which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to provide for a State-sponsored nonimmigrant pilot program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF8D49DBCD5A245BEB801F683C74C7A7B"><section section-type="section-one" id="H6ADD3B902DD647209D3EE2359D055568"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State-Sponsored Visa Pilot Program Act of 2026</short-title></quote>.</text></section><section id="H2B418F5C526842F790950CFE45382F64"><enum>2.</enum><header>State-sponsored nonimmigrant program</header><text display-inline="no-display-inline">Section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) is amended—</text><paragraph id="HC550CEBABE0A4EFE80527195D848CA06"><enum>(1)</enum><text>in subparagraph (U)(iii), by striking the <quote>or</quote> at the end;</text></paragraph><paragraph id="H39B4BFE755114F4B9D09518BDC0505F3"><enum>(2)</enum><text>in subparagraph (V), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H5D747AEE04744E11A0985793E3B59AE7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HDD6FF538D55C4D0C86EAA7D6CFD1510B"><subparagraph commented="no" id="H30D80AAB49D74D8A8A202F6844D689D0" indent="up1"><enum>(W)</enum><clause commented="no" display-inline="yes-display-inline" id="HB94AE6A328C74CC697CFF3124B669948"><enum>(i)</enum><text>an alien who is sponsored by a State and is coming temporarily to the United States to reside in such State to perform services, provide capital investment, direct the operations of an enterprise, or otherwise contribute to the economic development agenda of such State in a manner determined by the State; and</text></clause><clause commented="no" indent="up1" display-inline="no-display-inline" id="idb612adddcb9749589dd1a19c20ed321e"><enum>(ii)</enum><text display-inline="yes-display-inline">the alien spouse and minor children of any alien described in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4BABAD3D4FF14F1AABBB90795F30232B"><enum>3.</enum><header>Admission of State-sponsored nonimmigrants</header><subsection id="HCC90DDC9C0414F62BD4C7D702AF0CD43"><enum>(a)</enum><header>Requirements for State-Sponsored nonimmigrants</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended—</text><paragraph id="HBB556B62EC2E464089C94D38D983CBB0"><enum>(1)</enum><text>in subsection (h), by striking <quote>(H)(i)(b) or (c), (L), or (V)</quote> and inserting <quote>(H)(i)(b), (H)(i)(c), (L), (V), or (W)</quote>; and</text></paragraph><paragraph id="H11A9F1DBEF23488DB1809FF418001A12"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H68D2A4EAEA7B48C5BDDA10BFBCEF350D"><subsection id="HB503B2DD69AD45568E9C6408204FA49A"><enum>(s)</enum><header>Requirements applicable to State-Sponsored nonimmigrant visas</header><paragraph id="HACAE9EFA5EB5432FB4C0755D7B9864FC"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H1DFFBD5FAE904F86B378F31A7502C9A3"><enum>(A)</enum><header>Reside</header><text>The term <term>reside</term> means to live and establish a residence in a State for a consecutive period of more than 14 days (not including any period after the approval of the resident’s petition for immigrant status).</text></subparagraph><subparagraph id="H3952557E139148E293D580D5B00CCB87"><enum>(B)</enum><header>Secretary</header><text>Except as otherwise specifically provided in this subsection, the term <term>Secretary</term> means the Secretary of Homeland Security.</text></subparagraph><subparagraph id="HE769167A93464280A0A86759FC818069"><enum>(C)</enum><header>State</header><text>Notwithstanding section 101(a)(36), the term <term>State</term> means a State of the United States and the District of Columbia.</text></subparagraph><subparagraph id="HF44EB343D98D41F787EA97EDECFCA018"><enum>(D)</enum><header>State-sponsored nonimmigrant</header><text>The term <term>State-sponsored nonimmigrant</term> means an alien who has been sponsored by a State for admission under section 101(a)(15)(W).</text></subparagraph><subparagraph id="H76EEA508DD6B43EFBFC9AC6646FAE636"><enum>(E)</enum><header>State-sponsored nonimmigrant program</header><text>The term <term>State-sponsored nonimmigrant program</term> means a nonimmigrant program to regulate the employment, investment, and place of residence of State-sponsored nonimmigrants.