<enactingFormula style="-uslm-lc:I650120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d151e62" identifier="/us/bill/119/s/759/s1" style="-uslm-lc:I650146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Modernizing Access to Our Public Oceans Act</shortTitle>”.</content></section>
<section id="d151e72" identifier="/us/bill/119/s/759/s2" style="-uslm-lc:I650141"><num class="bold" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd8a82b32-b191-11f1-9a59-536044908edc" style="-uslm-lc:I650120">  In this Act:</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8a82b33-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/1" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Exclusive economic zone</inline>.—</heading><content>The term “<term>exclusive economic zone</term>” has the meaning given that term in <ref href="/us/usc/t46/s107">section 107 of title 46, United States Code</ref>.</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a82b34-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/2" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Fishing restriction</inline>.—</heading><chapeau>The term “<term>fishing restriction</term>” means a restriction on fishing in a federally managed fishery established under section 303(b)(2) of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1853/b/2">16 U.S.C. 1853(b)(2)</ref>), including—</chapeau><subparagraph class="firstIndent0 fontsize10" id="yd8a85245-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/2/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a full or partial fishing closure, in terms of both area and duration, or a seasonal closure;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8a85246-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/2/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a no-catch zone in the fishery;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8a85247-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/2/C" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a restriction on the method of catch for the fishery; and</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8a85248-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/2/D" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>another restriction on fishing, as determined by the Secretary.</content></subparagraph>
</paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a85249-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/3" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe; tribal organization</inline>.—</heading><content>The terms “Indian Tribe” and “Tribal organization” have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a8524a-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/4" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Native hawaiian organization</inline>.—</heading><content>The term “<term>Native Hawaiian organization</term>” has the meaning given the term in section 6207 of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s7517">20 U.S.C. 7517</ref>), except that the term includes the Department of Hawaiian Home Lands and the Office of Hawaiian Affairs of the State of Hawaii.</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a8524b-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/5" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Nonprofit organization</inline>.—</heading><content>The term “<term>nonprofit organization</term>” means an organization that is described in section 501(c) of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a8524c-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/6" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Recreational vessel</inline>.—</heading><content>The term “<term>recreational vessel</term>” has the meaning given that term in <ref href="/us/usc/t46/s2101">section 2101 of title 46, United States Code</ref>.</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8a8524d-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s2/7" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Commerce.</content></paragraph>

<section id="d151e183" identifier="/us/bill/119/s/759/s3" style="-uslm-lc:I650141"><num class="bold" value="3">SEC. 3. </num><heading>DATA STANDARDIZATION.</heading><content style="-uslm-lc:I650120">  Not later than 31 months after the date of the enactment of this Act, the Secretary, in consultation with relevant stakeholders, including State and local governments, Indian Tribes, and Native Hawaiian organizations, shall develop and adopt standards with respect to the coordination and dissemination of geospatial data relating to fishing restrictions, use of the exclusive economic zone by recreational vessels, and access to Federal waters by such vessels, including such data made available under section 4.</content></section>
<section id="d151e191" identifier="/us/bill/119/s/759/s4" style="-uslm-lc:I650141"><num class="bold" value="4">SEC. 4. </num><heading>DATA PUBLICATION AND ACCESSIBILITY.</heading><subsection class="firstIndent0 fontsize10" id="yd8aaea5e-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Data on Fishing and Recreational Vessels in Exclusive Economic Zone</inline>.—</heading><chapeau>Not later than 4 years after the date of the enactment of this Act, the Secretary, acting through the Director of the Office of Science and Technology of the National Marine Fisheries Service, and to the maximum extent practicable, shall make available on a publicly accessible website geographic information system data that—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8aaea5f-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>includes, with respect to the exclusive economic zone—</chapeau><subparagraph class="firstIndent0 fontsize10" id="yd8aaea60-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/1/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>information with respect to the conditions under which fishing restrictions are imposed and the areas within the exclusive economic zone that are open or closed to recreational boating, diving, and related recreational activities (as determined by the Secretary), including for safety reasons such as because of the presence of harmful algal blooms;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8aaea61-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/1/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the areas of the exclusive economic zone with restrictions on the use of motorized propulsion, horsepower, or fuel by or of recreational vessels; and</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8aaea62-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/1/C" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the types of recreational vessels that are restricted on each area of the exclusive economic zone;</content></subparagraph>
</paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8aaea63-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>describes the geographic boundaries of areas where fishing restrictions occur; and</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab1174-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/3" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3)</num><subparagraph class="inline" id="yd8ab1175-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/3/A"><num value="A">(A) </num><content>identifies Federal marine protected areas, including National Marine Sanctuaries, national marine monuments, and other federally protected waters; and</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yd8ab1176-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/a/3/B" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>includes information on what fishing, recreational boating, and other related recreational activities are authorized in each such area.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab1177-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Data on Navigation Within Exclusive Economic Zone</inline>.—</heading><paragraph class="firstIndent0 fontsize10" id="yd8ab1178-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall continue to make available digitized geographic information system data that includes, with respect to access to the exclusive economic zone—</chapeau><subparagraph class="firstIndent0 fontsize10" id="yd8ab1179-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/1/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>navigation information;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ab117a-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/1/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>bathymetric information;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ab117b-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/1/C" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>depth charts; and</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ab117c-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/1/D" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>other information, consistent with law and policy.</content></subparagraph>
</paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab117d-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/b/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Website</inline>.—</heading><content>The Secretary shall, to the extent practicable, make the data described in paragraph (1) available on the website on which the Secretary makes the data described in subsection (a) available.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab117e-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/c" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Data Accessibility</inline>.—</heading><chapeau>The Secretary shall ensure that the website on which the Secretary makes the data described in subsections (a) and (b) available—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8ab388f-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/c/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>organizes that data so that the data is findable, accessible, interoperable, and reusable; and</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab3890-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/c/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>includes a mechanism by which users can be easily updated when new data becomes available.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab3891-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/d" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Public Comment</inline>.—</heading><chapeau>The Secretary shall develop—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8ab3892-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/d/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a process to allow members of the public to submit questions or comments regarding the data described in subsections (a) and (b) and the accessibility of that data under subsection (c); and</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab3893-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/d/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>methods to improve the accessibility of data.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab3894-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/e" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><chapeau>The Secretary shall update—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8ab3895-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/e/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the data described in subsections (a)(1) and (b) not less frequently than 2 times each year; and</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab3896-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/e/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the data described in paragraphs (2) and (3) of subsection (a) in real time.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab3897-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/f" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Nondisclosure of Certain Information</inline>.—</heading><chapeau>The Secretary may not, consistent with applicable law and policy, disclose, in any geographic information system data made publicly available under this section—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8ab3898-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/f/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>information regarding the nature, location, character, or ownership of historic, paleontological, cultural, or archaeological resources; or</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ab3899-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/f/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>commercial fishing information, including proprietary information.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ab5faa-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s4/g" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of Tribal Waters and Fishing Areas</inline>.—</heading><content>The authorities granted by this section shall not apply with respect to any usual or accustomed fishing areas or Tribal waters.</content></subsection>

