which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a ranchland program to support the United States cow herd, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rebuilding America's National Cow Herd Act</short-title></quote> or the <quote><short-title>RANCH Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id19e86e3e32524d7fb0d58b54a3e11095"><enum>2.</enum><header>Ranchland program</header><subsection commented="no" display-inline="no-display-inline" id="id84b291effb4a4f0cb884b016597f3e39"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of Agriculture (referred to in this section as the <term>Secretary</term>) shall carry out a ranchland program under which the Secretary shall enroll eligible land described in subsection (b) through contracts with owners and operators.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc4491ac84fff43c580f6e25be67124f0"><enum>(b)</enum><header>Eligible land</header><text display-inline="yes-display-inline">An owner or operator may enroll in the program established under this section cropland that—</text><paragraph commented="no" display-inline="no-display-inline" id="idf2108c84680b42f6b1881cad69938b6a"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary determines had a cropping history or was considered to be planted for not less than 4 of the 6 crop years preceding the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id724eea0590b741538c440041291315b0"><enum>(2)</enum><text display-inline="yes-display-inline">will be restored to perennial grass and forb cover and support grazing.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcfc706c5059b4ad9a904cbda6bc7f6e1"><enum>(c)</enum><header>Contracts</header><text display-inline="yes-display-inline">A contract under this section shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id7d08db8e80ff4122a84b33ccd2cd3960"><enum>(1)</enum><text display-inline="yes-display-inline">require the establishment on the eligible land of perennial grass and forb cover appropriate to the region, soil type, and intended grazing use, as determined by the Secretary;</text></paragraph><paragraph id="id02a639c618c14b9d82e657e144893411"><enum>(2)</enum><text>require, not later than 2 years after enrollment of the eligible land, a site-specific grazing management plan approved by the Secretary;</text></paragraph><paragraph id="id51c3f3d52bd94b9194ad70d563f18784"><enum>(3)</enum><text>be for a term of not less than 10 years and not more than 15 years;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f3efd3d53f6454c8b5050b66a0f260c"><enum>(4)</enum><text display-inline="yes-display-inline">beginning with the fourth year of the contract, provide for the temporary suspension of the base history for the land covered by the contract through the end of the contract; and</text></paragraph><paragraph id="id7138ef444f484e31bb16ef0d197c841c"><enum>(5)</enum><text>permit the activities described in subsection (d).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida08e8f57ca2a4531911fb48332d689ff"><enum>(d)</enum><header>Permitted activities</header><text>The activities referred to in subsection (c)(5) are the following:</text><paragraph id="id7e9f43041167498b8cf137b2d7e68860"><enum>(1)</enum><text>Grazing in accordance with the grazing management plan.</text></paragraph><paragraph id="id43031f9603e4409d8d62a369fcc25caf"><enum>(2)</enum><text>Fire presuppression, fire-related rehabilitation, and construction of fire breaks.</text></paragraph><paragraph id="id67fc53fc5aa540e39814b469770fa549"><enum>(3)</enum><text>Clipping or mowing to assist in perennial grass and forb establishment.</text></paragraph><paragraph id="idf28823723924456a8836ef0a7005d9d0"><enum>(4)</enum><text>Emergency haying in response to a localized or regional drought, flooding, wildfire, or other emergency, outside the primary nesting season, when—</text><subparagraph id="idf6a33cea3f2445ada50893f87b6b61de"><enum>(A)</enum><text>the county is designated as D2 (severe drought) or greater according to the United States Drought Monitor;</text></subparagraph><subparagraph id="idec5f7cd285234d12a7e8188455ac2fb3"><enum>(B)</enum><text>there is at least a 40 percent loss in forage production in the county; or</text></subparagraph><subparagraph id="idad033e1624a548b184e7f1de4ff79e8f"><enum>(C)</enum><text>the Secretary, in coordination with the appropriate State technical committee established under section 1261 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3861">16 U.S.C. 3861</external-xref>), determines that the program can assist in the response to a natural disaster event without permanent damage to the established cover.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbf9ab9496ecb44a985f8785efb090fa7"><enum>(e)</enum><header>Payments</header><paragraph commented="no" display-inline="no-display-inline" id="idffccc20681964436acd27c74cecdff68"><enum>(1)</enum><header display-inline="yes-display-inline">Annual rental payments</header><text display-inline="yes-display-inline">The annual rental rate for a payment under a contract under this section shall be equal to 75 percent of the county average dryland cash rental rate for cropland determined under section 1234(d)(4)(A) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3834">16 U.S.C. 3834(d)(4)(A)</external-xref>).</text></paragraph><paragraph id="idfdc2d569c1e1471395a5055f1403fd6e"><enum>(2)</enum><header>Cost-sharing payments</header><text>The Secretary shall pay to an owner or operator 50 percent of the cost of establishing perennial grass and forb cover on eligible land enrolled under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf9f2dd280cd48a89ed771bba7c352fb"><enum>(3)</enum><header>Incentive payments</header><text>In addition to the cost sharing payment described in paragraph (2), the Secretary shall make an incentive payment to—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide08fd265b32042e0a9e4ec17581e970f"><enum>(A)</enum><text display-inline="yes-display-inline">an owner or operator in an amount equal to 50 percent of the cost of using a high-quality diverse native seed mix for establishment of cover described in paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideed20cd82ad44936a07f3cac0185d5c3"><enum>(B)</enum><text>an owner or operator that is a beginning farmer or rancher in an amount equal to 50 percent of the cost share provided under paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59f62470f42b47a6aefd574f46303bfb"><enum>(4)</enum><header>Limitation</header><text>The total amount of cost share payments under paragraph (2) and incentive payments under paragraph (3) shall not exceed 100 percent of the cost of establishing perennial grass and forb cover on eligible land enrolled under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddf21242eff9844d4ae024d2b90059221"><enum>(f)</enum><header>Enrollment; acreage limitation</header><paragraph commented="no" display-inline="no-display-inline" id="id1f2d479c196b43389d4820913b5a8be7"><enum>(1)</enum><header>Enrollment</header><subparagraph commented="no" display-inline="no-display-inline" id="id4289941e10d844239dfc3468c92a9731"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall accept applications for contracts under this section on a continuous basis, using ranking periods that are not less frequent than annual.