<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5299</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260806">August 6, 2026</action-date><action-desc><sponsor name-id="S359">Mr. Heinrich</sponsor> (for himself and <cosponsor name-id="S440">Mr. Armstrong</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Head Start Act to establish Tribal certification standards for Indian Head Start programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Language Educators in Classrooms Act</short-title></quote>.</text></section><section id="ida83fec5fc41c48e48311bf2e39e2ffce"><enum>2.</enum><header>Exclusion from nationwide Head Start teacher credentialing calculation</header><text display-inline="no-display-inline">Section 648A(a)(2) of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9843a">42 U.S.C. 9843a(a)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide83b723f1400421291691b8c4a87fb02"> <enum>(1)</enum> <text>in subparagraph (A), by inserting <quote>(other than Indian Head Start programs)</quote> after <quote>center-based programs</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8c4416f91924427d8b03780e36d899f6"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd63a673d46e542fa88c1bb9fa39ace5c"> <enum>(A)</enum> <text display-inline="yes-display-inline">in clause (i), by inserting <quote>(other than Indian Head Start programs)</quote> after <quote>center-based programs</quote>; and</text>
                </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b85742523784d719f026d3115dd91fd">
                    <enum>(B)</enum>
 <text>in clause (ii), by inserting <quote>(other than Indian Head Start programs)</quote> after <quote>center-based programs</quote>.</text>
 </subparagraph></paragraph></section><section id="id44d67daf73e24b7ca93ffdf294c59010"><enum>3.</enum><header>Staff qualifications for Indian Head Start programs</header><text display-inline="no-display-inline">Section 648A(a)(2) of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9843a">42 U.S.C. 9843a(a)(2)</external-xref>) is amended—</text><paragraph id="idd05be786c6f44acb826e9eaef6a2e1c4"><enum>(1)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text></paragraph><paragraph id="ida6375caaa8ba45929ae23d36d79ac757"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id29887f9883744cfd97bba2d96dff7396"><subparagraph id="idebf8d39f6b514ebe8d811d137321a4e7"><enum>(C)</enum><header>Degree requirements applicable to Indian Head Start programs</header><clause id="idedcb9cbd8aca44e4a672bc74ce65cf08"><enum>(i)</enum><header>Minimum requirements</header><text>In order to help fulfill the objectives of Head Start programs for Indian (including Alaska Native) children and families, notwithstanding subparagraph (A) or (B), or any other provision of this subchapter, the Secretary shall ensure that all Indian Head Start teachers and teaching assistants in center-based programs either—</text><subclause id="id639df480138e4ef39d5c124bb592227a"><enum>(I)</enum><text>possess at the time of hire—</text><item id="id708772d9b4b34e2991137671d13f79f9"><enum>(aa)</enum><text>at least a child development associate credential;</text></item><item id="idf780379ff14f410ab134adf2b2237a5b"><enum>(bb)</enum><text>an early childhood education certificate from an institution of higher education (as defined by section 101 or 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002)), including a Tribal college or university; or</text></item><item id="id750390f799484759bb9a00b5f87c48f7"><enum>(cc)</enum><text>an early childhood education certificate issued by a State government entity, as long as the requirements for attaining that certificate meet or exceed the requirements to obtain a child development associate credential; or</text></item></subclause><subclause id="ide265b59bc57d437189eed1354460e146"><enum>(II)</enum><text>provide, at the time of hire, proof of enrollment in an education program that will, upon completion, result in the receipt of—</text><item id="ide376e089fc36422ab8bc50dfe47f68bd"><enum>(aa)</enum><text>at least a child development associate credential;</text></item><item id="idf6fcb304dc8948bfab0b5f8f831f31e7"><enum>(bb)</enum><text>an early childhood education certificate from an institution of higher education (as defined by section 101 or 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002)), including a Tribal college or university; or</text></item><item id="id9bb0a032256e4b0c8f0a7e1437af188d"><enum>(cc)</enum><text>an early childhood education certificate issued by a State government entity, as long as the requirements for attaining that certificate meet or exceed the requirements to obtain a child development associate credential.</text></item></subclause></clause><clause id="id235f2d6bc4bb40c4818f8a14f20261e8"><enum>(ii)</enum><header>Requirements for degree completion</header><text>The Secretary shall ensure that Indian Head Start teachers and teaching assistants who meet the requirements of clause (i)(II) complete the education program and earn such credential or certificate not later than 2 years after the date of hire by the Indian Head Start program.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idc4849022127e409f902b0257565e4e62"><enum>(3)</enum><text>in clause (i) of subparagraph (D), as so redesignated—</text><subparagraph id="id3db3214cad7745aa939d4ad8d44748a7" commented="no"><enum>(A)</enum><text>in subclause (I), in the matter preceding item (aa), by inserting <quote>except with respect to Indian Head Start programs</quote> after <quote>Head Start agencies</quote>; and</text></subparagraph><subparagraph id="id2e1a461703414e2ca427517d153f3f73"><enum>(B)</enum><text>in subclause (III), by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraph (A), (B), or (C)</quote>.</text></subparagraph></paragraph></section><section id="idb82259c97dc4456c9de2f8cdfc30710c"><enum>4.</enum><header>Staff qualifications for Indian Early Head Start programs</header><subsection commented="no" display-inline="no-display-inline" id="idbd76f8b42f884e3e87dd7b9bf594e1be"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 645A(h) of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9840a">42 U.S.C. 9840a(h)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf3088c2705d649b0b9895632670501a7"><subsection id="id78a81d306fdc49ed92b443900cab9f54"> <enum>(h)</enum> <header>Center-Based staff</header> <text>The Secretary shall—</text>

