which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the National Oceanic and Atmospheric Administration to maintain the Cooperative Institute program.</official-title></form><legis-body><section id="id8a55521fd9bc4363b6a8b6b3aafacfda" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cooperative Institute Act of 2026</short-title></quote>.</text></section><section id="ide4a7822d39ae4214867f3243a2ac6f8a"><enum>2.</enum><header>Cooperative Institutes</header><subsection commented="no" display-inline="no-display-inline" id="ide5943d21172846c0af8e9b1540736ef4"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id6ff07036e2224e8a9216f37553682605"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id252abc132fc24cbbb119542509a70b7a"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Commerce, Science, and Transportation of the Senate and the Committees on Natural Resources and Science, Space, and Technology of the House of Representatives.</text></paragraph><paragraph id="id0dcc225ac6664657b6cb529743b259fd"><enum>(3)</enum><header>Cooperative Institute</header><text>The term <term>Cooperative Institute</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd3ddad6745cd493db54532de3000f603"><enum>(A)</enum><text display-inline="yes-display-inline">an academic or research partnership between—</text><clause commented="no" display-inline="no-display-inline" id="id7fc3411627354d929234461dd118f8d8"><enum>(i)</enum><text display-inline="yes-display-inline">the National Oceanic and Atmospheric Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idac00b0e74e964952b179b381a93aa2fe"><enum>(ii)</enum><text display-inline="yes-display-inline">an eligible research institution, or an association or alliance of 2 or more eligible research institutions; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3433623069524486a2c235a3068a3b66"><enum>(B)</enum><text display-inline="yes-display-inline">that was or is formed either through cooperative agreements previously established under the authority of section 406 of the National Oceanic and Atmospheric Administration Authorization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/15/1540">15 U.S.C. 1540</external-xref>) or under the authority of this section.</text></subparagraph></paragraph><paragraph id="idb1d15933621f4bcaba3908f89d924406"><enum>(4)</enum><header>Eligible research institution</header><text>The term <term>eligible research institution</term> means a research institution that—</text><subparagraph id="id68507c79394f415fad909f405ac98ba6"><enum>(A)</enum><text>is a non-Federal academic or nonprofit institution;</text></subparagraph><subparagraph id="id82813a4af0394a599c2214bf34588dcc"><enum>(B)</enum><text>has an established research program in one or more areas relevant to the Administration’s mission;</text></subparagraph><subparagraph id="id1b75d53f483a4245a53b36939b928f09"><enum>(C)</enum><text>promotes the involvement of students and postdoctoral scientists in research and education; and</text></subparagraph><subparagraph id="id878829f1ae1743888f6a513e62173396"><enum>(D)</enum><text>cooperates with other research institutes included in Cooperative Institutes.</text></subparagraph></paragraph><paragraph id="id9fd37db0e78849948a3659668beb9401"><enum>(5)</enum><header>Under Secretary</header><text>The term <term>Under Secretary</term> means the Under Secretary of Commerce for Oceans and Atmosphere.</text></paragraph></subsection><subsection id="id547d129454034c96900e97139d07d440"><enum>(b)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="idf41d428c2575497aa338dbedb3f55787"><enum>(1)</enum><header>Program goals</header><text display-inline="yes-display-inline">The Under Secretary shall maintain within the Administration a Cooperative Institute program, which shall promote basic and applied research, education, training, and outreach that aligns with the Administration’s mission, fund research capabilities that do not exist within the Administration, and expand research capacity in sciences that are related to the work of the Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39fbc35d5f054de5a83481527688869f"><enum>(2)</enum><header>Cooperative Institute activities</header><text display-inline="yes-display-inline">To achieve these goals, the Cooperative Institutes shall—</text><subparagraph id="id463362a0ce5a4f38b68b5cdd0342c346"><enum>(A)</enum><text>conduct collaborative, long-term research relevant to the Administration’s mission, with substantial involvement between