BILL</legis-type><official-title>To amend title 39, United States Code, to limit the compensation and benefits provided to executive officers of the Postal Service, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>USPS Executive Benefit and Bonus Removal Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id02abcd7c13b04c2aab38e6a870fa1daa"><enum>2.</enum><header>Prohibition of Certain Executive Fringe Benefits</header><text display-inline="no-display-inline">Section 1003 of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block id="id00F200B279D04462AC3EE58A6E8B36E4" style="OLC" act-name=""><subsection id="idC5F5B754DF1046A1ACB968C7EF7F61FB"><enum>(e)</enum><header>Limitation of Executive Fringe Benefits</header><paragraph commented="no" display-inline="no-display-inline" id="ida1c84361301f4cc884bcafa825681367"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id1efbbd466839477ba8c577599b6e9b3c"><enum>(A)</enum><header display-inline="yes-display-inline">Covered Executive Officer</header><text>The term <term>covered executive officer</term>—</text><clause commented="no" display-inline="no-display-inline" id="id59690a5f24a44033a7db44b96bc19178"><enum>(i)</enum><text display-inline="yes-display-inline">means the Postmaster General, the Deputy Postmaster General, any Postal Service officer or employee serving in a Postal Career Executive Service position at level II or above, or any successor executive pay classification; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7cc27ccd5b7d47538fff0209beeb1ace"><enum>(ii)</enum><text>does not include the Inspector General of the Postal Service.</text></clause></subparagraph><subparagraph id="iddb20eb96a31a45619d6e21928321db28" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Deferred Compensation</header><text>The term <term>deferred compensation</term> includes any nonqualified deferred compensation arrangement, supplemental executive retirement plan, or similar arrangement under which compensation is earned in one period but paid in a later period, whether or not subject to <external-xref legal-doc="usc" parsable-cite="usc/26/409A">section 409A</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb69f7b21141841db8930e21b0b5e6d97"><enum>(C)</enum><header>Fringe Benefit</header><text>The term <term>fringe benefit</term> includes the following:</text><clause id="id489088d6468d492fa9055e99b540e2a8"><enum>(i)</enum><text>A wellness reimbursement or similar wellness incentive payment, unless offered on substantially the same terms to substantially all career employees of the Postal Service.</text></clause><clause id="id1280468dffb748049036a5a6e331917d"><enum>(ii)</enum><text>Parking or a parking allowance, except space made available on the same terms as to non-executive employees at the same duty station.</text></clause><clause id="id60f24b2e2dc04b48be0f8bf49c862c6c"><enum>(iii)</enum><text>Financial planning, tax preparation, estate planning, or similar personal financial advisory services.</text></clause><clause id="ide5f75b7c41ea4895b4c5c1d1d40e10ae"><enum>(iv)</enum><text>Retirement counseling services, unless offered on substantially the same terms to substantially all career employees of the Postal Service.</text></clause><clause id="id47d8910c36214dcbb3974ab2d745409a"><enum>(v)</enum><text>Reimbursement for enrollment or renewal fees for TSA PreCheck, Global Entry, CLEAR, or any similar trusted traveler or expedited-screening program.</text></clause><clause id="id2ed996da32314267ab97ee6342c371fa"><enum>(vi)</enum><text>Membership dues or fees for any airline club, airport lounge program, hotel loyalty tier, or similar travel-amenity program.</text></clause><clause id="id01e5af08d9ef4f1aab4656dae8182da9"><enum>(vii)</enum><text>Any relocation expense, allowance, bonus, or benefit provided in connection with, or in anticipation of—</text><subclause id="id1fbe41b239284b9d8c09b8b777c134b0"><enum>(I)</enum><text>the hiring, appointment, or commencement of service of the officer;</text></subclause><subclause id="idf5f26f23dcfe40b1bff243ee3c43ca92"><enum>(II)</enum><text>the retirement or separation from service of the officer; or</text></subclause><subclause id="id0f0d1102527e41c2aa52c6185fcc8405"><enum>(III)</enum><text>any other change in the officer's status with the Postal Service.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida5501e109b7f46efb29452a0a5d79757"><enum>(2)</enum><header>Limitation on fringe benefits</header><text display-inline="yes-display-inline">Notwithstanding subsection (a) or any other provision of law, the Postal Service may not provide, pay for, or reimburse, directly or indirectly, on behalf of any covered executive officer, any fringe benefit.</text></paragraph><paragraph id="id16cd2f8b55544db6b19fd6184f914eae"><enum>(3)</enum><header>Exception for official travel</header><text>Paragraph (2) may not be construed to prohibit reimbursement of ordinary and necessary travel expenses incurred in the performance of official duties, consistent with applicable Federal travel regulations.