which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to strengthen program integrity oversight for the Health Care Fraud and Abuse Control Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Fraud Prevention and Enforcement Act</short-title></quote>.</text></section><section id="idbb7dccf0bb2e4ba1b3f581a73e8b52e5"><enum>2.</enum><header>Strengthening program integrity oversight for the Health Care Fraud and Abuse Control Program</header><subsection id="idd95bde4b63e0455bb8a916b6105f6b21"><enum>(a)</enum><header>Additional funding</header><paragraph id="id919bb4cac156487a9cfcf940c6f62596"><enum>(1)</enum><header>Departments of Health and Human Services and Justice</header><text>Section 1817(k)(3)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)(A)(i)</external-xref>) is amended—</text><subparagraph id="idb6cef55b9d084fdba97525e6ff407bd7"><enum>(A)</enum><text>in subclause (III), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id93a2489b3cd54d40910a35f281577b9a"><enum>(B)</enum><text>in subclause (IV)—</text><clause id="id333a807b030a4dec8e0be7123d5271a0"><enum>(i)</enum><text>by inserting <quote>and before fiscal year 2027</quote> after <quote>after fiscal year 2006</quote>; and</text></clause><clause id="id4d0f4f4a0903449fb1fdf07b0c0a0b01"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="idb241330e5efa44848ade6081bbd5a9e9"><enum>(C)</enum><text>by adding at the end the following new subclauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id127efa03135043b8b4c4561a62fb5089"><subclause id="idacd62daf10724128a85f9ea247d93072"><enum>(V)</enum><text>for fiscal year 2027, $490,000,000;</text></subclause><subclause id="id57d6457165dc4f42aefbdf5c6fb4e4cb"><enum>(VI)</enum><text>for fiscal year 2028, $520,000,000;</text></subclause><subclause id="id47c59cd8dc0341c8ae2836c705d35813"><enum>(VII)</enum><text>for fiscal year 2029, $570,000,000; and</text></subclause><subclause id="idcd4ab6f037c648b080d26375ce07ff66"><enum>(VIII)</enum><text>for each fiscal year after fiscal year 2029, the limit under this clause for the preceding fiscal year, increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) over the previous year.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id77d20fd1e07247dbb76fa80875e847f2"><enum>(2)</enum><header>Office of the Inspector General of the Department of Health and Human Services</header><text>Section 1817(k)(3)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)(A)(ii)</external-xref>) is amended—</text><subparagraph id="iddc193cd981a94dbcaa1e003d31bb64ea"><enum>(A)</enum><text>in subclause (VIII), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idcd10bc6de6794799ae9bcf44eb055fe2"><enum>(B)</enum><text>in subclause (IX)—</text><clause id="idaa6d9b931e274185a97332b9dc26e392"><enum>(i)</enum><text>by inserting <quote>and before fiscal year 2027</quote> after <quote>after fiscal year 2007</quote>; and</text></subclause><subclause id="id4b4a865aea174c42a8be0cfb7447e391"><enum>(XIII)</enum><text>for each fiscal year after fiscal year 2029, not less than the amount required under this clause for the preceding fiscal year, increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) over the previous year.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id7640448e317b41128238b896233b9992"><enum>(3)</enum><header>Federal Bureau of Investigation</header><text>Section 1817(k)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)(B)</external-xref>) is amended—</text><subparagraph id="id28c1db07cd7e44aeb5f9133184af91e3"><enum>(A)</enum><text>in clause (vii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="iddcaf164531e14246820f778876227cee"><enum>(B)</enum><text>in clause (viii)—</text><clause id="id14f4da39b69947d893193bf93cec1ee2"><enum>(i)</enum><text>by inserting <quote>and before fiscal year 2027</quote> after <quote>after fiscal year 2006</quote>; and</text></clause><clause id="idfb5ba8039aa74608ab28af44a1ad2c0e"><enum>(xii)</enum><text>for each fiscal year after fiscal year 2029, the amount to be appropriated under this subparagraph for the preceding fiscal year, increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) over the previous year.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idc7e0a1db2c754e438518215bea35575a"><enum>(4)</enum><header>Medicare Integrity Program</header><text>Section 1817(k)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(4)</external-xref>) is amended—</text><subparagraph id="id229906da8dda4b62870ff7273c3986d8"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="idd78bb1e1d3124e14a67b7ca5cc5fa1a5"><enum>(i)</enum><text>in clause (vii), by inserting <quote>and before fiscal year 2027</quote> after <quote>after fiscal year 2002</quote>; and</text></clause><clause id="id217b8126296c4a288efa7dba7587bf14"><enum>(ii)</enum><text>by adding at the end the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2ce2dc02890c4b0ba0a42a3b65390505"><clause id="idd89c08abddbe43f8bac98856ce84eb61"><enum>(viii)</enum><text>For fiscal year 2027, $1,280,000,000.</text></clause><clause id="idcd3701c14f5445d385451232e8b6ab22"><enum>(ix)</enum><text>For fiscal year 2028, $1,380,000,000.</text></clause><clause id="id5c55b9f87d5649e6a8705815bc81d892"><enum>(x)</enum><text>For fiscal year 2029, $1,480,000,000.