which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require employers to provide paid annual leave to employees, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFC7D3A856B754417B8CAACD477E373BC"><section section-type="section-one" id="H586A08E6D2E4482E8FBF251004332D33"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteed Paid Vacation Act</short-title></quote>.</text></section><section id="HF96ADA7A5D3644A5BEC5DB4C07BF9703"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H10CB9121A7B04DC2B2878B69C42EFDF4"><enum>(1)</enum><header>Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and <term>industry or activity affecting commerce</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9ea542f81a164d499460320d16f39245"><enum>(A)</enum><text display-inline="yes-display-inline">mean any activity, business, or industry in commerce or in which a labor dispute would hinder or obstruct commerce or the free flow of commerce; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76154a2d7f264524b226827c4b8e77a1"><enum>(B)</enum><text display-inline="yes-display-inline">include <quote>commerce</quote> and <quote>industry affecting commerce</quote>, as defined in paragraphs (1) and (3) of section 501 of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/142">29 U.S.C. 142(1)</external-xref> and (3)).</text></subparagraph></paragraph><paragraph id="HA185FE0019B54218B3CDD4B70ACD5CBD"><enum>(2)</enum><header>Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term> means an individual who is—</text><subparagraph display-inline="no-display-inline" id="HEEB230C5C41649629796189EAAF31AF1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H58A6E10A7F6E4C6F8B1F1B2D5B16B586"><enum>(i)</enum><text display-inline="yes-display-inline">an employee who is not covered under any other provision of this paragraph;</text></clause><clause display-inline="no-display-inline" id="H811C11D782DB47E28A27AAFF3D6E32DD" indent="up1"><enum>(ii)</enum><text>an employee of the Government Accountability Office; or</text></clause><clause commented="no" id="H0C6FC343E83D4831804922483D22BBB4" indent="up1"><enum>(iii)</enum><text>an employee of a covered employer described in paragraph (3)(B)(i)(V);</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H5C1B7D6DBE8A4FAEAE7FC506B3187C55"><enum>(B)</enum><text>a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a)), other than an applicant for employment;</text></subparagraph><subparagraph id="HE73C37E13AB145BAAC377770FCCAF307"><enum>(C)</enum><text>a covered employee, as defined in section 411(c) of title 3, United States Code;</text></subparagraph><subparagraph id="HE5864B971E3A4056BC52E845DD45483F"><enum>(D)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>), other than an applicant for employment; or</text></subparagraph><subparagraph id="H32150820A5A842589BCFAA5047BE0CF9"><enum>(E)</enum><text>a Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code (without regard to the limitation in section 6381(1)(B) of that title), who is not covered under subparagraph (C).</text></subparagraph></paragraph><paragraph id="H9B1CAB70CF2E46AF93251986F4428D27"><enum>(3)</enum><header>Employer</header><subparagraph id="H311A19462D2945CC930145215D715020"><enum>(A)</enum><header>In general</header><text>The term <term>employer</term> means any person who is—</text><clause id="HFEC53CA738A94E9785F19F690016FD34"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H5230AF019BD64DEABD137C7461675F31"><enum>(I)</enum><text>a covered employer who is not described in any other subclause of this clause;</text></subclause><subclause id="HBA41F9434F584407A371C83E3D65F96D" indent="up1"><enum>(II)</enum><text>an entity employing a State employee described in section 304(a) of the Government Employee Rights Act of 1991;</text></subclause><subclause id="HD44A2557EB774F2BACF6ACCA0EE73C9B" indent="up1"><enum>(III)</enum><text>an employing office, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>);</text></subclause><subclause id="HECF6A14342844041BE07C93FC46622E9" indent="up1"><enum>(IV)</enum><text>an employing office, as defined in section 411(c) of title 3, United States Code; or</text></subclause><subclause id="HB9CAB0487BDA4824B0230D82D5D435AA" indent="up1"><enum>(V)</enum><text>an employing agency covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text></subclause></clause><clause id="H0CC7E5DC393D41E18052C13909A26CD5" indent="up1"><enum>(ii)</enum><text>engaged in commerce (including government), or an industry or activity affecting commerce (including government).</text></clause></subparagraph><subparagraph id="H0A40179284B241808CF0EA3AC5750349"><enum>(B)</enum><header>Covered employer</header><clause id="H0D45F9C3769D4EA08529513A434466D0"><enum>(i)</enum><header>In general</header><text>In subparagraph (A)(i)(I), the term <term>covered employer</term>—</text><subclause id="HC940DE7C6920400D88D382AD5F1A7A42"><enum>(I)</enum><text>means any person engaged in commerce or in any industry or activity affecting commerce who employs 1 or more employees for each working day during each of 20 or more calendar workweeks in the current or preceding year;</text></subclause><subclause id="H3FFEFA5016CF4525A672F116C5C5C091"><enum>(II)</enum><text>includes the Government Accountability Office and the Library of Congress;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide0c7367e0ce0410a8569ec02497e1ce7"><enum>(III)</enum><text>includes any public agency;</text></subclause><subclause id="HAEC6DF959F9F4D8F8A880836B82E967B"><enum>(IV)</enum><text>includes—</text><item id="H9E814120AE8343BBB3B6F5886FA90D64"><enum>(aa)</enum><text>any person who acts, directly or indirectly, in the interest of an employer covered by this clause to any of the employees of such employer; and</text></item><item id="H88F35779911542BCAD9193806C58614B"><enum>(bb)</enum><text>any successor in interest of such an employer; and</text></item></subclause><subclause commented="no" id="H339AC1B740E04A87940B6D15C7277330"> <enum>(V)</enum> <text display-inline="yes-display-inline">includes any carrier (as such term is defined in section 1 of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151</external-xref>)) and any carrier by air (as described in section 201 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/181">45 U.S.C. 181</external-xref>)).</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="iddd6418d13bc7481cad49c5d8eb925bbc"><enum>(ii)</enum><header>Public agency</header><text>For purposes of clause (i)(III), a public agency shall be considered to be a person engaged in commerce or in an industry or activity affecting commerce.