which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require social media platform providers to obtain parental consent with respect to children creating or maintaining accounts or profiles on their platforms, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Approval for Youth Social Media Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7a99e4d264344ab9895e9d45a6b38efa" section-type="subsequent-section"><enum>2.</enum><header>Requiring parental consent for children to access social media</header><subsection commented="no" display-inline="no-display-inline" id="idbd8fbc03d192470fb1f834897f44cf6d"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text>Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="ida923c56f635a44c99e605f02eb1fb376"><enum>(1)</enum><text>Social media use by children has been linked to mental health and developmental harms.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf931736af5349a2a247b30ce14ff318"><enum>(2)</enum><text>Certain social media platform features, including recommendation algorithms and engagement-maximizing designs, may exacerbate those harms.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff211291f8154d48ba1162d186594b88"><enum>(3)</enum><text>Children require additional protections online.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2bf943d4a20e46588a6dd50da4eecc4a"><enum>(b)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="idcac59a03081c47d9b968df9b6a27e578"><enum>(1)</enum><header>Requiring verifiable parental consent for children to create or maintain social media platform accounts</header><subparagraph commented="no" display-inline="no-display-inline" id="id11be5158e8904227a38442ba5b632b92"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Unless a social media platform provider has received verifiable parental consent from the parent of a user that the social media platform provider knows or should know is a child, such social media platform provider may not allow such child to create or maintain an account or profile on the social medial platform of the provider.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd45d9375674e42098e7cfe1ad941baf7"><enum>(B)</enum><header>Parent-supervised account</header><text>If a social media platform provider receives verifiable parental consent for a child to create and maintain an account or profile on the social media platform of the provider, such social media platform provider shall ensure that such account or profile is a parent-supervised account.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddef97c4a18c04269bb097f345f7a3763"><enum>(2)</enum><header>Age and parental consent verification</header><subparagraph commented="no" display-inline="no-display-inline" id="id90ffd4ce29f4451cbe8577f51595db11"><enum>(A)</enum><header>In general</header><text>A social media platform provider shall take reasonable steps to determine—</text><clause commented="no" display-inline="no-display-inline" id="idc2bb910836414091b847b4a28f74b77d"><enum>(i)</enum><text display-inline="yes-display-inline">whether a user of the social media platform is a child; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id70416ef8171540efac4fc0ed464cb075"><enum>(ii)</enum><text>in the event the social media platform provider determines that a user is a child—</text><subclause commented="no" display-inline="no-display-inline" id="id1adc49c7cdbf49d1844934e5eb7705c0"><enum>(I)</enum><text display-inline="yes-display-inline">whether verifiable parental consent has been obtained; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id410b9701496b4e2f911edc73bfadab23"><enum>(II)</enum><text>whether the account of such child is a parent-supervised account.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6805d4bb77e40eab95020595617f809"><enum>(B)</enum><header>Use of information</header><text>A social media platform provider—</text><clause commented="no" display-inline="no-display-inline" id="idc18a2e7ee1e940d8ac050c60fa722381"><enum>(i)</enum><text display-inline="yes-display-inline">may not use any information collected in complying with subparagraph (A) for any other purpose; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id38056a228d95444589055bfcc2439f46"><enum>(ii)</enum><text>shall, unless required by other applicable law, delete such information—</text><subclause commented="no" display-inline="no-display-inline" id="idd50e4dfdd01a49d7a742873b4a85032c"><enum>(I)</enum><text display-inline="yes-display-inline">when the user to which such information applies turns 16 years of age; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id801962e0a8064631aac95d16358fcbba"><enum>(II)</enum><text>if the user to which such information applies deletes their account or profile before the date the user turns 16 years of age, when the user deletes their account or profile.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a8b8d6cf5ba445c93b9d669e0cd3312"><enum>(3)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Commission may promulgate regulations establishing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8d7ca1b47cde48838a55f75f7ac51214"><enum>(A)</enum><text display-inline="yes-display-inline">acceptable methods by which a social media platform provider may determine whether a user of the platform is a child;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id134492ad572d46a883fb74c5ca2e8b9a"><enum>(B)</enum><text>acceptable methods by which a social media platform provider may obtain and verify parental consent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60493aed6e1d43d6b26907d5fe5bac43"><enum>(C)</enum><text>minimum requirements for parent-supervised accounts.