</text></subparagraph><subparagraph id="HF9C5221535DA4AECBBB5FB67CC6086E8"><enum>(F)</enum><header>State-sponsored nonimmigrant status</header><text>The term <term>State-sponsored nonimmigrant status</term> means status granted to an alien admitted as a nonimmigrant pursuant to section 101(a)(15)(W).</text></subparagraph></paragraph><paragraph id="H4CE2C2335CF044449FE0204B83ADFC32"><enum>(2)</enum><header>State-sponsored nonimmigrant program</header><text>Any State may submit an application to the Secretary to participate in the State-sponsored nonimmigrant program by sponsoring aliens for admission to the United States.</text></paragraph><paragraph id="HEE93E900140A45C8A6A9ED63204A2956"><enum>(3)</enum><header>State-sponsored nonimmigrant program approval</header><text>The Secretary shall approve any application submitted by a State (or compact of States) pursuant to paragraph (2) for a State-sponsored nonimmigrant program that—</text><subparagraph id="HEC47F12A266440AD8897357201704D94"><enum>(A)</enum><text>was approved by the legislature of the State;</text></subparagraph><subparagraph id="H474351FBC0E64E9CA1F5B8EEC7306255"><enum>(B)</enum><text>regulates, in a manner determined by the State, the employment and residence of State-sponsored nonimmigrants;</text></subparagraph><subparagraph id="H5B38400C64F54148888560D7C3B025E7"><enum>(C)</enum><text>implements procedures, in a manner determined by the Secretary, to inform the Secretary of the failure of a nonimmigrant to comply with the terms of State-sponsored nonimmigrant status when the State is made aware of such failure;</text></subparagraph><subparagraph id="H52299E59C4794D809BDA3194B4657838"><enum>(D)</enum><text>allows, in a manner determined by the State, a State-sponsored nonimmigrant who has been admitted to seek employment with an employer other than the employer with which the nonimmigrant was initially employed; </text></subparagraph><subparagraph id="id51969b6635194c4bbab771065b862229"><enum>(E)</enum><text>implements procedures to periodically assess labor needs and occupational wage data in the State;</text></subparagraph><subparagraph id="idb667aea9f12b4ea2adb0bd260a1565b7">
                  <enum>(F)</enum>
 <text>establish mechanisms to receive and investigate complaints of United States worker displacement in the State;</text>
 </subparagraph><subparagraph id="id344f5843bda9446d8c6923fbbc9504b7"><enum>(G)</enum><text>attests, in a form to be determined by the Secretary, that the hiring of the State-sponsored nonimmigrant has not displaced and will not displace a United States worker; and</text></subparagraph><subparagraph id="H800F410F5D5D433DAF5A042A7B76C29B"><enum>(H)</enum><text>implements procedures, in a manner determined by the Secretary, to annually inform the Secretary of the place of residence and employment of all State-sponsored nonimmigrants residing in the State.</text></subparagraph></paragraph><paragraph id="H7EEAADCDA80945AC814F9AF9D5DFB31F"><enum>(4)</enum><header>State petition</header><subparagraph id="H22ABA4181D10419D81FEA1EF4393E5AE"><enum>(A)</enum><header>In general</header><text>A State that participates in the State-sponsored nonimmigrant program shall submit a petition in such form and containing such relevant information as the Secretary shall specify to sponsor an alien under this subsection.</text></subparagraph><subparagraph id="H3E55E271E50347B7A2A5ACA961895577"><enum>(B)</enum><header>Approval</header><text>A visa may not be granted to an alien described in subparagraph (A) until the Secretary approves a petition submitted pursuant to subparagraph (A). Such approval does not, of itself, establish that the alien is a State-sponsored nonimmigrant.</text></subparagraph><subparagraph id="H6863C86345384BFF8F519BB0D2E5B702"><enum>(C)</enum><header>Fee</header><text>The Secretary may require a State that submits a petition pursuant to subparagraph (A) to pay a reasonable fee of an amount that is sufficient to cover, but not exceed, the cost of processing the application.