Immunity for good faith conduct.</toc-entry></toc></subsection></section><section commented="no" display-inline="no-display-inline" id="id95fdd3f303fd4f7084652681bcd74a8f"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to protect the public from repeat violent felons by establishing a comprehensive national system for the registration of repeat violent felons in response to the vicious attack of Karly Rain Wood.</text></section><section commented="no" display-inline="no-display-inline" id="id9a097e8a84664051a9d1cb2e7fc3823b"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id02140029a8554b5c97b63e39b2c6cb81"><enum>(1)</enum><header>Arson; assault with intent to commit rape; extortion; firearms use; kidnapping; serious violent felony; serious drug offense; State</header><text>The terms <term>arson</term>, <term>assault with intent to commit rape</term>, <term>extortion</term>, <term>firearms use</term>, <term>serious violent felony</term>, <term>serious drug offense</term> and <term>State</term> have the meanings given those terms in section 3559(c)(2) of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide0e03933a5f34be9a67097bc1b3bbe03"><enum>(2)</enum><header>Assistance program</header><text>The term <term>assistance program</term> means the Repeat Violent Felon Management Assistance Program established under section 12.</text></paragraph><paragraph id="id84e8d007386945b1a76664f7cfd7e538"><enum>(3)</enum><header>Employee</header><text>The term <term>employee</term> includes an individual who is self-employed or works for any other entity, whether compensated or not.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb0c5bc4663c4ab6a36086fe4cb88c87"><enum>(4)</enum><header>Excepted offense</header><text>The term <term>excepted offense</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4612dfeeb9e64d28ab697163e31d76b4"><enum>(A)</enum><text display-inline="yes-display-inline">robbery, an attempt, conspiracy, or solicitation to commit robbery, or a miscellaneous violent offense for which the defendant establishes by clear and convincing evidence that—</text><clause commented="no" display-inline="no-display-inline" id="id6bb78c390cb04c42bd510797c8a5a816"><enum>(i)</enum><text display-inline="yes-display-inline">no firearm or other dangerous weapon was used in the offense and no threat of use of a firearm or other dangerous weapon was involved in the offense; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc094683dbb904f3fb2ba2d8ee6bd5e27"><enum>(ii)</enum><text display-inline="yes-display-inline">the offense did not result in death or serious bodily injury (as defined in section 1365 of title 18, United States Code) to any person; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93c813aa768842f5b3a835f55f6502c9"><enum>(B)</enum><text>arson for which the defendant establishes by clear and convincing evidence that—</text><clause commented="no" display-inline="no-display-inline" id="idb58e7c024e36418ea58d468fee97cef0"><enum>(i)</enum><text display-inline="yes-display-inline">the offense posed no threat to human life; and</text></clause><clause id="idf720a64ec08741188a41d8b40f7c9e53" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the defendant reasonably believed the offense posed no threat to human life.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dd81cfcc23d42a3922a5ad4f5e86b83"><enum>(5)</enum><header>Firearm</header><text>The term <term>firearm</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide50a300b9d0c4bd6a1dbd0e71d3a8afb"> <enum>(6)</enum> <header>Indian Tribe</header> <text>The term <term>Indian Tribe</term> means a federally recognized Indian Tribe.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23158cf942dc41a5a2d508b9415db8f0"><enum>(7)</enum><header>Jurisdiction</header><text>The term <term>jurisdiction</term> means—</text><subparagraph id="id3fbdb6bde16347f1aa4d4220a110bace"><enum>(A)</enum><text>a State; and</text></subparagraph><subparagraph id="idfb3ae0b2310f4e7d8f24f68bd3b07a18" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an Indian Tribe that elects to qualify as a jurisdiction for the purposes of this Act under section 13(a)(1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id005007180e5e450fa2bb044e501ee83e"><enum>(8)</enum><header>Miscellaneous violent offense</header><text>The term <term>miscellaneous violent offense</term> means an offense punishable by a maximum term of imprisonment of 5 years or more that has as an element the use, attempted use, or threatened use of physical force against the person of another or that, by its nature, involves a substantial risk that physical force against the person of another may be used in the course of committing the offense.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b9e36d294fe4d299f55523503cf79ec"><enum>(9)</enum><header>National repeat violent felon registry</header><text>The term <term>National Repeat Violent Felon Registry</term> means the registry maintained under section 8(a)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b10aaa6959a40209c1ba47c2c4c3604"> <enum>(10)</enum> <header>National website</header> <text>The term <term>national website</term> means National Repeat Violent Felon Public Website established under section 8(b)(1).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a437ce39c3a495abeb5fdc4e8b5ecb2"><enum>(11)</enum><header>Notification program</header><text>The term <term>notification program</term> means the Repeat Violent Felon Community Notification Program established under section 9(a).</text></paragraph><paragraph id="idff8b97904fcf406c9a94ec23e6a47c1a"><enum>(12)</enum><header>Qualifying offense</header><text>The term <term>qualifying offense</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6b9d456e35f1460ba805d4db8d0949e8"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text><clause commented="no" display-inline="no-display-inline" id="id6448c00a982945c78a95cfb7867fa167"><enum>(i)</enum><text display-inline="yes-display-inline">arson;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0911465055b54261b65c7135e771cc51"><enum>(ii)</enum><text>murder;</text></clause><clause commented="no" display-inline="no-display-inline" id="id37114382150a4800a4949bd05c648fc8"><enum>(iii)</enum><text>voluntary manslaughter;</text></clause><clause commented="no" display-inline="no-display-inline" id="id269c702b45ef4e5ea070c56ac4556fcc"><enum>(iv)</enum><text>kidnapping;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfe896813805141cbac535edf9036c017"><enum>(v)</enum><text>aggravated assault;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida7cbeb02d3ac48ea83e381d8ec5b5cfe"><enum>(vi)</enum><text>a forcible sexual