        <paragraph commented="no" display-inline="no-display-inline" id="idd9b8217d245743368c18204dceabdb39">
          <enum>(1)</enum>
 <text>in subsection (a)(6)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2e4a365694994d488680ee769ffed6cd"> <enum>(A)</enum> <text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text>
          </subparagraph>
          <subparagraph commented="no" display-inline="no-display-inline" id="idaa4f899cb81144628eb2d25fd812cb5c">
            <enum>(B)</enum>
 <text display-inline="yes-display-inline">in subparagraph (B), by striking the semicolon and inserting <quote>; or</quote>; and</text>

            <enum>(D)</enum>

                <enum>(E)</enum>
 <text>in the case of an offense under paragraph (3) of subsection (a) in which the amount of access devices that are counterfeit or unauthorized exceeds 1,000 devices, a fine under this title or imprisonment for not more than 30 years, or both.</text>
              </subparagraph>

            <enum>(B)</enum>
 <text>in paragraph (10), by striking <quote>; and</quote> and inserting a semicolon;</text>

            <enum>(C)</enum>

 <text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ida1d6381c007348b59288273064613a20"> <paragraph id="id5238fbd2c67d424eada004f8768efde2"> <enum>(12)</enum> <text>the term <term>gift card</term> means a physical or virtual card, code, or device that may be issued to a consumer on a prepaid basis, in whole or in part, for personal, family, or household purposes in a specified amount, regardless of whether that amount may be increased or reloaded in exchange for payment, and that is redeemable upon presentation by a consumer at a single merchant, a group of affiliated merchants, or a group of unaffiliated merchants, including gift card redemption information.</text>

          </subparagraph>
        </paragraph>
 </subsection><subsection id="id6d066de7816544fa9072d21a731a9e7c"><enum>(b)</enum><header>Increased penalties for fraud against persons over the age of 60</header><paragraph commented="no" display-inline="no-display-inline" id="id6cb7e87e99c84d1b8aba1b6796f3ac63"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1029">section 1029</external-xref> the following:</text><quoted-block id="id88ec17fda3d04261b20c556a513a422b" display-inline="no-display-inline" style="USC"><section commented="no" display-inline="no-display-inline" id="ida194c843e386438481dc25bd595a0b66"><enum>1029A.</enum><header>Fraud against persons over the age of 60</header><subsection id="id86528530eaff4d4296ed60a5affdd619"><enum>(a)</enum><header>Definition</header><text>For purposes of this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id166083e77f3f40e2a704aa273b671ceb"><enum>(1)</enum><header>Covered felony violation</header><text display-inline="yes-display-inline">The term <term>covered felony violation</term> means any offense that is a felony violation of—</text><subparagraph id="id01d460edd82d431db03ba0784cec5c45"><enum>(A)</enum><text>any provision contained in this chapter (relating to fraud and false statements), other than this section; and</text></subparagraph><subparagraph id="id948dbe5a00444de18ab888d3d0237128"><enum>(B)</enum><text>any provision contained in chapter 63 (relating to mail, bank, and wire fraud).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf37703e8281e4b658524c65a216e46f9"><enum>(2)</enum><header>Knowingly</header><text>The term <term>knowingly</term> means that the defendant acts with actual knowledge of the victim’s age, deliberate ignorance of the victim’s age, or with reckless disregard for the victim’s age.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb104436110fa461faf948a57b00e15d7"><enum>(b)</enum><header>Offense</header><text>Whoever, during and in relation to any covered felony violation, knowingly commits such offense against a person over the age of 60 shall be sentenced to a term of imprisonment of 2 years, in addition to the term of imprisonment imposed for the covered felony violation.</text></subsection><subsection id="ide6c6b78aa2814897bc369f95e38fd704"><enum>(c)</enum><header>Consecutive sentence</header><text>Notwithstanding any other provision of law—</text><paragraph id="id36b6b98a82da40a49efbff0359ca7b6a"><enum>(1)</enum><text>a court shall not place on probation any person sentenced under subsection (b), nor shall the term of imprisonment imposed on a person under subsection (b) run concurrently with any other term of imprisonment, except as provided in paragraph (2); and</text></paragraph><paragraph id="idde2bbc2d380845dabbbb13427e3a6317"><enum>(2)</enum><text>a term of imprisonment imposed on a person under this section may, in the discretion of the court, run concurrently, in whole or in part, only with another term of imprisonment that is imposed by the court at the same time on that person for an additional violation of this section, provided that such discretion shall be exercised in accordance with any applicable guidelines and policy statements issued by the United States Sentencing Commission pursuant to section 994 of title 28.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide41dac294e8c42e39f75a15d1658822f"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by inserting the following item after the item for section 1029:</text><quoted-block style="USC" id="idb5dedba8-3f01-4d4b-9eec-c95a0b5f9836"><toc><toc-entry level="section">1029A. Fraud against persons over the age of 60.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfb80794d24f64f0f8b0e9d7cb6340b02"><enum>(c)</enum><header>Defining monetary instruments</header><text display-inline="yes-display-inline">Section 1956(c)(5) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3710492a9f524e05a9ea019095848262"><enum>(1)</enum><text>by striking <quote>means (i) coin or currency</quote> and inserting the following: “means—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3068562597b441e2a25d879af2e2f9d1"><subparagraph commented="no" display-inline="no-display-inline" id="id3cb5e8ffe8fb482990e2d04ea9243404"><enum>(A)</enum><text display-inline="yes-display-inline">coin or currency</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc61b952cb9aa446ba72b34d6cd6eec48"> <enum>(2)</enum> <text>by striking <quote>, or (ii) investment securities</quote> and inserting the following: “;</text>
          <quoted-block style="OLC" display-inline="no-display-inline" id="id79881eb01fc04a96b9960186f14e8ab5">
            <subparagraph commented="no" display-inline="no-display-inline" id="id694849e431b84b99953cb2a07352f191">
              <enum>(B)</enum>
