<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5259</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260805">August 5, 2026</action-date><action-desc><sponsor name-id="S407">Mr. Hagerty</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit sanctuary jurisdictions from receiving community development block grants, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Housing Welfare for Illegal Aliens Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide68e615456014bdb8f86b7993239057c"><enum>2.</enum><header>Ineligibility of sanctuary jurisdictions for community development block grants</header><text display-inline="no-display-inline">Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) is amended—</text><paragraph id="ida7f2ebb5797a470fa3a1642ce5fea40c"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida1f27f7f9c2048258e922c40976a91e3"><paragraph id="id734bf4ff1eca416ebfcfba6f0b9be70c"><enum>(25)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0bd690bad25042f7ac67e123169bc5c2"><enum>(A)</enum><text>Except as provided in subparagraph (B), the term <term>sanctuary jurisdiction</term> means any State or political subdivision of a State that has in effect a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from—</text><clause commented="no" display-inline="no-display-inline" id="idb633fce32f70493cac5b80f147a4b70c" indent="up1"> <enum>(i)</enum> <text display-inline="yes-display-inline">sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual.</text>
 </clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id490813434bfe400a8588929a361f97cd"><enum>(ii)</enum><text display-inline="yes-display-inline">complying with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>, 1357) to comply with a detainer for, or notify about the release of, an individual.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id502a4152f70943aea68aa79481a04749"><enum>(iii)</enum><text display-inline="yes-display-inline">A State or political subdivision of a State shall not be deemed a sanctuary jurisdiction based solely on its having a policy whereby its officials will not share information regarding, or comply with a request made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>, 1357) to comply with a detainer regarding, an individual who comes forward as a victim or a witness to a criminal offense.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id9d7e6fd5e6f8452c8cfe8c59bbba7f69"><enum>(2)</enum><text>in section 104(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304(b)</external-xref>)—</text><subparagraph id="idec6156d6ad4e417b9e983a7561cc2ae6"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idc24250df16b0467fa93be3102bab1324"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="idee0b16d3a5554545b4d5648a6466c764"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ccb3c86d71b47d489669f42e472cbf7"><paragraph id="ida57899d0ce154193b17259d264931634"><enum>(6)</enum><text>the grantee is not a sanctuary jurisdiction and will not become a sanctuary jurisdiction during the period for which the grantee receives a grant under this title; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id82002acedbd5417d823a1b22a88287f4"><enum>3.</enum><header display-inline="yes-display-inline">Codification of ‘mixed-status’ rule to prevent the prorating of housing assistance to households with illegal alien residents</header><subsection id="idae8138a365184fd8a4fd1af3384aa8f2"><enum>(a)</enum><header>Restriction on use of assisted housing</header><text>Section 214(b) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id65b8fe3e556c4cb49dc017a40d94d87c"><paragraph id="idd2d703b5b30349559f03463e899133d0" indent="up1"><enum>(2)</enum><text>If the eligibility for financial assistance of at least one member of a family has been affirmatively established under the program of financial assistance and under this section, and the ineligibility of one or more family members has not been affirmatively established under this section, the applicable Secretary shall not make any financial assistance available on any prorated basis until eligibility has been affirmatively established for all members of a family regardless of age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide2323ada70124b238ae0bc3c40af4ee8"><enum>(b)</enum><header>Removal of assistance</header><text>Section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id80448c0056d24177b77d17b77982750c"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (c);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3fa9488f6cf545459996c005317dded9"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through (i) as subsections (c) through (h), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d6f7f9095264463b341ae75e755b542"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="idae8e04fed2fb4d38aae8acddb2dc882d"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>subsection (d)(4)(A)(ii)</quote> and inserting <quote>subsection (c)(4)(A)(ii)</quote>; and</text></subparagraph><subparagraph id="id01bbb1b60e9549b782615647518315aa"> <enum>(B)</enum> <text>in paragraph (3), by striking <quote>subsection (d)(4)(B)(ii)</quote> and inserting <quote>subsection (c)(4)(B)(ii);</quote>;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id611cdbc27d6641d79f63fe770a69dc8e"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e)(1), as so redesignated, by striking <quote>subsection (d)</quote> and inserting <quote>subsection (c)</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b6fb1181e8b4482b5e226d7140e283e"><enum>(5)</enum><text>in subsection (g), as so redesignated, by striking <quote>subsection (d)</quote> and inserting <quote>subsection (c)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b41d2e3920844768569f328388e4703"><enum>(6)</enum><text>in subsection (h), as so redesignated, by striking <quote>subsection (d)</quote> each place that term appears and inserting <quote>subsection (c)</quote>.</text></paragraph></subsection><subsection id="id26d20845456f44d5930ac00de68241c1"><enum>(c)</enum><header>Verification of eligibility for housing assistance</header><text>Subsection (h) of section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>), as so redesignated under subsection (b), is amended—</text><paragraph id="id99d6466e587e45c38351d388415a5967"><enum>(1)</enum><text>in paragraph (1), by striking <quote>at least the individual or one family member</quote> and inserting <quote>individual and all family members regardless of age</quote>; and</text></paragraph><paragraph id="id246b1920b69a44dda49309fde1b8cf91"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2648896500664a699f309c148c5864bd"><paragraph id="id5bfd35236bbe4fcdac1519c487460866"><enum>(4)</enum><header>Prorated assistance</header><text>With respect to pending verification of eligibility as described in paragraph (1), the applicable Secretary may not provide any financial assistance to any individual or family on any prorated basis until verification of eligibility has been confirmed for all individuals or family members regardless of age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id28f1422f3de144e7809b9cf0d514b1fb"><enum>4.</enum><header>Requiring public housing agencies to affirmatively establish and verify citizenship before providing financial assistance</header><text display-inline="no-display-inline">Subsection (h)(2)(A) of section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>), as so redesignated under section 3, is amended—</text><paragraph id="id7abda0d1c6264d75bae1103588a32a39"><enum>(1)</enum><text>by striking <quote>may, notwithstanding paragraph (1) of this subsection,</quote> and inserting <quote>shall</quote>; and</text></paragraph><paragraph id="id8556ab9335bb48248c065e328d3f6f6b"><enum>(2)</enum><text>by striking <quote>assistance</quote> and inserting <quote>assistance; and</quote>.</text></paragraph></section><section id="id52675ba4f1ce4e8697c8f40a74f32b8f"><enum>5.</enum><header>Restricting eligibility of certain noncitizens of the United States for housing programs</header><text display-inline="no-display-inline">Section 214(b)(1) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(b)(1)</external-xref>) is amended—</text><paragraph id="id234693bdced943d39d52cebcf36b572d"><enum>(1)</enum><text>by inserting <quote>or section 811</quote> after <quote>title III</quote>; and</text></paragraph><paragraph id="idd4a985cc83df4d44b20fa347dc48b5b9"><enum>(2)</enum><text>by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/12851">42 U.S.C. 12851 et seq.</external-xref>, 8013), section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>)</quote> after <quote>Affordable Housing Act</quote>.</text></paragraph></section></legis-body></bill>