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf574ca8a51e4469ea7f5aa89fa20e198"><enum>(C)</enum><header>Predecessors</header><text>Any reference in this paragraph to an employer shall include a reference to any predecessor of such employer.</text></subparagraph></paragraph><paragraph id="HE29DBC3EB0A443CDA49D060FFA6402AE"><enum>(4)</enum><header>Paid annual leave</header><text>The term <term>paid annual leave</term>—</text><subparagraph id="HDF18E0722B134CB0B334D3438C18E629"><enum>(A)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), means paid vacation leave, paid personal leave, paid leave provided on an annual basis (provided under this Act or otherwise), or any other form of paid leave provided to a covered employee by the employer of such covered employee to be used during a period (other than nonworkdays established by State or Federal law) in which the covered employee would otherwise work; and</text></subparagraph><subparagraph id="HEBFD75046775466B8A92B238957E6AFF"><enum>(B)</enum><text>does not include—</text><clause id="H5482887C63BA4C729F801A843D41ACEE"><enum>(i)</enum><text>leave provided under the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601</external-xref>, et seq.);</text></clause><clause commented="no" display-inline="no-display-inline" id="id982b37faeb114b898aafb3ca8bd32e73"><enum>(ii)</enum><text>leave (paid or unpaid) that is provided by an employer of a covered employee, including such leave required by Federal, State, or local law, and is—</text><subclause commented="no" display-inline="no-display-inline" id="id3c993328da6b42ba855cd3d941b6dcfd"><enum>(I)</enum><text display-inline="yes-display-inline">family or medical leave;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbe6341d8d68545de980ba2f804b90d3b"><enum>(II)</enum><text>sick leave;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id99ed69eecf7340e382fdbffcdf87ae5c"> <enum>(III)</enum> <text>bereavement leave;</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="ideb7edb49f61c4e4ab5b9826bdf72cf72"><enum>(IV)</enum><text>leave related to the adoption or fostering of a child;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id68b3bd8601d7465abe868ab375e6e254"><enum>(V)</enum><text>leave related to domestic violence, sexual assault, or stalking;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id543318dc12b34e19be6f26f9884a5c3c"><enum>(VI)</enum><text>leave with respect to a public health emergency;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida6bd12f066b24502ac5976877dc090a3"><enum>(VII)</enum><text>leave for a holiday established by Federal, State, or local law; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5280b78a351142a7805065f5bffaf0d3"><enum>(VIII)</enum><text>leave for jury duty, for a civic duty, or to vote; or</text></subclause></clause><clause id="id9e56ca9ae4224801893d0ff863a2a10f" commented="no"><enum>(iii)</enum><text>any absence or paid leave under workers’ compensation or a disability plan.</text></clause></subparagraph></paragraph><paragraph id="H47A5FAAFB6374B45B80F57C0939FAFA9"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2d177006e4b48efad28fbfaaa580f79"><enum>(6)</enum><header>FLSA definitions</header><subparagraph commented="no" display-inline="no-display-inline" id="idc672c93a1ab54e43a61227bec9b3f5e5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the terms <term>employ</term>, <term>employee</term>, <term>person</term>, <term>public agency</term>, <term>State</term>, and <term>tipped employee</term> have the meanings given the terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb18cec7a787a4a06afcee0b893a8e1ba"> <enum>(B)</enum> <header>Employee</header> <text>For purposes of paragraph (2)(A)(i), the term <term>employee</term> has meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>), except that a reference in such section to an employer shall be considered a reference to an employer described in paragraph (3)(A)(i)(I).</text>
 </subparagraph></paragraph></section><section id="HE0704B278FDA4A449F0E6154F693E8DA"><enum>3.</enum><header>Earned paid annual leave</header><subsection id="H5DFB16DCCB294FB1BD4634F60F2A8FA7"><enum>(a)</enum><header>Earning of paid annual leave</header><paragraph id="H85A915B8C7174132ABB7441A97F6A67E"><enum>(1)</enum><header>Earning of annual leave</header><text display-inline="yes-display-inline">An employer shall provide each covered employee employed by the employer not less than 1 hour of paid annual leave for every 25 hours worked by the covered employee.</text></paragraph><paragraph id="H870992C2BA9D4E22B4AA39788F588ABD"><enum>(2)</enum><header>Limitation</header><subparagraph commented="no" display-inline="no-display-inline" id="ide68616b0d8f5429987c5867b175dfef5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of complying with paragraph (1), an employer shall not be required to provide more than 80 hours of paid annual leave to a covered employee during any 12-month period.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81b236b02393443bb3b31915e62867f9"><enum>(B)</enum><header>Greater than 80 hours of paid annual leave</header><text>In determining the amount of hours provided to a covered employee for purposes of limitation under subparagraph (A), an employer may not include—</text><clause commented="no" display-inline="no-display-inline" id="id9b67538db43544d199c8c90e6c83f5f4"><enum>(i)</enum><text display-inline="yes-display-inline">any earned and unused paid annual leave that is carried over by the covered employee from a previous 12-month period under subsection (b)(5);</text></clause><clause commented="no" display-inline="no-display-inline" id="id301066a12d9e42b0aded4bbcc39e85a5"><enum>(ii)</enum><text>any leave acquired by the covered employee through equitable relief provided under section 6 for a violation of section 5; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idd019cda7c40746faac18c7b44a796e07"><enum>(iii)</enum><text>any leave reinstated to the covered employee under subsection (d)(2)(A).</text></clause></subparagraph><subparagraph id="ida2343f7ed417488fbaa7e4931ad7e5e3"><enum>(C)</enum><header>Rule of construction</header><text>This section shall not be construed to preclude an employer from providing more than 80 hours of paid annual leave.</text></subparagraph></paragraph><paragraph id="HF8395FA53D74496DAEB28A70E00C9284"><enum>(3)</enum><header>Commencement of earning paid annual leave</header><text>A covered employee shall begin to earn paid annual leave at the commencement of employment of such covered employee.