which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that nitrile glove procurements comply with the requirements of the Make PPE in America Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Glove Act of 2026</short-title></quote>.</text></section><section id="id14ac2cc5af6b48248abbc14031138405"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id515e5f0c11244f97a46b9d8f481354db"><enum>(1)</enum><header>AbilityOne Program</header><text>The term <term>AbilityOne Program</term> means the program carried out under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/85">chapter 85</external-xref> of title 41, United States Code.</text></paragraph><paragraph id="id9bb6c5627a22413b9553a7684cd4b24d"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means the Department of Homeland Security, the Department of Health and Human Services, the Department of Veterans Affairs, the Department of Defense, and any other executive agency that procures covered nitrile gloves through a governmentwide acquisition contract, blanket purchase agreement, indefinite delivery/indefinite quantity contract, prime vendor arrangement, AbilityOne contract, or other shared procurement vehicle.</text></paragraph><paragraph id="id7567614a8bed4d49929326ae4a97a5eb"><enum>(3)</enum><header>Covered nitrile glove</header><text>The term <term>covered nitrile glove</term> means a nitrile examination glove, or other non-surgical nitrile glove procured by the Federal Government for medical, public health, emergency response, homeland security, laboratory, biodefense, or other protective use.</text></paragraph><paragraph id="id02557dd075df4d239c342f28a9e7fab3"><enum>(4)</enum><header>Covered procurement vehicle</header><text>The term <term>covered procurement vehicle</term> means any contract, order, blanket purchase agreement, indefinite delivery/indefinite quantity contract, governmentwide acquisition contract, prime vendor arrangement, distribution arrangement, Procurement List designation, authorized distributor arrangement, or other acquisition mechanism used by a covered agency to procure covered nitrile gloves through or in coordination with the AbilityOne Program.</text></paragraph><paragraph id="idcc228e753a63446384436721fb702fd8"><enum>(5)</enum><header>Qualified domestic manufacturer</header><text>The term <term>qualified domestic manufacturer</term> means an entity that—</text><subparagraph id="idb921b2ab55294390aa0e8c558be8f71d"><enum>(A)</enum><text>manufactures covered nitrile gloves in the United States;</text></subparagraph><subparagraph id="iddbdd623660e1470b975203cdf9d8a020"><enum>(B)</enum><text>is majority-owned and controlled by United States persons;</text></subparagraph><subparagraph id="id064729bc85904b8e8a3fb6b336a9f147"><enum>(C)</enum><text>is not owned, controlled, or subject to significant influence, directly or indirectly, by a foreign entity of concern, including through subsidiaries, affiliates, joint ventures, financing arrangements, licensing arrangements, or contractual arrangements; and</text></subparagraph><subparagraph id="id602adb88cec44b0e89a889517d695c09"><enum>(D)</enum><text>has the demonstrated capacity to manufacture covered nitrile gloves at commercial scale in the United States.</text></subparagraph></paragraph><paragraph id="idadc01cc358d7498c9e913b66de4ea9bc"><enum>(6)</enum><header>Manufacture</header><text>The term <term>manufacture</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5de009d21c124d59a97998c1951f8e93"><enum>(A)</enum><text display-inline="yes-display-inline">means performing the principal production processes necessary to produce covered nitrile gloves as the end item procured by the Federal Government, including forming, dipping, curing, finishing, testing, and packaging such gloves; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8ca24fa803340f8b65f2a3e6872d3e6"><enum>(B)</enum><text display-inline="yes-display-inline">does not include activities consisting primarily of resale, brokerage, distribution, warehousing, order fulfillment, relabeling, repackaging, reboxing, kitting, invoicing, shipping, inspection, or other administrative or logistical handling of gloves manufactured by another entity.</text></subparagraph></paragraph><paragraph id="id9102da81e90149d68b1e49746e8df069"><enum>(7)</enum><header>Supplier agreement</header><text>The term <term>supplier agreement</term> means a written agreement between an AbilityOne participating nonprofit agency, central nonprofit agency, authorized AbilityOne distributor, prime contractor, or other entity responsible for furnishing covered nitrile gloves to the Federal Government and a qualified domestic manufacturer that—</text><subparagraph id="id6eac292ca6b0436cb2f4b49ac0645c59"><enum>(A)</enum><text>has a term of not less than two years;</text></subparagraph><subparagraph id="id9297bd7be77d47d39bec01243386d8d2"><enum>(B)</enum><text>includes a binding minimum purchase commitment, minimum order quantity, or other enforceable commercially reasonable demand commitment sufficient to support domestic production planning and investment;</text></subparagraph><subparagraph