<section id="d151e376" identifier="/us/bill/119/s/759/s5" style="-uslm-lc:I650141"><num class="bold" value="5">SEC. 5. </num><heading>COOPERATION AND COORDINATION.</heading><subsection class="firstIndent0 fontsize10" id="yd8acbf3b-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Community Partners and Third-party Providers</inline>.—</heading><chapeau>For purposes of carrying out this Act, the Secretary may—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8acbf3c-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>coordinate and partner with non-Federal entities, including—</chapeau><subparagraph class="firstIndent0 fontsize10" id="yd8acbf3d-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>States;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8acbf3e-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Indian Tribes, Native Hawaiian organizations, and Tribal organizations;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8acbf3f-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/C" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>interstate commissions (as defined in section 303 of the Interjurisdictional Fisheries Act of 1986 (<ref href="/us/usc/t16/s4102">16 U.S.C. 4102</ref>));</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ace650-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/D" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Regional Ocean Partnerships (as defined in section 10202 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<ref href="/us/usc/t16/s1468">16 U.S.C. 1468</ref>));</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ace651-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/E" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>experts in data science, analytics, and operations research;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ace652-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/F" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the private sector, including technology or geospatial data industries;</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ace653-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/G" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>nonprofit organizations; and</content></subparagraph>
<subparagraph class="firstIndent0 fontsize10" id="yd8ace654-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/1/H" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>institutions of higher education (as defined in section 201 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1001">20 U.S.C. 1001</ref>)); and</content></subparagraph>
</paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ace655-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/a/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>enter into agreements with experts within entities described in any of subparagraphs (A) through (H) of paragraph (1) to carry out any of the provisions of this Act.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd8ace656-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/b" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Interagency Coordination</inline>.—</heading><content>The Secretary shall, to the maximum extent practicable, work with the relevant offices of the Department of the Interior, the Department of Agriculture, the Department of Defense, the Department of Energy, the Environmental Protection Agency, the Coast Guard, the Army Corps of Engineers, and the Interagency Working Group on Ocean and Coastal Mapping codified by section 12203 of the Ocean and Coastal Mapping Integration Act (<ref href="/us/usc/t33/s3502">33 U.S.C. 3502</ref>), to ensure compatibility and interoperability among applicable Federal databases with respect to the collection and dissemination of geospatial data relating to public outdoor recreational use of the exclusive economic zone.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd8ace657-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s5/c" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Applicability of Federal, State, and Tribal Law and Regulations</inline>.—</heading><content>The Secretary, in developing and distributing geospatial data under this Act, shall make clear that the data are subject to applicable laws and regulations of the Federal Government, States, and Indian Tribes.</content></subsection>

<section id="d151e475" identifier="/us/bill/119/s/759/s6" style="-uslm-lc:I650141"><num class="bold" value="6">SEC. 6. </num><heading>RULE OF CONSTRUCTION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd8ad8298-b191-11f1-9a59-536044908edc" style="-uslm-lc:I650120">  Nothing in this Act may be construed—</chapeau><paragraph class="firstIndent0 fontsize10" id="yd8ad8299-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s6/1" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to modify or alter the definition of the term “<term>navigable waters</term>” under any provision of Federal law;</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ad829a-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s6/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to affect the jurisdiction or authority of Federal or State agencies to regulate navigable waters;</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ad829b-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s6/3" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to increase or diminish the responsibility or authority of Federal or State agencies or Indian Tribes to manage fisheries under existing law;</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ad829c-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s6/4" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to satisfy any requirement for government-to-government consultation with Indian Tribes or Native Hawaiian organizations; or</content></paragraph>
<paragraph class="firstIndent0 fontsize10" id="yd8ad829d-b191-11f1-9a59-536044908edc" identifier="/us/bill/119/s/759/s6/5" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to affect or modify any treaty or other right of any Indian Tribe.</content></paragraph>