offense;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd70eb059d79348ec82be738a0769b2a0"><enum>(vii)</enum><text>robbery;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2d4d2b8fe9f54efdbbf9e0849e9474ff"><enum>(viii)</enum><text>extortion;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67c0a10877a44052a217e21bb31cafc8"><enum>(ix)</enum><text>the unlawful use or unlawful possession of a firearm;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida8753cbadf1549d9a14e30c769e03530"><enum>(x)</enum><text display-inline="yes-display-inline">the use or unlawful possession of explosive material (as defined in section 841 of title 18, United States Code);</text></clause><clause commented="no" display-inline="no-display-inline" id="id5a839a31ae614389b722a8229866ae67"><enum>(xi)</enum><text display-inline="yes-display-inline">assault with intent to commit rape;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0ad348c438524099b5a9888e7b89cb8d"><enum>(xii)</enum><text display-inline="yes-display-inline">a serious violent felony; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb7ef1f48428a44ac9d3ccaed3dbff7da"><enum>(xiii)</enum><text display-inline="yes-display-inline">the use of a firearm, during and in relation to, or in furtherance of an offense described in clauses (i) through (xii); and</text></clause></subparagraph><subparagraph id="ida04bf820bdc9460eb2ae5c2dfebcdf25" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>does not include an excepted offense.</text></subparagraph></paragraph><paragraph id="idc8004ad3dc3b4424b8ccdf037dee502c"><enum>(13)</enum><header>Register</header><text>The term <term>register</term> means the submission of a registration to a registry.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc9ba670f6d84535ad9d9ac7f9b5d3aa"><enum>(14)</enum><header>Registry</header><text>The term <term>registry</term> means a jurisdiction-wide repeat violent felon registry maintained in accordance with section 4(b).</text></paragraph><paragraph id="id16fcc21819ec4de69514f84a1c3f7057"> <enum>(15)</enum> <header>Resides</header> <text>The term <term>resides</term> means, with respect to an individual, the location of the individual’s home or other place where the individual habitually lives.</text>
 </paragraph><paragraph id="idbe8fef3d19ee41caab811977aae74537"><enum>(16)</enum><header>Repeat violent felon</header><text>The term <term>repeat violent felon</term> means an individual who—has received a final conviction of—</text><subparagraph id="id6188d1ffe02d4f56a288ad9676a8f9fb"><enum>(A)</enum><text>not fewer than 2 qualifying offenses; or</text></subparagraph><subparagraph id="id4c22be27cefc4672a41b925ee178d1b9"><enum>(B)</enum><text>not fewer than 1 qualifying offense and not fewer than 1 serious drug offense.</text></subparagraph></paragraph><paragraph id="id16dd52fda4de4335a513ef65444f9f7a"><enum>(17)</enum><header>Student</header><text>The term <term>student</term> means an individual who enrolls in or attends an educational institution, including (whether public or private) a secondary school, trade or professional school, and institution of higher education.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id9a2f53047c7d41afaf90f1e09b63b6f6"><enum>4.</enum><header>Karly Rain Wood repeat violent felon registration and notification program</header><subsection commented="no" display-inline="no-display-inline" id="id81a66fdc271a4705aa789d013e1a5afd"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="id130d490e859845e588b35b38884e5f89"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Attorney General shall establish a program within the Department of Justice to be known as the <quote>Karly Rain Wood Repeat Violent Felon Registration and Notification Program</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c10da28b4c1471b8a096bcffdbc4ac0"><enum>(2)</enum><header>Coordination of State registries</header><text>Under the program established under paragraph (1), the Attorney General shall coordinate with jurisdictions in maintaining the registries required under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a3009c6c1d14d8ea75849c7211cda64"><enum>(3)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Attorney General shall issue guidance and promulgate regulations to carry out this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb10acbdc0d44125b434912d191e6cc2"><enum>(b)</enum><header>Jurisdiction requirement</header><text display-inline="yes-display-inline">Not later than the date prescribed under section 11(a), each jurisdiction shall maintain a jurisdiction-wide repeat violent felon registry under which a repeat violent felon shall be required to comply with the registration requirements under section 5.</text></subsection></section><section id="idca9e6569a43f43edad40bf9299958ecd"><enum>5.</enum><header>Registration requirements</header><subsection id="idc2de1f43b3b8451d9bb124f35451ac47"><enum>(a)</enum><header>In general</header><text>A repeat violent felon shall register and keep the registration current in each jurisdiction where the repeat violent felon—</text><paragraph commented="no" display-inline="no-display-inline" id="id1c9ca3df69304f0291487ada23bc0c2b"><enum>(1)</enum><text display-inline="yes-display-inline">resides;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideafeb0820a8a405aa6d2de1d164e28e4"><enum>(2)</enum><text display-inline="yes-display-inline">is an employee; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb546efb0a2684fda98a46416bae43530"><enum>(3)</enum><text display-inline="yes-display-inline">is a student.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id090ef32ba3cd480da3683e7babd79ca9"><enum>(b)</enum><header>Initial registration</header><paragraph commented="no" display-inline="no-display-inline" id="id8c89b4f4480b446a9cdafee548da1ddc"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For initial registration purposes only, a repeat violent felon shall register in each jurisdiction in which the repeat violent felon is convicted if such jurisdiction is different from the jurisdiction in which the repeat violent felon resides.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55492b196bf94fe3a2881ea72b186520"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">A repeat violent felon required to register under this Act shall submit an initial registration to each required registry—</text><subparagraph id="id53c81ade90494170af297490e5b4aec1"><enum>(A)</enum><text>before completing a sentence of imprisonment with respect to the offense giving rise to the registration requirement; or</text></subparagraph><subparagraph id="id7707c4f4538b4c96ae44e333bf68361f"><enum>(B)</enum><text>if the repeat violent felon is not sentenced to a term of imprisonment, not later than 3 business days after being sentenced for that offense.