, the Senate then proceed to vote on
the motion to invoke cloture on H.R. 5297, as amended; further, that if
cloture is invoked on the bill, then all post-cloture time be yielded
back, the bill be read a third time, and the Senate then proceed to vote
on passage of the bill, as amended, with no intervening action or
debate.
Ordered further, That the filing deadline for first degree
amendments be 3:00 p.m. on Monday, September 13, 2010.
Ordered further, That the filing deadline for second degree
amendments be 12:00 noon on Tuesday, September 14, 2010.
Ordered further, That with respect to the cloture motions filed in
relation to H.R. 5297, the mandatory quorums required under Rule XXII be
waived.
Ordered further, That the time during any period of Morning
Business, recess or adjournment count post-cloture. (Aug. 5, Sept. 14,
15, 2010.)