</text></paragraph><paragraph id="H023219AD04F446E08DA6202A210CC55D"><enum>(4)</enum><header>Overtime and minimum wage exempt employee</header><text>For purposes of this section, a covered employee who is exempt from overtime and minimum wage requirements under section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) shall be deemed to work 40 hours in each workweek.</text></paragraph></subsection><subsection id="H6155B0B674FA4B4D875B392BE336CF98"><enum>(b)</enum><header>Use of paid annual leave</header><paragraph id="H976E04E75DA04C36B611101F3F5E26C9"><enum>(1)</enum><header>In general</header><text>Paid annual leave earned under subsection (a)(1) may be used by a covered employee for any reason.</text></paragraph><paragraph id="HE1F13968B57846A981705455467B1D6C"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3) of subsection (c) and except as provided in subsection (d)(2), a covered employee may use paid annual leave earned by the covered employee under subsection (a)(1) at any time after the leave is earned during, except as provided in paragraph (5), the 12-month period after the leave is earned.</text></paragraph><paragraph id="H1D400038BDF441A5B3AB400B418B9C38"><enum>(3)</enum><header>Rate of compensation</header><subparagraph id="H438E170C8837403BBDE7955E1D743AA1"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a covered employee using paid annual leave earned under subsection (a)(1) shall be compensated, for the period that the covered employee is using such leave, at the regular rate at which the covered employee would have been paid for such period if the covered employee were not using the paid annual leave.</text></subparagraph><subparagraph id="HB805713CB90B4267949D0739AE02F278"><enum>(B)</enum><header>Tipped employee</header><text>For the purposes of subparagraph (A), a covered employee who is a tipped employee shall be compensated, for the period that such employee is using paid annual leave earned under subsection (a)(1), at a rate equivalent to the greater of—</text><clause commented="no" display-inline="no-display-inline" id="id55010246e8e14221b1dbcf5bcaa8cf78"><enum>(i)</enum><text display-inline="yes-display-inline">the minimum wage required under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idf67b8f70c87e4aaab31c411d80380673"><enum>(ii)</enum><text display-inline="yes-display-inline">the applicable State minimum wage;</text></clause><clause commented="no" display-inline="no-display-inline" id="id066f8ada6dac42eca08396d67db45ff1"><enum>(iii)</enum><text display-inline="yes-display-inline">the applicable local minimum wage;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4e17fa73fad342e39bbcfd43f16bd304"><enum>(iv)</enum><text display-inline="yes-display-inline">any other wage rate required by Federal, State, or local law; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id1c744f7f96c64fb1bdad0959ddc79225"><enum>(v)</enum><text display-inline="yes-display-inline">the regular rate at which the employee is employed.</text></clause></subparagraph></paragraph><paragraph id="H2D513B625968470CB7C13B7AF908B7C4"><enum>(4)</enum><header>Loaning of annual leave</header><subparagraph id="H04DFF975C96448F5BF63E344A22D0576"><enum>(A)</enum><header>Loaned leave</header><text>An employer may loan paid annual leave to a covered employee for use by such covered employee in advance of the covered employee earning such paid annual leave under subsection (a)(1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81090f6070eb4c94b9f02a5de6e4183d"><enum>(B)</enum><header>Use of loaned leave</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), paid annual leave loaned under subparagraph (A) shall be treated as if earned under subsection (a)(1).</text></subparagraph><subparagraph id="H3373A242F0714AB9A21E563461B82DC0"><enum>(C)</enum><header>Reimbursement for loaned leave</header><clause commented="no" display-inline="no-display-inline" id="id534c304f8aa546b5a01c9bd54f3220c6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An employer may require a covered employee of such employer to reimburse the employer for any paid annual leave loaned under subparagraph (A) that such covered employee has not earned at the time of the termination of the employment of the covered employee.</text></clause><clause commented="no" display-inline="no-display-inline" id="ide9286575711c4ed09abc53dfcc5b3b8b"><enum>(ii)</enum><header>Rate</header><text display-inline="yes-display-inline">Reimbursement under clause (i) shall be at the applicable rate described in paragraph (3).</text></clause></subparagraph></paragraph><paragraph id="idf770b436497f471884ad7cd1bf2c8224"><enum>(5)</enum><header>Carryover</header><text>An employer shall permit a covered employee of such employer to carry over not more than 40 hours of any earned and unused paid annual leave under subsection (a)(1) in a 12-month period to be used by the covered employee in the following 12-month period.</text></paragraph><paragraph id="idd85f304c20184cf9bc585c9f1bed3d89"><enum>(6)</enum><header>Increments of use of paid annual leave</header><text>An employer shall allow any covered employee to use paid annual leave earned under subsection (a)(1) in increments of the smaller of—</text><subparagraph id="id8d50da99464740cbb76935ada398e501"><enum>(A)</enum><text>an hour; or</text></subparagraph><subparagraph id="id18df724ad7ff4eb7b752f87d1ef5117e"><enum>(B)</enum><text>the smallest increment of time that the employer’s payroll system uses to account for absences or use of other time.</text></subparagraph></paragraph><paragraph id="id5446f9ec90fd46e78a6252b0a3384ef0"><enum>(7)</enum><header>Benefits retained during leave</header><subparagraph commented="no" display-inline="no-display-inline" id="ida08713269694407c844daae4c4c8159d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An employer shall maintain any employment benefits provided to a covered employee during any period in which the covered employee takes paid annual leave, and such benefits shall be provided in the same manner as if the covered employee had continued in employment continuously for the duration of such leave.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21bec1d92e9146f7ae5ff612ef0a0f23"><enum>(B)</enum><header>Employment benefits</header><text>For purposes of subparagraph (A), the term <term>employment benefits</term> has the meaning given such term in section 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>), except that a reference in such section to the terms employee and employer shall be considered a reference to a covered employee and employer (as such terms are defined in section 2), respectively.