<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5314</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260806">August 6, 2026</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make certain individuals and entities ineligible to participate in Federal programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Cash for Cohabitating Kins of Crooks Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id45212a13b4c54eccb3f93aeb4174a428"><enum>2.</enum><header>Ineligibility to participate in Federal programs</header><subsection commented="no" display-inline="no-display-inline" id="id947bb8ad569e4b669243f6c167d687f4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id42f0890b89bb4915abb68d826b2145cb"><enum>(1)</enum><header>Covered person</header><text>The term <term>covered person</term> means an individual or entity that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id019e95d5109a4250a762b951dc0ce816"><enum>(A)</enum><text display-inline="yes-display-inline">owns a terminated provider;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c105daa77114e1faa8b60f205942b8f"><enum>(B)</enum><text display-inline="yes-display-inline">resides with the owner of a terminated provider; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3fd5ddb796e84a7aae2c911fcdaf4056"><enum>(C)</enum><text>is the spouse of the owner of a terminated provider.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc375786bcdc04fada82bf4c9cbb3e5c5"><enum>(2)</enum><header>Spouse</header><text>The term <term>spouse</term> does not include an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9de61e02c34a4464819617904d7de9a1"><enum>(A)</enum><text>is living apart from the individual's spouse as of the last day of the most recent taxable year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bab58ec6b1f45bfad2db82b3dadce63"><enum>(B)</enum><text display-inline="yes-display-inline">is a survivor of domestic abuse committed by the individual's spouse or of spousal abandonment by the individual's current spouse.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf4cd287784c48c8bcd09f87f764cf59"><enum>(3)</enum><header>Terminated provider</header><text>The term <term>terminated provider</term> means a former contractor or provider of a service under a Federal program, the contract for the provision of which the Federal Government terminated as a result of fraud or a criminal conviction.</text></paragraph></subsection><subsection id="id15a6cb1d25da49ee9f9da895385c7191"><enum>(b)</enum><header>Prohibition</header><text>A covered person may not enter into a contract with the Federal Government, receive a grant, loan, subaward, or reimbursement from the Federal Government, or enter into any other financial transaction for goods or services paid for in part or full by the Federal Government.</text></subsection></section></legis-body></bill>
