which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to provide payments for alternative manure management practices under the environmental quality incentives program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H36E7AB8744A040A69C6D366067AB9296"><section section-type="section-one" id="H0D34118FAC7F41318A9673C2CAEC6709"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Converting Our Waste Sustainably Act of 2026</short-title></quote> or the <quote><short-title>COWS Act of 2026</short-title></quote>.</text></section><section id="HC7761607EB3B4C318D965425390F4B65"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id4f8b0a72971a47919bd0a34c6f80a2ce"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1240A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-1">16 U.S.C. 3839aa–1</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8dba6216bb8940cca5c95b6e72b09a36"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (10) as paragraphs (3) through (12), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79ef993e7b95404b9d95f89f29581e20"><enum>(2)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7fc4bd0a23024b03a14c1039d064e327"><paragraph id="id38fe1441a492489c83c5592b84ccfea0"><enum>(1)</enum><header>Alternative manure management practice</header><text>The term <term>alternative manure management practice</term> means management measures that reduce baseline methane and nitrous oxide emissions and, where applicable, reduce nitrate leaching into groundwater or improve carbon sequestration, including—</text><subparagraph id="id7453fd7997934a708b3adf6b78ad6dab"><enum>(A)</enum><text>converting to or improving pasture-based management, including management-intensive rotational grazing (as defined in section 1240L(d)(1));</text></subparagraph><subparagraph id="id11ef10f9f3624b9d84588d699b0f6dce"><enum>(B)</enum><text>compost-bedded pack barns that compost manure, slatted floor pit storage that is cleaned out at least once a month, or other similar practices as determined by the Secretary; and</text></subparagraph><subparagraph id="id23edbb203ae04e129d1c74e5ebc270ad"><enum>(C)</enum><text>solid separation, scrape and vacuum technologies, or other measures, including manure management system retrofits, that primarily avoid wet handling and storage infrastructure in conjunction with—</text><clause id="idf11016498de440e4ae79434c9a70c889"><enum>(i)</enum><text>open or enclosed solar drying;</text></clause><clause id="id652ddb896cc447be8364b30d6e06c8ad"><enum>(ii)</enum><text>composting;</text></clause><clause id="idaf1e6f043c9c42da9fde2f5e5ad86963"><enum>(iii)</enum><text>vermiculture or vermifiltration;</text></clause><clause id="id76ab6773a5c24f3399cc8d5a232c3736"><enum>(iv)</enum><text>forced evaporation;</text></clause><clause id="ide58f9a8fb0184f68a39c6c341cdc53fc"><enum>(v)</enum><text>solid storage; or</text></clause><clause id="id4a9d0a18e65d4eeb9c62e803c510ea79"><enum>(vi)</enum><text display-inline="yes-display-inline">other similar methods, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="HB8B902742E6640CAAFC52EA3CD0B0045"><enum>(2)</enum><header>Composting practice</header><text>The term <term>composting practice</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9fa9166dbd604de09021c0dc02bbc11f"><enum>(A)</enum><text display-inline="yes-display-inline">an activity (including an activity that does not require the use of a composting facility) to produce compost from organic waste that is—</text><clause id="H9CCF8FD5E7C940798547910606B091E5"><enum>(i)</enum><text>generated on a farm; or</text></clause><clause id="H0FD9C286D4DA402B8455584FF7599FFD"><enum>(ii)</enum><text>brought to a farm from the nearby community; and</text></clause></subparagraph><subparagraph id="HE3319D979127456B86C2EEDF8088C8CE"><enum>(B)</enum><text>the use and active management of compost on a farm to improve water retention and soil health, subject to the condition that such use shall be in compliance with applicable Federal, State, and local laws.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7a1805f085ce41d3bef63f8b0ae344e7"><enum>(3)</enum><text>in paragraph (8) (as so redesignated), in subparagraph (A)—</text><subparagraph id="HFBB2DF3DD10E4576A7646B90CE90A968"><enum>(A)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HE1D58281B2794CA787BA4BC834218937"><enum>(B)</enum><text>by redesignating clause (vii) as clause (ix); and</text></subparagraph><subparagraph id="H7DC7313A8EBD4F5ABB69CC06C722C729"><enum>(C)</enum><text>by inserting after clause (vi) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H10C01638918B4A31BFFF5E783B279EC9"><clause id="HC676EEA884CA42AAA22A335782DE4DDB"><enum>(vii)</enum><text display-inline="yes-display-inline">composting practices;</text></clause><clause id="HDD25907997704151A2AB64F9B7ADF761"><enum>(viii)</enum><text display-inline="yes-display-inline">alternative manure management practices; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HFD4AD7CB8D504768B55229E5E95E1F4C"><enum>(b)</enum><header>Conservation activities</header><text display-inline="yes-display-inline">Section 1240I(2)(B)(i) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21(2)(B)(i)</external-xref>) is amended by inserting <quote>and composting practices (as defined in section 1240A)</quote> after <quote>drainage management systems</quote>.