</text></subparagraph></paragraph></subsection><subsection id="H4BBB701B890141008CDCEC7552BC441E"><enum>(c)</enum><header>Procedures for use of paid annual leave</header><paragraph id="H6B0E0A0E9C864E0A805C82536897C8F3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), a covered employee may use paid annual leave earned under subsection (a)(1) upon a verbal or written notification by the covered employee to the employer of the covered employee as provided in paragraph (2).</text></paragraph><paragraph id="H881B1D5DA635437B873452A42B8EB100"><enum>(2)</enum><header>Employee notification</header><subparagraph id="id8b4671fba1b643bbb6bb5d2b9b57abad"><enum>(A)</enum><header>Format of notice</header><text>An employer may not specify whether the notification under paragraph (1) is provided through a verbal notice or a written notice.</text></subparagraph><subparagraph id="id720d325065fe42dd9c84e6f937293cb1"><enum>(B)</enum><header>Notice samples</header><text>The Secretary shall create samples for verbal and written notices required under paragraph (1).</text></subparagraph><subparagraph id="id622a4ca967444a3eb6907f5ff4955eec"><enum>(C)</enum><header>Timing of notice</header><text>A covered employee shall provide notice regarding an intent to use paid annual leave under paragraph (1) on a day that is—</text><clause commented="no" display-inline="no-display-inline" id="id646d697cc55a4c479bd0f5c9a90b23b2"><enum>(i)</enum><text display-inline="yes-display-inline">before the day on which the covered employee intends to use the paid annual leave; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2fbba0042f1644278f538771d9037c85"><enum>(ii)</enum><text>not more than 14 days before the day on which the covered employee intends to use the paid annual leave.</text></clause></subparagraph><subparagraph id="H00EEDA98CC29456896DCEE98DC2E4C1D"><enum>(D)</enum><header>Emergency or unforeseeable use of leave</header><text>Notwithstanding subparagraph (C), an employer shall waive any notice requirement and allow the use of paid annual leave earned under subsection (a)(1) in the case of an emergency or a situation in which a covered employee can not provide timely notice to an employer for the use the paid annual leave.</text></subparagraph></paragraph><paragraph id="H9A138FA484374001AF6CAEEE9B38274E"><enum>(3)</enum><header>Reasonable restrictions</header><subparagraph commented="no" display-inline="no-display-inline" id="idf024b0573dd3492d989335b77a5a1af3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), an employer may—</text><clause commented="no" display-inline="no-display-inline" id="idb8e7b685abda436d83b6d46480f00970"><enum>(i)</enum><text display-inline="yes-display-inline">place limited, reasonable restrictions regarding the scheduling of paid annual leave earned under subsection (a)(1) for a bona fide business reason; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfbcbe3c3a74c45a2b85fc21e0fe376fc"><enum>(ii)</enum><text display-inline="yes-display-inline">reject a scheduling request under paragraph (1) for such leave for a bona fide business reason.</text></clause></subparagraph><subparagraph id="id1325dc36cfe74a9db74470b3895292c0"><enum>(B)</enum><header>Limitation on rejection</header><clause commented="no" display-inline="no-display-inline" id="id4a03b0bffbfc43b69e8a3c6f8fd8fbda"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An employer may not reject a request by a covered employee under subparagraph (A)(ii) unless the employer—</text><subclause id="iddb306aee45c1495f9300fc71c659ef7b"><enum>(I)</enum><text>provides other reasonable alternative times, as described in clause (ii), for the covered employee to schedule such leave; and</text></subclause><subclause id="idc64c55d111424ec5870b9eb3c3d36b6c"><enum>(II)</enum><text>complies with the notice requirement described in clause (iii).</text></subclause></clause><clause id="id2b1230d59f064e1e8ff4d8b3e2675e2e"><enum>(ii)</enum><header>Reasonable alternatives</header><subclause commented="no" display-inline="no-display-inline" id="idce083eb8dfbc4593b703fc5d8f0b2192"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A reasonable alternative time described in this clause is a date other than a date a covered employee requests to use paid annual leave that is within 30 days before or after the date requested by the covered employee.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd4dd266e56ab485f867f069e4aa75cc9"><enum>(II)</enum><header>Expiration of paid leave</header><text display-inline="yes-display-inline">An employer may not offer a reasonable alternative time described in this clause to prevent the use of paid annual leave that is set to expire.</text></subclause></clause><clause id="id7476035d9a29474684d254f0c7fb27d0"><enum>(iii)</enum><header>Denial notice</header><text>In any case in which an employer rejects a request of a covered employee to use paid annual leave under subparagraph (A)(ii), the employer shall, not later than 5 business days after the day the covered employee made such request, provide to the covered employee a written notice—</text><subclause id="id60ec5d8b678d4a28b2133565808a91f0"><enum>(I)</enum><text>detailing the bona fide business reason for such denial; and</text></subclause><subclause id="idb82ed349e77742d8a3be774cb987ce85"><enum>(II)</enum><text>that provides the reasonable alternative time described in clause (ii).</text></subclause></clause></subparagraph></paragraph><paragraph id="H0AFB4178EDFC43918C2F4BACE17DB954"><enum>(4)</enum><header>Purpose of use of paid annual leave</header><text>An employer may not require a covered employee to disclose the purpose or reason for which the covered employee is using paid annual leave under subsection (a)(1).</text></paragraph><paragraph id="H63E2255004C94CB184ED7C5EF08E7ECF"><enum>(5)</enum><header>Prohibition on finding cover</header><text>An employer may not require, as a condition of using paid annual leave earned under subsection (a)(1), that a covered employee search for or find a replacement to cover the hours during which the covered employee is using such paid annual leave.</text></paragraph><paragraph id="id9e736dcd7c274048a1cda0b9f5788c56"><enum>(6)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall provide guidance to employers on compliance with paragraph (3), including by defining the terms <term>limited, reasonable restriction</term> and <term>bona fide business reason</term>.