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51d1e27deebe49ada8f83a3af8731712"><enum>(3)</enum><header>Inability to comply</header><text>The Attorney General may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb0d2b905a1dd46e7acd1db7a00a71127"><enum>(A)</enum><text display-inline="yes-display-inline">specify the applicability of—</text><clause commented="no" display-inline="no-display-inline" id="id14bec5589a3d4e029015e13c8aac3ffe"><enum>(i)</enum><text display-inline="yes-display-inline">the requirements of this Act to repeat violent felons convicted before the enactment of this Act; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb8e8bcb89044a59b77c1646ca1bceea"><enum>(ii)</enum><text display-inline="yes-display-inline">the implementation of this Act in a particular jurisdiction; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5581a796ad3e43169e3981214220f715"><enum>(B)</enum><text display-inline="yes-display-inline">prescribe rules for the registration of any repeat violent felon who is unable to comply with this paragraph.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8b9047a7f0364650b42f4ca5e17a4354"><enum>(c)</enum><header>Contents</header><paragraph commented="no" display-inline="no-display-inline" id="id2af87662bb9149bdb639c0dc15169a55"><enum>(1)</enum><header>Information provided by repeat violent felon</header><text>A registration by a repeat violent felon shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf3073fe3ae5a4bbaac8424896d7e0d17"><enum>(A)</enum><text display-inline="yes-display-inline">the name of the repeat violent felon (including any alias used by the individual);</text></subparagraph><subparagraph id="id7e1f2581cd1141bf9ebf9a992d1d3465"> <enum>(B)</enum> <text>the social security number of the repeat violent felon;</text>
 </subparagraph><subparagraph id="idfe671f3c1c2b49f4bf8902a55935dc0f"><enum>(C)</enum><text>the address of each residence at which the repeat violent felon resides or will reside;</text></subparagraph><subparagraph id="idc502bb296e4d41d59550ddd31f2dd6a9"><enum>(D)</enum><text>the name and address of any place where the repeat violent felon is an employee or will be an employee;</text></subparagraph><subparagraph id="ida1adef3f37d54a4ba67ce9b8ef3b425f"><enum>(E)</enum><text>the name and address of any place where the repeat violent felon is a student or will be a student;</text></subparagraph><subparagraph id="id69dd5ddc541545418ced385103ae1ead"><enum>(F)</enum><text>the license plate number and a description of any vehicle owned or operated by the repeat violent felon;</text></subparagraph><subparagraph id="id27f9bb7df4694552912adc178aed1a83"><enum>(G)</enum><text>information relating to intended travel of the repeat violent felon outside the United States, including any anticipated dates and places of departure, arrival, or return, carrier and flight numbers for air travel, destination country and address or other contact information therein, means and purpose of travel, and any other itinerary or other travel-related information determined appropriate by the Attorney General; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5be50f32c8d4501a1c2feca85c407dc"><enum>(H)</enum><text>any other information determined appropriate by the Attorney General.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9607765aab845f987052411fd25a6d6"><enum>(2)</enum><header display-inline="yes-display-inline">Information provided by jurisdiction</header><text display-inline="yes-display-inline">Each jurisdiction in which a repeat violent felon registers shall include in the registry with respect to the repeat violent felon—</text><subparagraph id="ida98b8668e9204609a7a3f37ba703c4a8"><enum>(A)</enum><text>a physical description of the repeat violent felon;</text></subparagraph><subparagraph id="ida35983dd7fee4dd4adb0440276ca37d3"><enum>(B)</enum><text>the text of the provision of law defining each criminal offense for which the repeat violent felon is registered;</text></subparagraph><subparagraph id="idcb57be323ce24332b57e286c1277c3d6"><enum>(C)</enum><text>the criminal history of the repeat violent felon, including—</text><clause commented="no" display-inline="no-display-inline" id="id8c2e8d6c5197414c81af1ccb7d9ecef8"><enum>(i)</enum><text display-inline="yes-display-inline">the date of all arrests and convictions;</text></clause><clause commented="no" display-inline="no-display-inline" id="id27e6df4c76654bba93651faf82d77651"><enum>(ii)</enum><text display-inline="yes-display-inline">the status of parole, probation, or supervised release;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc80c447a7b424ea3bced9c0ad30c9b64"><enum>(iii)</enum><text display-inline="yes-display-inline">registration status; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id839dd5c962f34e8badf1893e0383944a"><enum>(iv)</enum><text display-inline="yes-display-inline">the existence of any outstanding arrest warrants for the repeat violent felon;</text></clause></subparagraph><subparagraph id="idbab5b3f1448d4acd9f330b1eb55e4f2e"><enum>(D)</enum><text>an up-to-date photograph of the repeat violent felon;</text></subparagraph><subparagraph id="id195565929131422d9f8a565cabb1bf24"><enum>(E)</enum><text>a set of fingerprints and palm prints of the repeat violent felon;</text></subparagraph><subparagraph id="idf2f2f076332b4d5c8949a64f24dcddc8"> <enum>(F)</enum> <text>a DNA sample of the repeat violent felon;</text>
 </subparagraph><subparagraph id="id43bdf177f2084598996e2910418fc29e"><enum>(G)</enum><text>a photocopy of a valid driver's license or identification card issued to the repeat violent felon by a jurisdiction; and</text></subparagraph><subparagraph id="id89c63c4d2aab45979006a930d483c432"><enum>(H)</enum><text>any other information determined appropriate by the Attorney General.</text></subparagraph></paragraph></subsection><subsection id="id42732761cee147c2a4c1be613566d76f"> <enum>(d)</enum> <header>Periodic in person verification</header> <text>Not less frequently than once every 90 days after the date on which a repeat violent offender completes initial registration in accordance with this Act, the repeat violent felon shall—</text>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id343f3ee9abe44c9ba95a359efff662dc">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">appear in person in a facility of not less than 1 jurisdiction in which the repeat violent felon is registered;</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="idfa88e8d1f9664dd29a35f07f9194f19a">
                    <enum>(2)</enum>
 <text display-inline="yes-display-inline">allow the jurisdiction to take an up-to-date photograph; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id405aa8f41b8e4ca4a338ee2070f4863e">
                    <enum>(3)</enum>
 <text display-inline="yes-display-inline">verify the information in each registry in which the repeat violent felon is required to be registered.</text>
