which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To limit the duties that may be imposed with respect to school supplies and educational materials, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Back-to-School Supplies Affordability Act</short-title></quote>.</text></section><section id="idf1e4b4ed48e94958b3fe1942deca4bce"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that arbitrary and chaotic tariffs increase the cost of school supplies for students, families, teachers, schools, and local governments.</text></section><section id="id03befccd422e43f2aaaa8dbada6196b0"><enum>3.</enum><header>Limitation on imposition of duties on school supplies and educational material</header><subsection commented="no" display-inline="no-display-inline" id="idc01d4d47fccf4569a965c955fa11e863"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, no duty described in subsection (b) applies with respect to any item described in subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8fe3dc1f13b04ede994bcfb0675bcb0a"><enum>(b)</enum><header>Duty described</header><text display-inline="yes-display-inline">A duty is described in this subsection if the duty imposed on an article exceeds the duty in effect for the article on January 19, 2025, except if the duty was—</text><paragraph commented="no" display-inline="no-display-inline" id="ida8eaaa476950424f835850b58937b547"><enum>(1)</enum><text display-inline="yes-display-inline">imposed pursuant to title VII of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1671">19 U.S.C. 1671 et seq.</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8fcb94acc63a4af1a05517c643cea80a"><enum>(2)</enum><text>proclaimed pursuant to section 201 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id20ebcd3078a54fe19f91befc886ca005"><enum>(c)</enum><header>Items described</header><text display-inline="yes-display-inline">An item is described in this subsection if—</text><paragraph commented="no" display-inline="no-display-inline" id="id7a632a27083a4237b255aa7a3e8896ad"><enum>(1)</enum><text display-inline="yes-display-inline">the item is an item used in an elementary or secondary school classroom, as designated through regulations issued by the Secretary of Commerce, in coordination with the Secretary of Education, unless there is enacted into law a joint resolution of disapproval under subsection (e) with respect to the item; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55b8dcac75d94813ae791963f42b7e6d"><enum>(2)</enum><text display-inline="yes-display-inline">the item is classified under any of the following headings, subheadings, and statistical reporting numbers of the Harmonized Tariff Schedule of the United States:</text><subparagraph commented="no" display-inline="no-display-inline" id="idfed8c13e128c456ab06e116ae5b20dd6"><enum>(A)</enum><text display-inline="yes-display-inline">3926.10 (Office or school supplies).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71f45cc714524b37b05c95f347beffc7"><enum>(B)</enum><text display-inline="yes-display-inline">4202.92 (Backpack and lunchboxes).</text></subparagraph><subparagraph id="id8779e00c03da4b12b7088a70b3ff04f6"><enum>(C)</enum><text>4820.10.20 (Diaries, notebooks and address books, bound, memorandum pads, letter pads, and similar articles).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41e0fa9d0d2e447e83a77a6328d62e1c"><enum>(D)</enum><text display-inline="yes-display-inline">4903 (Children’s picture, drawing, or coloring books).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfebb4d3f462489d90539c7940b75a2e"><enum>(E)</enum><text display-inline="yes-display-inline">4910 (Calendars).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c8162028a354df58f04f6fbf1b1c33f"><enum>(F)</enum><text display-inline="yes-display-inline">8471.60.20 (Keyboards).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8465d5d02ee04acb94debb43fe21141d"><enum>(G)</enum><text>9603.29.8010 (Hairbrushes).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1193dd6fb3642a79ec8b1445c21597b"><enum>(H)</enum><text display-inline="yes-display-inline">9606 (Pencils, crayons, pencil leads, pastels, drawing charcoals, writing or drawing chalks and tailors' chalks).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27fcbfb14bbb4f04b1d84d599b8417f9"><enum>(I)</enum><text display-inline="yes-display-inline">9608 (Ball point pens, felt tipped and other porous tipped pens and markers, fountain pens, pencil-holders and similar holders, parts of the foregoing articles).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id840f8695ca2546d7b674df7c8c116c82"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of Commerce shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="id1e8ad5cb92974453b632fe249ca27010"><enum>(1)</enum><text display-inline="yes-display-inline">a list of the items exempt from the application of duties pursuant to this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71b71dd7e7e34b89a2e8e9be1535cbcd"><enum>(2)</enum><text display-inline="yes-display-inline">a list of the items designated, during the period covered by the report, by the Secretary pursuant to subsection (c)(1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9640a9f087e14319aac0b91434641fb1"> <enum>(e)</enum> <header>Joint resolution of disapproval</header> <paragraph commented="no" display-inline="no-display-inline" id="id21630ba57aae4b4b8cc40e352941e6eb"> <enum>(1)</enum> <header>Joint resolution of disapproval defined</header> <text display-inline="yes-display-inline">In this section, the term <term>joint resolution of disapproval</term> means a joint resolution the sole matter after the resolving clause of which is as follows: <quote>That Congress disapproves the designation of _____ as a school supply eligible for exemption from duties under section 3 of the <short-title>Back-to-School Supplies Affordability Act</short-title>, notice of which was submitted to Congress on ______.</quote>, with the first blank space being filled with the name of the item and the second blank space being filled with the date the report that contained the designation of the item was submitted to Congress.</text>

                <paragraph commented="no" display-inline="no-display-inline" id="id2c8faf7c381f4ccab162688be61de95b">
                    <enum>(2)</enum>
                    <header>Expedited procedures</header>
 <text display-inline="yes-display-inline">The provisions of subsections (b) through (f) of section 152 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192</external-xref>) apply to a joint resolution of disapproval to the same extent that such subsections apply to joint resolutions under such section 152.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id9365df7f88b74e62973d2722856e21b3">
                    <enum>(3)</enum>
                    <header>Rules of the senate and the house of representatives</header>
 <text display-inline="yes-display-inline">This subsection is enacted by Congress—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id0315c1e7d01c4cbbbf689c27cf2764f5">
                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of a joint resolution of disapproval, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idd3b7a3222662499bae19936cdbaf6fa0">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text>
                    </subparagraph>
