<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5236</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260804">August 4, 2026</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to ensure Medicaid coverage of mental health services and primary care services furnished on the same day.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Coordination and Access to Resources Equitably for Youth Act</short-title></quote> or the <quote><short-title>Improving CARE for Youth Act</short-title></quote>.</text></section><section id="idDF7F8135FD184AF9BDD5A4F6D0B10BD8"><enum>2.</enum><header>Medicaid coverage of mental health services and primary care services furnished on the same day</header><subsection id="id4e5f506c83de43918e65cbaf95b54f9a"><enum>(a)</enum><header>In general</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><paragraph id="idDC5653C8F4C04175839FC2D0ACEDE751"><enum>(1)</enum><text>in paragraph (89), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="id512C546E301C4AC7B8A5FFEF139B4296"><enum>(2)</enum><text>in paragraph (90)(C), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id00844179EE5D4667B1592E9C5965D2B8"><enum>(3)</enum><text>by inserting after paragraph (90)(C) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id088A0D61A6D94D90A39A638A098BA1B8"><paragraph id="id4e2a16e34c4c49e0abb39a25d87d5314"><enum>(91)</enum><text>not prohibit payment under the plan for a mental health service or primary care service furnished to an individual for which payment would otherwise be payable under the plan, with respect to such individual, if such service were not a same-day qualifying service (as defined in subsection (zz)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idca5c65f929924359b057b2486e5ab7c8"><enum>(b)</enum><header>Same-Day qualifying services defined</header><text>Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5E7E400EB3B646BEA2F815E07CF4AAA6"><subsection id="id05569b072c8b4999ace09f6b9e090fef"><enum>(zz)</enum><header>Same-Day qualifying services defined</header><text>For purposes of subsection (a)(91), the term <term>same-day qualifying service</term> means—</text><paragraph id="idf006701087fa4e0f804f4865afddda85"><enum>(1)</enum><text>a primary care service furnished to an individual by a provider at an office, clinic, or other outpatient facility on the same day a mental health service is furnished to such individual by such provider (or another provider) at the same office, clinic, or other outpatient facility; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12fe32708a844d8fbc2c6153fc90bb1a"><enum>(2)</enum><text>a mental health service furnished to an individual by a provider at an office, clinic, or other outpatient facility on the same day a primary care service is furnished to such individual by such provider (or another provider) at the office, clinic, or other outpatient facility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