</text></subparagraph><subparagraph id="idea9503ae8a4f4f83bfcbaf5e21d32ca9"><enum>(D)</enum><header>Fee waiver for domestic workforce investment</header><text>The Secretary shall waive any fee otherwise required under subparagraph (C) with respect to a State that demonstrates its State-sponsored nonimmigrant program assesses a fee that is allocated by the State to fund workforce investment activities carried out in the State.</text></subparagraph></paragraph><paragraph id="H36F8A5C685D142A1A34670B59F3A3D56"><enum>(5)</enum><header>State-sponsored nonimmigrants</header><text display-inline="yes-display-inline">The Secretary of State shall approve a nonimmigrant visa for an alien and the Secretary of Homeland Security shall admit such alien to the United States as a State-sponsored nonimmigrant or grant State-sponsored nonimmigrant status to the alien if the alien—</text><subparagraph id="HC3A0941B5C6F4F9BACC3EC51326DB89D"><enum>(A)</enum><text>is otherwise admissible under this Act;</text></subparagraph><subparagraph id="H53265C03780E4E948030415A4D5A55E9"><enum>(B)</enum><text display-inline="yes-display-inline">passes a comprehensive background check conducted by the National Vetting Center to ensure such alien does not pose a security risk to the United States;</text></subparagraph><subparagraph id="H3D60B28625654828BC3BD7DCC04CDEB5"><enum>(C)</enum><text>is petitioned for by a State that participates in the State-sponsored nonimmigrant program approved by the Secretary pursuant to paragraph (3);</text></subparagraph><subparagraph id="H8E029705CC154849A81920219CE659E0"><enum>(D)</enum><text>has not previously violated any term or condition of State-sponsored nonimmigrant status; and</text></subparagraph><subparagraph id="H5AE7F5B11E124AA191DF3A652FEE4EEA"><enum>(E)</enum><text>has paid any bond that the State may require under paragraph (13).</text></subparagraph></paragraph><paragraph id="H7597660FC1B64B9E8F152AF363DC16EB"><enum>(6)</enum><header>Period of authorized status</header><subparagraph id="H01F4639C5BE049C6BE2B539EA25171B7"><enum>(A)</enum><header>In general</header><text>The period of authorized status for a State-sponsored nonimmigrant shall be a period determined by the State, but may not exceed 3 years.</text></subparagraph><subparagraph id="H16A5C401B4A44A2A8D2C217EC1FFDEA3"><enum>(B)</enum><header>Renewal</header><clause id="H81EB02818BE34EB7B2E6E78B17CD960F"><enum>(i)</enum><header>Location</header><text>Subject to clause (ii), the period of authorized status under subparagraph (A) shall be renewable inside or outside of the United States.</text></clause><clause id="H6971A9876AB4444588BFB489615DC04F"><enum>(ii)</enum><header>Condition</header><text>Renewals under clause (i) may be granted only if—</text><subclause id="H629D785992D64D1EA9FAE99888D13524"><enum>(I)</enum><text>the sponsoring State requests such renewal; and</text></subclause><subclause id="HB1E953C3419E4938BD5B82E9FC7CEED6"><enum>(II)</enum><text display-inline="yes-display-inline">the State-sponsored nonimmigrant has resided continuously in such sponsoring State, or States subject to an interstate compact (not including any period of residence after the approval of a petition for immigrant status of which the alien is a beneficiary).</text></subclause></clause></subparagraph><subparagraph id="HAA92E9C5652A4DF19B3675E7396585B6"><enum>(C)</enum><header>Termination</header><text>The Secretary shall terminate the period of authorized status as a State-sponsored nonimmigrant if—</text><clause id="H83180A382CFF4D3DA65193933393F61D"><enum>(i)</enum><text>the State-sponsored nonimmigrant resides or works outside of the State, or States subject to an interstate compact under paragraph (7), that sponsored the alien;</text></clause><clause id="H64BD1D49B46C4CD59A9B95FF230AE67A"><enum>(ii)</enum><text>the State-sponsored nonimmigrant, after sufficient notice, fails to follow all rules and regulations required by the State, as determined by the State (following any appeals process established by the State); or</text></clause><clause id="H98BED3A35093443887D4366301E4EC0E"><enum>(iii)</enum><text>the State that sponsored the State-sponsored nonimmigrant, after sufficient notice to such State-sponsored nonimmigrant, requests termination of such status (following any appeals process established by the State) unless another State sponsors the nonimmigrant.