<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5338</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260806">August 6, 2026</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to prohibit the Secretary of Energy from prescribing any new or amended energy conservation standards for a product that is not technologically feasible and economically justified, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Efficiency Reform Act of 2026</short-title></quote>.</text></section><section id="idcca44f30215a4f1fa57432361b13eef7"><enum>2.</enum><header>Procedures, interpretations, and policies for consideration of new or revised conservation standards and test procedures</header><subsection id="idf1c6b75480744abe8dec39a3b860f2d0"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary of Energy (referred to in this section as the <quote>Secretary</quote>) shall issue a final rule for the notice of proposed rulemaking entitled <quote>Energy Conservation Program: Procedures, Interpretations, and Policies for Consideration of New or Revised Energy Conservation Standards and Test Procedures for Consumer Products and Certain Commercial/Industrial Equipment</quote> (91 Fed. Reg. 42034; July 7, 2026).</text></subsection><subsection id="id53dec26676c1401aa6ac3ce0a7d3cac6"><enum>(b)</enum><header>Required contents</header><text>The final rule issued under subsection (a) shall retain, at a minimum, the procedural requirements set forth in the notice of proposed rulemaking described in subsection (a) with respect to—</text><paragraph id="id8be0acb667b8479da0b7bbc6616c84bf" commented="no"><enum>(1)</enum><text>the binding nature of the Process Rule on the Department of Energy;</text></paragraph><paragraph id="id3ded8b16d66d4bb7979bf70df8412fe6" commented="no"><enum>(2)</enum><text>mandatory comparative walk-up analysis for economic justification; and</text></paragraph><paragraph id="id658f9d008c8e48bb876f5b3ae648032c" commented="no"><enum>(3)</enum><text>the requirement that a final test procedure be published at least 180 days before the proposition of an energy conservation standard for the same product.</text></paragraph></subsection><subsection id="id2cc765e1e6b14544afb5d4574c377ceb"> <enum>(c)</enum> <header>Failure To comply</header> <paragraph commented="no" display-inline="no-display-inline" id="id399bbb6291fb48a890b16949d76f7903"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text display-inline="yes-display-inline">If the Secretary fails to issue a final rule under subsection (a) by the deadline described in that subsection, effective on the day after that deadline—</text>
          <subparagraph id="id954617a3379e4c02a6ab3126994c218d">
            <enum>(A)</enum>
 <text>the revisions to part 430 of title 10, Code of Federal Regulations, made by the final rules described in paragraph (2) are void; and</text>
          </subparagraph>
          <subparagraph id="idaee55c334e334860ab7c030f4c4a8aa7">
            <enum>(B)</enum>
 <text>that part shall be in effect as if those revisions had not been made.</text> </subparagraph> </paragraph> <paragraph id="id5c02ee80b4424c2bb255e000857a80b0"> <enum>(2)</enum> <header>Final rules described</header> <text>The final rules referred to in paragraph (1)(A) are the following:</text>

            <enum>(A)</enum>
 <text>The final rule of the Department of Energy entitled <quote>Energy Conservation Program for Appliance Standards: Procedures, Interpretations, and Policies for Consideration in New or Revised Energy Conservation Standards and Test Procedures for Consumer Products and Commercial/Industrial Equipment</quote> (86 Fed. Reg. 70892 (December 13, 2021)).</text>
          </subparagraph>
          <subparagraph id="idafdc53dbce1149e5a00bc62295c0e84c">
            <enum>(B)</enum>
 <text>The final rule of the Department of Energy entitled <quote>Energy Conservation Program for Appliance Standards: Procedures, Interpretations, and Policies for Consideration in New or Revised Energy Conservation Standards and Test Procedures for Consumer Products and Commercial/Industrial Equipment</quote> (89 Fed. Reg. 24340 (April 8, 2024)).</text>
          </subparagraph>
        </paragraph>
 </subsection><subsection id="idc5714261158d408795a6cac37010eafe"><enum>(d)</enum><header>Limitation</header><text>Effective beginning on the date that is 181 days after the date of enactment of this Act, unless specifically authorized by an Act of Congress, the Secretary may not make any revisions to part 430 of title 10, Code of Federal Regulations, that are substantially dissimilar to—</text><paragraph commented="no" display-inline="no-display-inline" id="id4edd3ef9a34548fd8ef39d2c0b224322"><enum>(1)</enum><text display-inline="yes-display-inline">the final rule issued under subsection (a); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a014b986d804f9b8f261e6ea7040d42"><enum>(2)</enum><text>if that final rule is not issued, the notice of proposed rulemaking described in subsection (a).