which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Energy Regulatory Commission to consider cybersecurity risks from quantum computers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quantum Grid Utility Assurance and Resilient Defense Act of 2026</short-title></quote> or the <quote><short-title>Quantum-GUARD Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id2052578054cb4d819ec3e9e2d23c0400"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id6d924c85be65447cb7e34aa41bcb653c"><enum>(1)</enum><header>Bulk-power system</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph id="id5bddf5670da14d7b8e014e05c1b6e969"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph id="idb474bb8c27ae44ddb2beac5c3299ffc0"><enum>(3)</enum><header>Electric Reliability Organization</header><text>The term <term>Electric Reliability Organization</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide26301ee51c1402eb047499cf5139c80"><enum>(4)</enum><header>High-value</header><text display-inline="yes-display-inline">The term <term>high-value</term>, with respect to an IT or OT system, means that the system is so critical to an organization that the loss or corruption of information within the system or loss of access to the system would have serious impacts on the ability of the organization to perform its mission or conduct business.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ffb1e4497a44c29ac3bf1e5854cd366"><enum>(5)</enum><header>Information technology; IT</header><subparagraph commented="no" display-inline="no-display-inline" id="idefa657648d9748f0aa389b499bf71f64"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>information technology</term> or <term>IT</term> means any equipment or interconnected system or subsystem of equipment used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information.</text></subparagraph><subparagraph id="id0ca2bb15d7eb49a4b8a4ec06944e2aeb"><enum>(B)</enum><header>Inclusions</header><text>The term <term>information technology</term> or <term>IT</term> includes, at a minimum, computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab9d93c8a2714631961c484e6dd06723"><enum>(6)</enum><header>Operational technology; OT</header><subparagraph commented="no" display-inline="no-display-inline" id="id367de982302b489fbf4b8755d2ce85a3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>operational technology</term> or <term>OT</term> means any programmable system or device that—</text><clause commented="no" display-inline="no-display-inline" id="id4824f7bb83634b6ea501014336f81112"><enum>(i)</enum><text display-inline="yes-display-inline">interacts with the physical environment (or manages devices that interact with the physical environment); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9092eb4cbce744938170c7576be53e22"><enum>(ii)</enum><text display-inline="yes-display-inline">detects or causes a direct change through the monitoring or control of devices, processes, or events.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91fc8be444b040989311634efb900fe1"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>operational technology</term> or <term>OT</term> includes, at a minimum, industrial control systems, building management systems, fire control systems, and physical access control mechanisms.</text></subparagraph></paragraph><paragraph id="id463dfe3d43dd4731add8fa2ebfddbf9a"><enum>(7)</enum><header>Post-quantum cryptography; PQC</header><text display-inline="yes-display-inline">The term <term>post-quantum cryptography</term> or <term>PQC</term> means cryptographic algorithms or methods that are assessed not to be specifically vulnerable to attack by any of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id984ad897ae2b476188e579549159c754"><enum>(A)</enum><text display-inline="yes-display-inline">a quantum computer (as defined in section 3 of the Quantum Computing Cybersecurity Preparedness Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1526">6 U.S.C. 1526</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/260">Public Law 117–260</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69fe01ef35f848faa95c5c9993b1a7fd"><enum>(B)</enum><text display-inline="yes-display-inline">a classical computer (as defined in that section).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide691964a6a3242349cee576089dcc4a0"><enum>(8)</enum><header>PQC sandbox</header><text>The term <term>PQC sandbox</term> means a program for innovation and development with respect to the use of post-quantum cryptography in IT and OT applications for the electric grid that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id590468757db74a408f7d8a9555513edb"><enum>(A)</enum><text>assembles relevant stakeholders, which may include operators of the bulk-power system, IT and OT vendors, relevant Federal agencies, relevant State and local organizations, and distribution utilities (as defined in section 217(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824q">16 U.S.C. 824q(a)</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf63b3b25ce174e9e94f4f468e511bd80"><enum>(B)</enum><text>addresses challenges in PQC cybersecurity development and adoption;</text></subparagraph><subparagraph id="id35e25c484ef44bca8979cc676fce4eff"><enum>(C)</enum><text>prioritizes activities that support, encourage, or enable PQC integration into—</text><clause commented="no" display-inline="no-display-inline" id="idc41dd334082f49009a1224f73c1aeaa4"><enum>(i)</enum><text display-inline="yes-display-inline">existing systems; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb02c486e3d00491aba2da92b6e5abf25"><enum>(ii)</enum><text display-inline="yes-display-inline">during the 5-year period beginning on the date of enactment of this Act, systems that are expected to be deployed within that 5-year period;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b7e8ad185fc4febac22f49e4d03321e"><enum>(D)</enum><text>may include briefings, workshops, software challenges, hardware modeling, grid simulations, or red-teaming exercises; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf223b3a2172d4d85a4c41de9bd81b9b5"><enum>(E)</enum><text>may be used to develop and test demonstrations, proofs of concept, interoperability between IT and OT systems, and pilot applications.