</text></paragraph></subsection><subsection id="H81AD5D57F63F42C9B1CE5FE1ECD0924A"><enum>(d)</enum><header>Procedures regarding leave for employee separation</header><paragraph id="ideb02cc9a52704137bba7f7fc90073cae"><enum>(1)</enum><header>Compensation</header><text>In any case in which the employment of a covered employee is terminated and such covered employee has unused paid annual leave earned under subsection (a)(1) (including any leave carried over under subsection (b)(5)), the employer of the covered employee shall provide financial compensation, at the applicable rate described in subsection (b)(3), to such covered employee for all such paid annual leave earned by the covered employee that is unused as of the date of the termination.</text></paragraph><paragraph id="HEADA29B48E5F4CABA311AC205EF148F5"><enum>(2)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">If the employment of a covered employee with an employer is terminated and the covered employee is subsequently rehired by the employer within 12 months after that termination—</text><subparagraph commented="no" id="H775F0C8AD191480DAFA06FFBC1D64BE5"><enum>(A)</enum><text>in a case in which the covered employee had paid annual leave (other than paid annual leave earned under subsection (a)(1) and compensated for under paragraph (1)) that was not compensated for by the employer at the applicable rate described under subsection (b)(3) (as if such paid annual leave was paid annual leave earned under subsection (a)(1)), the employer shall reinstate such paid annual leave to the covered employee; and</text></subparagraph><subparagraph id="HB6DDEB749C2C4B8D8462425138FAA2B1"><enum>(B)</enum><text>the covered employee shall be entitled to use such leave and earn additional paid annual leave under subsection (a)(1) at the recommencement of employment with the employer.</text></subparagraph></paragraph></subsection></section><section id="H1D22FD057BE743AEB20312FDB6E7293C"><enum>4.</enum><header>Employer notice and system requirements</header><subsection id="HE6B1CEBD28BE4306B45BAA9ADF6A5F0B"><enum>(a)</enum><header>Employer notice requirement</header><text>An employer shall notify each covered employee of the employer about the paid annual leave policy of such employer, which shall include the information described in subsection (b), by—</text><paragraph id="H9C4C8229EF144126939E1605967F253D"><enum>(1)</enum><text>providing such information, in writing, to each covered employee on or before the first day of employment of such covered employee;</text></paragraph><paragraph id="H552E2BB4226F4BCEAEC9771934A9346C"><enum>(2)</enum><text>including such information in any employee handbook; and</text></paragraph><paragraph id="HF18E9A9BD270443081D050D569438B80"><enum>(3)</enum><text>posting a notice containing such information in a physical conspicuous place on the premises of the employer or a virtual conspicuous place, where notices to employees are customarily posted.</text></paragraph></subsection><subsection id="H7DF3475FB6F6465CBD6A09937907A521"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The information provided pursuant to subsection (a) shall include—</text><paragraph id="HD4F8BCFAD1C04F7EB366B4A8D1415F80"><enum>(1)</enum><text>the paid annual leave policy of such employer, including any paid annual leave policy that provides paid annual leave in excess of the requirements of this Act;</text></paragraph><paragraph id="H48C845A86E8B4A22AF8B6F3779F001DC"><enum>(2)</enum><text>information—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5926f016b18e4f8598f2c3ca7efc2e9c"><enum>(A)</enum><text display-inline="yes-display-inline">pertaining to the filing of an action under section 6;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde66f366bcc54685b65ef3df45d7c6c1"><enum>(B)</enum><text>regarding the protections that a covered employee has in exercising rights under this Act; and</text></subparagraph><subparagraph id="id1bccce5c1cc04cabb6e28796baa8abaf"><enum>(C)</enum><text>on how the covered employee can contact the Secretary (or other appropriate authority as described in section 6) if any such rights are violated; and</text></subparagraph></paragraph><paragraph id="H02B10D0A4C9C4E34A171C85BB6D37DC9"><enum>(3)</enum><text>details of any notice requirement the employer may require, as described in section 3(c)(2).</text></paragraph></subsection><subsection id="idf1c9efd1e66749d09aae0dca996269d9"><enum>(c)</enum><header>System requirement</header><text>Each employer shall establish a system, such as through an online portal, written request, or through pay stubs, to inform each covered employee of the employer how much paid annual leave each covered employee has earned.</text></subsection><subsection id="idf63f7f70cdf9417d990363870c9604b5"><enum>(d)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall provide guidance to employers on compliance with this section, including regarding sample notices and systems.</text></subsection></section><section commented="no" id="H0AEDA33CFEFC4047BDCB790A0600188E"><enum>5.</enum><header>Prohibited acts</header><subsection commented="no" id="H640A4BB886CC4A50B45B48219E2E0242"><enum>(a)</enum><header>Interference with rights</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to interfere with, restrain, or deny the exercise of, or the attempt to exercise, any right provided under this Act, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id2c18e4f79f714a0cad7905e40ab2caf9"><enum>(1)</enum><text>violating any provision of section 3 or 4;</text></paragraph><paragraph commented="no" id="H74815AF0A0504A50BB26E7D8F0E434A9"><enum>(2)</enum><text>discharging or discriminating against (including retaliating against) any individual, including a job applicant, for exercising or attempting to exercise, any right provided under this Act;</text></paragraph><paragraph commented="no" id="HDC665EA3706D4A0AA11A741A48D6637F"><enum>(3)</enum><text>using the taking of paid annual leave provided under this Act as a negative factor in an employment action, such as hiring, promotion, reducing hours or numbers of shifts, or a disciplinary action; or</text></paragraph><paragraph commented="no" id="H49F93BBFECCF4E1980D8FDCC3DACFC4A"><enum>(4)</enum><text>counting the use of such paid annual leave under a no-fault attendance policy or any other absence-control policy.