                </paragraph>
 </subsection><subsection id="id5fe2372576b0419f8c586d6999ea602b"><enum>(e)</enum><header>Time and manner of updates</header><text>A repeat violent felon shall provide and update information required under subsection (c)(1), including information relating to intended travel outside the United States required under subsection (c)(1)(G), in conformity with any time and manner requirements prescribed by the Attorney General.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id23c8e8196d4848b4b21ccaae9dd279be"> <enum>(f)</enum> <header>Period of registration</header> <text>A repeat violent felon shall keep the registration required under this Act current for the life of the repeat violent felon (excluding any time the repeat violent felon is in custody or civilly committed).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idb3627d4239a245cdafb45b3dc59890fa"><enum>(g)</enum><header>Keeping registration current</header><paragraph commented="no" display-inline="no-display-inline" id="id2b54bbf7938b43f9b6db2f354c45f802"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 3 business days after the date on which a repeat violent felon has a change in name, student status, or place of residence or employment, the repeat violent felon shall appear in person in not fewer than 1 jurisdiction in which the repeat violent felon is registered to inform the jurisdiction of the change.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd7c742bc0da4006a40d6fc3a8c9a268"><enum>(2)</enum><header>Jurisdiction notification</header><text>A jurisdiction receiving information of a change from a repeat violent felon under paragraph (1) shall immediately inform each other jurisdiction in which the repeat violent felon is registered of the change.</text></paragraph></subsection><subsection id="id09515772fc60450d802dcb7e7cda9594"> <enum>(h)</enum> <header>Effects of failure To comply</header> <paragraph commented="no" display-inline="no-display-inline" id="idff943290607b4b77a36b82191acde467"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>Each jurisdiction, other than a federally recognized Indian Tribe, shall provide a criminal penalty that includes a maximum term of imprisonment that is greater than 1 year for the failure of a repeat violent felon to comply with the requirements of this Act.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="idb704860b2d0542358676fae5258016af">
                    <enum>(2)</enum>
                    <header>Notification</header>
 <text>If a repeat violent felon fails to comply with the requirements of this Act, an appropriate official of the relevant jurisdiction shall—</text>
                    <subparagraph commented="no" display-inline="no-display-inline"
                        id="idec4c0a23ed86403ab4740d7e6c68e330">
                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">notify the Attorney General and appropriate law enforcement agencies; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline"
                        id="id9aef40959c7f42ac871ce915ee3d9e9c">
                        <enum>(B)</enum>
 <text>revise the registry of the jurisdiction to reflect the failure.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idc73a785fcde2469cb9a2bd18752e4296"> <enum>(3)</enum> <header>Action</header> <text>The appropriate official described in paragraph (2), the Attorney General, and each appropriate law enforcement agency shall take any appropriate action to ensure compliance of a repeat violent felon with the requirements of this Act.</text>
                </paragraph>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="idc8b4c340b8a847798d3bf87a39538399"><enum>6.</enum><header>Duty to notify repeat felons</header><subsection commented="no" display-inline="no-display-inline" id="idf037b8275632431b9df28efa944a9e76"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Shortly before the release of a repeat violent felon from custody, or, if the repeat violent felon is not in custody, immediately after the sentencing of the repeat violent felon for the offense giving rise to the duty to register, an appropriate official shall—</text><paragraph id="id409b127058d747f4be6954d615639813"><enum>(1)</enum><text>inform the repeat violent felon of the duties of a repeat violent felon under this Act and explain those duties;</text></paragraph><paragraph id="idf2d79ed4a35e491189a682f7fae66692"><enum>(2)</enum><text>require the repeat violent felon to read and sign a form stating that the duty to register has been explained and that the repeat violent felon understands the registration requirement; and</text></paragraph><paragraph id="idfad20988f3c145e0b8f5079de679bbc4"><enum>(3)</enum><text>ensure that the repeat violent felon is registered.</text></paragraph></subsection><subsection id="idf974105d2969479c80675c43450b2ec9"> <enum>(b)</enum> <header>Inability To comply</header> <text>The Attorney General shall prescribe rules for the notification of repeat violent felons who cannot be registered in accordance with subsection (a).</text>
            </subsection></section><section commented="no" display-inline="no-display-inline" id="idd33725b246d04087957f0e05614ed5bc"><enum>7.</enum><header>Public access to repeat violent felon information</header><subsection commented="no" display-inline="no-display-inline" id="idec1b3ddc68884b728828d3e5dc6d194b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="id0f5aa580e4d44dd2ba48171836a8861d">
                    <enum>(1)</enum>
                    <header>Information</header>
 <text display-inline="yes-display-inline">Subject to subsection (b), each jurisdiction shall make available on the internet, in a manner that is readily accessible to all jurisdictions and to the public, a public website that includes all information about each repeat violent felon in the registry of the jurisdiction.</text>
                </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f1cc18759f5429ca212ae1a045d7fbe">
                    <enum>(2)</enum>
                    <header>Single query</header>