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4af977df557440a9aab7302a23f5cfa"><enum>(B)</enum><header>Delay</header><text>The Secretary may delay a ranking period described in subparagraph (A) if—</text><clause commented="no" display-inline="no-display-inline" id="id0205084d1c364fb194d1ff031f37651d"><enum>(i)</enum><text display-inline="yes-display-inline">the available acreage for enrollment is less than 1,000,000 acres; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id582aa019b62b4810a9b22d0c0a33f017"><enum>(ii)</enum><text>commodity prices are elevated and there is an expected shortage of commodities grown on the eligible land targeted for enrollment.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida6c324c15b7b4058a5655d7a590eac86"><enum>(2)</enum><header>Acreage limitation</header><text display-inline="yes-display-inline">The Secretary may enroll in the program established under this section not more than 20,000,000 acres.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf8503cde18ce48ae8c24bbe41f5a5c3b"><enum>(g)</enum><header>Priorities</header><text display-inline="yes-display-inline">In entering into contracts under this section, the Secretary shall prioritize—</text><paragraph commented="no" display-inline="no-display-inline" id="id061f37a400344ff3823191d952574a37"><enum>(1)</enum><text display-inline="yes-display-inline">owners or operators who are beginning farmers or ranchers, as defined by the Secretary;</text></paragraph><paragraph id="idd9139730675b4a66acc0a5f499a51ba5"><enum>(2)</enum><text>owners that operate a livestock grazing operation or have plans to start a livestock grazing operation;</text></paragraph><paragraph id="id681d3fb750c94e29beaadf7573570141"><enum>(3)</enum><text>owners or operators that agree to follow a conservation plan that includes provisions to support wildlife habitat or land that is part of wildlife corridors;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65227173c9fc430b8c5b045a1f229fc9"><enum>(4)</enum><text display-inline="yes-display-inline">high-quality, diverse, native seed mixes for establishment of perennial grass and forb cover;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida579bd9c300b4999bf2a2d549f4d79af"><enum>(5)</enum><text display-inline="yes-display-inline">highly erodible land; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide53a0eb0d5a54e6e9c11a8f3d186c949"><enum>(6)</enum><text>marginal cropland.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf7a8ee0122c84f06bdd9f40666469293"><enum>(h)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall make available to owners or operators technical assistance for the duration of a contract entered into under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id71c93186fd24424a8cc343259b3e0977"><enum>(i)</enum><header>Automatic enrollment</header><paragraph commented="no" display-inline="no-display-inline" id="id3975f200b3de406883579f96dee31efd"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On expiration of a contract entered into under this section, the Secretary shall automatically enroll the eligible land enrolled under the contract in a contract under section 1231(d)(2) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(d)(2)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f4878410fff42e190b65c65ab5928e5"><enum>(2)</enum><header>Exemptions</header><text>For purposes of automatically enrolling eligible land under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id502f37e6369d4a76969abbf726763a8f"><enum>(A)</enum><text>the eligible land shall not count towards the applicable acreage limitations described in section 1231(d)(2)(A) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(d)(2)(A)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8ce0ee7a441433dbf4f875679010d67"><enum>(B)</enum><text>the method of enrollment described in section 1231(d)(2)(C) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(d)(2)(C)</external-xref>) shall not apply.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf773a203590e473fba77a41f4b9597b1"><enum>(3)</enum><header>Producer flexibility</header><text>An owner or operator may opt out of the automatic enrollment under paragraph (1), but the eligible land shall be ineligible for reenrollment under this section.</text></paragraph></subsection><subsection id="idfdf8c743abe342b1a0e259cdf7d165aa"><enum>(j)</enum><header>Enrollment in other programs</header><text>An owner or operator party to a contract entered into under this section may enroll the eligible land in any program under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831 et seq.</external-xref>) for any activity for which a cost share or incentive payment is not provided under paragraph (2) or (3) of subsection (e).</text></subsection><subsection id="id508e118d3fbf42e5ae1af279cecdf90d"><enum>(k)</enum><header>Payment limitation</header><text>The total amount of payments received, directly or indirectly, by a person or legal entity for a fiscal year under this section may not exceed $155,000.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7068223045634372bf01df4fe32af9e7"><enum>(l)</enum><header>Adjusted gross income limitation</header><text>Section 1001D(b)(2) of the Food Security Act of 1985 (7 U.S.C. 1308–3a(b)(2)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id507dbb8891a04013b6e368333e74fec7"><subparagraph commented="no" display-inline="no-display-inline" id="id85c95eb84f954e5995870b974d4dd9e2"><enum>(F)</enum><text display-inline="yes-display-inline">A payment or benefit under section 2 of the <short-title>Rebuilding America's National Cow Herd Act</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