</text></subsection></section><section id="H5806F2B69BFF4459BFFFDFD50594933F"><enum>3.</enum><header>Establishment and administration</header><subsection commented="no" display-inline="no-display-inline" id="id9e6153b6af314bf9b5728dacebfe0beb"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) is amended—</text><paragraph id="idc407dded684b483d8ec849ff0b61e43f"><enum>(1)</enum><text>in subsection (d)(7)—</text><subparagraph id="H1C1221E0693C412BB46D10AF1937C699"><enum>(A)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">state-determined</header-in-text></quote> before <quote><header-in-text level="paragraph" style="OLC">high-priority</header-in-text></quote>; and</text></subparagraph><subparagraph id="HA3998AE8F9B446FE8B0D0B801AE2545C"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="H6D89F30513CC44A7ADFE77AB5D787569"><enum>(i)</enum><text>in clause (iii), by striking <quote>or</quote> at the end;</text></clause><clause id="HA2A7328FBBBB4BDC8DF64642EF6085F7"><enum>(ii)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="HB7ED1771EE10476E9995F7F62C0968C9"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6EC38E97742F44A89F28258F585EB652"><clause id="HE05D7FA0F4B743B493815A7FA726161C"><enum>(v)</enum><text display-inline="yes-display-inline">increases carbon sequestration or reduces greenhouse gas emissions, including emissions of methane and nitrous oxide.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7f1e7c2c62b549c68460253ae99415a1"><enum>(2)</enum><text>in subsection (f)(1), by inserting <quote>and alternative manure management practices</quote> after <quote>including grazing management practices</quote>;</text></paragraph><paragraph id="H68B552D2E96A4B898DCBA1584F5F2C0D"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsections (h) through (j) as subsection (i) through (k), respectively; and</text></paragraph><paragraph id="H7F8269E8C02D4B21A36C254980CA8D1B"><enum>(4)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3B0C21A48FFB43F9925BAD3071ACA19F"><subsection id="HB2E706E23A3640FC9F205F4BCE6C4EF7"><enum>(h)</enum><header>Alternative Manure Management Practices</header><paragraph id="H8B4993B3CF804B169D87FFA5BD68F069"><enum>(1)</enum><header>Payment amounts</header><text>The Secretary may provide a payment for an alternative manure management practice for an amount that is up to 100 percent of the costs associated with planning, design, materials, equipment, installation, labor, management, maintenance, and training related to implementing that practice.</text></paragraph><paragraph id="H316DE25A6B974E2E989AAB6B6DF8C1A6"><enum>(2)</enum><header>Advanced payments</header><text>The Secretary shall provide at least 50 percent of the amount of total payments for an alternative manure management practice in advance for all costs related to—</text><subparagraph id="H2399A03815094306ABF7E179995449BA"><enum>(A)</enum><text>purchasing or contracting materials and equipment; or</text></subparagraph><subparagraph id="H8BC33429A6B946C698AD7F83933FFA84"><enum>(B)</enum><text>any technical assistance provided by the Secretary.</text></subparagraph></paragraph><paragraph id="HA8833B05C1A147D7B20E02541410283D"><enum>(3)</enum><header>Term</header><text>A contract under the program that includes an alternative manure management practice under this subsection shall have a term that does not exceed 3 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf1b0abf12e0a442b91189ab90ad59f86"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idc8e732ad85214bd4b8505eff398df2fb"><enum>(1)</enum><text>Section 1240G of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-7">16 U.S.C. 3839aa–7</external-xref>) is amended by striking <quote>1240B(j)</quote> and inserting <quote>1240B(k)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id465d634ef4344433b7c0ff73454f66d2"><enum>(2)</enum><text>Section 1241(i)(2)(D) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(i)(2)(D)</external-xref>) is amended by striking <quote>1240B(h)(2)</quote> and inserting <quote>1240B(i)(2)</quote>.</text></paragraph></subsection></section><section id="H4EA09FEF07314388A1C0FB8D3EF71B09"><enum>4.