</text></paragraph></subsection><subsection id="id9333bafdfcf1419da3b58867641e9d35"><enum>(e)</enum><header>Force of law</header><text>Effective beginning on the date that is 181 days after the date of enactment of this Act, appendix A to subpart C of part 430 of title 10, Code of Federal Regulations (including any revisions made to that appendix), shall have the force and effect of law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbe988f6a549b4a80be5a39cdd84aa3ac"><enum>(f)</enum><header>Regulations voided</header><text>Effective on the date of enactment of this Act, the following final rules shall be null and void:</text><paragraph commented="no" display-inline="no-display-inline" id="id737a36cf9541499883e4f48450498a7c"><enum>(1)</enum><text display-inline="yes-display-inline">The final rule of the Department of Energy entitled <quote>Energy Conservation Program: Energy Conservation Standards for Consumer Furnaces</quote> (88 Fed. Reg. 87502 (December 18, 2023)).</text></paragraph><paragraph id="ide76395f34bd64280bf6a416ab6b40de4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>The final rule of the Department of Energy entitled <quote>Energy Conservation Program: Energy Conservation Standards for Commercial Water Heating Equipment</quote> (88 Fed. Reg. 69686 (October 6, 2023)).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idaf76eef5f8664176bc7902ae155abd2c"><enum>3.</enum><header>Significant energy savings definition</header><text display-inline="no-display-inline">Section 321 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc2f7cff6c9e04e9b968cd5562cb29e06"><paragraph commented="no" display-inline="no-display-inline" id="id5135521e6ecc4d52a1486c39c3b919e3"><enum>(67)</enum><header>Significant energy savings</header><subparagraph commented="no" display-inline="no-display-inline" id="id69bb7ab06bb249c2aa3aef94b6d9c50c"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>significant energy savings</term> means a reduction, over a 30-year period, of not less than 10 percent in full fuel cycle energy use, as determined by the Secretary using the applicable test procedure required under this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide56b698f67784dc6ba08fcb378ea2f05"><enum>(B)</enum><header>Full fuel cycle energy use</header><text display-inline="yes-display-inline">For the purpose of subparagraph (A), full fuel cycle energy use includes all primary energy consumed in the extraction, processing, transportation, generation, transmission, and distribution of energy to the point of end-use.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id2691f1b157a14db1a5b98cba700a51b9"><enum>4.</enum><header>Revocation of standards amendments requirement</header><subsection commented="no" display-inline="no-display-inline" id="iddea8b1995c1f494cab8757f786b7bb96"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 325 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id22f510f7d85a4629a81059e137e625a2"><enum>(1)</enum><text>by redesignating paragraph (4) of subsection (m) as paragraph (7) of subsection (o), and moving the paragraph appropriately; and</text></paragraph><paragraph id="id6450d5c5e5894ebcb3ec4ecc0fffc234"><enum>(2)</enum><text>by striking subsection (m) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70ef55c0f90d43f7b4f9be57064340c3"><subsection commented="no" display-inline="no-display-inline" id="id25d77834fb8e402a9e7abe1989cda671"><enum>(m)</enum><header>Reserved</header></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67ac65686e66442d80e0a791a1601ca3"><enum>(b)</enum><header>Conforming amendment</header><text>Section 345(e)(1)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6316">42 U.S.C. 6316(e)(1)(A)</external-xref>) is amended by striking <quote>(m)</quote> and inserting <quote>(n)</quote>.</text></subsection></section><section id="id6d59a284ccf542979f412ffa41e56484"><enum>5.</enum><header>Petition for an amended standard; petition timelines</header><text display-inline="no-display-inline">Section 325(n) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(n)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7822f3be3daa4ff795a7408c823c0e9b"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2fce22a87c184b2dbcec3fa73cbe85d4"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (C) as subclauses (I) through (III), respectively, and indenting appropriately;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6a5b9e26332a403f9808b48c1a0638fb"><enum>(B)</enum><text>in the undesignated matter following subclause (III) (as so redesignated), by striking <quote>The grant</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id01fe1744ec504c64b722085021086d94"><subparagraph id="idf98dc0f5345543b0b86e2b83e095d58e" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>No presumption</header><text>The grant</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c7eae6a66f24eb794e73d55e7f49c02"><enum>(C)</enum><text>by striking the paragraph designation and all that follows through <quote>criteria—</quote> in the matter preceding subclause (I) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb2aa6740cab94dc99902122d73ab4bab"><paragraph commented="no" display-inline="no-display-inline" id="id539c6e4c5aab4de5b81cc74d0fa63690"><enum>(2)</enum><header>Grant of petition</header><subparagraph commented="no" display-inline="no-display-inline" id="id79155a67cd6b4622b88a35dcb4a19248"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall grant a petition under paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id4868e5d7a9df43ee849a7cadfec251d4"><enum>(i)</enum><text display-inline="yes-display-inline">if the Secretary finds that the petition contains clear and convincing evidence of the need for an amended standard; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id06fa939122154cabbe51eff1372bebfe"><enum>(ii)</enum><text>subject to the conditions that—</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93d82770fabe48fe8e6de9467494649f"><enum>(2)</enum><text>in paragraph (5)(B), by striking <quote>3 years</quote> and all that follows through the period at the end and inserting <quote>at least 6 years after publication of the final rule establishing the standard.