id="id461cddc1f3e44e80a36dad75152aa1bf"><enum>(C)</enum><text>establishes pricing, delivery, quality assurance, and performance requirements;</text></subparagraph><subparagraph id="id59d9b622bb9942e0887cf847c96b24de"><enum>(D)</enum><text>identifies the qualified domestic manufacturer and the United States manufacturing facility that will manufacture the covered nitrile gloves;</text></subparagraph><subparagraph id="ida365100c84a54933a07d0554bf708030"><enum>(E)</enum><text>provides that covered nitrile gloves furnished under the agreement may not be substituted with products manufactured by another manufacturer unless approved by the covered agency through a modification of the supplier agreement; and</text></subparagraph><subparagraph id="iddc037e8dfd944c909c7100e8c1cd7f3d"><enum>(F)</enum><text>is enforceable directly between the contracting entity and the qualified domestic manufacturer.</text></subparagraph></paragraph></section><section id="ida52cbc0565584cda94747fdcd6c52be0"><enum>3.</enum><header>Application of Make PPE in America Act to AbilityOne-based nitrile glove procurements</header><subsection id="idc33d75e25e6e472c8f660f13d7113bee"><enum>(a)</enum><header>In general</header><text>If a covered agency procures covered nitrile gloves through a covered procurement vehicle, the agency shall ensure that such vehicle is structured to comply with the domestic sourcing and long-term contracting requirements contained in section 70953 of the Make PPE in America Act (subtitle C of title IX of <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1313).</text></subsection><subsection id="id265635f69da24a0ca38ea71a4b6620dd"><enum>(b)</enum><header>Supplier agreement requirement</header><text>A covered procurement vehicle may be used to furnish covered nitrile gloves to a covered agency if the vehicle includes, or is modified to include, one or more supplier agreements with qualified domestic manufacturers that satisfy the requirements of this Act. Such supplier agreements may be incorporated through an existing AbilityOne arrangement, authorized distributor arrangement, prime vendor arrangement, contract modification, ordering procedure, or other lawful procurement mechanism.</text></subsection><subsection id="idddf5e92a575148bdae68d168e65f746f"><enum>(c)</enum><header>Duration</header><text>Each supplier agreement required under subsection (b) shall have a term of not less than two years.</text></subsection><subsection id="id5209b2a9f1d844f2847dd1a1df0ff94c"><enum>(d)</enum><header>Exclusive domestic manufacturing requirement</header><text>Covered nitrile gloves furnished under a covered procurement vehicle shall be manufactured exclusively by qualified domestic manufacturers.</text></subsection><subsection id="idbb4349d2d2ba4e5aaa9d462581d1cb19"><enum>(e)</enum><header>No avoidance through intermediary contracting</header><text>A covered agency may not treat the use of an AbilityOne contract, central nonprofit agency arrangement, authorized distributor arrangement, prime vendor arrangement, or other intermediary contract structure as satisfying the long-term contracting purposes of the Make PPE in America Act (subtitle C of title IX of <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) unless the qualified domestic manufacturer of the covered nitrile gloves receives a supplier agreement meeting the requirements of this Act.</text></subsection><subsection id="id50ef3467b9c64391ba5254c2dc3d4e70"><enum>(f)</enum><header>Manufacturer continuity requirement</header><text>A covered procurement vehicle shall continue to source covered nitrile gloves from the qualified domestic manufacturer identified in the applicable supplier agreement throughout the term of that agreement unless—</text><paragraph id="id8c0480e4ea9e44f1bd9e82d26819827b"><enum>(1)</enum><text>the qualified domestic manufacturer consents in writing;</text></paragraph><paragraph id="idef67b8832439431b85cb4a9c52e52af9"><enum>(2)</enum><text>the covered agency determines that the manufacturer has materially failed to perform under the supplier agreement;</text></paragraph><paragraph id="id82e81d9e557f4d6cb8f7ffcc7c0250d1"><enum>(3)</enum><text>another exception applies as provided by Federal procurement law; or</text></paragraph><paragraph id="idd50019a17df743e28b4f32b9aec657c6"><enum>(4)</enum><text>any substitution of the qualified domestic manufacturer shall require a written modification to the supplier agreement and shall be documented in the contract file.</text></paragraph></subsection></section><section id="iddf08e5201e8449978049ad6b1ad7d981"><enum>4.</enum><header>Ownership and control requirement</header><subsection id="ida8fd7ce9f23d424b94a114ba46cfd04b"><enum>(a)</enum><header>In general</header><text>A manufacturer may not qualify as a qualified domestic manufacturer under this Act unless the manufacturer is majority-owned and controlled by United States persons.