which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize and expand the imposition of sanctions under the Nicaragua Investment Conditionality Act of 2018, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Electoral Fairness and Opposition Rights through Mandates for Accountability Act of 2026</short-title></quote>.</text></section><section id="idd4d8b170d0594dd28462d3f10286b8ba"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="ide3f8974a038044ee9068161c61358afb"><enum>(1)</enum><text>The Government of Nicaragua, under the leadership of Daniel Ortega and Rosario Murillo, has engaged in systematic corruption, undermined democratic institutions, eroded the rule of law, and committed widespread human rights abuses, including state-sponsored violence against Nicaraguan citizens, contributing to regional instability, forced migration, transnational repression, and national security concerns.</text></paragraph><paragraph id="idfa76636d50c34c33b84a6627a568460f"><enum>(2)</enum><text>The 2021 Nicaraguan presidential election, which resulted in the consolidation of authoritarian rule led by Daniel Ortega and Rosario Murillo, was preceded by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id18bb839c3dcf492e8931e751bcc6bdda"><enum>(A)</enum><text display-inline="yes-display-inline">the arrest, disqualification, and forced exile of opposition candidates;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2c5b45ab984496c904aaad810ea57d9"><enum>(B)</enum><text display-inline="yes-display-inline">the annulment of political parties;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id211a01f20f1445378ab085692d44cd2c"><enum>(C)</enum><text display-inline="yes-display-inline">crackdowns on civil society; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ad148cd7fd948e5952461eab27f35af"><enum>(D)</enum><text display-inline="yes-display-inline">restrictions on the press.</text></subparagraph></paragraph><paragraph id="idb7ef34cc7ca044cd8c93b7f732c2d122"><enum>(3)</enum><text>Since 2018, the Murillo-Ortega regime has revoked the legal registration of hundreds of nonprofit and faith-based organizations as part of its broader campaign to suppress civil society and religious institutions.</text></paragraph><paragraph id="idae3f8d7f73804d258b444a8593ebf960"><enum>(4)</enum><text>On November 30, 2022, pursuant to section 402(b)(1)(A) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6442">22 U.S.C. 6442(b)(1)(A)</external-xref>), the Secretary of State designated Nicaragua as a country of particular concern for religious freedom for having engaged in or tolerated particularly severe violations of religious freedom.</text></paragraph><paragraph id="id9097e8e1673c4f5eb5f7635a557c953a"><enum>(5)</enum><text>On December 18, 2023, the Murillo-Ortega regime arrested 11 Nicaraguan pastors and ministry workers affiliated with the organization Mountain Gateway and issued arrest warrants for 3 United States citizens affiliated with the organization on politically motivated charges.</text></paragraph><paragraph id="idcc938345d4f9469694f088b0f767658c"><enum>(6)</enum><text>On July 20, 2026, Daniel Ortega publicly announced that Nicaragua would no longer hold competitive elections, marking the abandonment of elections and further consolidating authoritarian governance.</text></paragraph><paragraph id="ide0897f27cf7c4d58b62a3ab80158957e"><enum>(7)</enum><text>Nicaragua does not meet minimum democratic standards under the Inter-American Democratic Charter.</text></paragraph><paragraph id="id12b79819e4dd497ca51e258f63bbc831"><enum>(8)</enum><text>The policies of the United States Government should support the people of Nicaragua in restoring peace and democracy, protecting human rights, and promoting free, fair and internationally observed elections.</text></paragraph></section><section id="id410fe43bb7ce472ab3db5e0c375c9a16"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="idaef19e148af64e15b6f4f395d1d57d3a"><enum>(1)</enum><text>to seek a resolution to the political crisis in Nicaragua that includes—</text><subparagraph id="id19ce980e6ece4ccc9d09932d4908e88b"><enum>(A)</enum><text>a commitment by the Government of Nicaragua to hold competitive, free, and fair elections that meet democratic standards and permit credible international observation of elections;</text></subparagraph><subparagraph id="id9c57e3710e8149379d3794af7cc6c08e"><enum>(B)</enum><text>the cessation of the violence perpetrated against civilians by the National Police of Nicaragua and by armed groups supported by the Government of Nicaragua; and</text></subparagraph><subparagraph id="id8949fe9fdbbb4fc7be42f30aa8c4cf7a"><enum>(C)</enum><text>independent investigations into the killings of protesters in Nicaragua; and</text></subparagraph></paragraph><paragraph id="idc697f36129b045ce8e71fc09d53e2069" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>to support diplomatic engagement in order to advance a negotiated and peaceful solution to the political crisis in Nicaragua.