</text></paragraph></subsection><subsection commented="no" id="H0F4CD26CFAA34FD9A880548E31A2C9C0"><enum>(b)</enum><header>Interference with proceedings or inquiries</header><text>It shall be unlawful for any person to discharge or in any other manner discriminate against (including retaliating against) any individual, including a job applicant, because such individual—</text><paragraph commented="no" id="HB792C7CE9509469684604DF06EC34BAE"><enum>(1)</enum><text>has filed an action under section 6, or has instituted or caused to be instituted any proceeding, under this Act;</text></paragraph><paragraph commented="no" id="HD3082E023E1D4A0DA2D83632C3052B93"><enum>(2)</enum><text>has given, or intends to give, any information in connection with any inquiry or proceeding relating to any right provided under this Act; or</text></paragraph><paragraph commented="no" id="H36D50E3A0EA8444B95251ED0BBF14A6D"><enum>(3)</enum><text>has testified, or intends to testify, in any inquiry or proceeding relating to any right provided under this Act.</text></paragraph></subsection><subsection id="idf7245d1581314de6910f5fefc50f2a2d"><enum>(c)</enum><header>Impermissible consideration</header><text>A violation of subsection (a) or (b) shall be established when a complaining party demonstrates that the complaining party exercising any right provided under this Act was a motivating factor in any action described in subsection (a) or (b) against the complaining party, even if other factors also motivated the action.</text></subsection></section><section id="H4246B65D3E434668A1D0D48DF57E26D8"><enum>6.</enum><header>Enforcement and investigative authority</header><subsection id="HAA461EC3FD3E4C7FA952A5C3555AA240"><enum>(a)</enum><header>In general</header><paragraph commented="no" id="H3FEF6B7F5F644EAAAEB7648106628ACA"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" id="HB089912C1E1148BC9FFCA607245694E3"><enum>(A)</enum><text>the term <term>employee</term> means a covered employee described in subparagraph (A) or (B) of section 2(2); and</text></subparagraph><subparagraph commented="no" id="HA1A75387EFED4BD797D8739D351043C1"><enum>(B)</enum><text>the term <term>employer</term> means an employer described in subclause (I) or (II) of section 2(3)(A)(i).</text></subparagraph></paragraph><paragraph id="H75593C2B1951454292613E4B5257171A"><enum>(2)</enum><header>Investigative authority</header><subparagraph id="H69B025F852934AD6957D4222E4354EA2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure compliance with this Act, or any regulation or order issued under this Act, the Secretary shall have, subject to subparagraph (C), the investigative authority provided under section 11(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), with respect to employers, employees, and other individuals affected by an employer.</text></subparagraph><subparagraph id="H6A2C83D7E9A84A12A388EE12BAB1667A"><enum>(B)</enum><header>Obligation to keep and preserve records</header><text>An employer shall make, keep, and preserve records pertaining to compliance with this Act in accordance with section 11(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>) and in accordance with regulations prescribed by the Secretary.</text></subparagraph><subparagraph id="H421ECB705A3F4B91B2E6BF2BDD32CF04"><enum>(C)</enum><header>Required submissions generally limited to an annual basis</header><text>The Secretary may not require, under the authority of this paragraph, an employer to submit to the Secretary any books or records more than once during any 12-month period, unless the Secretary has reasonable cause to believe there may exist a violation of this Act or any regulation or order issued pursuant to this Act, or is investigating a charge pursuant to paragraph (4).</text></subparagraph><subparagraph id="HFD6759C0012942FD8FA2224C4A05051B"><enum>(D)</enum><header>Subpoena authority</header><text>For the purposes of any investigation provided for in this paragraph, the Secretary shall have the subpoena authority provided for under section 9 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/209">29 U.S.C. 209</external-xref>).</text></subparagraph></paragraph><paragraph id="HF30D32AEE20B43F6BC55964AD889C076"><enum>(3)</enum><header>Private right of action</header><subparagraph id="H13DEE37C05FE4E82BF415FAF1CA4CAEC"><enum>(A)</enum><header>In general</header><text>An action to recover damages or equitable relief prescribed in subparagraph (B) may be maintained against any employer in any Federal or State court of competent jurisdiction by an employee or individual or a representative for and on behalf of—</text><clause id="H5BE445E76EE14B489192AE3EE9C04696"><enum>(i)</enum><text>the employee or individual; or</text></clause><clause id="H639F277AA2B74370BBD8F08CABCCE72A"><enum>(ii)</enum><text>the employee or individual and others similarly situated.</text></clause></subparagraph><subparagraph id="H92541EC748584A719CC7C323BFB84C2C"><enum>(B)</enum><header>Liability</header><text>Any employer who violates section 5 (including a violation relating to rights provided under section 3) shall be liable to any employee or individual affected—</text><clause id="HFFFADB9B532A495A994917871378710E"><enum>(i)</enum><text>for damages equal to—</text><subclause id="H2185DE270F3A4C3B85C09C31E6529EE3"><enum>(I)</enum><text>the amount of—</text><item id="H86A19743ECB545C9A296A6BD824D11C4"><enum>(aa)</enum><text>any wages, salary, employment benefits, or other compensation denied or lost by reason of the violation; or</text></item><item id="HB5EC35481A14405FB39575E0B5AF7608"><enum>(bb)</enum><text>in a case in which wages, salary, employment benefits, or other compensation have not been denied or lost, any actual monetary losses sustained as a direct result of the violation up to a sum equal to 80 hours of wages or salary for the employee or individual;</text></item></subclause><subclause id="H8FEADD8AC76A4BA8970CDFC5540A12B5"><enum>(II)</enum><text>the interest on the amount described in subclause (I) calculated at the prevailing rate; and</text></subclause><subclause id="H4E1CD318DA0F4C85B2CED82F6255C5C5"><enum>(III)</enum><text>an additional amount as liquidated damages; and</text></subclause></clause><clause id="H5AF5E6C30AE14F1EA90FB8A9EA13BB1F"><enum>(ii)</enum><text>for such equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></clause></subparagraph><subparagraph id="H897E78EEB22945A394258BA8E2FD0ECC"><enum>(C)</enum><header>Fees and costs</header><text>The court in an action under this paragraph shall, in addition to any judgment awarded to the plaintiff, allow a reasonable attorney’s fee, reasonable expert witness fees, and other costs to be paid by the defendant.</text></subparagraph><subparagraph id="HF9FACCB7C8A447CF97E6B8E44B0ECC1B"><enum>(D)</enum><header>Limitations</header><clause id="H3A346159F91949B08438F0C2DC6C3BCE"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), an action may be brought under this paragraph or paragraph (4) not later than 2 years after the date of the last event constituting the alleged violation for which the action is brought.