</text></clause></subparagraph><subparagraph id="HA7F4EA79DE164C33B20ABF62EF89FA3F"><enum>(D)</enum><header>Employment authorization</header><clause id="HFC4CD0B66B4448D8B6C39F1B946038B4"><enum>(i)</enum><header>In general</header><text>All aliens admitted as State-sponsored nonimmigrants under section 101(a)(15)(W)—</text><subclause id="HC09BF1B3B8274350A66951F7C72473B5"><enum>(I)</enum><text>shall be authorized for employment for purposes of section 274A; and</text></subclause><subclause id="H20007C12048D43BDB1C90FBF3BD68EB9"><enum>(II)</enum><text>shall be issued appropriate documentation evidencing such authorization.</text></subclause></clause><clause id="H81BC5F3747CF4BC69487A8BD2D345FEC"><enum>(ii)</enum><header>State regulation</header><text>Notwithstanding clause (i), the employment of State-sponsored nonimmigrants may be regulated in a manner determined by each State that participates in the State-sponsored nonimmigrant program.</text></clause><clause id="id57d9eb1993014a81a70554c2e18a1eb5"><enum>(iii)</enum><header>Occupational licenses and credentials</header><text>Notwithstanding any other provision of law, State-sponsored nonimmigrants shall be eligible to apply for—</text><subclause id="idcb930ed1fb504bfeabbcf17036ebb318"><enum>(I)</enum><text>occupational licenses regulated by the sponsoring State or applicable interstate compact;</text></subclause><subclause id="idf15d5ec56eee42b18deaf9a102d293fd"><enum>(II)</enum><text>certificates;</text></subclause><subclause id="id7a037135ff394a84acbd09aaa5df04af"><enum>(III)</enum><text>credential evaluations; and</text></subclause><subclause id="id7eb4ecc311964a5aa5125f3708b9a2fc"><enum>(IV)</enum><text>skills assessments.</text></subclause></clause></subparagraph></paragraph><paragraph id="H056F5D19AFEB4EF7BC30FD274932603D"><enum>(7)</enum><header>State compacts</header><subparagraph id="HD39433CC33E64146BED3A3B4F993D994"><enum>(A)</enum><header>In general</header><text>States may enter into interstate compacts for the joint implementation or administration of the State-sponsored nonimmigrant program in such States.</text></subparagraph><subparagraph id="H784CD37512EF493189CED3FFC75DF1C6"><enum>(B)</enum><header>Consideration</header><text>A State-sponsored nonimmigrant shall be considered to be sponsored by a State if the State-sponsored nonimmigrant is sponsored by any State subject to an interstate compact under subparagraph (A) and resides in any such State.</text></subparagraph></paragraph><paragraph id="H4796949CF1FD4584922D8BAB67F0E0C2"><enum>(8)</enum><header>Appeals</header><subparagraph id="H3BF207E0C43D417FB163D62F90627E77"><enum>(A)</enum><header>Federal appeals</header><text>The denial of an application by a State to be a State-sponsored nonimmigrant or the request to terminate the period of authorized status by a State—</text><clause id="H049D17DE95B7410A8D8A287A99ABF80C"><enum>(i)</enum><text>is not reviewable by any Federal department, agency, or court; and</text></clause><clause id="H8452D57EE7734EF9B321BC7BD0BC11E7"><enum>(ii)</enum><text>may not be grounds for an appeal of a termination of a visa or status for a State-sponsored nonimmigrant.</text></clause></subparagraph><subparagraph id="HA267868A61FB4233B96EED856A6ED6E7"><enum>(B)</enum><header>State appeals</header><text>At the sole discretion of the State and in a manner determined by the State, a State that participates in the State-sponsored nonimmigrant program may create a process for a State-sponsored nonimmigrant or an alien that has applied for participation in the State-sponsored nonimmigrant program in the State to appeal an adjudication of an application by the State or determination by the State that the State-sponsored nonimmigrant violated the terms or conditions that were created by the State for the participation of the alien in the State-sponsored nonimmigrant program in the State.