 <text display-inline="yes-display-inline">The jurisdiction shall maintain the website required under paragraph (1) in a manner that will permit the public to obtain relevant information for each repeat violent felon by a single query for any given ZIP Code or geographic radius set by the user.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67077317c4144dfca585f2d51aadc760"><enum>(3)</enum><header>Participation in National Repeat violent public website</header><text display-inline="yes-display-inline">Each jurisdiction shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id88dae25a14754de6b01ec58f2416236b"><enum>(A)</enum><text display-inline="yes-display-inline">include in the design of the website required under paragraph (1) all field search capabilities needed for full participation in the national website; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide48c5af3ebf043b4abdb17c95aa8ce73"><enum>(B)</enum><text display-inline="yes-display-inline">participate in the national website as provided by the Attorney General.</text></subparagraph></paragraph></subsection><subsection id="id0a857c0f34fe414782ef62e979a5756a"> <enum>(b)</enum> <header>Mandatory exemptions</header> <text>A jurisdiction shall exempt from disclosure on the internet website required under subsection (a)(1)—</text>
                <paragraph id="id58a637c710d847a2905aa48a98be7444">
                    <enum>(1)</enum>
 <text>the identity of any victim of a sex offense;</text> </paragraph> <paragraph id="id6face60d71a545dd859153f6370d0cc8"> <enum>(2)</enum> <text>the social security number of a repeat violent felon;</text>
                </paragraph>
                <paragraph id="id8baba5a7515144849d874b72d09f4eff">
                    <enum>(3)</enum>
 <text>any reference to arrests of a repeat violent felon that did not result in conviction; and</text>
                </paragraph>
                <paragraph id="id353edf9ae205409a8aec29877d3a4b7a">
                    <enum>(4)</enum>
 <text>any other information exempted from disclosure by the Attorney General.</text>
                </paragraph>
            </subsection><subsection commented="no" display-inline="no-display-inline"
                id="idd16016d2a8a648eba8f9390c704fba4d">
                <enum>(c)</enum>
                <header>Links</header>
 <text>Each internet website required under subsection (a)(1) shall include, to the extent practicable, links to repeat violent felon safety and education resources.</text>
            </subsection><subsection id="id11a7c3ee4e10408ca17f1f7663d86bc3">
                <enum>(d)</enum>
                <header>Correction of errors</header>
 <text>Each internet website required under subsection (a)(1) shall include instructions on how to seek correction of information that an individual contends is erroneous.</text>
            </subsection><subsection id="idc908593ec3124b3ba55ded88af24ca98">
                <enum>(e)</enum>
                <header>Warning</header>
 <text>Each internet website required under subsection (a)(1) shall include a warning that—</text>
                <paragraph commented="no" display-inline="no-display-inline"

                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">instructs that information on the website should not be used to unlawfully injure, harass, or commit a crime against any individual named in the registry or residing or working at any reported address; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id01d73aa70fd544ebbfff79f85630030d">
                    <enum>(2)</enum>
 <text display-inline="yes-display-inline">notes that any action described in paragraph (1) could result in civil or criminal penalties.</text>
                </paragraph>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="id2666ef4412e1472fa0c851990a61e01b"><enum>8.</enum><header>National Repeat Violent Felon Registry and website</header><subsection commented="no" display-inline="no-display-inline" id="id4143b434ecc9492483f681590f0bfc40"><enum>(a)</enum><header display-inline="yes-display-inline">Registry</header><paragraph commented="no" display-inline="no-display-inline" id="id2e291509702a43f2815bbbf675417850"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Attorney General shall maintain a national database to be known as the <quote>National Repeat Violent Felon Registry</quote> within the Federal Bureau of Investigation for the registration of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2645fb18e63049b7a5b4e57232e9e371"><enum>(A)</enum><text display-inline="yes-display-inline">each repeat violent felon; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00fa2949f1c34f34b22ebcaa250fa4b5"><enum>(B)</enum><text display-inline="yes-display-inline">any other individual required to register in the registry of a jurisdiction.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59f119e204604b0a9bc14e06844cfd12"><enum>(2)</enum><header>Electronic forwarding</header><text>The Attorney General shall ensure through the National Repeat Violent Felon Registry or otherwise that updated information about a repeat violent felon is immediately transmitted by electronic forwarding to each relevant jurisdiction.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id141d715dd0434b6bbf879fc83ca2562e"><enum>(b)</enum><header>National website</header><paragraph commented="no" display-inline="no-display-inline" id="id199001dd93374576af7a1e885f822f01"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall establish and maintain a website to be known as the <quote>National Repeat Violent Felon Public Website</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d84ba9328d24efca945db7d3b488ab4"><enum>(2)</enum><header>Contents</header><text>The national website shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id23da6a710c6640c8a412a62a377da704"><enum>(A)</enum><text display-inline="yes-display-inline">include relevant information for—</text><clause commented="no" display-inline="no-display-inline" id="ida71c60956b18440298a8cdd458d8d587"><enum>(i)</enum><text display-inline="yes-display-inline">each repeat violent felon; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id09d3d0a8d87046ebac6a34835a74daa8"><enum>(ii)</enum><text display-inline="yes-display-inline">any other individual included on the website of a jurisdiction established under section 7(a)(1);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ccd56c1c9d746538e504358c7392c4b"> <enum>(B)</enum> <text display-inline="yes-display-inline">allow the public to obtain relevant information for each repeat violent felon by a single query for any given ZIP Code or geographical radius set by the user in a form and with such limitations as may be established by the Attorney General; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb05958c7b6ea45fd82799e8237e171fe"><enum>(C)</enum><text display-inline="yes-display-inline">have such other field search capabilities as the Attorney General determines appropriate.</text></subparagraph></paragraph></subsection></section><section id="idc23d52178a2c4ad0b4a1ddaf73c09023"><enum>9.</enum><header>Repeat violent felon community notification program</header><subsection commented="no" display-inline="no-display-inline" id="id08d4523bdc984c4196211e7d996cbc1a"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text>There is established within the Department of Justice a program to be known as the <quote>Repeat Violent Felon Community Notification Program</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1588715639e84729872c310d830bb61b"> <enum>(b)</enum> <header>Notification</header> <text>Except as provided in subsection (c), immediately upon a repeat violent felon registering or updating a registration, an appropriate official in the jurisdiction of the relevant registry shall provide the information in the registry (other than information exempted from disclosure under section 7(b)) with respect to the repeat violent felon to the following:</text>