</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id4477c584a265416bb5a603204c15a460"><enum>6.</enum><header>Criteria for prescribing new or amended standards</header><subsection commented="no" display-inline="no-display-inline" id="id7ef1503981754bdeb7dfa99ae01d67ce"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 325(o) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(o)</external-xref>) is amended—</text><paragraph id="idd2fb73311b8c464f90d57c6ebf86f304"><enum>(1)</enum><text>in paragraph (1), by striking <quote>The Secretary</quote> and inserting <quote>Except as provided in paragraph (2), the Secretary</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddca89d9da3824a6dbec9cfdad18b90b1"><enum>(2)</enum><text>by redesignating paragraphs (2), (3), (4), (5), (6), and (7) (as added by section 4(a)(1)) as paragraphs (4), (5), (6), (7), (8), and (9), respectively;</text></paragraph><paragraph id="idb9b65f0c9c734e06b86cfb4daa09d31c"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idad1975ed6adc45ce9accff2ed234f8fc"><paragraph id="idc23f1d636487421ca0c64a5ac0b19463"><enum>(2)</enum><header>Amended standard</header><text>The Secretary may prescribe an amended standard that is less stringent than the previous standard or that results in an increased maximum allowable energy use if the Secretary demonstrates with clear and convincing evidence that the amended standard is necessary—</text><subparagraph id="idbee9437b5114448ab85474f36d4ffbb7"><enum>(A)</enum><text>to ensure availability of reliable, safe, and economically accessible products;</text></subparagraph><subparagraph id="id90ccc638a433496c9be607de8010aa47"><enum>(B)</enum><text>to avoid undue burdens on small manufacturers, taking into consideration supply chain, technical feasibility, and cost impacts;</text></subparagraph><subparagraph id="ida5f18b9751e745748351126f8062fb86"><enum>(C)</enum><text>to prevent the unavailability in the United States of any covered product type (or class) of performance characteristics that are substantially the same as those generally available in the United States at the time that the prior standard was applicable; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id022fc8ac0a5f475d82729bada49fb599"><enum>(D)</enum><text display-inline="yes-display-inline">to prevent the influx into the United States of foreign market competitors.</text></subparagraph></paragraph><paragraph id="id5302e6469aea440cb3ff0b83dfbd0938"><enum>(3)</enum><header>New product coverage determination</header><text>The Secretary shall not—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida849011c28034b40b63b8a1ca7f84ca6"><enum>(A)</enum><text display-inline="yes-display-inline">amend a standard to include a new product type unless the Secretary has first made a new product coverage determination under subsection (q) or section 322; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd2a53043dda4738bd71903fe46623dc"><enum>(B)</enum><text display-inline="yes-display-inline">issue or finalize a rulemaking under this section that addresses multiple product types with similar but different functions.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb6862eedc4b48ea87a5d0d0a2d5c6a1"><enum>(4)</enum><text>in paragraph (4)(B) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf0e5adee500a4eeb9e5de907e20becce"><enum>(A)</enum><text>in clause (i)—</text><clause id="id8d7d05cff1584d7aa24e6b7484e1d0ac"><enum>(i)</enum><text>in the matter preceding subclause (I), by striking <quote>receiving views and comments furnished with respect to</quote> and inserting <quote>providing public notice in the Federal Register that includes at least 60 days for public comment, and receiving such comments, with respect to</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd8cbcf0a9bdf4c26832a602c014de080"><enum>(ii)</enum><text>in subclause (I), by striking <quote>impact</quote> and inserting <quote>impact, including cumulative regulatory burdens,</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1aab5dd709324b92941c610a7324dee0"><enum>(iii)</enum><text>in subclause (V), by adding <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3451011e7be045a08cf20a30a77c2167"><enum>(iv)</enum><text>in subclause (VI), by striking <quote>; and</quote> and inserting a period; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8279bb96543b4d2daec3b0f85d451d5f"><enum>(v)</enum><text>by striking subclause (VII); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f885e9f8537431f8180e86abef9988a"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9f4d6b14f1a1411e9a2c6b5d75ed99ff"><clause id="ideb966258d0cb4de096809a509a8f5cca"><enum>(iv)</enum><header>Defined consumer-valued characteristics</header><subclause id="id0354d3db80dc412a9ea928eb8480a476"><enum>(I)</enum><header>In general</header><text>In determining whether a standard is technologically feasible, the Secretary shall, after receiving comments, define <quote>consumer-valued performance characteristics</quote>, including reliability, product lifetime, features, sizes, capacities, installation and venting methods, fuel types, technologies, materials, volumes, and the ability to replace a product without changes to existing drainage and venting methods.