</text></subparagraph></paragraph><paragraph id="H1041ED025C8F49C2AB0C66732B58817E"><enum>(9)</enum><header>Waiver of rights prohibited</header><subparagraph id="H16157019980B497FB1196609C48E2248"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), a State-sponsored nonimmigrant may not be required to waive any substantive rights or protections under this Act.</text></subparagraph><subparagraph id="HBF450B5FF31C46C497E5F3423765A503"><enum>(B)</enum><header>Construction</header><text>Nothing under this paragraph may be construed to affect the interpretation of any other law.</text></subparagraph><subparagraph id="HA4F017B95B544C69B15629A67839A5BC"><enum>(C)</enum><header>Exception</header><text>Notwithstanding subparagraph (A) or any other provision of law, an alien may not be provided State-sponsored nonimmigrant status unless the alien has waived any right—</text><clause id="H74A6614399064AF798AD7C7CB9F39A9C"><enum>(i)</enum><text>to review or appeal under this Act of an immigration officer’s determination as to the admissibility of the alien at the port of entry into the United States; or</text></clause><clause id="HF80AF77BF42046E7A038FA03FFE693BA"><enum>(ii)</enum><text>to contest or appeal, other than on the basis of an application for asylum, any action for removal of the alien.</text></clause></subparagraph></paragraph><paragraph id="H4C6BBCEE0D4E47A491101E2E0017EE76"><enum>(10)</enum><header>Tax responsibilities</header><text>An employer shall comply with all applicable Federal, State, and local tax laws with respect to each State-sponsored nonimmigrant employed by the employer.</text></paragraph><paragraph id="H11E00BC1FA244D80885A36CA3D7B569E"><enum>(11)</enum><header>Labor and tax laws</header><text>State-sponsored nonimmigrants shall be subject to all Federal, State, and local laws regarding taxation, employment, or hiring of persons in the State.</text></paragraph><paragraph id="HB833366CCB55424194E87123024BE20B"><enum>(12)</enum><header>Federal public benefits</header><subparagraph id="id952bf9638f6a4cf485e1d1b2a2d6764c"><enum>(A)</enum><header>In general</header><text>Beginning on the date of participation in the State-sponsored nonimmigrant program, no State-sponsored nonimmigrant may apply for or receive any Federal means-tested benefit or entitlement. For purposes of this subparagraph, any benefits received by a spouse, child, or dependent living in the same household that is a United States citizen or is otherwise eligible for such benefits shall not be taken into account.</text></subparagraph><subparagraph id="H33B5FA3901D84742A0187B3472A91EF0"><enum>(B)</enum><header>Employer fee</header><text>For purposes of subsections (a)(2) and (b)(1)(B) of 4980H of the Internal Revenue Code of 1986, a State-sponsored nonimmigrant shall be treated as a full-time employee certified as having enrolled in a qualified health plan with respect to which an applicable premium tax credit or cost-sharing reduction is allowed or paid with respect to the employee.</text></subparagraph><subparagraph id="HAEBF5589695A43D0A956FFEC423AF7C9"><enum>(C)</enum><header>Employer payments</header><text>An employer of a State-sponsored nonimmigrant shall pay into the general fund of the Treasury an amount equivalent to the Federal tax on the wages paid to the nonimmigrants that the employer would be obligated to pay under chapters 21 and 23 of the Internal Revenue Code of 1986 had the nonimmigrants been subject to such chapters, subject to the same penalties as provided for failure to pay such tax.</text></subparagraph><subparagraph id="H6C998540D086449B9503D5862C3EAB13">
                  <enum>(D)</enum>
                  <header>Inclusion of nonimmigrants in save</header>