Administration scientists and those at eligible research institutions in one or more scientific disciplines of interest to the Administration;</text></subparagraph><subparagraph id="idbc7df407d76448bdb0b89f233bb8defe"><enum>(B)</enum><text>leverage scientific, educational, and outreach expertise at eligible research institutions which, depending on the research needs determined by the Administration, may or may not be located near an Administration facility;</text></subparagraph><subparagraph id="id5672f6420e524fc199bdcdaf49383423"><enum>(C)</enum><text>support the participation of undergraduate and graduate students and postdoctoral scientists in Administration-related research studies; and</text></subparagraph><subparagraph id="idb31d036d0f324ffeb5c081553e0d7d2a"><enum>(D)</enum><text>strengthen or expand research capacity within the research institutions in Administration-related research by providing funding to support administrative and scientific research activities.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91058531e29040e994d7f592713c7b52"><enum>(3)</enum><header>Emerging research</header><text>Every 2 years, the Under Secretary shall conduct an assessment of the need for additional Cooperative Institutes to address emerging research needs that align with the program goals described in paragraph (1).</text></paragraph></subsection><subsection id="idf9e39ebbd701426593d2a6a1f51ed9db"><enum>(c)</enum><header>Establishment of Cooperative Institutes</header><paragraph commented="no" display-inline="no-display-inline" id="id4f2fb39c61374b498ff6c0ecd5ebbd94"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The Under Secretary may establish a Cooperative Institute by entering into a cooperative agreement with an eligible research institution, or an association or alliance of 2 or more eligible research institutions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab149064821c47fb91533420e1e45d65"><enum>(2)</enum><header>Competition and review</header><subparagraph commented="no" display-inline="no-display-inline" id="id4aba531a351f4eb5a8d4d60d1bd2bd01"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Under Secretary shall use an open competition and merit-based peer-review process for selecting eligible research institutions for each new Cooperative Institute, except as specified in subparagraph.</text></subparagraph><subparagraph id="id9c30b9d1976f4f2c981cad5bde1b324a"><enum>(B)</enum><header>Restricted pool</header><text>The Under Secretary may use a limited competition when the Administration determines that it is in the best interest of the Federal Government to restrict the pool of qualified eligible research institution applicants. The Under Secretary shall justify the rationale for such a restriction under the Department of Commerce and Administration policies related to Federal assistance.</text></subparagraph></paragraph><paragraph id="id21855b618cbe47bf8a08dc66a11bcdb3"><enum>(3)</enum><header>Consolidation</header><text>In cases where multiple eligible research institutions join to form a Cooperative Institute, the Administration shall encourage these eligible research institutions to consolidate management, administrative, and oversight activities into one lead Cooperative Institute, provided the benefit of consolidation outweighs the costs.</text></paragraph><paragraph id="id0963a56c38df4772816f694671a3e48e" commented="no"><enum>(4)</enum><header>Collaboration</header><subparagraph commented="no" display-inline="no-display-inline" id="id69be6ba1d7be440aad434e7328639c46"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To foster collaborations, the Administration is authorized to collocate Federal employees and staff from eligible research institutions of Cooperative Institutes. These collocations may involve—</text><clause commented="no" display-inline="no-display-inline" id="id90b197adb1f949dc8c1a6f91cd94dcd3"><enum>(i)</enum><text display-inline="yes-display-inline">Cooperative Institute staff hosted at Federal facilities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1fde54f8a724458e9e1dfbc3626e0b5a"><enum>(ii)</enum><text display-inline="yes-display-inline">Federal staff assigned their duty station at the eligible research institutions.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id820d820a4588428e8d169d639a924d94"><enum>(B)</enum><header>Choice of arrangement</header><text display-inline="yes-display-inline">The Administration may choose the arrangement described in this paragraph that best fits the needs of the Cooperative Institute when the benefits outweigh the costs.