<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 410</calendar><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 736</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250226">February 26, 2025</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself, <cosponsor name-id="S414">Mr. Ossoff</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S439">Mrs. Moody</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S293">Mr. Graham</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S422">Mr. Welch</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260519">May 19, 2026</action-date><action-desc>Reported by <sponsor name-id="S153">Mr. Grassley</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the penalty for prohibited provision of a phone in a correctional facility, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lieutenant Osvaldo Albarati Stopping Prison Contraband Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id00fa5fff2a454a788936d4a633b23591"><enum>2.</enum><header>Prohibited provision of a phone</header><text display-inline="no-display-inline">Section 1791(b) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ideab92f8670f447878c17fae3605c4210"><enum>(1)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51193a385d3e44cb998cdfd42985a5ed"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB2103C92BAC34C02B96276C908DFE436"><paragraph commented="no" display-inline="no-display-inline" id="id1b0de3d97f81463386aedc431e00b6e2"><enum>(4)</enum><text>in the case of a violation of subsection (a)(1), imprisonment for not more than 2 years, or both, if the object is specified in subsection (d)(1)(F) of this section;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1f21caf3f8c47029c86217f2fd7ed95"><enum>(3)</enum><text>in paragraph (5), as so redesignated, by inserting <quote>, in the case of a violation of subsection (a)(2),</quote> before <quote>(d)(1)(F)</quote>.</text></paragraph></section><section id="id29a87ee11e854b67acff34d1ccca92dd"><enum>3.</enum><header>Review of policies</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Director of the Bureau of Prisons shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id22e7a5ba14554ad0ae0789536308184a"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a review of the policies of the Bureau of Prisons pertaining to inmates who make, possess, obtain, or attempt to make or obtain a prohibited object, as defined in section 1791(d)(1) of title 18, United States Code; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86d2acc21912497f8b182598a67b055c"><enum>(2)</enum><text display-inline="yes-display-inline">update those policies as needed to improve protections for incarcerated individuals and staff. </text></paragraph></section></legis-body><endorsement><action-date>May 19, 2026</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