 <text>Not later than 30 days after the date of the enactment of the <short-title>State-Sponsored Visa Pilot Program Act of 2026</short-title>, the Secretary shall modify the Systematic Alien Verification for Entitlements Program of U.S. Citizenship and Immigration Services to add any status under section 101(a)(15)(W) as an alien category that is ineligible for the benefits and entitlements described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H96CC3DDEFCF7439094FDF504537806A2"><enum>(13)</enum><header>Bonds</header><subparagraph id="HEA996AE29031491D839E5207DD6B4534"><enum>(A)</enum><header>In general</header><text>States may require State-sponsored nonimmigrants to pay a bond in an amount determined by the State to incentivize voluntary compliance with the terms and conditions of the State-sponsored nonimmigrant program.</text></subparagraph><subparagraph id="HCBDC26EADFD244F38DEAD88B7FA59194"><enum>(B)</enum><header>Study</header><clause id="H7F86C38D937242DDB0B7D112E0AFBA90"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">At the end of each fiscal year, the Inspector General of the Department of Homeland Security and the Comptroller General of the United States shall each independently submit a report to the congressional committees specified in clause (iii) that identifies, for each State that participates in the State-sponsored nonimmigrant program, the percentage of State-sponsored nonimmigrants that have resided or worked illegally in a State other than the State that sponsored them (not including any State-sponsored nonimmigrants who are beneficiaries of approved immigration petitions).</text></clause><clause id="H37D3E3797E594339858B84073106D112"><enum>(ii)</enum><header>Assignment</header><text display-inline="yes-display-inline">A State-sponsored nonimmigrant who resides or works illegally in a State other than the State that sponsored the nonimmigrant shall be assigned to the percentage of the State that initially sponsored the nonimmigrant if the State participates in an interstate compact.</text></clause><clause id="H32E5C8EF83E14D38BFAF499C7DB5704C"><enum>(iii)</enum><header>Congressional committees</header><text display-inline="yes-display-inline">The congressional committees specified in this clause are—</text><subclause id="H0D326C1555C04E4A9EA159782E9400E9"><enum>(I)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subclause><subclause id="HDA416882D28148B0B1A99BF4716B7DC3"><enum>(II)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subclause><subclause id="H237204183FFA470BAEC1BA22431EDA31"><enum>(III)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></subclause><subclause id="H01AC68250F544E57AC155CEF4944FDDB"><enum>(IV)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></subclause></clause></subparagraph><subparagraph id="H1612D7E5308B428D8571F4F62AAC6022"><enum>(C)</enum><header>Mandatory bonds</header><clause id="H969F4E42FB0A4572BD5C1CC9426980AF"><enum>(i)</enum><header>In general</header><text>During the first fiscal year following a determination under subparagraph (B) by the Comptroller General of the United States or the Inspector General of the Department of Homeland Security that more than 3 percent of the State-sponsored nonimmigrants sponsored by a State violated the terms and conditions of State-sponsored nonimmigrant status in the most recently completed fiscal year, the State shall require each State-sponsored nonimmigrant in the State, as a condition of participation in the State-sponsored nonimmigrant program, to post a bond equal to not less than $4,000.</text></clause><clause id="H206AC2E30B8045B681BBDD3DC9F69BF3"><enum>(ii)</enum><header>Subsequent bonds</header><text>The bond amount under clause (i) shall be raised by $1,000 during each fiscal year following a subsequent determination under subparagraph (B) by the Comptroller General or the Inspector General of the Department of Homeland Security that more than 3 percent of the State-sponsored nonimmigrants sponsored by the State violated the terms and conditions of State-sponsored nonimmigrant status in the most recently completed fiscal year.</text></clause><clause id="H4D46B5EA725F4CE3AF91AFE0D5841B78">
                    <enum>(iii)</enum>
                    <header>Inflation adjustment</header>
 <text>Effective for the first fiscal year that begins more than 6 months after the date of the enactment of the <short-title>State-Sponsored Visa Pilot Program Act of 2026</short-title>, and for each fiscal year thereafter, the amounts described in this subparagraph shall be increased by the percentage (if any) by which the Consumer Price Index for the month of June preceding the date on which such increase takes effect exceeds the Consumer Price Index for all urban consumers published by the Department of Labor for the same month of the preceding calendar year.</text>
