<congress display="yes">119th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 874</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To ensure that whistleblowers, including contractors, are protected from retaliation when a Federal employee orders a reprisal, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id53182a5c-29fb-4620-bf20-7e6fbd6f42ab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Whistleblower Protections for Contractors Act of 2025</short-title></quote>.</text></section><section id="id1dfc4183-520e-4848-9abe-5bec0698ad0c" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Defense contractor employees: protection from reprisal for disclosure of certain information</header><text display-inline="no-display-inline">Section 4701 of title 10, United States Code, is amended—</text><paragraph id="id1e3b1133-9c5c-4cb8-940e-7d68c0ba9a86" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id2f041320-a80e-4aa1-a3f7-2d5bb941dfa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause id="id65d8ff65-fba0-49be-8a8c-fceb700a5172" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A)—</text><subclause id="idae99bbaf-4667-48d6-aac5-f80f3baaf565" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>An employee</quote> and all that follows through <quote>services contractor</quote> and inserting <quote>A protected individual</quote>; and</text></subclause><subclause id="id8b2e813c-753c-48a7-8a6f-03bfb9aa0205" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>disclosing</quote> and all that follows through <quote>evidence of</quote>; and</text></subclause></clause><clause id="idaac39214-d8be-47e6-a4c0-039df4dfcc1f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraphs (A), (B), and (C) and inserting the following subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2fed8b27-2bbf-4621-bd8d-413ba289752e" changed="not-changed"><subparagraph id="id82dec32f-cf0e-4166-bea0-af9b72e1f53e" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Refusing to obey an order that would require the protected individual to violate a law, rule, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="id9685ced3-fd49-4936-aff7-56def80feaa9" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="id12cedf69-8a55-4474-89e4-913a2d7e73a7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Gross mismanagement of any Department of Defense contract or grant, any gross waste of Department funds, any abuse of authority relating to any Department contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Department contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="idcfda55ae-803b-4c33-baa8-663f458a6de9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">Gross mismanagement of any National Aeronautics and Space Administration contract or grant, any gross waste of Administration funds, any abuse of authority relating to an Administration contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Administration contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="id484b8156-4114-4383-b054-62667ac0b581" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">A substantial and specific danger to public health or safety.</text></clause></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id823ab02c-9d35-46d0-bd21-b8324c896e3d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause id="id34bfb644-4494-4858-b2cf-c127a959c251" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="id38ecd76a-4477-4749-ad4c-f134e211885b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idabe31bc9-677d-4304-a64b-9334d4bb3968" changed="not-changed"><subparagraph id="id19afe15c-4cb0-49fb-8dc3-637c7fa94911" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id9aeb5a92-d292-4b3d-8211-89852a700436" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="idbd3695f6-c322-4807-a020-e3f97a5e8876" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8d2e6c89-3c1f-4f89-adb7-c96910e49954" changed="not-changed"><subparagraph id="idae2c4a80-de14-4a67-b679-97f8a81f4a0c" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idef3e28f1-14eb-4c21-a342-2152b5bccf00" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (7) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id52d4b443-7adb-4bc6-97f1-77abc2761cf1" changed="not-changed"><paragraph id="id51c3e424-cb6d-42e8-8b88-c679d91eb8b6" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Clarification for scope of waiver restrictions</header><text display-inline="yes-display-inline">The rights, forum, and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id037fe896-e901-4dd1-9637-f04eaab50371" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (e) and redesignating subsections (f) and (g) as subsections (e) and (f), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c46e41d-2e6d-4acd-a5c2-e9f018602e5c" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated—</text><subparagraph id="id600b0910-c058-4797-b2cb-eb8f20d3e200" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></subparagraph><subparagraph id="id044c6500-97bf-432f-9477-814251c87169" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the employee</quote> and inserting <quote>the protected individual</quote>; and</text></subparagraph></paragraph><paragraph id="id44535edb-632d-4709-b4f0-76ee6f04a2a4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (f), as so redesignated, by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcba353bf-d857-418a-aac9-245d835a710c" changed="not-changed"><paragraph id="id913240ef-2c52-4c6b-af96-5cca0b1ab6f6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">The term <term>protected individual</term> means—</text><subparagraph id="id556bebc4-32fe-4ac0-bc01-1d765653d896" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, including—</text><clause id="id2107dcee-1f9a-4434-850a-efa7df90172a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline"> the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id197e641e-35bb-4584-baf5-cd0e1e395a1e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline"> the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id74a4198e-bcb6-4f73-be0f-4a15384cc6dd" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense;</text></clause></subparagraph><subparagraph id="id074add4a-4ee8-4fb0-abc7-ac24e10ecef8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an employee of a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, or a former employee of such contractor, subcontractor, grantee, or subgrantee whose protected disclosure or engagement in any activity protected against reprisal under this section occurred prior to termination, including an employee of—</text><clause id="idc3b471c4-5d71-4f17-9842-aa2141457ea6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id562b30b5-46ff-400e-af6e-8328aee45bbb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf487e127-ccb4-43ec-a0db-16eba4541a70" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense; or</text></clause></subparagraph><subparagraph