<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5325</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260806">August 6, 2026</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself and <cosponsor name-id="S426">Mr. Kim</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Delaney Hall Closure Act</short-title></quote>.</text></section><section id="idcece22633d024562ab9649c082835fcd"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ide1c1bd47088b4851929a6dbb8640a528"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text></paragraph><paragraph id="id1a69a4595abc4485bee2743be4949c31"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="ide3ed5d588ff949a6b7bb8d121f63ff11"><enum>3.</enum><header>Closure of Delaney Hall Detention Center</header><subsection id="id3bd50dcea6044dd88479735a4b56ea40"><enum>(a)</enum><header>In general</header><text>The Secretary—</text><paragraph id="ide2e6c3b2652742d29a0b81869593276d"><enum>(1)</enum><text>not later than 90 days after the date of the enactment of this Act, shall cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey; and</text></paragraph><paragraph id="id8a68fea8bcdf4d0baa06695e6bbd2bf5"><enum>(2)</enum><text>shall not enter into any contract or agreement to operate the Delaney Hall Detention Center in Newark, New Jersey, as a facility to detain aliens in the custody of the Secretary.</text></paragraph></subsection><subsection id="idf4bc260988284c75b264c3cc0c43ae80"><enum>(b)</enum><header>Termination for convenience</header><paragraph commented="no" display-inline="no-display-inline" id="id5615df133749419fa39207aad2a480b4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the Government’s interest, the Secretary shall terminate any contract for the operation of the Delaney Hall Detention Center in Newark, New Jersey.</text></paragraph><paragraph id="id0b1b749060534e6db5963a449d12fa33"><enum>(2)</enum><header>Liability</header><text>The Department shall be liable only for payment under the payment provisions of a contract described in paragraph (1) for services rendered before the date on which the termination of such contract becomes effective.</text></paragraph></subsection></section></legis-body></bill>