</text></subclause><subclause id="idcc77c6fa7d7f41639f805ec6247d683b"><enum>(II)</enum><header>Application</header><text>The consumer-valued performance characteristics defined under subclause (I) shall not be eliminated or impacted by new or amended standards.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc5b7309246945139d9f9ef25698c612"><enum>(5)</enum><text>in paragraph (5) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf88a2122f2fe470fb393195a0345cd08"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7822339b265e4b9a9ba8ef097aad0be6"><enum>(B)</enum><text>by striking the paragraph designation and all that follows through <quote>a test</quote> in clause (i) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf2ca2e51ec3d4365942cd8c9f095b1a9"><paragraph commented="no" display-inline="no-display-inline" id="id4947fd52294541738785da2479268965"><enum>(5)</enum><header>Limitation on prescribing new or amended standards</header><subparagraph commented="no" display-inline="no-display-inline" id="ide2ab4fc6f35140e482a9e781617c6128"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary may not prescribe an amended or new standard under this section for a type (or class) of covered product if—</text><clause commented="no" display-inline="no-display-inline" id="id99fa150d6afe4033bfa258c19300067c"><enum>(i)</enum><text display-inline="yes-display-inline">a test</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id792d2b44e7804b5a8e2fd3d83247480f"><enum>(C)</enum><text>in the undesignated matter following clause (ii) (as so redesignated), by striking <quote>For purposes of section 327, a determination under subparagraph (B)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id484e27eabb944df685910443e5e57356"><subparagraph commented="no" display-inline="no-display-inline" id="idc98bbed58fe84e8d888195e5d34cad50"><enum>(B)</enum><header>Determination as standard</header><text>For purposes of section 327, a determination under subparagraph (A)(ii)</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29843fb991854733a0fdd8292e8f7b26"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64783f7b53ee49b192a7c2bdd01da4ad"><subparagraph commented="no" display-inline="no-display-inline" id="ide72170313d1f4a76afb2467643328ad6"><enum>(C)</enum><header display-inline="yes-display-inline">Ties to China</header><text>The Secretary may not prescribe a new or amended energy conservation standard under this section for a type (or class) of covered product unless the Secretary, not later than the date on which the standard is prescribed, publicly discloses each meeting relating to covered products, if any, held by the Secretary with any entity that, during the 5-year period preceding that date—</text><clause commented="no" display-inline="no-display-inline" id="id9b0fb113bfe5496c9c0938c1aec60435"><enum>(i)</enum><text display-inline="yes-display-inline">has had substantial ties to the People’s Republic of China or the Chinese Communist Party; and</text></clause><clause id="id279b7c95f9d84b73aafefdbb3c48e382"><enum>(ii)</enum><text>has manufactured, sold, or shipped goods entering the United States that are of that type (or class) of covered product.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7450a19e17864e46b18507016ad90f77"><enum>(6)</enum><text>in paragraph (6) (as so redesignated), by striking the paragraph designation and all that follows through <quote>capacities,</quote> in the first sentence and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide06d0dda0b63453f8ad40b08aa5e2a81"><paragraph commented="no" display-inline="no-display-inline" id="id18518c2154c34703968781c9d8d4b091"><enum>(6)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary shall not prescribe an amended or new standard under this section unless the Secretary finds (and publishes such finding) that, based on a preponderance of the evidence in the record, the standard will not result in the unavailability in the United States in any covered product type (or class) of performance characteristics (including reliability), product lifetime, features, sizes, capacities, installation methods, fuel types, technologies, materials,</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98e4d0649858471e844390ca6017fa29"><enum>(7)</enum><text>in paragraph (7) (as so redesignated), by striking the designation and all that follows through <quote>may</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86a1970b88fe4e728e89589cecc7d0eb"><paragraph commented="no" display-inline="no-display-inline" id="id1227f18fbf1f4f2a832f9348aef4438e"><enum>(7)</enum><header>Limitation regarding major functions</header><subparagraph id="id5d6c334f258144f2959a06bcd52b9661"><enum>(A)</enum><header>Definition of major function</header><text>In this paragraph, the term <term>major function</term>, with respect to a covered product type, means a fundamental use or purpose of the covered product type, including the fuel type.