which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans’ Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to share veterans’ contact information with State veterans agencies to improve outreach, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering States to Serve Veterans Act</short-title></quote>.</text></section><section id="id6b950ff22b2c451e95f895a4be628b36"><enum>2.</enum><header>Sharing of veterans’ contact information with State veterans agencies</header><subsection id="id67448846cbcf445c936a42e985126b15"><enum>(a)</enum><header>In general</header><paragraph id="id7507af48d3d346f7a2a3fb2eac99ff2a"><enum>(1)</enum><header>Requirement</header><text>Subject to paragraph (2), not less frequently than quarterly, the Secretary of Veterans Affairs shall share with each State veterans agency contact information of veterans maintained by the Department of Veterans Affairs for statistical purposes and conducting outreach to veterans residing in that State.</text></paragraph><paragraph id="ide8d13ab3cf3a4a98af3f9898037abba1"><enum>(2)</enum><header>Limitations</header><text>Contact information shared under this Act shall not include—</text><subparagraph id="id0e29d85746824291b1ca7c7a93f02395"><enum>(A)</enum><text>any protected health information (as defined in section 160.103 of title 45, Code of Federal Regulations (or any successor regulations));</text></subparagraph><subparagraph id="ide97e3435c4fb4649b7ba9dd8a5279560"><enum>(B)</enum><text>any Social Security number or date of birth;</text></subparagraph><subparagraph id="id29e6755bd7344a1bbf4eaa28537f6cda"><enum>(C)</enum><text>any financial, disability rating, appeal, or claims information; or</text></subparagraph><subparagraph id="idef24c3bb3bf54a1c9813cc21fa6262c8"><enum>(D)</enum><text>any information designated by the Secretary as sensitive or restricted under Federal law.</text></subparagraph></paragraph></subsection><subsection id="id97880647468b413c9befc9b9126521c2"><enum>(b)</enum><header>Notice; opt out</header><paragraph id="id45990f291037472fae5173f52cb30876"><enum>(1)</enum><header>Notice</header><subparagraph commented="no" display-inline="no-display-inline" id="idc64d238457ea41d3823662eeeb740b04"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide clear notice to each veteran, in paper and electronic communications, that—</text><clause id="id404f86b3dc974d2c9e8ac29c9e9643c9"><enum>(i)</enum><text>the veteran’s contact information may be shared, for statistical and outreach purposes, with the State veterans agency of the State in which the veteran resides; and</text></clause><clause id="id3e4dc93e081c4224ae455dead0c223e9"><enum>(ii)</enum><text>the veteran may opt out of such sharing at any time.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0513c43e72784694b9319c9d6d252e6c"><enum>(B)</enum><header>Timing</header><text>The Secretary shall provide notice required by subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id554846c667aa4f02a5df266a98117177"><enum>(i)</enum><text display-inline="yes-display-inline">45 days before the initial transfer of contact information to a State veterans agency for any individual who is a veteran on the date of the enactment of this Act; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id8bfc673409a449699b348a67d4db6838"><enum>(ii)</enum><text display-inline="yes-display-inline">at the time of transition from military service for any individual who is a member of the Armed Forces.</text></clause></subparagraph></paragraph><paragraph id="id5e344fdfa99c4708911a2d2bb943a472"><enum>(2)</enum><header>Opt out</header><subparagraph id="idb90e2838e4dc41d38d9767520fd2256d"><enum>(A)</enum><header>Process</header><text>The Secretary shall establish and maintain an accessible process for veterans to opt out of contact-information sharing under this Act, including an online form and toll-free telephone number.</text></subparagraph><subparagraph id="id587bad74e3b74353b64363064380926c"><enum>(B)</enum><header>Prohibition</header><text>If a veteran opts out of contact-information sharing under this Act through the process established under subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id2edf3389fdd341f8bb368a13699e08c9"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary shall not share the contact information of the veteran under this Act unless the veteran subsequently provides the Secretary affirmative consent for such sharing; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id757631e89ee9481ba6ba1b8463339fbd"><enum>(ii)</enum><text display-inline="yes-display-inline">any State veterans agency in receipt of contact information of the veteran shall immediately cease use of and destroy that information.</text></clause></subparagraph></paragraph></subsection><subsection id="idcd73cfefc18c4baf9030530e8b8ad6a9"><enum>(c)</enum><header>Privacy and security</header><paragraph id="id39cdd23433384e02a3473b8ff0bd9785"><enum>(1)</enum><header>Use and disclosure</header><text>Each State veterans agency that receives contact information of veterans under this Act—</text><subparagraph id="id93894116e71e46d0852d56b283e6b479"><enum>(A)</enum><text>shall use such information solely for statistical and outreach purposes authorized by the Secretary; and</text></subparagraph><subparagraph id="idfbcc986cf27648168ce833c8290434e7"><enum>(B)</enum><text>shall not—</text><clause commented="no" display-inline="no-display-inline" id="idb0d994de974240518fe53095fa94f491"><enum>(i)</enum><text display-inline="yes-display-inline">sell, transfer, or otherwise disclose such information to any third party; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id744e294752f44803bd5198eb363cab84"><enum>(ii)</enum><text display-inline="yes-display-inline">publish data based on such information.</text></clause></subparagraph></paragraph><paragraph id="id615285988dfb4e80a4faf650546bb2a1"><enum>(2)</enum><header>Security measures</header><text>Each State veterans agency that receives contact information of veterans under this Act shall implement data protection and cybersecurity measures consistent with Federal standards for safeguarding personally identifiable information.</text></paragraph><paragraph id="ida63095015d6f44d7bebb0cb81d0ac794" commented="no"><enum>(3)</enum><header>Compliance</header><text>The Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3376d507fc33420085f2be0bd014c8cd"><enum>(A)</enum><text display-inline="yes-display-inline">shall require proof of compliance with the measures described in paragraph (2) before sharing contact information of veterans under this Act with a State veterans agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e07a056045948d4ae96a4ea58881e5e"><enum>(B)</enum><text display-inline="yes-display-inline">shall not share contact information of veterans under this Act with a State veterans agency that does not demonstrate compliance with the requirements of this Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ca6016648f845f89e7e54ddd8fba9b2"><enum>(C)</enum><text display-inline="yes-display-inline">shall require certifications or audits to ensure ongoing compliance with this Act. </text></subparagraph></paragraph></subsection><subsection id="id24599a95ecf3431da322d65592bd1342"><enum>(d)</enum><header>State veterans agency defined</header><text>In this section, the term <term>State veterans agency</term> means an agency of a State government that provides a range of benefits and services to veterans and their families.</text></subsection><subsection id="id22b7c28958944d83bfc4d2d81a7fc4ce"><enum>(e)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall prescribe regulations to carry out this Act, including procedures for contact-information sharing, opt-out management, and security compliance.</text></subsection><subsection id="id6f364606b3bb4ace85ddc069738542be"><enum>(f)</enum><header>Effective date</header><text>Subsections (a) through (d) shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