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34d154adb41145b6abd46aa4336b7879"><enum>(9)</enum><header>Reliability standard</header><text>The term <term>reliability standard</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a8953ee3074483f805281eaedc79fd9"><enum>(10)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Energy, acting through the Office of Cybersecurity, Energy Security, and Emergency Response.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idf4e7d57afb654830af54e30eb60f77d0"><enum>3.</enum><header>FERC consideration of cybersecurity risks from quantum computers</header><text display-inline="no-display-inline">Beginning on the date of enactment of this Act, in reviewing a proposed reliability standard, or a proposed modification to a reliability standard, under section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>) or issuing an order under subsection (d)(5) of that section, the Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id2b94bdef052e44f4a29f966b2a527d4e"><enum>(1)</enum><text display-inline="yes-display-inline">consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfc93a2062edb4be5ad6eaab0852d3ff2"><enum>(A)</enum><text display-inline="yes-display-inline">cybersecurity risks from quantum computers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id610f95199cba40f5a5e30498ff446b26"><enum>(B)</enum><text display-inline="yes-display-inline">potential uses of post-quantum cryptography in IT and OT systems to protect against those risks; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f61f93f1f1448aa89f74dbfe0e3d203"><enum>(2)</enum><text>take such action the Commission determines to be appropriate based on that consideration.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id832c9ec275f24e05bebbf6ac9ab93f8f"><enum>4.</enum><header>DOE PQC sandbox</header><subsection commented="no" display-inline="no-display-inline" id="id84a6e4e13336489e8bb07754557a4037"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a PQC sandbox.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb1751128cd0249ffaceab9612623c34a"><enum>(b)</enum><header>Collaboration</header><text display-inline="yes-display-inline">In establishing and maintaining the PQC sandbox under subsection (a), the Secretary may collaborate, as appropriate, with appropriate officials at other Federal agencies.</text></subsection><subsection id="id83f2f0aeb4104c1c9c7f0d26d2172082"><enum>(c)</enum><header>Outreach</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall publish a report describing the outcomes of, and recommendations arising from, PQC sandbox activities, to encourage PQC adoption by operators of the bulk-power system.</text></subsection></section><section id="ide3e1f4aeced5433f90b012fc93a52173"><enum>5.</enum><header>PQC report</header><subsection id="id29d13da9d8f143c58b06aa94d24ec0b8"><enum>(a)</enum><header>Study</header><text>The Secretary, in consultation with the Electric Reliability Organization and other appropriate organizations, shall conduct a study of cybersecurity risks to the bulk-power system from quantum computers, including, at minimum—</text><paragraph id="id37ecb00acaa54e1ca484cd6f59925a9c"><enum>(1)</enum><text>risks to IT and OT systems; and</text></paragraph><paragraph id="id7ea7fefa61fa4ec9be1211903575a4f1"><enum>(2)</enum><text>obstacles to transitioning high-value IT and OT systems to PQC.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8483506c802f4d7a98e656c0b9395d4c"><enum>(b)</enum><header>Requirements</header><text>In conducting the study under subsection (a), the Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id5ec0642fab714c9aa133fe79d0cd0cf0"><enum>(1)</enum><text>develop recommendations for actions that the Commission could take to ensure reliable operations of the bulk-power system; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d8094cb21fd4f518dab1aeeccda54b3"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, correlate the high-value IT and OT systems considered in the study with appropriate categories based on reliability standards, such as impact categories relating to the Bulk Electric System (as defined by the Electric Reliability Organization), so the results of the study may be readily applied by the Electric Reliability Organization.</text></paragraph></subsection><subsection id="id8957ad80c2f04168892042ced84269b7"><enum>(c)</enum><header>Report</header><paragraph commented="no" display-inline="no-display-inline" id="id4555cf29aaf84f9d89d8444814eb37b2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the study required under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c66d0618a8d43c08d94d11b8f27a59d"><enum>(2)</enum><header>Form</header><text>The report required under paragraph (1) shall be in unclassified form, but may include a classified annex.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51aefba79925499da5df0e2d723d52f0"><enum>(3)</enum><header>Public availability</header><text>The Secretary shall make available to the public the unclassified portion of the report required under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