                                                  id="id42013601dd794242b753a7fc2dd16d3a">
                                                  <enum>(1)</enum>
 <text>ensure that all teachers providing direct services to children and families participating in Early Head Start programs located in Early Head Start centers, with the exception of Indian Early Head Start programs located in Indian Early Head Start centers subject to paragraph (2), have a minimum of a child development associate credential, and have been trained (or have equivalent coursework) in early childhood development; and</text>
                                                </paragraph>
                                                <paragraph id="idc85bb5ff36ff465b9019a0957f1e052c">
                                                  <enum>(2)</enum>
 <text>ensure that all teachers providing direct services to children and families participating in Indian Early Head Start programs located in Indian Early Head Start centers—</text>
                                                  <subparagraph
                                                  id="iddcfe3c4ea4414e03acdacda58d95494c">
                                                  <enum>(A)</enum>
 <text>possess at the time of hire—</text> <clause id="id82c8bb4002a649409ce4a567ffa1afe6"> <enum>(i)</enum> <text>at least a child development associate credential;</text>
                                                  </clause>
                                                  <clause id="id6d9f77592cb84b24b86687f4e5501b05">
                                                  <enum>(ii)</enum>
 <text>an early childhood education certificate from an institution of higher education (as defined by section 101 or 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002)), including a Tribal college or university; or</text>
                                                  </clause>
                                                  <clause id="idde0dff52eacf4728ab79bada06f8711b">
                                                  <enum>(iii)</enum>
 <text>an early childhood education certificate issued by a State government entity, as long as the requirements for attaining that certificate meet or exceed the requirements to obtain a child development associate credential; or</text>
                                                  </clause>
                                                  </subparagraph>
                                                  <subparagraph

                                                  <enum>(B)</enum>
 <text>provide, at the time of hire, proof of enrollment in an education program that will, upon completion, result in the receipt of—</text>

                                                  <enum>(i)</enum>
 <text>at least a child development associate credential;</text>
                                                  </clause>
                                                  <clause id="id1a4d36856bc744189373bc6361af8f2e">
                                                  <enum>(ii)</enum>
 <text>an early childhood education certificate from an institution of higher education (as defined by section 101 or 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002)), including a Tribal college or university; or</text>
                                                  </clause>
                                                  <clause id="id5034d86d2de041ea8fa7ac99f5dc63a8">
                                                  <enum>(iii)</enum>
 <text>an early childhood education certificate issued by a State government entity, as long as the requirements for attaining that certificate meet or exceed the requirements to obtain a child development associate credential.</text>

                                                  </subparagraph>
                                                </paragraph>
 </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb99bdf7e589047998aee7ba7604765e6"><enum>(b)</enum><header>Definitions</header><text>Section 637 of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9832">42 U.S.C. 9832</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida591d92dd6a7451dbb16856bdb7c12ff"><enum>(1)</enum><text>by redesignating paragraphs (10) through (26) as paragraphs (11) through (27), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id082a80bbdbdb47d4a107436de35c1e82"><enum>(2)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide9839f6b20424e6d933ce8bc97a49f76"><paragraph commented="no" display-inline="no-display-inline" id="ida6955d18b2554b92b08a5529cd2815b5"><enum>(10)</enum><header>Indian Early Head Start program</header><text>The term <term>Indian Early Head Start program</term> means an Early Head Start program served through an Indian tribe (including a consortium of such tribes or an alternative agency) or Tribal organization.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