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcba0ef2d5c94538812f8b6b2cb9386c"><enum>(B)</enum><header>Limitation</header><text>The Secretary shall not</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9ac5de9c7444a65b8cd9b914ca0dc58"><enum>(8)</enum><text>by striking paragraph (9) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0c4dfea35ad94218b05b29f1a8b39039"><paragraph commented="no" display-inline="no-display-inline" id="ida2ab152f2ad54209911af5c1600bf4e7"><enum>(9)</enum><header>Application to products</header><subparagraph commented="no" display-inline="no-display-inline" id="idd3525afed04b468b8844c02cd6aa93aa"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in subparagraph (B) or subsection (p)(4), an amendment prescribed under this subsection shall apply to covered products or equipment manufactured after the date that is 5 years after publication of the final rule establishing the applicable standard.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd6f16f2844424c2bbf97d65410110592"><enum>(B)</enum><header>Compliance date</header><text display-inline="yes-display-inline">No amended standard prescribed under this subsection may establish a compliance date for a covered product earlier than 10 years after the compliance date of the most recent standard applicable to that covered product.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a6f7755b1304c45be69ecd2b824893b"><enum>(9)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7a874142babc4595988fe1966ca07250"><paragraph id="id18c80b17194041459ac2bb3a7d0a7b76"><enum>(10)</enum><header>Separate standards for vented products or equipment based on venting category</header><subparagraph id="ide45ab802aa6e40098c811a4ab8dbffdd"><enum>(A)</enum><header>In general</header><text>In any rulemaking to establish a new or amended energy conservation standard for any type (or class) of product or equipment described in subparagraph (D), the Secretary shall establish separate energy conservation standards for such type (or class) of product or equipment—</text><clause id="id959aaf09251742ec96a9cd435febb094"><enum>(i)</enum><text>for each of the Category I, Category II, Category III, and Category IV venting categories, to the extent that such products or equipment exist in the market; and</text></clause><clause id="id61244c29b0d1435a91f86904a6a6341b"><enum>(ii)</enum><text>that reflect the unique performance-related features of the relevant venting category, including with respect to technology, venting, installation, and performance.</text></clause></subparagraph><subparagraph id="id9b15ae42d4eb44ee9814cec276c3de9d"><enum>(B)</enum><header>Venting category determination</header><text>In establishing energy conservation standards pursuant to this paragraph, the Secretary shall determine and label the venting category for each type (or class) of product or equipment described in subparagraph (D) in accordance with the requirements for venting category determination under the applicable standard of the American National Standards Institute.</text></subparagraph><subparagraph id="idcac809d5add2477da5abf10e6431dd4f"><enum>(C)</enum><header>Inapplicability of certain criteria</header><text>Paragraph (1) shall not apply with respect to any energy conservation standard established pursuant to this paragraph.</text></subparagraph><subparagraph id="id773cf6ed8d3c40b2bc5998dbd9104ef9"><enum>(D)</enum><header>Applicability</header><text>The type (or class) of product or equipment referred to in this paragraph are the following:</text><clause id="id3299cd1df39449edb58c44a5c417a78b"><enum>(i)</enum><text>Any covered product—</text><subclause id="id688883da535c4d31b266f462232c3f33"><enum>(I)</enum><text>that is classified into any of the Category I, Category II, Category III, or Category IV venting categories; and</text></subclause><subclause id="id12dcb384002141deb81a9c2a46e7d082"><enum>(II)</enum><text>for which energy conservation standards are applicable under this part.</text></subclause></clause><clause id="id82b0eac7c9a8456d944f4d30447084ce"><enum>(ii)</enum><text>Any covered equipment (as defined in section 340)—</text><subclause id="id66d53920380b40da86c074d050cc3b49"><enum>(I)</enum><text>that is classified into any of the Category I, Category II, Category III, or Category IV venting categories; and</text></subclause><subclause id="ide2bb29ff54a24fedbdd67a991fd44eb5"><enum>(II)</enum><text>for which energy conservation standards are applicable under this part.