                <paragraph id="id7555769255084c5a9751c4a5ba1cb30d">
                    <enum>(1)</enum>
 <text>The Attorney General for inclusion in the National Repeat Violent Felon Registry and other appropriate databases.</text>
                </paragraph>
                <paragraph id="idc15c41622cea4e26bed117e5cf9275f2">
                    <enum>(2)</enum>
 <text>Appropriate law enforcement agencies (including appropriate probation agencies) and each school and public housing agency in each area in which the repeat violent felon resides, is an employee, or is a student.</text>
                </paragraph>
                <paragraph id="id44ba18140f6f4fe79b5f377b52258682">
                    <enum>(3)</enum>
 <text>Each jurisdiction where the repeat violent felon resides, is an employee, or is a student, and each jurisdiction from or to which a change of residence, employment, or student status occurs.</text>
                </paragraph>
                <paragraph id="id274e4279d1f84f7c949c51e1d40e85af">
                    <enum>(4)</enum>
 <text>Any agency responsible for conducting employment-related background checks under section 3 of the National Child Protection Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/34/40102">34 U.S.C. 40102</external-xref>).</text>
                </paragraph>
                <paragraph id="id5dfb9a68239e4b9cb78b8c1e808ca47f">
                    <enum>(5)</enum>
 <text>Social service entities responsible for protecting minors in the child welfare system in any relevant jurisdiction.</text>
                </paragraph>
                <paragraph id="id2b552e232f504ba9bba9255f235015a7">
                    <enum>(6)</enum>
 <text>Volunteer organizations in which contact with minors or other vulnerable individuals might occur in any relevant jurisdiction.</text>
                </paragraph>
                <paragraph id="id03eb46c6ad8647c38879f2e92abfd205">
                    <enum>(7)</enum>
 <text>Any organization, company, or individual who requests such notification pursuant to procedures established by the jurisdiction.</text>
                </paragraph>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3a8e84e949114eb4ae23aa8eebd89b95"><enum>(c)</enum><header>Frequency</header><text>An organization, company, or individual described in subsection (b)(6) or (b)(7) may opt to receive the notification described in that subsection not less frequently than once every 5 business days.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id03553bc613cb4136992588d69d88d024"><enum>10.</enum><header>Registry management and website software</header><subsection commented="no" display-inline="no-display-inline" id="id13d1f35c6c6a4a75bb436e93e2815202"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General, in consultation with jurisdictions, shall develop and support software to enable jurisdictions to establish and operate uniform registries and websites required under section 7(a)(1).</text></subsection><subsection id="idb9a80922ce7d44ba886cafc3fdf8d38c"><enum>(b)</enum><header>Criteria</header><text>The software developed and maintained under subsection (a) shall facilitate—</text><paragraph id="idcb43a562ddb14982a7e99bb0e94cddcc"><enum>(1)</enum><text>the immediate exchange of information among jurisdictions;</text></paragraph><paragraph id="id3fd432a826d5428cac6c5e3613f9cb40"> <enum>(2)</enum> <text>public access over the internet to appropriate information, including the number of registered repeat violent felons in each jurisdiction on a current basis;</text>
 </paragraph><paragraph id="idd96b005482e746d786700989568131c3"><enum>(3)</enum><text>full compliance with the requirements of this Act; and</text></paragraph><paragraph id="iddf0d97c2fe2b4a67ab15dd114e60a0d7"><enum>(4)</enum><text>communication of information under the notification program.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8d43062dc1504acfb529d42655f9fc6a"><enum>11.</enum><header>Implementation by jurisdictions</header><subsection commented="no" display-inline="no-display-inline" id="id2c760c23092a44cd8c9962b72f4f3e0f"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each jurisdiction shall implement the requirements of this Act not later than the later of—</text><paragraph commented="no" display-inline="no-display-inline" id="id417f279098ae4c26822a9703074db320"><enum>(1)</enum><text>3 years after the date of enactment; and</text></paragraph><paragraph id="id222469dccaa64bebaa2de9c49e4773ca"><enum>(2)</enum><text>1 year after the date on which the software developed under section 10(a) is available for use by jurisdictions.</text></paragraph></subsection><subsection id="id409764e7614a4d2bb19fbf5d7da9afed"><enum>(b)</enum><header>Extensions</header><text>The Attorney General may authorize for a jurisdiction not more than 2 1-year extensions of the deadline for implementation prescribed under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf28c1524fa9647b4866d470cac2274de"> <enum>(c)</enum> <header>Failure To comply</header> <paragraph commented="no" display-inline="no-display-inline" id="idf07b13a656204c70b4676fe28df86f4c"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>Subject to subsection (d), for any fiscal year beginning after the date on which a jurisdiction is required to begin to implement the requirements of this Act, if the jurisdiction fails, as determined by the Attorney General, to substantially implement this Act, the Attorney General shall reduce the amounts that would otherwise be allocated for that fiscal year to the jurisdiction under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>) by 10 percent.</text>
                </paragraph>
                <paragraph id="iddd1ee0f21d52490ba02d83dd86f0a5fa" commented="no">
                    <enum>(2)</enum>
                    <header>Reallocation; purpose</header>
 <text>The Attorney General may reallocate amounts not allocated to a jurisdiction pursuant to paragraph (1) to that jurisdiction to be used solely for the purpose of implementing the requirements of this Act.</text>
                </paragraph>
            </subsection><subsection id="idd393d3c95bb549dc975acbf4e5c22d65"><enum>(d)</enum><header>State constitutionality</header><paragraph commented="no" display-inline="no-display-inline" id="id4bbd960ec38a4a819080bf00d1b2b9ec">