</enum><header>Prioritization of applications</header><text display-inline="no-display-inline">Section 1240C(b) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-3">16 U.S.C. 3839aa–3(b)</external-xref>) is amended—</text><paragraph id="HC1884DE9B8294BC8952BC8DEBF757BFB"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and indenting the subparagraphs appropriately;</text></paragraph><paragraph id="HCEDC7AF496A14E17968B8AF7A060ABF3"><enum>(2)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>In evaluating</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0C27F497D6CB4CDC829E7F1416036268"><paragraph id="H1D292D49266647B2ACC9DB326BAA6012"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In evaluating</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H05FE4929308B41F19764C384D6884ECF"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5109E7B2078446E8B524C89A816AAEF1"><paragraph id="H673F7345C6644864B24876D719BB50E3"><enum>(2)</enum><header>Alternative manure management applications</header><subparagraph id="H7F4F08D71F684DB5B323FD91EB726BAB"><enum>(A)</enum><header>In general</header><text>The Secretary shall develop criteria for evaluating and ranking applications under the program that include an alternative manure management practice to prioritize applications that will maximize—</text><clause id="H64D3BE9E84094D32AE6FB66DBC560FC1"><enum>(i)</enum><text>carbon sequestration;</text></clause><clause id="H7A1AD0259B894AB9B26839342DAA263A"><enum>(ii)</enum><text>greenhouse gas emissions reductions; and</text></clause><clause id="H9BB14E0EB6034EEF88E521041DEF7656"><enum>(iii)</enum><text>overall environmental and public health benefits, including improved water quality and quantity.</text></clause></subparagraph><subparagraph id="H24AAD6658A914F66ACAA70E1BAEED19B"><enum>(B)</enum><header>Additional criteria</header><text>In awarding contracts under the program that include an alternative manure management practice, the Secretary shall develop criteria to ensure—</text><clause id="H16CF6C3F84DD4444B99F781FFCB5EF56"><enum>(i)</enum><text>geographical diversity;</text></clause><clause id="H3C43F1685C304D0396F21F6077BF8C63"><enum>(ii)</enum><text>scale diversity, including support for small and medium-sized dairy and livestock operations; and</text></clause><clause id="H3761F51DCC2144F5988269C61622CE8E"><enum>(iii)</enum><text>participation by operations with a demonstrated track record of adopting conservation measures and reducing greenhouse gas emissions.</text></clause></subparagraph><subparagraph id="H2A94D7F0D7BC46D0A7FE040494FC70A0"><enum>(C)</enum><header>Cluster applications</header><text>The Secretary shall establish procedures under which—</text><clause id="HB46A71C808EF4F1ABC002605F12478F3"><enum>(i)</enum><text>a group of producers may submit a joint application under the program for a shared composting facility;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida8d54e295f124f6fb5965f1c1348b0bb"><enum>(ii)</enum><text display-inline="yes-display-inline">that group of producers may jointly enter into a contract under the program with the Secretary; and</text></clause><clause id="H6B05F02326B54A07B696ADC8C46F1D9D"><enum>(iii)</enum><text>the Secretary allocates payments to each producer that is a party to that joint contract.</text></clause></subparagraph><subparagraph id="HF46288494E654E2998C03793B59051E4"><enum>(D)</enum><header>Serving certain producers</header><text>To the maximum extent practicable, the Secretary shall award the majority of contracts under the program that include an alternative manure management practice each fiscal year to small and medium-sized dairy and livestock operations, including—</text><clause id="H8EBD7714A42C4DDDA143FDE7DCBB273A"><enum>(i)</enum><text>beginning farmers or ranchers;</text></clause><clause id="H5006CECB59C1455FBB1F2A4DAE01E1D2"><enum>(ii)</enum><text>limited resource farmers and ranchers; and</text></clause><clause id="HE7AF23AC0D90482683E0D5AF693DC39E"><enum>(iii)</enum><text>socially disadvantaged farmers and ranchers.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8AD3C188438F4A078C483FDCD9EC2B96"><enum>5.</enum><header>Duties of the Secretary</header><text display-inline="no-display-inline">Section 1240F of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-6">16 U.S.C. 3839aa–6</external-xref>) is amended—</text><paragraph id="H9529708BDD674718AA563CC67791578A"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>To the extent</quote>; and</text></paragraph><paragraph id="HF17B3F5E46DA49AC97E144D3399D8E68"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE1B09DC727F2488A94D8423EB22DC203"><subsection id="HDDD3CF5A74BE4C45B608D3D9596678C4"><enum>(b)</enum><header>Alternative manure management</header><text>With respect to contracts under the program that include an alternative manure management practice, the Secretary shall—</text><paragraph id="H770294A0FB7D487CA8DD79DD155024D4"><enum>(1)</enum><text>determine and publish factors for estimating the carbon sequestration and greenhouse gas emissions reductions for each alternative manure management practice;</text></paragraph><paragraph id="H413974C4760E4E33BF724EDBA4509F4A"><enum>(2)</enum><text>identify eligible producers based on the alternative manure management practices used at the time of application, including the anaerobic decomposition of volatile solids stored in a lagoon or other predominantly liquid anaerobic environment and their ability to replace or complement that anaerobic system with an alternative manure management practice; and</text></paragraph><paragraph id="HBD31D4A983684718A5C89CDB653EC04B"><enum>(3)</enum><text>assist