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcc9727fcb43f4009b09cb060933601fd"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id8a74d627a0e14a3fb995a719847df8ad"><enum>(1)</enum><text>Section 321(33)(B)(i)(III) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291(33)(B)(i)(III)</external-xref>) is amended by striking <quote>325(o)(4)</quote> and inserting <quote>325(o)(6)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5517d07ba61e4a17968c717b68f63b64"><enum>(2)</enum><text>Section 325 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8bea479b963f4816a17fc4720b97343e"><enum>(A)</enum><text>in subsection (e)(6)(E)(ii), by striking <quote>(m)(4)(A)(ii)</quote> and inserting <quote>(o)(9)(A)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b3deaca3b50446ca03f6e7c35516007"><enum>(B)</enum><text>in subsection (n)(2)(C), by striking <quote>(o)(2)(B)(i)(II)</quote> and inserting <quote>(o)(4)(B)(i)(II)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id252060f775904ff484d3a7827ae61ba1"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (p)(2)(A)—</text><clause commented="no" display-inline="no-display-inline" id="id8f54e4166e58461ebeeeda8a698ed8f0"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>(o)(2)</quote> and inserting <quote>(o)(4)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4bfa9ff02f234ac48cce7aeef646e6a1"><enum>(ii)</enum><text>by striking <quote>(o)(4)</quote> and inserting <quote>(o)(6)</quote>.</text></clause></subparagraph></paragraph></subsection></section><section id="id359c7ba752bd486798670f753df8639a"><enum>7.</enum><header>Procedure for prescribing new or amended standards</header><text display-inline="no-display-inline">Section 325(p) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(p)</external-xref>) is amended—</text><paragraph id="id5b4199d446f042d9a1e71d5f8d197dc0"><enum>(1)</enum><text>by redesignating paragraphs (1) through (4) as paragraphs (2) through (5), respectively; and</text></paragraph><paragraph id="id698b76e662a3434594f17d8a1f4dfac1"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idab9c1c35f0cc4a87974786078ea4be52"><paragraph id="id64bb965d938345deb5537cd42901a7e7"><enum>(1)</enum><text>Not later than 1 year after the date of publication in the Federal Register of a final test procedure prescribed under section 323, if applicable, for a covered product specified in or classified pursuant to section 322, the Secretary may publish in the Federal Register a request for information or other preliminary rulemaking notice as to whether an energy conservation standard should be prescribed for such type (or class) of covered product.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idf7301d0d6c9442b08d3632680d6e59e8"><enum>8.</enum><header>Product classes</header><text display-inline="no-display-inline">Section 325 of the Energy Policy Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended by striking subsection (q) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida215d947ddb5409ab57e98460c19d062"><subsection id="ide7038f8cf606422899322a9282f13dc1"><enum>(q)</enum><header>Product classes</header><paragraph id="ida7f2029dec654c4880a5dd4e218f6b5e"><enum>(1)</enum><header>Definition of performance-related feature</header><text>In this subsection, the term <term>performance-related feature</term>, with respect to a covered product, means a feature that—</text><subparagraph id="ide5b3bcea33b9485786a14c2a9f01452e"><enum>(A)</enum><text>measurably affects energy consumption, capacity, or another quantifiable characteristic relevant to energy use of that covered product; or</text></subparagraph><subparagraph id="id7fce1256ad364c88af9c206061ccacf1"><enum>(B)</enum><text>is already present in a subset of existing products or is commercially mature and highly considered by consumers when choosing among comparable products, including reliability, product lifetime, features, sizes, capacities, installation methods, fuel types, technologies, materials, compatibility with existing systems, including other common vented appliances, and volumes.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id363f73bb1841461e96914d23f129a261"><enum>(2)</enum><header>Rule</header><text>The Secretary shall issue a rule establishing 1 or more product classes for covered products—</text><subparagraph id="id6b4508d7d859443eab3be4ecb47395fa"><enum>(A)</enum><text>that consume a different kind of energy than the energy consumed by other covered products within that type (or class);</text></subparagraph><subparagraph id="id804c329914464f7b8de1d9ef74999070"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idcb149ea7582945918fe0f0c9fd4626bb"><enum>(i)</enum><text>that have a performance-related feature that other products within that type (or class) do not have; and</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id0e2196058a61405180a005b293b93024"><enum>(ii)</enum><text>the performance-related feature described in clause (i) of which justifies a higher or lower standard from the standard that applies (or will apply) to other products within that type (or class); or</text></clause></subparagraph><subparagraph id="ide5b1b1ca73f141f6a9774770c15b4f5d"><enum>(C)</enum><text>that materially affect operating and venting conditions or energy consumption or use in a way that cannot be captured by adjustments to test procedures.</text></subparagraph></paragraph><paragraph id="id5bee43d3949b4f9bbdf2e3b6549aa486"><enum>(3)</enum><header>Procedural requirements</header><text>To establish a new product class under subparagraph (B) or (C) of paragraph (2), the Secretary shall—</text><subparagraph id="id680eb63806a04b67987eea13600d895a"><enum>(A)</enum><text>publish a notice of proposed rulemaking in the Federal Register that—</text><clause id="id3dcf242d5a8b4360b96b0555f96a2eae"><enum>(i)</enum><text>defines the proposed product class with precision, including function, performance-related feature, and product attribute; and</text></clause><clause id="id31aa06d206294058966182b176a75a20"><enum>(ii)</enum><text>demonstrates whether the performance-related feature is imminently feasible; and</text></clause></subparagraph><subparagraph id="idfa30f695e2054c3c8774aa5da3d98367"><enum>(B)</enum><text>allow a minimum public comment period of 60 days.