UNANIMOUS CONSENT AGREEMENTS
S. 2731(ORDER NO. 698)
1.--Ordered, That on Monday, July 14, 2008, upon the expiration of
Morning Business, the motion to proceed to the consideration of S. 2731,
a bill to authorize appropriations for fiscal years 2009 through 2013 to
provide assistance to foreign countries to combat HIV/AIDS,
tuberculosis, and malaria, and for other purposes, be agreed to and the
Senate proceed to the consideration of the measure; provided, that when
the bill is reported, the committee reported substitute amendment be
withdrawn and the Senator from Delaware (Mr. Biden) be recognized to
offer a Managers' substitute on behalf of himself and the Senator from
Indiana (Mr. Lugar); provided further, that the Managers' substitute be
agreed to and the bill as amended be considered original text for the
purpose of further amendment.
Ordered further, That the only first degree amendments in order be
those listed in this agreement and that they be subject to second degree
amendments which are relevant to the first degree amendment to which
offered. The amendments are as follows:
Mr. Bunning--reauthorization current law
Mr. Cornyn--sunset commission/review related to AIDS programs
Mr. DeMint--reduce spending authorizaton to $35b
Mr. DeMint--prohibit fund use for extraneous provisions not
related to AIDS--subject to a 60 vote threshold
Mr. Gregg--establish an IG within Global AIDS Office
Mr. Gregg--include cost-share agreements
Mr. Kyl--specify authorization level for last year will be $10b
Mr. Sessions-- strike lifting ban on visas for individuals HIV/
AIDS--subject to 60 vote threshold
Mr. Thune/Mr. Kyl--cut AIDS funding/devote to Indian law
enforcement or safe drinking water--subject to a 60 vote threshold
Mr. Vitter--IG for contributions to global fund
Ordered further, That where indicated, an amendment that requires a
60 vote threshold be agreed to if it achieves 60 votes and the motion to
reconsider be considereed made and laid upon the table; if it does not
achieve 60 votes, the amendment then be withdrawn.
Ordered further, That the provisions of this agreement with respect
to those amendments that are in order be invalidated if the text of the
amendments have not been provided to the Managers by 2:00 p.m. on
Monday, July 14, 2008 and the Managers, acting jointly, have so notified
the 2 Leaders by 3 p.m.
Ordered further, That if the Managers and Leaders, acting jointly,
have determined that a side-by-side amendment strategy is the
appropriate approch for the listed amendments, it then be in order for
side-by-side amendments to be offered, with the Majority amendment
getting the first vote in any side-by-side arrangement.
Ordered further, That upon disposition of all amendments, the bill
as amended be read a third time and the Foreign Relations Committee be
discharged from further consideration of H.R. 5501, the House companion
measure, and the Senate proceed to its immediate consideration; that all
after the enacting clause be striken and the text of S. 2731, as
amended, be inserted in lieu thereof, the bill be read a third time and
the Senate proceed to vote on passage of H.R. 5501, as amended; provided
further, that upon passage of H.R. 5501, S. 2731 be returned to the
Calendar. (July 11, 2008.)
S. 1974
2.--Ordered, That S. 1974, a bill to make technical corrections
related to the Pension Protection Act of 2006, remain at the desk. (Mar.
31, 2008.)
VETO MESSAGE ON S. 5
3.--Ordered, That the veto message on S. 5, the Stem Cell Research
Enhancement Act of 2007, be considered as read and that it be printed in
the Record and spread in full upon the Journal.
Ordered further, That the message be held at the desk. (June 20,
2007.)

4.--Ordered, That if the Senate receives from the House a message on
H.R. 3997, an act to amend the Internal Revenue Code of 1986 to provide
earnings assistance and tax relief to members of the uniformed services,
volunteer firefighters, and Peace Corps volunteers, and for other
purposes, with an amendment that is not germane to the Senate amendment
or the underlying bill, that the bill and its amendments be referred to