</text></clause><clause id="id0459974bedcd49e2bde55afbf844983e"><enum>(xi)</enum><text>For each fiscal year after fiscal year 2029, the amount appropriated under this subparagraph for the preceding fiscal year, as increased pursuant to subparagraph (C)(ii).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ide156a3968c7048da8aadfa5522d2aa15"><enum>(B)</enum><text>in subparagraph (C)(ii), by striking <quote>For each fiscal year after 2010</quote> and inserting <quote>For each of fiscal years 2011 through 2026, and for each fiscal year after fiscal year 2029</quote>.</text></subparagraph></paragraph><paragraph id="iddab324c69eb04040ad2bbe8e787816a6"><enum>(5)</enum><header>Medicare-Medicaid data match program</header><text>Section 1817(k)(4)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(4)(D)</external-xref>) is amended—</text><subparagraph id="id9d86708ad3ff4b04b44c81221ced7774"><enum>(A)</enum><text>in clause (v), by inserting <quote>through fiscal year 2026</quote> after <quote>and each fiscal year thereafter</quote>; and</text></subparagraph><subparagraph id="id835d636616d34c9d9afbf3f6bf21c498"><enum>(B)</enum><text>by adding at the end the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id32a141a71067464c87ab26a7215cd25a"><clause id="id65dbdc4d03bf4bdf910993bddac72411"><enum>(vi)</enum><text>$110,000,000 for fiscal year 2027.</text></clause><clause id="idd7122688139e4959875e8bdbc6b044e2"><enum>(vii)</enum><text>$120,000,000 for fiscal year 2028.</text></clause><clause id="idcc2bf9b15c0c4bea8af7b575a29b3e87"><enum>(viii)</enum><text>$130,000,000 for fiscal year 2029.</text></clause><clause id="idecf0231a0fd840cf91bf70e3bc9c3726"><enum>(ix)</enum><text>For each fiscal year after fiscal year 2028, the amount appropriated under this subparagraph for the preceding fiscal year, as increased pursuant to subparagraph (C)(ii).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idf40a3f7e4cd846eba702873bb4f70d21"><enum>(b)</enum><header>Expansion of investigative authority of the office of the inspector general of the department of health and human services</header><text>Section 1817(k)(3)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)(A)(ii)</external-xref>) is amended—</text><paragraph id="id46c37258ec154e8f824628e18f8b19f0"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text style="OLC" level="clause">Medicare and medicaid activities</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="clause">Office of the inspector general of the department of health and human services</header-in-text></quote>; and</text></paragraph><paragraph id="id55fdcb2736b54157b32e243ade6cc04a"><enum>(2)</enum><text>in the matter preceding subclause (I), by striking <quote>title XIX</quote> and inserting <quote>title XIX and any program established under title I (or under the amendments made by such title) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) that is administered by the Secretary</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id07c437f918cd463986b4ceec7cf75eb4"><enum>(c)</enum><header>Clarification concerning the definition of health plan</header><text>Section 1128C of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7c">42 U.S.C. 1320a–7c</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id573c6fe7f26f42179e43de6f8862662e"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(B), by inserting <quote>public and private</quote> before <quote>delivery</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e481c3b245c4288857f40ce408287b9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), in the matter preceding paragraph (1), by inserting <quote>public or private</quote> before <quote>plan or program</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7b502a08a3cb47a49c75446aba49d4df"><enum>(d)</enum><header>Clarification of authority for the activities of the departments of justice and health and human services</header><text display-inline="yes-display-inline">Section 1817(k)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id65F103242E6C4843A1D296599340137B"><subparagraph commented="no" display-inline="no-display-inline" id="idcc835f3e71414d34890e96dd64ddd1f4"><enum>(D)</enum><text display-inline="yes-display-inline">Rule of construction.—Nothing in this paragraph shall be construed to limit the authority of the Secretary, the Attorney General, or the Inspector General of the Department of Health and Human Services to use funds made available under this paragraph to—</text><clause commented="no" display-inline="no-display-inline" id="ida97b826ba24b44cb8817e6a3eca00582"><enum>(i)</enum><text display-inline="yes-display-inline">detect or prosecute health care fraud and abuse; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcecd06bcb20e435f930172edbbbb9600"><enum>(ii)</enum><text display-inline="yes-display-inline">communicate with the public about health care fraud.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd765074f70404d72ab6d33e7ad6be950"><enum>(e)</enum><header>Annual report to congress</header><text>Section 1817(k)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd5c189129196436c8b9dbcf99512427a"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id985829b5b71c448b9ac5703bd883d932"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text style="OLC" level="paragraph">report</header-in-text>.