<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5306</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260806">August 6, 2026</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Power Act to require the Federal Energy Regulatory Commission to consider the effects of Commission-jurisdictional rates on the affordability of electricity for consumers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Electricity Rates Act of 2026</short-title></quote>.</text></section><section id="id50e290f23d6545a6ab9ff836648fb5b2"><enum>2.</enum><header>Consideration of effects of rates on consumer affordability</header><text display-inline="no-display-inline">Section 201 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcf64f7d34f484c6e917f589caf5be228"><subsection commented="no" display-inline="no-display-inline" id="idf8584f3edd2841ec993fd52ebb4a7203"><enum>(h)</enum><header>Affordability as a component of just and reasonable rates</header><paragraph commented="no" display-inline="no-display-inline" id="id8c83337bbd9f453fa8fc2412d8cff784"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In making any determination of whether a rate or charge is just and reasonable under this part, the Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5f661224fb2f44ee8cba735a53f38ecc"><enum>(A)</enum><text display-inline="yes-display-inline">consider whether the rate or charge is likely to result in retail electricity prices that are unaffordable for electric consumers (as defined in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde0aa64bf4d14b85be9e73729d74ad4b"><enum>(B)</enum><text display-inline="yes-display-inline">presume that the rate or charge is likely to result in retail electricity prices that are unaffordable for electric consumers (as so defined) if the Commission determines that the rate or charge is likely to result in an increase in retail electricity prices of 5 percent or more.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b206fcbf74a4e9a87d7df477469167b"><enum>(2)</enum><header>Unaffordable rates and charges prohibited</header><text>If the Commission determines under paragraph (1) that a rate or charge is likely to result in retail electricity prices that are unaffordable for electric consumers (as defined in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>)), such rate or charge shall not be considered to be just and reasonable for purposes of this part.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