id="id451caac6-2464-4cee-abcc-28deacbf7bef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a person performing personal services for the Department of Defense or the National Aeronautics and Space Administration pursuant to a contractual agreement for the performance of personal services, including a personal services contract or personal services agreement, and who engages in an activity for which any reprisal is prohibited under subsection (a), including a person performing personal services pursuant such a contractual agreement for—</text><clause id="idd31201a0-f9fa-440a-863d-5643c66960de" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id4c783d3e-0df7-42d0-a2c2-836740a37e60" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8178d5f2-c710-41ad-9270-586ac2942407" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id96facade-7011-453e-a7df-c0650eba0d53" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Enhancement of non-defense contractor protection from reprisal for disclosure of certain information</header><text display-inline="no-display-inline">Section 4712 of title 41, United States Code, is amended—</text><paragraph id="id2d13c18b-4396-42f1-80ff-419ba955ad55" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id55fd9f1f-6619-4773-b607-b2c9365e0663" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1fae1df-2254-47ef-983d-e54dbd92e4fd" changed="not-changed"><paragraph id="id28d99e27-5099-420a-acd1-641162e5a822" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A protected individual may not be discharged, demoted, or otherwise discriminated against as a reprisal for the following:</text><subparagraph id="id2c3d246e-415e-4bf9-9521-a4b0d0491ad6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Refusing to obey an order that would require the protected individual to violate a law, rule, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="id02bf23b5-18a3-4641-8432-4a6dd582226d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="id79a2c025-e09c-4840-ad4c-3002479ceb9e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Gross mismanagement of any Federal contract or grant, any gross waste of Federal funds, any abuse of authority relating to any Federal contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Federal contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="id0ba1cc38-c858-4a9b-8acd-22ed9cdc004a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">A substantial and specific danger to public health or safety.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id9b930573-359a-4867-9fbd-c7fe67c3b927" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause id="id4957458a-b8df-4bae-b36f-45d7151ad9bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="idcbcd3a58-4abf-4c42-a5a4-cab45f9d1aa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfdcfbd5b-9614-48d6-b99d-bc7886204e72" changed="not-changed"><subparagraph id="id56a97f4a-cd36-4320-ae62-43aa9fd70421" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id5f43a905-5088-48b7-9764-527674555207" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="id01db60fa-f2e8-4c85-8809-9a9057131067" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88a2747f-98b5-4fa3-84d9-33084a9a97d6" changed="not-changed"><subparagraph id="id3c74ae48-2005-44df-abe6-0102e5c79cde" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id77801fd0-d51c-46dc-bcf2-813f2b3d435a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (7) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5c755971-5c43-4230-a903-2d06151615f3" changed="not-changed"><paragraph id="idd57628d7-220b-40e7-ad6f-3be8e6c85a3f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Rights, forum, and remedies not waivable</header><text display-inline="yes-display-inline">The rights, forum, and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idf95d016f-7f44-497e-b5c5-39b46cbaf7db" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text><subparagraph id="idbf389a8c-0bec-48a3-aa3b-546fb848177c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0587b56b-cc87-47fe-ab49-86978d8ee3d2" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the employee</quote> and inserting <quote>the protected individual</quote>;</text></subparagraph></paragraph><paragraph id="id69e4019a-450c-4c08-bde9-e46de0f4d1ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (f) and redesignating subsections (g) and (h) as subsections (f) and (g), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf67b1bbc-e3a2-4dc0-a292-7cdb36e8c9de" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (f), as so redesignated, by inserting after paragraph (2) the following new paragraph:</text><quoted-block id="id34957c3a-40af-4320-876a-30e2d425315c" changed="not-changed" display-inline="no-display-inline" style="OLC"><paragraph id="idf8aa30b1-f3f2-4bc2-bceb-a261d6106118" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>protected individual</term> means—</text><subparagraph id="id9d98c8c3-b85a-4c1a-ac09-e3cfe6e1adeb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a contractor, subcontractor, grantee, or subgrantee of the Federal Government, including—</text><clause id="id33564b92-42e1-47d5-b61b-c532c52dda8d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States;</text></clause><clause id="id3399b57c-78b7-4875-99ee-c4a9a8c49421" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8e85d4e3-2c01-4d9e-bcd6-0c6e940a91ac" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>));</text></clause></subparagraph><subparagraph id="idc97d70db-4b92-4b4b-8f4a-fcaafbd109e9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an employee of a contractor, subcontractor, grantee, or subgrantee of the Federal Government or a former employee of such contractor, subcontractor, grantee, or subgrantee whose protected disclosure or engagement in any activity protected against reprisal under this section occurred prior to termination, including an employee of—</text><clause id="id3341cf88-1eac-4390-919e-9f80cd8d117d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States;</text></clause><clause id="idb59517c6-5b84-4014-9bb1-967827f54727" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddac6ef19-32e4-4fcd-8e9f-0c320d222a66" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)); or</text></clause></subparagraph><subparagraph id="id587a7f66-b7f8-4e22-a34b-c83b845d6282" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a person performing personal services for the Federal Government pursuant to a contractual agreement for the performance of personal services, including a personal services contract or personal services agreement, including a person performing personal services pursuant to such a contractual agreement for—</text><clause id="idc90a8017-e588-4ccf-8461-1f469a4d513e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States;</text></clause><clause id="idc7e46c4f-4ef4-486f-b55b-3c8a0442c58c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i);