                    <enum>(1)</enum>
                    <header display-inline="yes-display-inline">In general</header>
 <text>In evaluating whether a jurisdiction has substantially implemented the requirements of this Act for the purpose of subsection (c)(1), the Attorney General shall consider whether the jurisdiction is unable to substantially implement those requirements because of a demonstrated inability to implement certain provisions that would place the jurisdiction in violation of the constitution of the jurisdiction, as determined by a ruling of the highest court of the jurisdiction.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43e1d632b9a246fe87b14668de533d03"><enum>(2)</enum><header>Efforts</header><subparagraph commented="no" display-inline="no-display-inline" id="idd1ed5a937c694ebd847bbc6fcafe4099"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a jurisdiction is unable to substantially implement the requirements of this Act due to the circumstances described in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idaa99ff96931042eaa5dc8583c112b342"><enum>(i)</enum><text display-inline="yes-display-inline">the Attorney General and the jurisdiction shall make good faith efforts to accomplish substantial implementation of this Act and to reconcile any conflicts between this Act and the constitution of the jurisdiction; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7fa5961c0c5c4f06adbe193f689e5bc4"><enum>(ii)</enum><text>the Attorney General may determine that the jurisdiction is in compliance with this Act if the jurisdiction has made, or is in the process of implementing, 2 reasonable alternative procedures or accommodations consistent with the purposes of this Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd8c2c62f5e94869ba92ace00b6b8f7b"><enum>(B)</enum><header>Consultation</header><text display-inline="yes-display-inline">In considering whether compliance with the requirements of this Act would likely violate the constitution of a jurisdiction or an interpretation thereof by the highest court of the jurisdiction, the Attorney General shall consult with the chief executive and chief legal officer of the jurisdiction concerning the jurisdiction's interpretation of the jurisdiction's constitution and rulings thereon by the jurisdiction's highest court.</text></subparagraph></paragraph></subsection><subsection id="id8f8c70eddd2a473caec212bcb9a78358"><enum>(e)</enum><header>Rule of construction</header><text>The provisions of this Act directing States or officials of States shall be construed to constitute conditions required to avoid the reduction of Federal funding described in subsection (c)(1).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id8095b98ebc16415785f0c3cf71fc6f2b"><enum>12.</enum><header>Repeat violent felon management assistance program</header><subsection commented="no" display-inline="no-display-inline" id="id4e4e6cb4823b491eb1467da45e469b58"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Attorney General shall establish and implement a program to be known as the <quote>Repeat Violent Felon Management Assistance Program</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ideeccd7a2e67b4a7d9684f9900c91e691"><enum>(b)</enum><header>Grants authorized</header><paragraph commented="no" display-inline="no-display-inline" id="idb61d6103e81348b2b914923c6f605342"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Under the program established under subsection (a), the Attorney General may award grants to jurisdictions to offset the costs of implementing the requirements of this Act.</text></paragraph><paragraph id="id0d91496e385e4b909555465878019bb6"><enum>(2)</enum><header>Application</header><text>The chief executive of a jurisdiction seeking a grant under this section shall, for each fiscal year during which a grant under this section is sought, submit to the Attorney General an application in such form and containing such information as the Attorney General may require.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6e0d043074d442a8a4a673e4f0e77f2b"><enum>(c)</enum><header>Bonus payments for prompt compliance</header><paragraph commented="no" display-inline="no-display-inline" id="idfb90b558ef114d89a6131863ecfdd8c2"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible entity defined</header><text>In this subsection, the term <term>eligible entity</term> means a jurisdiction that, as determined by the Attorney General, substantially complies with the requirements of this Act by a date that is not later than 2 years after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecb5ecec73674a7fb86ba41f78eb1c00"><enum>(2)</enum><header>Bonus payments</header><text display-inline="yes-display-inline">The Attorney General may award an eligible entity with a grant as a bonus for prompt compliance with the requirements of this Act for the first fiscal year beginning after the date on which the Attorney General determines the eligible entity is in substantial compliance with those requirements.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7c854e50b244463a8e54d72c047e1bd"><enum>(3)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of a payment under this subsection to an eligible entity shall be, of the total amount received by the eligible entity under a grant under subsection (b) for the preceding fiscal year—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54fab1a6bab347ebb0c064516e140625"><enum>(A)</enum><text display-inline="yes-display-inline">10 percent if the Attorney General makes the determination described in paragraph (2) during the period beginning on the date of enactment of this Act and ending on the date that is 540 days after such date; and</text></subparagraph><subparagraph id="idc1cd4c61118b4aedbb707c6b79ed1b6e"><enum>(B)</enum><text>5 percent if the Attorney General makes the determination described in paragraph (2) during the period beginning 540 days after the date of enactment of this Act and ending on the date that is 2 years after such date.</text></subparagraph></paragraph></subsection><subsection id="id57d3f748455f46559b276c9b861010ce"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General such sums as may be necessary for each of fiscal years 2027 and 2028 to carry out this section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id560b0ca47d5d4590a6f1b1ad1343c54d"><enum>13.