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id69443b9ed6d44c9893c9d229844d7c48"><enum>9.</enum><header>Requirements of manufacturers</header><text display-inline="no-display-inline">Section 326 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6296">42 U.S.C. 6296</external-xref>) is amended—</text><paragraph id="idcaa558d79f674528bb3203aa5a724079"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id90bb60be09d744c380bb5d44a518d251"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (4); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7bf7461e7464f99819861e1ba6874e5"><enum>(B)</enum><text>by redesignating paragraph (5) as paragraph (4); and</text></subparagraph></paragraph><paragraph id="id90c2af66ba28449baf34309cbd09ee71"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id8cfc18d2aa1943fc902db1dd9e52f375"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (6); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c0e0f0dc0b845f697965b599ce50ae4"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block id="id88a570391eef464995ff9b68214d85c0" display-inline="no-display-inline" style="OLC"><paragraph id="idd885b527942149a7b225185efae45dab"><enum>(3)</enum><header>New, changed, or revoked models</header><text>Information or reports required pursuant to this section shall be required only with respect to new, changed, or revoked models of covered products or test procedures to which a rule under section 324 applies.</text></paragraph><paragraph id="idb3f2f4b75f844bd482d4c29f834fc335"><enum>(4)</enum><header>Single submission</header><subparagraph id="id1d5893730db94fbdbc018b64b5699ff7"><enum>(A)</enum><header>In general</header><text>The Secretary shall coordinate with the Commission and the Administrator of the Environmental Protection Agency (referred to in this paragraph as the <quote>Administrator</quote>) to eliminate duplication among the reporting requirements required under this section and identical information collected by the Commission and the Administrator under the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2601">16 U.S.C. 2601 et seq.</external-xref>) and the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>), respectively, so that only a single submission with such information is required to be submitted to the Secretary under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb36190237e041b9ba5ecf7fec40aa65"><enum>(B)</enum><header>Administration</header><text>In carrying out subparagraph (A), the Secretary shall, in coordination with the Commission and the Administrator—</text><clause id="id42b30783a5c84d81b95f534c3eea90f0"><enum>(i)</enum><text>ensure that data elements, definitions, and reporting formats are harmonized; and</text></clause><clause id="id6aed3b4e987546d3b982e846cc1277c5"><enum>(ii)</enum><text>enable the secure sharing of information among the Department of Energy, the Commission, and the Environmental Protection Agency.</text></clause></subparagraph><subparagraph id="id10b859948ad84c34899ebcc1e1024f6e"><enum>(C)</enum><header>Disputes</header><text>The Secretary shall resolve disputes among the Commission, the Administrator, and the Secretary relating to carrying out this section.</text></subparagraph><subparagraph id="id4d9dc542fe4546398f83564c7b5f6adc"><enum>(D)</enum><header>Separate submissions</header><text>The Commission and the Administrator may not require separate or additional submission requirements beyond the single submission required under subparagraph (A) unless—</text><clause commented="no" display-inline="no-display-inline" id="id8d73207c98364f07b8df7605ba0e7ccd"><enum>(i)</enum><text display-inline="yes-display-inline">those requirements are agreed to pursuant to subparagraph (A); or</text></clause><clause id="id90d4b7bbedbc4810bfdc78abe1961978"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id5db38ca3b57541019ebab371d52a95aa"><enum>(I)</enum><text>the information is necessary to carry out an explicit statutory obligation; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida9b25d77de70431289a4c54274441025" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the requesting agency explains in writing why the information cannot be obtained through the requirements agreed to pursuant to subparagraph (A).</text></subclause></clause></subparagraph></paragraph><paragraph id="id6f3ae4bf60a94b159527037db023c050" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Manufacturer responsibility</header><text>If a covered product or industrial equipment is a component in a finished product, the manufacturer of that component, not the manufacturer of the covered product, industrial equipment, or other finished product, shall be responsible for submitting information pursuant to this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idbed1808361dc46fdaef9f11f37dda9a8"><enum>10.