</text></paragraph></section><section id="id8654992fe2594ef3ac59987874b03b49"><enum>4.</enum><header>Renewal and termination of Nicaragua Investment Conditionality Act of 2018</header><text display-inline="no-display-inline">Section 10 of the Nicaragua Investment Conditionality Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/335">Public Law 115–335</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id403f1b89b3ca43c396a01c392635b7c3"><section id="id024a392bd035428b9010219d17781409"><enum>10.</enum><header>Effective period</header><subsection commented="no" display-inline="no-display-inline" id="id5e1ad63d33464e53bd57066fbf8cc5f7"><enum>(a)</enum><header display-inline="yes-display-inline">Effective date</header><text>The provisions of this Act shall be in effect on and after the date of the enactment of the <short-title>Restoring Electoral Fairness and Opposition Rights through Mandates for Accountability Act of 2026</short-title>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id016b685cd8ac44ab9de10057f3460336"><enum>(b)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The provisions of this Act, and any sanctions imposed under this Act, shall terminate on the earlier of—</text><paragraph commented="no" display-inline="no-display-inline" id="id1d5e4982c6784e9ca3910e74592a6a3e"><enum>(1)</enum><text display-inline="yes-display-inline">December 31, 2035; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42d7a033e6d0405ca29c8aac41dc5202"><enum>(2)</enum><text>the date that is 90 days after the President certifies to the appropriate congressional committees that a resolution to the political crisis in Nicaragua has been reached that includes—</text><subparagraph id="idcfea41f5162d4e06bf1d0edc9ce2d90d"><enum>(A)</enum><text>a commitment by the Government of Nicaragua to hold competitive, free, and fair elections that meet democratic standards and permit credible international observation of elections;</text></subparagraph><subparagraph id="id793d7eba99a0441db343c2423eada49d"><enum>(B)</enum><text>the cessation of the violence perpetrated against civilians by the National Police of Nicaragua and by armed groups supported by the Government of Nicaragua; and</text></subparagraph><subparagraph id="idd3ec8c7b68f5450a877321b4bd526d41" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>independent investigations into the killings of protesters in Nicaragua.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id23692e7742574270b193fe1f001cf562"><enum>5.</enum><header>Imposition of sanctions with respect to gold sector of economy of Nicaragua</header><text display-inline="no-display-inline">Section 5(a) of the Nicaragua Investment Conditionality Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/335">Public Law 115–335</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide179302061c44d33b2eb0414e932dc66"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97a51c9d4b8845ff853dd9a16996db6d"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4441e709756746c29f738bd3b2163b5a"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64f174a30f364a8ca3fd99882c4b0b53"><paragraph id="idb8ccff06b758426b8fec219d58fd974b"><enum>(5)</enum><text>to operate or have operated in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id843f2cea51fa4ac8ac5a262b7d1a3ea5"><enum>(A)</enum><text display-inline="yes-display-inline">the gold sector of the economy of Nicaragua; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idadf22524f1c5478b808562efe699ce14"><enum>(B)</enum><text display-inline="yes-display-inline">any other sector of the economy of Nicaragua identified by the Secretary of State, in consultation with the Secretary of the Treasury, for the purposes of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id3be7ed81c5464ceca6cd5ddc666a6961"><enum>6.</enum><header>Expansion of list of activities subject to sanctions with respect to Nicaragua</header><text display-inline="no-display-inline">Section 5(b) of the Nicaragua Investment Conditionality Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/335">Public Law 115–335</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9133c482f9e6435e980fb22d292b510e"><paragraph id="id151d98f26e594e669b45bf76ed323c81"><enum>(5)</enum><text>The arrest or prosecution of a person, including a person who is a member, volunteer, or employee of the Catholic Church or a Protestant Church, because of the legitimate exercise by that person of the freedom of religion.</text></paragraph><paragraph id="idf555471c7a744749b14dd08f951ab4f1"><enum>(6)</enum><text>The conviction and sentencing of a person who is a democratic political actor or a member of an independent civil society organization for politically motivated charges.