an eligible producer in achieving the carbon sequestration, greenhouse gas emissions reduction, and other environmental and public health goals of the alternative manure management practices by—</text><subparagraph id="H87F0E2D37DDB4C58BB9E6F5C3602BCA3"><enum>(A)</enum><text>providing payments for designing and implementing 1 or more alternative manure management practices;</text></subparagraph><subparagraph id="H5112BE23597C489CABE33789914BA974"><enum>(B)</enum><text>providing that eligible producer with information, technical assistance, and training to aid in implementation of the alternative manure management practices;</text></subparagraph><subparagraph id="H3FCB6050AA774CD4B38786EC756F4A54"><enum>(C)</enum><text>reviewing the adequacy of existing conservation practice standards for supporting the alternative manure management practices and, if necessary—</text><clause id="H37712780B43948BE9E58360E2742AB83"><enum>(i)</enum><text>revising existing conservation practice standards; and</text></clause><clause id="H8CD649B4211D493C8B6523E85C609C2C"><enum>(ii)</enum><text>developing new conservation practice standards; and</text></clause></subparagraph><subparagraph id="HE9B84D5D73BB4F8AA663CC1AB02C56EC"><enum>(D)</enum><text>entering into cooperative agreements with third-party technical assistance providers with relevant expertise in alternative manure management practices to ensure adequate technical services are available to that eligible producer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H17FF617F051341419E265E3D2BDE2928"><enum>6.</enum><header>Limitation on payments</header><text display-inline="no-display-inline">Section 1240G of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-7">16 U.S.C. 3839aa–7</external-xref>) is amended—</text><paragraph id="H97D5F1AF89054FE9A6EE8C5E61C8E5E2"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>Not including payments</quote>;</text></paragraph><paragraph id="HD9E1DB49105945A390668FC5853EEC8F"><enum>(2)</enum><text>in subsection (a) (as so designated), by striking <quote>, regardless of the number of contracts entered into under this subchapter by the person or legal entity</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8074c9e446442c49fdd98f79937083e"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF18A63E531DA4F95B534066257A0E86C"><subsection id="HC37F76A3D8D84F00B4AAB7CFDFC7F13E"><enum>(b)</enum><header>Waiver authority and limitation</header><text display-inline="yes-display-inline">The Secretary may—</text><paragraph id="HD4EC328E11EB4679B2197D005066A9E3"><enum>(1)</enum><text display-inline="yes-display-inline">waive the applicability of the limitations in section 1001D(b) or section 1240G for a payment made under a contract under the program that includes an alternative manure management practice if the Secretary determines that the waiver is necessary to fulfill the objectives of the applicable project; and</text></paragraph><paragraph id="H23C820E703F24259AA089FB528DBCA21"><enum>(2)</enum><text display-inline="yes-display-inline">impose a separate payment limitation for the contract with respect to which that waiver applies.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HFF628083C29B45F49CDB847C4B864773"><enum>7.</enum><header>New or innovative conservation approach</header><text display-inline="no-display-inline">Section 1240H(c)(1)(B)(i) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-8">16 U.S.C. 3839aa–8(c)(1)(B)(i)</external-xref>) is amended—</text><paragraph id="HCEAA576DC6D8464DAF895EF6E3F2D99D"><enum>(1)</enum><text>in subclause (VI), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="H2C03B808396F4D6FACD4333A60FDDD47"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF70A1D4D490F4D5AB64293977BC22290"><subclause id="H015DF6C8E64044A49B5BF9AD4E16D42B"><enum>(VIII)</enum><text display-inline="yes-display-inline">alternative manure management practices; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0FA3BF7E37894135B6222662845FB153"><enum>8.</enum><header>Delivery of technical assistance</header><text display-inline="no-display-inline">Section 1242(h) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H730F6C14D7854A8FB9D47E3F65F04C15"><paragraph id="H7B841AB71D0E4ABEB13F07760D182FF5"><enum>(5)</enum><header>Development of composting practice standard</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall—</text><subparagraph id="H891AAA199C8C44D1ABF3920196DD7026"><enum>(A)</enum><text>conduct a review of the composting facilities practice standard and the soil carbon amendment practice standard to determine the adequacy of those practice standards in advancing alternative manure management practices (as defined in section 1240A) and on-farm composting generation and utilization; and</text></subparagraph><subparagraph id="HF92668B657854FEFA4B60401C512E841"><enum>(B)</enum><text>develop and implement a new conservation practice standard for the on-farm production of compost.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