</text></subsection><subsection id="id45091063f85145988ca6f761ab982e84"><enum>(b)</enum><header>Foreign influence prohibition</header><text>A manufacturer may not qualify as a qualified domestic manufacturer if the manufacturer is owned, controlled, or subject to significant influence, directly or indirectly, by a foreign entity of concern, including through—</text><paragraph id="iddfed8e7720784364a88d0deb0c25779f"><enum>(1)</enum><text>a parent company, subsidiary, affiliate, or holding company;</text></paragraph><paragraph id="id3674adaa28814141aa2c3d7c9c145411"><enum>(2)</enum><text>a joint venture or partnership;</text></paragraph><paragraph id="id3437c75030094f37916452feab58e30d"><enum>(3)</enum><text>a contractual arrangement that gives a foreign entity effective control over production, pricing, supply, intellectual property, or operations;</text></paragraph><paragraph id="id1b458d553bee494899d464d0c2b1cb1d"><enum>(4)</enum><text>a financing arrangement that creates material foreign influence over the manufacturer;</text></paragraph><paragraph id="id1a6b48fab0964d7e912d5e198a3f21df"><enum>(5)</enum><text>a technology licensing arrangement that creates material dependence on a foreign entity of concern; or</text></paragraph><paragraph id="idbdceeda6c2cb4201a136dffff556f9b1"><enum>(6)</enum><text>any other arrangement determined by the head of the covered agency to present a supply chain, national security, or domestic manufacturing risk.</text></paragraph></subsection></section><section id="id8a31e0f00e7043a1b23ed485a81f32b0"><enum>5.</enum><header>Certification and enforcement</header><paragraph id="idbb25d2a3e35d41cb9dbfd924936c8956"><enum>(1)</enum><header>In general</header><text>For each covered procurement vehicle, the covered agency shall make and retain in the contract file a written certification that the vehicle is structured to comply with this Act, including that covered nitrile gloves are manufactured in the United States by qualified domestic manufacturers and that required supplier agreements have a term of not less than two years and include a minimum purchase quantity, minimum order volume, or other commercially reasonable demand commitment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75a1816944234abba02d03fccca466df"><enum>(2)</enum><header>Noncompliance</header><text display-inline="yes-display-inline">If a covered agency determines that a covered procurement vehicle is not in compliance with this Act, the agency shall take appropriate corrective action under applicable Federal procurement law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e44c946c605447a8f333a2dad3d5720"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as imposing a separate statutory certification obligation on the AbilityOne Program, a qualified nonprofit agency, a central nonprofit agency, an authorized distributor, a prime contractor, or a qualified domestic manufacturer.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id70c9cb8d11a44c428642fb3abb0a38d6"><enum>6.</enum><header>Rules of construction regarding procurement sourcing</header><subsection id="idec10e5458ee44f08938942868ead8e9e"><enum>(a)</enum><header>AbilityOne preserved</header><text>Nothing in this Act shall be construed to prohibit the use of the AbilityOne Program for the procurement of covered nitrile gloves.</text></subsection><subsection id="ideceb8ab05e2e451c9d58b12821914421"><enum>(b)</enum><header>No displacement required</header><text>Nothing in this Act shall be construed to require a covered agency to remove covered nitrile gloves from the Procurement List or to terminate an AbilityOne arrangement solely because the covered nitrile gloves are supplied through a qualified domestic manufacturer.</text></subsection><subsection id="id0ecdba58a21247ad9885d4c02e70b7fc"><enum>(c)</enum><header>Domestic manufacturing protected</header><text>Nothing in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/85">chapter 85</external-xref> of title 41, United States Code, or any regulation, contract, Procurement List designation, or distribution arrangement under that chapter shall be construed to permit a covered agency to avoid the domestic sourcing, ownership and control, certification, enforcement, or long-term supplier agreement requirements of this Act.</text></subsection></section><section id="idd6e1e4876c6e45d3900ede59c31e6a45"><enum>7.</enum><header>Implementation</header><subsection id="id4674c6c7579a4c159ed0afa9c2ad60a5"><enum>(a)</enum><header>In general</header><text>The head of each covered agency shall implement this Act through existing procurement authorities and shall ensure that any covered procurement vehicle in effect on or after the date of the enactment of this Act, including any vehicle previously entered into, accepted, awarded, expanded, or made available for use by another Federal agency, complies with this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide370934038d7448f9eae2618d58a1a52"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require the termination, cancellation, or re-competition of an existing covered procurement vehicle if the vehicle can be brought into compliance through modification, supplier agreements, ordering procedures, or other existing procurement authorities.</text></subsection></section></legis-body></bill>