</text></paragraph><paragraph id="idc69d7c7ad03b4de1b2b07f5fc8467ed3"><enum>(7)</enum><text>The provision of significant goods, services, or technology to or from Nicaragua, or by persons operating or having operated in Nicaragua, that support—</text><subparagraph commented="no" display-inline="no-display-inline" id="id99441837b10e41b093c967ca97680290"><enum>(A)</enum><text display-inline="yes-display-inline">the Government of the Russian Federation on or after February 24, 2022; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2740ebc226eb4d6aa87825262922b275"><enum>(B)</enum><text display-inline="yes-display-inline">the Government of the Islamic Republic of Iran on or after February 11, 1979.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8faa5caaba0b404fb9107655b2ba2fdb"><enum>7.</enum><header>Addition to list of priority sanctions targets</header><text display-inline="no-display-inline">Section 5(b)(2)(B) of the Reinforcing Nicaragua’s Adherence to Conditions for Electoral Reform Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/54">Public Law 117–54</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by inserting after clause (ix) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id83fae87bae8b40c4baeddd0cf2f5e4bd"><clause id="idb139cb7cf5664f4498169fb13122017e"><enum>(x)</enum><text>Officials of the Instituto de Prevision Social Militar (IPSM), commonly known as the Military Institute of Social Security of Nicaragua.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ide5d6ad05035f4c88a88b5a770d10f565"><enum>8.</enum><header>Report on implementation of sanctions</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, and annually thereafter for a period of 3 years, the Secretary of State, in consultation with the Secretary of the Treasury, shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the implementation of section 5 of the Reinforcing Nicaragua’s Adherence to the Conditions for Electoral Reform Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/54">Public Law 117–54</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), which shall include—</text><paragraph id="idf948eaecc05a49c5b639e30fc81fa986"><enum>(1)</enum><text>an update on the status of efforts to implement a coordinated strategy on the use of targeted sanctions under section 5(a)(1) of that Act;</text></paragraph><paragraph id="idfa44b6b720ac4aa1941f9eb850e34970"><enum>(2)</enum><text>a detailed description of concrete steps that have been taken under section 5(b)(1) of that Act to prioritize the implementation of the targeted sanctions required under section 5 of the Nicaragua Investment Conditionality Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/335">Public Law 115–335</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note); and</text></paragraph><paragraph id="idd890d860695546c596b2666144cc8372"><enum>(3)</enum><text>a detailed description of the results of the review of sanctionable targets required under section 5(b)(2) of the Reinforcing Nicaragua’s Adherence to the Conditions for Electoral Reform Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/54">Public Law 117–54</external-xref>;<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note).</text></paragraph></section><section id="id0c10dc148ad6418cbb8872656b70bf86"><enum>9.</enum><header>Assessment of conditions necessary for democratic transition</header><subsection id="id3b10c967031a479999b7ea99820d5478"><enum>(a)</enum><header>Assessment</header><text>The Secretary of State, in consultation with the heads of other relevant Federal agencies, shall conduct an assessment of the conditions necessary for an eventual democratic transition in Nicaragua, including the conditions necessary for—</text><paragraph id="id6399c587d7a145ae85dac99de575ff44"><enum>(1)</enum><text>the establishment of an impartial elections administration body;</text></paragraph><paragraph id="id245a47ffea0046169d00544b60b66f05"><enum>(2)</enum><text>the establishment of judicial independence;</text></paragraph><paragraph id="id9b92bb0f629e4ce8b95154de919b41f2"><enum>(3)</enum><text>police reform;</text></paragraph><paragraph id="id58b5ba566ce248a98fe79562574220ac"><enum>(4)</enum><text>strengthening government institutions;</text></paragraph><paragraph id="id81ed720806264a9b8922317be4dc8a5f"><enum>(5)</enum><text>the provision of humanitarian assistance; and</text></paragraph><paragraph id="id2496ed376f324ac1b6632817ab701a93"><enum>(6)</enum><text>the inclusion of Nicaraguan dissidents and opposition leaders in the transition.</text></paragraph></subsection><subsection id="id6eb8971dacad462a8db24c9e035bfdb9"><enum>(b)</enum><header>Report required</header><paragraph commented="no" display-inline="no-display-inline" id="id859d951a18d0437f92f88bf6df3e5426"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall submit a report on the assessment conducted under subsection (a) to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c95769b8a7c4bb790cc238d416d4996"><enum>(2)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be submitted in unclassified form but may include a classified annex.</text></paragraph></subsection></section></legis-body></bill>
