<enactingFormula style="-uslm-lc:I650120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d281e62" identifier="/us/bill/119/s/98/s1" style="-uslm-lc:I650146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Rural Broadband Protection Act of 2025</shortTitle>”.</content></section>
<section id="d281e72" identifier="/us/bill/119/s/98/s2" role="instruction" style="-uslm-lc:I650141"><num class="fontsize12" value="2">SEC. 2. </num><heading>VETTING PROCESS FOR PROSPECTIVE HIGH-COST UNIVERSAL SERVICE FUND APPLICANTS.</heading><content class="firstIndent0 fontsize10" id="xfd77e4e1-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650120">  Section 254 of the Communications Act of 1934 (<ref href="/us/usc/t47/s254">47 U.S.C. 254</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yfd783302-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="m">“(m) </num><heading class="fontsize10"><inline class="smallCaps">Vetting of High-Cost Fund Recipients</inline>.—</heading><paragraph class="firstIndent0 fontsize10" id="yfd783303-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection—</chapeau><subparagraph class="firstIndent0 fontsize10" id="yfd783304-3df9-11f1-850e-1d8f7df6e243" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>covered funding</term>’ means any new offer of high-cost universal service program funding, including funding provided through a reverse competitive bidding mechanism provided under this section, for the deployment of a broadband-capable network and the provision of supported services over the network; and</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yfd783305-3df9-11f1-850e-1d8f7df6e243" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the term ‘<term>new covered funding award</term>’ means an award of covered funding that is made based on an application submitted to the Commission on or after the date on which rules are promulgated under paragraph (2).</content></subparagraph>
</paragraph>
<paragraph class="firstIndent0 fontsize10" id="yfd783306-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Commission rulemaking</inline>.—</heading><content>Not later than 180 days after the date of enactment of this subsection, the Commission shall initiate a rulemaking proceeding to establish a vetting process for applicants for, and other recipients of, a new covered funding award.</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yfd783307-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><subparagraph class="firstIndent0 fontsize10" id="yfd783308-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In promulgating rules under paragraph (2), the Commission shall provide that, consistent with principles of technology neutrality, the Commission will only award covered funding to applicants that can demonstrate that they meet the qualifications in subparagraph (B).</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yfd783309-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications described</inline>.—</heading><content>An applicant for a new covered funding award shall include in the initial application a proposal containing sufficient detail and documentation for the Commission to ascertain that the applicant possesses the technical, financial, and operational capabilities, and has a reasonable business plan, to deploy the proposed network and deliver services with the relevant performance characteristics and requirements defined by the Commission and as pledged by the applicant.</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yfd78330a-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Evaluation of proposal</inline>.—</heading><chapeau>The Commission shall evaluate a proposal described in subparagraph (B) against—</chapeau><clause class="firstIndent0 fontsize10" id="yfd78330b-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>reasonable and well-established technical, financial, and operational standards, including the technical standards adopted by the Commission in orders of the Commission relating to Establishing the Digital Opportunity Data Collection (WC Docket No. 19–195) (or orders of the Commission relating to modernizing any successor collection) for purposes of entities that must report broadband availability coverage; and</content></clause>
<clause class="firstIndent0 fontsize10" id="yfd785a1c-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the applicant’s history of complying with requirements in Commission and other government broadband deployment funding programs.</content></clause>
</subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yfd785a1d-3df9-11f1-850e-1d8f7df6e243" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Penalties for pre-authorization defaults</inline>.—</heading><content>In adopting rules for any new covered funding award, the Commission shall set a penalty for pre-authorization defaults of at least $9,000 per violation and may not limit the base forfeiture to an amount less than 30 percent of the applicant’s total support, unless the Commission demonstrates the need for lower penalties in a particular instance.”</content></subparagraph>