</text></subparagraph></paragraph></subsection><subsection id="idefcf23cb8829474fa8733f556a05ac4f"><enum>(d)</enum><header>Financial assistance</header><paragraph commented="no" display-inline="no-display-inline" id="id0c244b80b79442c2b892fb7406da1240"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The cooperative agreements described in subsection (c)(1) shall be carried out in accordance with section 6305 of title 31, United States Code, and may be facilitated by a 5-year Federal financial assistance award.</text></paragraph><paragraph id="idf6811ec74f39460faa1d2f51419e6fd6"><enum>(2)</enum><header>Second award</header><text>The Under Secretary may award a second 5-year Federal financial assistance award after a Cooperative Institute renewal review, which shall—</text><subparagraph id="id5854a6f039bb4944804db2e36f3410e0"><enum>(A)</enum><text>be based on the outcome of an externally led peer review process that occurs at or about the beginning of the fourth year of the initial award;</text></subparagraph><subparagraph id="ided871eb4d8ab4afda0841e3d420df1b5"><enum>(B)</enum><text>be conducted with the help and support of the Science Advisory Board of the Administration;</text></subparagraph><subparagraph id="id14a05ce8790d4a96a9120d669e2f2c1a"><enum>(C)</enum><text>include a measurement of Cooperative Institute performance relative to well-established, mutually agreed-upon performance measures defined by the Administration and the research institutions; and</text></subparagraph><subparagraph id="id908631dce4dc4c61b762c1880f794dc7"><enum>(D)</enum><text>determine a potential renewal period of not more than 5 additional years and the level of funding commensurate with the final review rating.</text></subparagraph></paragraph></subsection><subsection id="id135a1ba018544b409bc6ea3b83d89001"><enum>(e)</enum><header>Discontinuance</header><text>The Under Secretary may terminate or decide not to renew an established Cooperative Institute if the following is submitted to the appropriate congressional committees not less than 60 days prior to termination or expiration of the Cooperative Institute cooperative agreement:</text><paragraph id="id5d6fa3a087614d14960cd1201dee28fb"><enum>(1)</enum><text>A timeline for the planned termination or expiration of the Cooperative Institute.</text></paragraph><paragraph id="id8141cea0e28346788dc64a2dc77e367b"><enum>(2)</enum><text>A detailed written report, including—</text><subparagraph id="idc7dbb567a805427e95df69b4b1dc89aa"><enum>(A)</enum><text>the justification for termination or expiration of the Cooperative Institute;</text></subparagraph><subparagraph id="id739014c437dd4b36a7697196d73ad73e"><enum>(B)</enum><text>any failures of the Cooperative Institute to meet its stated objectives, including poor management, poor research quality, or poor fiscal management;</text></subparagraph><subparagraph id="id9cc315c9d8f74606bb56fdd72a3d214a"><enum>(C)</enum><text>measurements of the Cooperative Institute performance relative to the mutually agreed-upon performance measures defined by the Administration and the eligible research institutions;</text></subparagraph><subparagraph id="idc4bd91dca035448a96c277e2d6fa0e5e"><enum>(D)</enum><text>plans for reassignment of Administration staff assigned to the Cooperative Institute; and</text></subparagraph><subparagraph id="id0a4f3eaa924743c59b3acdf54387d290"><enum>(E)</enum><text>an explanation of how the research needs that are being met by the Cooperative Institute will be fulfilled by other entities within the Administration, or an explanation of why the research needs no longer exist.</text></subparagraph></paragraph></subsection><subsection id="id2d550ac08bf54b269fe88b028301459e"><enum>(f)</enum><header>Handbook</header><text>The Under Secretary shall maintain a Cooperative Institute Handbook that outlines how the Administration will manage the Cooperative Institutes. The Under Secretary shall consult the Directors of Cooperative Institutes when updating the Cooperative Institute Handbook.</text></subsection><subsection id="ide5d02f514c934379b7c014b78249232f"><enum>(g)</enum><header>Maintenance of Cooperative Institutes</header><text>The Under Secretary shall maintain the Cooperative Institutes, or their successor bodies, in existence as of the date of enactment of this Act, unless terminated as specified in subsection (e).</text></subsection></section></legis-body></bill>
