UNANIMOUS CONSENT AGREEMENT
H.R. 3326 (ORDER NO. 159)
Ordered, That at 3:15 p.m. on Tuesday, October 6, 2009, the Senate
resume consideration of H.R. 3326, an act making appropriations for the
Department of Defense for the fiscal year ending September 30, 2010, and
for other purposes; provided, that the time until 3:45 p.m. be for
debate only, with the time equally divided and controlled between the
Senator from Hawaii (Mr. Inouye) and the Senator from Mississippi (Mr.
Cochran) or their designees; provided further, that the Senate then
proceed to vote in relation to the pending amendments in the following
order:
--Amdt. No. 2567, offered by the Senator from Wyoming (Mr.
Barrasso);
--Amdt. No. 2588, offered by the Senator from Minnesota (Mr.
Franken);
--Amdt. No. 2596, offered by the Senator from Missouri (Mr. Bond);
--Amdt. No. 2565, offered by the Senator from Oklahoma (Mr.
Coburn);
--Amdt. No. 2566, offered by the Senator from Oklahoma (Mr.
Coburn);
--Amdt. No. 2601, offered by the Senator from Vermont (Mr.
Sanders);
--Amdt. No. 2618, offered by the Senator from Oklahoma (Mr.
Inhofe);
--Amdt. No. 2580, offered by the Senator from Arizona (Mr.
McCain);
--Amdt. No. 2584, offered by the Senator from Arizona (Mr.
McCain);
--Amdt. No. 2623, offered by the Senator from Hawaii (Mr. Inouye),
which is a side-by-side to McCain 2560;
--Amdt. No. 2560, offered by the Senator from Arizona (Mr.
McCain);
--Amdt. No. 2583, offered by the Senator from Arizona (Mr.
McCain); and
--Amdt. No. 2616 (as modified), offered by the Senator from
Connecticut (Mr. Lieberman).
Ordered further, That the above list of first degree amendments be
the only amendments remaining in order to H.R. 3326, other than the
pending committee substitute amendment; provided, that no second degree
amendment or side-by-side amendment be in order to any of the listed
amendments, except as provided above.
Ordered further, That it be in order for the Managers to offer a
Manager's amendment that has been cleared by the Managers and Leaders,
and that if offered, the amendment be considered and agreed to and the
motion to reconsider be considered made and laid upon the table;
provided, that in the case where the Managers are agreeable with a
modification of a listed amendment, then the amendment be so modified
with the changes agreed upon by the Managers.
Ordered further, That upon disposition of the listed amendments, the
committee reported substitute, as amended, be agreed to, and the motion
to reconsider be considered made and laid upon the table, the bill, as
amended, be read a third time, and the Senate then proceed to vote on
passage of the bill, as amended; provided, that upon passage, the Senate
insist on its amendment, request a conference with the House of
Representatives on the disagreeing votes of the two Houses, and the
Chair be authorized to appoint conferees on the part of the Senate, with
the Subcommittee appointed as conferees.
Ordered further, That if a point of order is raised against the
substitute amendment and it is sustained, then it be in order for a new
substitute amendment to be offered, minus the offending provision; that
the substitute be considered and agreed to, no further amendments be in
order, and the bill, as amended, be read a third time, with the
provisions in this agreement listed after adoption of the original
substitute amendment remaining in effect.
Ordered further, That the only time remaining be 2 minutes equally
divided in the usual form, prior to each vote, and that in any sequenced
votes the vote time be limited to 10 minutes each after the first vote.