 </clause></subparagraph><subparagraph id="H2E89CB16C6CB49A4ADAA9A688E23936C"><enum>(D)</enum><header>Reimbursement of bonds</header><clause id="H657690CD60704D549843FEB0DA6233DE"><enum>(i)</enum><header>In general</header><text>Bonds paid to a State under this paragraph shall be reimbursed to any State-sponsored nonimmigrant that has not worked or resided in a State other than the State that sponsored the nonimmigrant or otherwise resided in the United States without status under the immigration laws in accordance with this subparagraph.</text></clause><clause id="HD6D71139D49F4582BDF3E6A7C3634743"><enum>(ii)</enum><header>Full reimbursement</header><text>The full amount of the bond shall be reimbursed in full immediately after—</text><subclause id="HFF2CDE8676D044F7AF6F60F6675A254E"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="H5DD1BE244B624B1B82B5EA004A14AADB"><enum>(aa)</enum><text>the alien applies to the Secretary of State (or the designee of such Secretary) at a United States embassy, consulate, or, if specified by the Secretary, other locations outside the United States; and</text></item><item id="H976AC9C729FF4A6C922B6792489A127A" indent="up1"><enum>(bb)</enum><text>in connection with the application, the State-sponsored nonimmigrant confirms his or her identity, or verifies his or her departure at such time from the United States pursuant to a biometric entry and exit data system;</text></item></subclause><subclause id="H59430B5A9DFD41DEAE8F01C7AAAD8809"><enum>(II)</enum><text>an approved petition for lawful permanent residency is approved on behalf of the State-sponsored nonimmigrant; or</text></subclause><subclause id="HF3922AEB649746CC8B01585160369D39"><enum>(III)</enum><text>the State-sponsored nonimmigrant dies.</text></subclause></clause><clause id="HC47A4BFA259547A1A0EF4AF8BB677C46"><enum>(iii)</enum><header>Payee</header><subclause id="H66436180D3F34F3B8253EA0605E90D0D"><enum>(I)</enum><header>Death of nonimmigrant</header><text>Upon the death of a State-sponsored nonimmigrant, payment shall be immediately paid to such State-sponsored nonimmigrant’s next of kin, as designated by such State-sponsored nonimmigrant on the application to be a State-sponsored nonimmigrant.</text></subclause><subclause id="H3028C13D10614C4B9C4FD76337DD6625"><enum>(II)</enum><header>Bank account</header><text>A State-sponsored nonimmigrant may specify on the application to be a State-sponsored nonimmigrant a bank account to which such amount be sent after the satisfaction of a condition specified in clause (ii).</text></subclause></clause><clause id="H380D124970B1439083444105F61BCFEA"><enum>(iv)</enum><header>Denial of reimbursement</header><text>Funds of a State-sponsored nonimmigrant held under this paragraph may not be denied by a State to the nonimmigrant unless the State demonstrates, by clear and convincing evidence, that the nonimmigrant knowingly violated a term or condition of State-sponsored nonimmigrant status—</text><subclause id="H3F97FC17929A41B0A0E9E8A99C7E9C4E"><enum>(I)</enum><text>by failing to depart the United States at the end of the period of authorized status; or</text></subclause><subclause id="H506FBE93E131476796BE3974EA2667BD"><enum>(II)</enum><text>working or residing in a State that did not sponsor the nonimmigrant.</text></subclause></clause><clause commented="no" id="HD1D07F310D3445CC87CFD05E62AACAF1"><enum>(v)</enum><header>Notice</header><text>The Secretary of State, in conjunction with the Secretary of Homeland Security, shall inform the State that the State-sponsored nonimmigrant has complied with clause (i).</text></clause></subparagraph></paragraph><paragraph id="H3C46CF48B58843238DC5220D23F4412C"><enum>(14)</enum><header>Penalties</header><text>If a State-sponsored nonimmigrant works or resides outside of the State, or outside of any of the States under an interstate compact that sponsored the nonimmigrant or fails to comply with any term or condition of State-sponsored nonimmigrant status, the Secretary shall—</text><subparagraph id="H8A92A556F30849FE8F8470BFACC36C4C"><enum>(A)</enum><text>revoke the employment authorization of such nonimmigrant; and</text></subparagraph><subparagraph id="HF49047A38A1F464E9398A948C326D41A"><enum>(B)</enum><text>initiate removal in accordance with section 237.