</enum><header>Effects on other law</header><text display-inline="no-display-inline">Section 327 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6297">42 U.S.C. 6297</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb79899eaf79f4e7f9fcbb9e4df980628"><enum>(1)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>Effective on</quote> and all that follows through <quote>any covered product</quote> and inserting <quote>Effective on the date the consumer product is specified in, or classified by the Secretary under, section 322 as a covered product</quote>; and</text></paragraph><paragraph id="id64899c25d91f458fa3292afd6d7d2fc4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id388f72fea8694e5093bc384253dbe477"><subsection id="idca64f82f007a4754b2951c9461c78523"><enum>(h)</enum><header>Rule of preemption on fuel use restrictions</header><text>State restrictions on fuel use or requirements, including labeling, applicable to or affecting the sale and use of covered products are subject to and preempted under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id166699c8398f43439c0c7abd5d1d363b"><enum>(i)</enum><header>General rule of preemption for energy conservation standards when Federal standard is revoked for a product</header><paragraph commented="no" display-inline="no-display-inline" id="id6f3544e65db84747938ed3e271130feb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No State regulation, or revision thereof, relating to energy efficiency, energy use, or water use of a covered product shall be effective even if the Federal standard relating to energy efficiency, energy use, or water use for that covered product has been revoked.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c29f7c854184080ac1023ad30763ad0"><enum>(2)</enum><header>Previous Federal standard in effect</header><text display-inline="yes-display-inline">On revocation of a Federal standard described in paragraph (1), the previously issued Federal standard shall be in effect.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id946706b183a94f1ea52a747a6c05918b"><enum>(3)</enum><header>Rule of construction</header><text>A revocation of a Federal standard described in paragraph (1) does not permit a State to fill the void of the revoked Federal standard—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida79482da08424aea83f84f361695f752"><enum>(A)</enum><text display-inline="yes-display-inline">by promulgating a new regulation, or revising an existing regulation; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c69518b903e40d6b1262f0f635161f3"><enum>(B)</enum><text display-inline="yes-display-inline">with a previously established State regulation.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4e1d2067cb0b4fa48523d10084afdb60"><enum>(j)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section—</text><paragraph commented="no" display-inline="no-display-inline" id="id7bb9f0a01623459bb7f8a700c716b6d7"><enum>(1)</enum><text display-inline="yes-display-inline">applies to all State and local governments, including municipalities exercising home-rule authority, special districts, commissions, and agencies created by or under State law; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ec7b290c7584a66a4076512e78e6299"><enum>(2)</enum><text display-inline="yes-display-inline">preempts any State or local law, code, or regulation, whether legislative or administrative in origin, that prohibits, directly or indirectly, the installation or use of a covered product or requires removal or substitution of a covered product based on—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb3d374d0cdba44c891db33d868ddb2fd"><enum>(A)</enum><text display-inline="yes-display-inline">its fuel source; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb10369791fae47189e14507337419676"><enum>(B)</enum><text display-inline="yes-display-inline">the emission of any air pollutant (as defined in section 302 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7602">42 U.S.C. 7602</external-xref>)).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="iddfa80ae0db6944ca9970cff02585ecce"><enum>11.</enum><header>Distribution transformers</header><text display-inline="no-display-inline">Section 346 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6317">42 U.S.C. 6317</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id953818e057bf4066957e1517c6b1ce20"><subsection id="id4c692060e23d41d68beb4c524ab80deb"><enum>(g)</enum><header>No new or revised standards for distribution transformers</header><paragraph commented="no" display-inline="no-display-inline" id="id99d7b792eb684cb88c08df77f2f034d9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date of enactment of the <short-title>Energy Efficiency Reform Act of 2026</short-title>, the Secretary may not prescribe any new or amended energy conservation standard under part B or this part for distribution transformers, including those distribution transformers for which the Secretary prescribed testing requirements under subsection (a)(1) and low-voltage dry-type distribution transformers.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7aa167fcd4e4da0af0b03607f19604f"><enum>(2)</enum><header>Effect on existing standards</header><text display-inline="yes-display-inline">Paragraph (1) does not affect any energy conservation standards prescribed under part B or this part before the date of enactment of the <short-title>Energy Efficiency Reform Act of 2026</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