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id28a3f87557354822af1ff5565c0daff5"><enum>(c)</enum><header>Enforcement</header><paragraph commented="no" display-inline="no-display-inline" id="id8dbc04d6f137490d89223085a4c1149f"><enum>(1)</enum><header>Enforcement by the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id5fa717532a3143068206c79ff7d4e246"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act or a regulation promulgated under this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id271a4277797c45fdb6811006160df967"><enum>(B)</enum><header>Powers of the Commission</header><clause commented="no" display-inline="no-display-inline" id="id89f0c24763e642b48875cc4613c08c5e"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9d0433a08f3846e0b9dd8f4ebb33988c"><enum>(ii)</enum><header>Privileges and immunities</header><text>Any person who violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></clause><clause commented="no" display-inline="no-display-inline" id="id3ce2a0ef8ce2471db2496c5fd071504c"><enum>(iii)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1568bbc89f2a48518387831ad0afba7a"><enum>(iv)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0f9b0a2338f4a428c76fe18866d203f"><enum>(2)</enum><header>Enforcement by States</header><subparagraph commented="no" display-inline="no-display-inline" id="id38549a520e824c9ba38cb06c50e68d6c"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States to—</text><clause commented="no" display-inline="no-display-inline" id="id5b3e01d188aa495abe432837c765273e"><enum>(i)</enum><text>enjoin further violation of this Act by such person;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0cbc7ace04184711847f8c5a27995211"><enum>(ii)</enum><text>compel compliance with this Act;</text></clause><clause commented="no" display-inline="no-display-inline" id="id634b2395fc2d4a97b7e1ebd2a820c5e5"><enum>(iii)</enum><text>obtain damages, restitution, or other compensation on behalf of such residents; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id35a78395f0df462ba4785a476d4a1a8d"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70e6c890ca2c4b86ab83908201d8a783"><enum>(B)</enum><header>Rights of the Commission</header><clause commented="no" display-inline="no-display-inline" id="id1a6c0eb4af904ab1ac1d5b5246c77c3a"><enum>(i)</enum><header>Notice to the Commission</header><subclause commented="no" display-inline="no-display-inline" id="id7d0a7b980dc74ca39e51d6ed7c7a0c1d"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (III), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under subparagraph (A) before initiating the civil action.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc4a705bb3f5447668e092013b7ec56a1"><enum>(II)</enum><header>Contents</header><text>The notification required by subclause (I) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</text></subclause><subclause id="idfb110e2694e14221855646531bae61df"><enum>(III)</enum><header>Exception</header><text>If it is not feasible for the attorney general of a State to provide the notification required by subclause (I) before initiating a civil action under subparagraph (A), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id630e8d1989214816a2443109e8718a80"><enum>(ii)</enum><header>Intervention by the Commission</header><text>The Commission may—</text><subclause commented="no" display-inline="no-display-inline" id="id9ef31ed03d8a4bc39091e532e851bdd8"><enum>(I)</enum><text>intervene in any civil action brought by the attorney general of a State under subparagraph (A); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id84f81cd2452f4e649aaacf777b1498fb"><enum>(II)</enum><text>upon intervening—</text><item commented="no" display-inline="no-display-inline" id="iddd1ecda5089e460297ad51df24b15225"><enum>(aa)</enum><text>be heard on all matters arising in the civil action; and</text></item><item commented="no" display-inline="no-display-inline" id="id1d9a4e9049f54e338720ad86a2381006"><enum>(bb)</enum><text>file petitions for appeal of a decision in the civil action.</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3bb2ca3fb10446a78c3504e35a4466b9"><enum>(C)</enum><header>Investigatory powers</header><text>Nothing in this paragraph may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide617181e401e4e008933e1aa71c7cd19"><enum>(D)</enum><header>Action by the Commission</header><text>If the Commission institutes a civil action or an administrative action with respect to a violation of this Act, the attorney general of a State may not, during the pendency of such action, bring a civil action under subparagraph (A) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</text></subparagraph><subparagraph id="idcff2538f38434c14910100a4ab458a8b"><enum>(E)</enum><header>Venue; service of process</header><clause commented="no" display-inline="no-display-inline" id="iddf02158b2f314e6cba19361800d273be"><enum>(i)</enum><header>Venue</header><text display-inline="yes-display-inline">Any action brought under subparagraph (A) may be brought in—</text><subclause commented="no" display-inline="no-display-inline" id="id0f397f02418140028f1398f116b754d9"><enum>(I)</enum><text>the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida03293672e534469bccfa03e117a769c"><enum>(II)</enum><text>another court of competent jurisdiction.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="iddfe7d737f3cc4145ba3f24261adee5b1"><enum>(ii)</enum><header>Service of process</header><text>In an action brought under subparagraph (A), process may be served in any district in which the defendant—</text><subclause commented="no" display-inline="no-display-inline" id="id1ca4643ce1e3450baf1575718ae46b5b"><enum>(I)</enum><text>is an inhabitant; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id236d6bd1640a4f8fa692f86fc323c350"><enum>(II)</enum><text>may be found.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8025db1fd6c647b68077f78caff8704f"><enum>(F)</enum><header>Actions by other State officials</header><clause commented="no" display-inline="no-display-inline" id="id073bb1183b8b476bb4bd56a2c33b8347"><enum>(i)</enum><header>In general</header><text>In addition to civil actions brought by attorneys general under subparagraph (A), any other officer of a State who is authorized by the State to do so may bring a civil action under subparagraph (A), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6f48eecdc4c44b76ac37ccf4c523367b"><enum>(ii)</enum><header>Savings provision</header><text>Nothing in this paragraph may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f9f85b62cf7457a8b8db7ffc88e0e77"><enum>(d)</enum><header>Definitions</header><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id92ce78ed2b4845b78fa088db06174d91"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual who has not attained 16 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ff5d09c07d94b37be79e42c31936e4c"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ae3edeb42c94b7895c89ef027e26bc0"><enum>(3)</enum><header>Educational platform</header><text>The term <term>educational platform</term> means a district-sanctioned or school-sanctioned learning management system or school information system used for the education of students.