</text></clause><clause id="H257D8C08607044FAB25E8F156220F5B0"><enum>(ii)</enum><header>Willful violation</header><text>In the case of such an action brought for a willful violation of section 5 (including a willful violation relating to rights provided under section 3), such action may be brought not later than 3 years after the last event constituting the alleged violation for which such action is brought.</text></clause><clause id="H634720990FC343B99883707786A54BB4"><enum>(iii)</enum><header>Commencement</header><text>In determining when an action is commenced under this paragraph or paragraph (4) for the purposes of this subparagraph, the action shall be considered to be commenced on the date when the complaint is filed.</text></clause></subparagraph></paragraph><paragraph id="H28E4B31799B947589D484F6099A49892"><enum>(4)</enum><header>Actions by the Secretary</header><subparagraph id="HD3579BAF41644BF887EAFE2DAFF38229"><enum>(A)</enum><header>Administrative actions</header><text display-inline="yes-display-inline">The Secretary shall receive, investigate, and attempt to resolve complaints of violations of section 5 in the same manner that the Secretary receives, investigates, and attempts to resolve complaints of violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29 U.S.C. 206 and 207).</text></subparagraph><subparagraph id="HDD62574C82404957A062E7FC326CCE43"><enum>(B)</enum><header>Civil action</header><text>The Secretary may bring an action in any court of competent jurisdiction to recover the damages and equitable relief described in paragraph (3)(B).</text></subparagraph><subparagraph id="HFAA78B39C27F4C798A716B1349298251"><enum>(C)</enum><header>Sums recovered</header><clause commented="no" display-inline="no-display-inline" id="id7566fb854775475f832506a3baa335d2"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any sums recovered by the Secretary pursuant to subparagraph (B) shall be held in a special deposit account and shall be paid, on order of the Secretary, directly to each employee or individual affected.</text></clause><clause commented="no" display-inline="no-display-inline" id="idbd1f033342d34bf5a1d2d29085bb7ae4"><enum>(ii)</enum><header>Unpaid recovered sums</header><subclause commented="no" display-inline="no-display-inline" id="id0dcb68baf4d742e890ad2cb883c10f8b"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Any such sums not paid to an employee or individual affected because of the inability to do so within a period of 3 years after such recovery shall be deposited into the fund established under subclause (II).</text></subclause><subclause id="iddd9700005229419c83ad45dc83714db1"><enum>(II)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund for amounts deposited under subclause (I).</text></subclause><subclause id="id80b15b42b70546f9ba18a442e4ed243a"><enum>(III)</enum><header>Deposits</header><text>Any sums deposited under subclause (I)—</text><item commented="no" display-inline="no-display-inline" id="id3bc5bd58346947f48abfd276ab8ab2df"><enum>(aa)</enum><text display-inline="yes-display-inline">shall be deposited in the fund established under subclause (II)—</text><subitem commented="no" display-inline="no-display-inline" id="id8df81e9fddfa454597b3b91a9a9a33fb"><enum>(AA)</enum><text display-inline="yes-display-inline">notwithstanding section 3302 of title 31, United States Code; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id83c16f1ea6d04524a5ae10b5c175b3b0"><enum>(BB)</enum><text display-inline="yes-display-inline">as offsetting collections; and</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id0392499cca6842d19da8721704f68ed5"><enum>(bb)</enum><text>may be used by the Secretary for enforcement activities, including related to this Act or the Fair Labor Standards Act of 1938.</text></item></subclause></clause></subparagraph><subparagraph commented="no" id="HF334155C6B1240CE81C71E78FA32D1D0"><enum>(D)</enum><header>Action for injunction by Secretary</header><text>The district courts of the United States shall have jurisdiction, for cause shown, in an action brought by the Secretary—</text><clause commented="no" id="HCE70C38819014B959609EE100A307C9E"><enum>(i)</enum><text>to restrain violations of section 5 (including a violation relating to rights provided under section 3), including the restraint of any withholding of wages, salary, employment benefits, or other compensation, plus interest, found by the court to be due to employees or individuals eligible under this Act; or</text></clause><clause commented="no" id="H50929CF15B494B1AB3BFAEB12C67A2FB"><enum>(ii)</enum><text>to award such other equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></clause></subparagraph><subparagraph id="H90CFDB20C6DC4B5A8929180002BEA137"><enum>(E)</enum><header>Solicitor of Labor</header><text>The Solicitor of Labor may appear for and represent the Secretary on any litigation brought under this paragraph.</text></subparagraph></paragraph><paragraph commented="no" id="H6D010AA9011947E095F53786345247F2"><enum>(5)</enum><header>Government Accountability Office and Library of Congress</header><text>Notwithstanding any other provision of this section, in the case of the Government Accountability Office and the Library of Congress, the authority of the Secretary under this subsection shall be exercised respectively by the Comptroller General of the United States and the Librarian of Congress.</text></paragraph></subsection><subsection commented="no" id="idc585fc1b4dde430aa5a54fb7d2817e02"><enum>(b)</enum><header>Employees covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, united States code</header><text>The powers, remedies, and procedures provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United States Code, to the President, the Merit Systems Protection Board, or any person, alleging a violation of section 412(a)(1) of that title, shall be the powers, remedies, and procedures this Act provides to the President, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(C).</text></subsection><subsection commented="no" id="H32D3CB7DF2874BDD957BB799A790D0BA"><enum>(c)</enum><header>Employees covered by Congressional Accountability Act of 1995</header><text>The powers, remedies, and procedures provided in the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person, alleging a violation of section 202(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) shall be the powers, remedies, and procedures this Act provides to that Board, or any person, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(D).