</text></paragraph><paragraph id="id2085f7ea5bb1408e8be7f7468f1964cb"><enum>(4)</enum><header>No Circumvention</header><subparagraph commented="no" display-inline="no-display-inline" id="id7223342523d34f31917d177fc92ee4e4"><enum>(A)</enum><header>No substitutes</header><text display-inline="yes-display-inline">The Postal Service may not provide a covered executive officer with increased base pay, a bonus, deferred compensation, or any other form of current or deferred compensation, that is designated, in whole or in part, as a substitute for a benefit prohibited under paragraph (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50a37c6845f14c22803dabdba8ef346b"><enum>(B)</enum><header>No limitation on base pay</header><text display-inline="yes-display-inline">Nothing in this paragraph limits the authority of the Postal Service to set base pay under subsection (a).</text></subparagraph></paragraph><paragraph id="id98c01cac264745c985c42d999a3522cd"><enum>(5)</enum><header>Reimbursement Required</header><text>A covered executive officer who receives a benefit prohibited under paragraph (2) after the effective date of this subsection shall reimburse the Postal Service for the fair market value of such benefit.</text></paragraph><paragraph id="idfdca246a5ddb4aa28171bc9dc7e02a0d"><enum>(6)</enum><header>Prohibition on Premium-Class Air Travel</header><subparagraph id="idbb1b871fac23415992798e49198568c2"><enum>(A)</enum><header>In general</header><text>Notwithstanding subsection (a) or any other provision of law, the Postal Service may not pay for, reimburse, or otherwise provide, directly or indirectly, first-class or business-class air travel accommodations for any covered executive officer.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef2eaf7b06ca4103b56fec0c83a49605"><enum>(B)</enum><header>Reimbursement Required</header><text display-inline="yes-display-inline">A covered executive officer who receives air travel accommodations prohibited under subparagraph (A) after the effective date of this subsection shall reimburse the Postal Service for the value of such accommodations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id0e6512d879004da9a9e1a05dabebbac9"><enum>3.</enum><header>Limit on Compensation</header><text display-inline="no-display-inline">Section 1001 of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0c10c9777f174bea9ae7cfcf3b63ae83"><subsection id="idbcb37626449742a9a6b6de3b695a437e"><enum>(f)</enum><header>Limit on Compensation</header><paragraph commented="no" display-inline="no-display-inline" id="id38732c21e7c344ae8ea0c54f221714ed"><enum>(1)</enum><header display-inline="yes-display-inline">Limit</header><text>No officer, executive, or employee of the Postal Service may receive compensation greater than that of the President under section 102 of title 3.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99caaa1cf7964e99953c8db41a5248ae"><enum>(2)</enum><header>No Circumvention</header><text display-inline="yes-display-inline">The Postal Service may not provide a covered executive officer (as defined in section 1003(e) of this title) with a bonus, deferred compensation, or any other form of current or deferred compensation in order to circumvent the compensation limit set in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idbba5fe06aa0149d59ca9ba1d4bfc0d5f"><enum>4.</enum><header>Restriction on Bonuses for Postmaster General</header><text display-inline="no-display-inline">Section 202 of title 39, United States Code, is amended in subsection (c) by—</text><subsection commented="no" display-inline="no-display-inline" id="idc9354597564f45c892420c605786042f"><enum>(a)</enum><text display-inline="yes-display-inline">striking <quote>The</quote> and inserting—</text><quoted-block id="id367C5E9997374FE1A7B815ECADF7EFD5" style="OLC" act-name=""><paragraph id="id19E9C02C168C4DD7936EFDC356537BDB"><enum>(1)</enum><header>Powers of the Governors</header><text>The</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id1a44995ad67642a283769e1c32aeec59"><enum>(b)</enum><text display-inline="yes-display-inline">adding at the end the following:</text><quoted-block id="id341A1CFFFFE045C1B7086655D54FBC30" style="OLC" act-name=""><paragraph id="idF0AE3C009A854608AAE4FCBD43941515"><enum>(2)</enum><header>Limit on compensation</header><text>Notwithstanding the provisions of section 3686 of this title, the Governors shall not approve any bonus, award, or other monetary compensation beyond basic pay for the Postmaster General for any fiscal year in which the total expenditures of the Postal Service exceeded the revenues of the Postal Service (including both appropriated and non-appropriated funds).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="idcd44f7cd667c4655a2fb7d792cfffc41"><enum>5.</enum><header>Rule of Construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to affect—</text><paragraph id="iddbff796a66ce46b49e9b6564597a8a73"><enum>(1)</enum><text>wellness, parking, or retirement-related benefits generally available to Postal Service employees who are not covered executive officers (as defined in section 1003(e) of title 39, United States Code, as amended by this Act);</text></paragraph><paragraph id="iddf9f2a28e9054ca08ff970e7c4de7544" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">any benefit provided to a bargaining-unit employee pursuant to a collective bargaining agreement entered into under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/12">chapter 12</external-xref> of title 39, United States Code; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd772410b6d8249d5992fc639b635e0dc"><enum>(3)</enum><text>any compensation described in section 423(b) of title 5, United States Code.</text></paragraph></section></legis-body></bill>
