name-id="S370">Mr. Booker</sponsor> introduced the following joint resolution; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>JOINT RESOLUTION</legis-type><official-title display="yes">To direct the removal of United States Armed Forces from hostilities within or against the Islamic Republic of Iran that have not been authorized by Congress.</official-title></form><resolution-body><section id="id7623e1e8c9ba4a46bae46c4b96438465" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id0c01a6fd6d5d42de9fd9001dfa7d3428"><enum>(1)</enum><text>Congress has the sole power to declare war under article I, section 8, clause 11 of the United States Constitution.</text></paragraph><paragraph id="idde6bf785938f41b9872997e025c8753d"><enum>(2)</enum><text>The President has a constitutional responsibility to take actions to defend the United States and its territories, possessions, citizens, service members, and diplomats from attack.</text></paragraph><paragraph id="idcd8c64db94dd4d06bd67036ed19fd63f"><enum>(3)</enum><text>Congress has not declared war upon Iran or any person or organization within Iran, nor enacted a specific statutory authorization for the use of military force within or against Iran.</text></paragraph><paragraph id="id677c1dedd0674c66a6a61f661c6fcf9d"><enum>(4)</enum><text>The purpose of the War Powers Resolution, as stated in section 2(a) of such resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541(a)</external-xref>), is to <quote>insure that the collective judgment of both the Congress and the President will apply to the introduction of United States Armed Forces into hostilities.</quote>.</text></paragraph><paragraph id="id35784c964e514e3fb7b182aba800f6c7"><enum>(5)</enum><text>Section 3 of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1542">50 U.S.C. 1542</external-xref>) states, <quote>The President in every possible instance shall consult with Congress before introducing United States Armed Forces into hostilities or into situations where imminent involvement in hostilities is clearly indicated by the circumstances.</quote>.</text></paragraph><paragraph id="id5b8a5e904e38484b9499baecba93c040"><enum>(6)</enum><text>During January and February 2026, the United States carried out the largest military buildup in the Middle East since the United States invaded Iraq in 2003.</text></paragraph><paragraph id="idf4f63c9d3ee94d4ba97674e03edba532"><enum>(7)</enum><text>On February 28, 2026, President Trump launched <quote>Operation Epic Fury</quote> by ordering the United States Armed Forces to conduct air and missile strikes inside Iran’s territory, declaring that the strikes would be <quote>massive and ongoing</quote> and describing the circumstances as <quote>war,</quote> without congressional authorization or consultation.</text></paragraph><paragraph id="idf02445d7546f4240b282a4a5d9a35b98"><enum>(8)</enum><text>According to United States Central Command, as of early March 2026, more than 50,000 members of the United States Armed Forces were participating in Operation Epic Fury.</text></paragraph><paragraph id="idd019fa7c3954423ab30d950e481355c6"><enum>(9)</enum><text>Since the launching of Operation Epic Fury, Iran and its proxies have struck United States diplomatic and military facilities across the Middle East.</text></paragraph><paragraph id="idef9d17428c03471189275285c05abdc4"><enum>(10)</enum><text>As of April 13, 2026, Iran’s retaliatory strikes have killed 13 members of the United States Armed Forces and injured more than 350, underscoring the sacrifices our servicemembers and their families make.</text></paragraph><paragraph id="id19c1eaa6f3f0412b96de7dda0669882b"><enum>(11)</enum><text>In March 2026, the Department of Defense deployed 2,500 Marines and confirmed the deployment of troops from the 82nd Airborne Division, including the 1st Brigade Combat Team, to support ongoing and unauthorized military operations in the Middle East.</text></paragraph><paragraph id="id8ea6c887b0624e8ba3dac655cc9cf82d"><enum>(12)</enum><text>Since the launching of Operation Epic Fury, the global cost of oil and gas, fertilizer, and basic goods have surged making it harder for American families to make ends meet.</text></paragraph><paragraph id="id940ad73475a14d2e99cf3995fedfbde9"><enum>(13)</enum><text>This use of military force within or against Iran constitutes the introduction of United States Armed Forces into hostilities within the meaning of section 4(a) of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1543">50 U.S.C. 1543(a)</external-xref>).</text></paragraph><paragraph id="id15eb00475c994b0daa5e9bc8706395e9"><enum>(14)</enum><text>Section 1013 of the Department of State Authorization Act, Fiscal Years 1984 and 1985 (<external-xref legal-doc="usc" parsable-cite="usc/50/1546a">50 U.S.C. 1546a</external-xref>) provides that any joint resolution or bill requiring the removal of United States Armed Forces from imminent engagement in hostilities without a declaration of war or specific statutory authorization shall be considered in accordance with the expedited procedures under section 601(b) of the International Security and Arms Export Control Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/329">Public Law 94–329</external-xref>).</text></paragraph></section><section id="id8fff4c90dcfe4861a55cbefbcbff3725"><enum>2.</enum><header>Removal of United States Armed Forces from hostilities within or against Iran</header><subsection id="id1e1875f80c0b45b38115bcaa8364edc7"><enum>(a)</enum><header>Removal</header><text>Pursuant to section 1013 of the Department of State Authorization Act, Fiscal Years 1984 and 1985 (<external-xref legal-doc="usc" parsable-cite="usc/50/1546a">50 U.S.C. 1546a</external-xref>), and in accordance with section 601(b) of the International Security Assistance and Arms Export Control Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/329">Public Law 94–329</external-xref>), Congress hereby directs the President to remove the United States Armed Forces from hostilities within or against Iran, unless explicitly authorized by a declaration of war or a specific authorization for use of military force.</text></subsection><subsection id="id5fe2fd7a009241518cbb9120eea14c7b"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to prevent the United States from—</text><paragraph id="iddbc04ec090324751ad5046170c1d4f20"><enum>(1)</enum><text>defending against an attack on the United States or its personnel or facilities in other nations;</text></paragraph><paragraph id="id677e3e6fd5b44e3c8b1faa63a94646ab"><enum>(2)</enum><text>collecting, analyzing, or sharing intelligence, including with the State of Israel and partner countries who have been attacked by Iran since February 28, 2026, and other nations and international organizations as appropriate, related to threats from Iran or its proxies; or</text></paragraph><paragraph id="id0db8c7e99a0a433aaa404e929e773205"><enum>(3)</enum><text>assisting Israel and partner countries who have been attacked by Iran since February 28, 2026, and other nations—</text><subparagraph id="idc4a5db8bab174585841821346f1a3328"><enum>(A)</enum><text>in directly defending against retaliatory attacks upon their territories by Iran or its proxies; or</text></subparagraph><subparagraph id="idbeef100ceff64ea6945555de0112eaa8"><enum>(B)</enum><text>by providing defensive materiel support for such defensive measures.</text></subparagraph></paragraph></subsection></section></resolution-body></resolution>