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide20d589789ad4b22baed472198f0055f"><enum>(4)</enum><header>Parent</header><text>The term <term>parent</term> includes a legal guardian of a child.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5cef7abc3d3d4192b53ed9860e707658"><enum>(5)</enum><header>Parent-supervised account</header><text>The term <term>parent-supervised account</term> means an account or profile of a child on a social media platform that provides a parent of such child with meaningful oversight tools that allow such parent to supervise and manage such child's use of the social media platform, including tools such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="id29a9e5c13f7147d1b912f285b6f4bde5"><enum>(A)</enum><text display-inline="yes-display-inline">the ability to access and manage the privacy and account settings of the account or profile;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2f70243f3f44f1db6cd090fbceb56bf"><enum>(B)</enum><text>the ability to establish or modify time limits regarding the child's use of the social media platform;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id445cb69501aa4229b913d795c6a8a4a7"><enum>(C)</enum><text>the ability to limit or disable direct messages or other private communications with other users of the social media platform;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3dc235fb58f14df6b7b7966b7794371e"><enum>(D)</enum><text>the ability to limit, approve, or disable purchases and other financial transactions on the social media platform;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9621d2215f54f5b91467c1d41ae4030"><enum>(E)</enum><text>the ability to manage who may contact, follow, or otherwise interact with the account or profile;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id720d3b491fe44254af0aef4ca2beb5b9"><enum>(F)</enum><text>the ability to view the child's activity and use of the social media platform; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfe2f6525cb5f4e328b997d09c4d4051c"><enum>(G)</enum><text>any additional oversight tools determined by the Commission to be appropriate through rulemaking.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe7ada779b8b46c6aa51db9c8bf10b53"><enum>(6)</enum><header>Social media platform</header><subparagraph commented="no" display-inline="no-display-inline" id="id3dbcf26ce8dd49efb3ee868c2edcf872"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>social media platform</term>—</text><clause id="id015832c5d7404b56b44ca4b8081ae673"><enum>(i)</enum><text>means a website or internet medium that—</text><subclause commented="no" display-inline="no-display-inline" id="id556a31fbb9574ad09d82a02847927d66"><enum>(I)</enum><text display-inline="yes-display-inline">permits a person to become a registered user, establish an account, or create a profile for the purpose of allowing users to create, share, and view user-generated content through such an account or profile;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a20f4e8cac84bd69c874fb3f2a55bce"><enum>(II)</enum><text display-inline="yes-display-inline">enables 1 or more users to generate content that can be viewed by other users of the website or internet medium; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide6aa8c948ae24797a40a2179c4c066d6"><enum>(III)</enum><text display-inline="yes-display-inline">primarily serves as a medium for users to interact with content generated by other users of the website or internet medium; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5ef6337427a6435a814b47790f49191c"><enum>(ii)</enum><text>does not include—</text><subclause commented="no" display-inline="no-display-inline" id="id9664092cf0e24b3b90858f49950d808c"><enum>(I)</enum><text>an email service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb0e1a80a357a4a0e965d04966bdc4b0d"><enum>(II)</enum><text>a text messaging service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id518da5aa6bf74ee2a9e9c25ed3ce6638"><enum>(III)</enum><text>an educational platform;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idffb096842a164dc7bcba0ba625caaa1c"><enum>(IV)</enum><text>a video conferencing service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idba32b8eb68f842a790c6068d066e1e1b"><enum>(V)</enum><text>online gaming where social interaction is incidental to the game being played; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id42e9efa650ad4405b194b86a9f174cc4"><enum>(VI)</enum><text>a communication service or tool where social interaction is incidental to the primary function of such service or tool.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06f1709131c44f799cfb98c6a7cc7cc3"><enum>(B)</enum><header>FTC ruleamking Authority</header><text>In order to address evolving technologies and platforms, the Commission may promulgate in accordance with section 553 of title 5, United States Code, rules to determine what websites or internet mediums meet the definition of <term>social media platform</term>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03d23091adfb4c92aec70fb3ca7ea905"><enum>(7)</enum><header>Social media platform provider</header><text>The term <term>social media platform provider</term> means any person who, for commercial purposes in or affecting commerce, provides, manages, operates, controls, or manufacturers a social media platform.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0953505b96243378c97ff5fb5819fad"><enum>(8)</enum><header>Text messaging service</header><text>The term <term>text messaging service</term> means a wireless messaging service, including such a service provided through short message service or multimedia messaging protocols that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idde2de54ad370404e8e70e76dba0f9602"><enum>(A)</enum><text display-inline="yes-display-inline">is not a component of, or linked to, a social media platform; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3efa4fde709044e79ff598f21bad0e97"><enum>(B)</enum><text>has a predominant or exclusive function of direct messaging consisting of the transmission of text, photos, or videos sent—</text><clause commented="no" display-inline="no-display-inline" id="idb24e7fb2540b4e10b38fb0678f6f7d31"><enum>(i)</enum><text display-inline="yes-display-inline">by electronic means;