</text></subsection><subsection commented="no" id="H454C53D3D4704F5D9987ED9306E5FCCD"><enum>(d)</enum><header>Employees covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code</header><text>The powers, remedies, and procedures provided in title 5, United States Code, to an employing agency, provided in chapter 12 of that title to the Merit Systems Protection Board, or provided in that title to any person, alleging a violation of chapter 63 of that title, shall be the powers, remedies, and procedures this Act provides to that agency, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(E).</text></subsection><subsection commented="no" id="H41F66640136C47AC9A0AFD00DBAED6A3"><enum>(e)</enum><header>Remedies for State employees</header><paragraph commented="no" id="H357BF37ACF1A4FDDB8B5B788F545DA37"> <enum>(1)</enum> <header>Waiver of sovereign immunity</header> <text>A State’s receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment to the Constitution or otherwise, to a suit brought by an employee of that program or activity under this Act for equitable, legal, or other relief authorized under this Act.</text>
 </paragraph><paragraph commented="no" id="H732D32BDD8B24335B40F9920FCC5E48C"><enum>(2)</enum><header>Official capacity</header><text>An official of a State may be sued in the official capacity of the official by any employee who has complied with the procedures under subsection (a)(3), for injunctive relief that is authorized under this Act. In such a suit, the court may award to the prevailing party those costs authorized by section 722 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>).</text></paragraph><paragraph commented="no" id="HC57323B86FA64FAAB6C0C99E3C1D8FEA"><enum>(3)</enum><header>Applicability</header><text>With respect to a particular program or activity, paragraph (1) applies to conduct occurring on or after the day, after the date of enactment of this Act, on which a State first receives or uses Federal financial assistance for that program or activity.</text></paragraph><paragraph commented="no" id="HB3D9F7D3369D42FA8E2656E51C50BF48"><enum>(4)</enum><header>Program or activity defined</header><text>In this subsection, the term <term>program or activity</term> has the meaning given the term in section 606 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-4a">42 U.S.C. 2000d–4a</external-xref>).</text></paragraph></subsection><subsection id="id214fc5dc3712468e94c51eb382a2f20a" commented="no"><enum>(f)</enum><header>Collective bargaining agreement resolution</header><text>In addition to the enforcement mechanisms under this section, an employee or labor organization may also use a grievance and arbitration procedure of a collective bargaining agreement to enforce collectively bargained provisions relating to paid annual leave.</text></subsection></section><section id="H51073C8FA5534FA5AA5A350027968EED"><enum>7.</enum><header>Effect on other laws and existing employment agreements</header><subsection id="id73d822c384b446a183f7e199b0d45195"><enum>(a)</enum><header>State or local laws</header><paragraph id="id482ca5d7aa1542a99d17a775fcee0f36"><enum>(1)</enum><header>Greater leave rights</header><text>Nothing in this Act shall be construed to supersede any provision of any State or local law that provides greater paid annual leave or other leave rights to covered employees or individuals than the rights established under this Act.</text></paragraph><paragraph id="idfd1b8b28e8a54856aed4477eb57e8dde"><enum>(2)</enum><header>Distinguish between types of leave</header><text>For the purposes of this subsection, a State or local law that does not distinguish between time earned for paid annual leave and time earned for sick leave shall be deemed a law that provides lesser paid annual leave or other rights to covered employees or individuals than the rights established under this Act.</text></paragraph></subsection><subsection id="HA3CE2D758A5C44B7A82B73015FC2C224"><enum>(b)</enum><header>More protective agreements</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to diminish the obligation of an employer to comply with any contract, collective bargaining agreement, or any employment benefit program or plan that provides greater paid annual leave or other leave rights to covered employees or individuals than the rights established under this Act.</text></subsection><subsection id="H298935C297314140AD6EBCC774CE539A"><enum>(c)</enum><header>Less protective agreements</header><text>The rights established for covered employes under this Act shall not be diminished by any contract, collective bargaining agreement, or any employment program or plan.</text></subsection></section><section id="H9AB9F209E7F84866A7931F547294AF38"><enum>8.</enum><header>Awareness campaign</header><subsection id="H327326E78DEA40D6BAA84267974A0CB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall carry out a public awareness campaign to inform the public about the earned paid annual leave entitlement established under this Act, which shall include information about—</text><paragraph id="H9310C99973BD4FDE9356D172E06109D7"><enum>(1)</enum><text>the rights provided to a covered employee under this Act; and</text></paragraph><paragraph id="H548F62CAAA214D7BBC6A5068E3B0D289"><enum>(2)</enum><text>resources available to a covered employee if the employee believes the rights provided under this Act have been violated.</text></paragraph></subsection><subsection id="H92994A08E8A04BB2808911FD969A7B03"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><section id="HE6358A4DAAF74ED482C6598C7E30573B"><enum>9.</enum><header>Effective dates</header><subsection id="H15E81E0A583D4D6A956F1C53745CC20E"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act shall take effect 180 days after the date of enactment of this Act.</text></subsection><subsection id="HC4907ADC388648FC843D1725F9C23BBA"><enum>(b)</enum><header>Collective bargaining agreements</header><text>In the case of an applicable collective bargaining agreement in effect on the effective date prescribed under subsection (a), the Act shall take effect on the earlier of—</text><paragraph id="HA337D0A9F51C4AEC9D85912103A86C07"><enum>(1)</enum><text>the date of the termination of such agreement;</text></paragraph><paragraph id="HE17BDA09C945443CB05DCA87C7D5C643"><enum>(2)</enum><text>the date of any amendment, made on or after such effective date, to such agreement; or</text></paragraph><paragraph id="HA7C18503D6184DAC897A10C78E4E257D"><enum>(3)</enum><text>the date that occurs 18 months after such effective date.</text></paragraph></subsection></section></legis-body></bill>
