which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide the Under Secretary of Commerce for Industry and Security with authority to attract highly qualified experts.</official-title></form><legis-body><section id="HFD46549BFDDC4FC1952D1B956B96D9F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>BIS Strategic Talent Recruitment to Enhance National Guardrails for Technological Handling Act</short-title></quote> or the <quote><short-title>BIS STRENGTH Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id78d8866be3394ef09dbd26b5ec6f2318"><enum>2.</enum><header>Appointment of highly qualified experts to Bureau of Industry and Security</header><subsection id="H3DC2FC5E98E64289A39B2C44D2756AF5" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary of Commerce for Industry and Security, in order to attract to the Bureau of Industry and Security highly qualified experts in needed occupations (as determined by the Under Secretary), may—</text><paragraph id="H376F3CCCE6214D7C85A60E2C5265E71E" commented="no"><enum>(1)</enum><text>conduct an annual study to identify specific gaps in uncommon, special knowledge, skills, and expertise at the Bureau that have been difficult to fill through the civil service and constrain the Bureau’s ability to effectively fulfil the Bureau’s mandate;</text></paragraph><paragraph id="HE16E92FCBBA74D66A51EDAA98EF7E733"><enum>(2)</enum><text>notwithstanding any provision of section 3304 or sections 3309 through 3318 of title 5, United States Code, appoint personnel from outside the civil service (as defined in section 2101 of title 5, United States Code) that have the expertise identified pursuant to paragraph (1) to positions in the Bureau; and</text></paragraph><paragraph id="H57A15A14D32B45688D1797A033E4B71C"><enum>(3)</enum><text>prescribe the rates of basic pay for positions to which employees are appointed under paragraph (2) at rates not in excess of the maximum rate of basic pay authorized for senior-level positions under section 5376 of title 5, United States Code, as increased by locality-based comparability payments under section 5304 of that title, notwithstanding any provision of that title governing the rates of pay or classification of employees in the executive branch.</text></paragraph></subsection><subsection id="H875CDA5BBB6D45B29F85842C35A62D99"><enum>(b)</enum><header>Limitation on term of appointment</header><text display-inline="yes-display-inline">The service of an employee under an appointment made pursuant to subsection (a) may not exceed 5 years.</text></subsection><subsection id="HBBDBA3966D18404C98A50B3CA6243AA0"><enum>(c)</enum><header>Limitation on total annual compensation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section or of section 5307 of title 5, United States Code, no additional payments may be paid to an employee appointed under subsection (a) in any calendar year if, or to the extent that, the total annual compensation of the employee will exceed the maximum amount of total annual compensation payable to the Vice President under section 104 of title 3, United States Code.</text></subsection><subsection id="H84A95F9C66C344268E3C38112BA33996"><enum>(d)</enum><header>Limitation on number of employees</header><text>The number of employees appointed and retained by the Under Secretary under subsection (a) shall not exceed 25 at any time.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H354DF6DAD5B144F6B9156708EB0B453E"><enum>(e)</enum><header>Report required</header><paragraph commented="no" display-inline="no-display-inline" id="HCE600B82B1744D0EA0AC7592F96A6D56"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Under Secretary shall submit to the committees specified in paragraph (2) a report that includes—</text><subparagraph id="H7D7B0C3EAA794166957D16F236187258"><enum>(A)</enum><text display-inline="yes-display-inline">a list of areas in which the Under Secretary has identified specific gaps in expertise pursuant to subsection (a)(1);</text></subparagraph><subparagraph id="H7B53E3F5B97D430EBA77E982B2594F46"><enum>(B)</enum><text>a description of the steps taken by the Under Secretary to appoint personnel with expertise in such areas from within the civil service during the period specified in paragraph (3);</text></subparagraph><subparagraph id="H31E9EDB8EFE54CCC8BA54FD16D50DD2D"><enum>(C)</enum><text>the number of individuals appointed to the Bureau of Industry and Security under the authority provided by this section during the period specified in paragraph (3);</text></subparagraph><subparagraph id="H7D87CA1D99634F288F3122806D53D5D8"><enum>(D)</enum><text>a description of the qualifications of such individuals and their responsibilities during that period;</text></subparagraph><subparagraph id="H221BF56795FE4086BAD885D6D902A179"><enum>(E)</enum><text>a description of the impact of such individuals on carrying out the mission of the Bureau of Industry and Security; and</text></subparagraph><subparagraph id="id7d159dc723994911bd21db3c6f464153"><enum>(F)</enum><text>an assessment of the long-term staffing needs of the Bureau of Industry and Security pertaining to export controls, including those needs identified in the course of carrying out this section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7845E84F0F0548DDA500F2FBDA7B8C79"><enum>(2)</enum><header>Committees specified</header><text display-inline="yes-display-inline">The committees specified in this paragraph are—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4CDF2B1D7B3C4EBFA12EC8858576A6ED"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Banking, Housing, and Urban Affairs and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="HB081B2E2E0FA4FCE8A5ABA14E00117CD"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government Reform and the Committee on Foreign Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9EAB843603ED47CCA2ED50DB9FF9E920"><enum>(3)</enum><header>Period specified</header><text display-inline="yes-display-inline">The period specified in this paragraph is—</text><subparagraph commented="no" display-inline="no-display-inline" id="H08A4EC88182E420482945E38B0663F14"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of the first report required by paragraph (1), the 180-day period preceding submission of the report; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA8C0B241B9CA4471AD2B18F2B55796BB"> <enum>(B)</enum> <text display-inline="yes-display-inline">in the case of any subsequent report required by paragraph (1), the 1-year period preceding submission of the report.</text>
 </subparagraph></paragraph></subsection><subsection id="H311C45431CD843088EDCA227ECCE9EC7"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to waive any requirement regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="idc0c1c028607f4edb87c9db5724dfaf82"><enum>(1)</enum><text display-inline="yes-display-inline">background investigations or qualifications of applicants to positions with the Bureau of Industry and Security; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54370d946eea4bcf8dad5fc6603e06a6"><enum>(2)</enum><text display-inline="yes-display-inline">compliance with applicable Federal ethics and conflict-of-interest statutes and regulations.</text></paragraph></subsection><subsection id="H96FDDD3BF7D8401F89475E26C0A4FDBE" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Termination</header><paragraph commented="no" display-inline="no-display-inline" id="id59283f06b60f40a59d36a39d549dd00c"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authority provided by this section shall cease to be effective on the date that is 5 years after the date of the enactment of this section.</text></paragraph><paragraph id="HE7B81BAD6FC944ABBBFF3FF74BE57299"><enum>(2)</enum><header>Savings provisions</header><text>In the case of an employee who, on the day before the termination date under paragraph (1), is serving in a position pursuant to an appointment under subsection (a)—</text><subparagraph id="H94818E7D76CA421DAEDBC2D20F0DFA5B"><enum>(A)</enum><text>the termination of the authority does not terminate the employee's employment in that position before the expiration of the lesser of—</text><clause commented="no" display-inline="no-display-inline" id="H82A15AC30879455FB259A2F623AB6AA0"><enum>(i)</enum><text>the period for which the employee was appointed; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HC0A0A81DFA0540FA9D80CAD88496F0C2"><enum>(ii)</enum><text>the period to which the employee's service is limited under subsection (b), including any extension made under paragraph (2) of that subsection before the termination of the authority; and</text></clause></subparagraph><subparagraph id="H904BF44927A84B2E978864E09036B4A6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the rate of basic pay prescribed for the position may not be reduced as long as the employee continues to serve in the position without a break in service.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