</enum><header>Election as jurisdiction by Indian Tribes</header><subsection commented="no" display-inline="no-display-inline" id="id767a58dbcb6e4599bf0ae7b107923143"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>An Indian Tribe may, by resolution or other enactment of the relevant Tribal council or comparable governmental body—</text><paragraph id="id9baa0aa3156e42c4a763ce833a5f3d4a"><enum>(1)</enum><text>elect to qualify as a jurisdiction for the purposes of this Act; or</text></paragraph><paragraph id="id63d09198d69f47638a8286dfe4385c96"><enum>(2)</enum><text>elect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5471f89575064e6a94f326fd0b7213e2"><enum>(A)</enum><text display-inline="yes-display-inline">delegate the requirements of this Act to not less than 1 jurisdiction within which the territory of the Indian Tribe is located; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd1bf1c06b36c4d3593df1f7b52410176"><enum>(B)</enum><text display-inline="yes-display-inline">provide access to its territory and such other cooperation and assistance as may be needed to enable such other jurisdiction or jurisdictions to carry out and enforce the requirements of this part.</text></subparagraph></paragraph></subsection><subsection id="id779a5039c9164109b6a23630ff2a058c"> <enum>(b)</enum> <header>Imputed election in certain cases</header> <text>An Indian Tribe shall be deemed to have made the election described in subsection (a)(2)(B) if—</text>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="ide36407f915ca4d97960edc8b07621dc0">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">the Indian Tribe is subject to the law enforcement jurisdiction of a State under section 1162 of title 18, United States Code; and</text>
                </paragraph>
                <paragraph id="idd60aca6ef1ec40abbed23a9f69223e6c">
                    <enum>(2)</enum>
 <text>the Indian Tribe—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id85be829da975492e96b366ccc0756544"> <enum>(A)</enum> <text display-inline="yes-display-inline">does not make an election under subsection (a)(1) by the date that is 1 year after the date of enactment of this Act;</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline"
                        id="id4cfbf949ae78465785183f37e00cbc42">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">rescinds an election of the Indian Tribe under subsection (a)(1); or</text>
                    </subparagraph>
                    <subparagraph id="id32f9fc5ffc6042708d427d1df26d2f44">
                        <enum>(C)</enum>
 <text>the Attorney General determines that the Indian Tribe—</text> <clause commented="no" display-inline="no-display-inline" id="id022094076ce245979985c4188d41c732"> <enum>(i)</enum> <text display-inline="yes-display-inline">has not substantially implemented the requirements of this Act; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline"
                            id="idbd77a548898c429a81b8f71473ef5a4c">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">is not likely to become capable of substantially implementing the requirements of this Act within a reasonable amount of time.</text>
                        </clause>
                    </subparagraph>
                </paragraph>
 </subsection><subsection id="ida145f944a98d404aa74035153ecb4dfc"><enum>(c)</enum><header>Cooperation between tribal authorities and other jurisdictions</header><paragraph commented="no" display-inline="no-display-inline" id="id00452268abd44469a09c4e2596f0c35a"><enum>(1)</enum><header display-inline="yes-display-inline">Nonduplication</header><text>An Indian Tribe that elects to be a jurisdiction for the purposes of this Act shall not be required to duplicate functions under this Act which are fully carried out by another jurisdiction or jurisdictions within which the territory of the Indian Tribe is located.</text></paragraph><paragraph id="id446b94f71fc3411eb82819e1e80240f2"><enum>(2)</enum><header>Cooperative agreements</header><text>An Indian Tribe may, through cooperative agreements with a jurisdiction or jurisdictions described in paragraph (1)—</text><subparagraph id="idbec758e616e142ab8e2a189a8e47cc6d"><enum>(A)</enum><text>arrange for the Indian Tribe to carry out any function of such a jurisdiction under this Act with respect to repeat violent felons subject to the Indian Tribe's jurisdiction; and</text></subparagraph><subparagraph id="idc2fa97d4019f4854b9cb5fde80e6813e"><enum>(B)</enum><text>arrange for such a jurisdiction to carry out any function of the Indian Tribe under this Act with respect to repeat violent felons subject to the Indian Tribe's jurisdiction.</text></subparagraph></paragraph></subsection></section><section id="id8c1567db2b5743b9848e3705367bbef3"><enum>14.</enum><header>Registration of repeat violent felons entering the United States</header><subsection commented="no" display-inline="no-display-inline" id="id841519061e754c00823d9ed6b10c9d98"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Secretary of State and the Secretary of Homeland Security, shall establish and maintain a system for informing the relevant jurisdictions about individuals entering the United States who are required to register under this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8a09eb158c8a4e0eb036ee2a908aecd2"><enum>(b)</enum><header>Information provision</header><text display-inline="yes-display-inline">The Secretary of State and the Secretary of Homeland Security shall provide information relevant to subsection (a) and carry out such functions as the Attorney General may direct in the operation of the system established under subsection (a).</text></subsection></section><section id="id4f0fe63868c2452f8cd3b09c57a1f2a5"><enum>15.</enum><header>Registration of repeat violent felons released from military corrections facilities or upon conviction</header><text display-inline="no-display-inline">The Secretary of Defense shall provide to the Attorney General the information described in section 5(c)(2) to be included in the National Repeat Violent Felon Registry and the national website relating to repeat violent felons who are—</text><paragraph commented="no" display-inline="no-display-inline" id="ida6c45719e2064fc5b5d90dc38380e341"><enum>(1)</enum><text>released from military corrections facilities following a sentence imposed for the commission of a qualifying offense; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45c08e33c7b9420685e29a43145d748e"> <enum>(2)</enum> <text>convicted of a qualifying offense if the sentences adjudged by courts-martial under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), do not include confinement.</text>
 </paragraph></section><section id="id9262d9237cb645129bfae9b31a82c336"><enum>16.</enum><header>Immunity for good faith conduct</header><text display-inline="no-display-inline">The Federal Government, jurisdictions, political subdivisions of jurisdictions, and their agencies, officers, employees, and agents shall be immune from liability for good faith conduct under this Act.</text></section></legis-body></bill>