—Not later than January 1</quote> and inserting “<header-in-text level="paragraph" style="OLC">report</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2bd93e2bb00f4e0285fda552ba01925b"><subparagraph commented="no" display-inline="no-display-inline" id="idb5b668b1d84b489795e71bf99e2b35b1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than April 1</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c3c68f4eecc427b83ed295709079fc4"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf108705218ac47f4a7c9e74912d99903"><subparagraph commented="no" display-inline="no-display-inline" id="id39f66f012f674f4d835c551689c6c238"><enum>(B)</enum><header>Required notice of delay</header><clause commented="no" display-inline="no-display-inline" id="id70100766d84149ee811aec720b7bf7b0"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>If the annual report required under subparagraph (A) is not submitted to Congress by April 1 of the year, the Secretary and Attorney General shall jointly provide notice to the appropriate committees of Congress beginning not later than such April 1, and annually thereafter until such report is submitted to Congress, stating the reason for the delay.</text></clause><clause commented="no" display-inline="no-display-inline" id="id168e5db4e3d64353991de5fcf60e1a1a"> <enum>(ii)</enum> <header>Applicable committees of Congress defined</header> <text display-inline="yes-display-inline">For purposes of this subparagraph, the term <term>appropriate committees of Congress</term> means the Committees on Finance and the Budget of the Senate and the Committees on Ways and Means, the Budget, and Energy and Commerce of the House of Representatives. </text>
 </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9b7ef9b52cd14f71b6b14af03b711349"><enum>(f)</enum><header>Process for determining funding allocation for departments of justice and health and human services</header><text>Section 1817(k)(3)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(3)(A)(i)</external-xref>) is amended, in the matter preceding subclause (I), by striking <quote>certify</quote> and inserting <quote>agree</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3988b898e3c4493f912ee7933d944e7d"> <enum>(g)</enum> <header>Inclusion of children’s health insurance program in medicare-Medicaid data match program</header> <text>Section 1893(g) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ddd">42 U.S.C. 1395ddd(g)</external-xref>) is amended—</text>

 </subsection></section><section id="id9584333885a1401295113a9031fe2457"><enum>3.</enum><header>GAO study and report on performance and effectiveness of Health Care Fraud and Abuse Control Program</header><subsection id="id8d26fcb08f05495792dfa16b49cb2aba"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study regarding the performance and effectiveness of the Health Care Fraud and Abuse Control Program. To the extent feasible and data are available, the study shall include the following:</text><paragraph id="idd2f322634dfd4907908dd510d7551e18"><enum>(1)</enum><text>An analysis of how the Department of Health and Human Services and the Department of Justice have used their appropriations to achieve the goals of the Health Care Fraud and Abuse Control Program under section 1128C of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7c">42 U.S.C. 1320a–7c</external-xref>).</text></paragraph><paragraph id="idbda91fc5aa0f44abb8d2aec1c289ff9c"><enum>(2)</enum><text>An analysis of performance assessments and other metrics the Department of Health and Human Services and the Department of Justice use to determine the performance and effectiveness of the Health Care Fraud and Abuse Control Program.</text></paragraph><paragraph id="idfd1945fbc6354ed488344097568f302a"><enum>(3)</enum><text>A description of how the Department of Health and Human Services and the Department of Justice obligated funds for the Health Care Fraud and Abuse Control Program.</text></paragraph><paragraph id="id3abe466626cb4ee4a35cb7b825a31df0"><enum>(4)</enum><text>An analysis of how the Department of Health and Human Services and the Department of Justice assess Health Care Fraud and Abuse Control activities and whether key program outputs have changed over time since the most recent Government Accountability Office report under section 1817(k)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(6)</external-xref>).</text></paragraph><paragraph id="id3131c5f12c624a959d3f1cc17e15687c"><enum>(5)</enum><text>An analysis of evidence available regarding the effectiveness of the Health Care Fraud and Abuse Control Program in reducing health care fraud and abuse.</text></paragraph><paragraph id="idea76b13eddf24b7c83ea2288dada846d"><enum>(6)</enum><text>An analysis of the timeliness of the annual Health Care Fraud and Abuse Control report under section 1817(k)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i(k)(5)</external-xref>) and how the Department of Health and Human Services and the Department of Justice could improve the timeliness of such report.</text></paragraph></subsection><subsection id="idc8f20546728a4dadb4003ba2a1a08015"><enum>(b)</enum><header>Report</header><text>Not later than 16 months after the date of enactment of this Act, the Comptroller General shall report to Congress the results of the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate.</text></subsection></section></legis-body></bill>