</text></subparagraph></paragraph><paragraph id="H6D5BF003AF074A8C84872510DD1BEA2A"><enum>(15)</enum><header>State administration of program</header><subparagraph id="H2CB3AEEF7C0C4027838BE9A1C5570115"><enum>(A)</enum><header>In general</header><text>Each State that participates in the State-sponsored nonimmigrant program shall establish, conduct, or maintain any assessments, programs, and enforcements related to the administration of the program, in accordance with subparagraphs (B) through (F).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaaff03bf4a5c4df9aa33201cc0ce72a5"><enum>(B)</enum><header>Rules and regulations</header><text>The State shall enforce all the rules and regulations of the State against employers who employ a State-sponsored nonimmigrant to the same extent as the enforcement of any other labor laws under State law.</text></subparagraph><subparagraph id="id377087d4cfb74733bf13eb6027dbc809"><enum>(C)</enum><header>Labor needs assessments</header><text>The State shall establish procedures for periodically assessing labor needs in the State and the State’s participation in the State-sponsored nonimmigrant program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcb66ae8cf5a42dbab5f577d70c21ef9"><enum>(D)</enum><header>Wage assessments</header><text display-inline="yes-display-inline">The State shall periodically conduct occupational wage assessments in the State to ensure the State-sponsored nonimmigrant program does not depress wage levels in the State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d4703d7001048759a4e0c096abc5bd3"><enum>(E)</enum><header>Complaints</header><text display-inline="yes-display-inline">The State shall establish a mechanism for receiving and investigating complaints of domestic worker displacement in the State and workplace discrimination.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9334d7fbe7524496b0f277ae1dc73e20"><enum>(F)</enum><header>Occupational licenses</header><text display-inline="yes-display-inline">The State shall establish mechanisms for State-sponsored nonimmigrants to apply for and obtain occupational licenses regulated by the State or applicable compact, certificates, credential evaluations, and skills assessments.</text></subparagraph></paragraph><paragraph id="H2863EFACC4434820A771DB2DD6C6D099"><enum>(16)</enum><header>Suspension of program approval</header><text>The Secretary shall suspend admissions under the State-sponsored nonimmigrant program for any State that fails—</text><subparagraph id="HD90982E3A2864C5A9262CDB8FA6A82E3"><enum>(A)</enum><text>to reimburse another State or a Federal agency under paragraph (15)(B) not later than 1 year after a final judgment against the State; or</text></subparagraph><subparagraph id="H6795C2C7565640D49B3D89FB32DA6F77"><enum>(B)</enum><text>to reimburse, in accordance with paragraph (13)(D), a State-sponsored nonimmigrant who—</text><clause id="HCB4D765D888C461EA87BD6CC78DC655D"><enum>(i)</enum><text>has departed the United States;</text></clause><clause id="H4B375B2B760F4DA4974E83F796B5A261"><enum>(ii)</enum><text>did not seek employment without authorization in a State that did not sponsor the nonimmigrant; and</text></clause><clause id="HBF0DAC18945A4A0FA2CF094CCA48BE4D"><enum>(iii)</enum><text>did not otherwise reside in the United States without status under the immigration laws.</text></clause></subparagraph></paragraph><paragraph id="HAE7DE6B1902A40C28D8AC6C049650454"><enum>(17)</enum><header>Fees</header><subparagraph id="H2D472EFD673B451087A0176F78F2CC71"><enum>(A)</enum><header>Federal fees</header><text>A State shall pay a fee to the Secretary for each year in which the State participates in the State-sponsored nonimmigrant program in an amount determined by the Secretary to be necessary to cover the Federal costs of overseeing the State-sponsored nonimmigrant program in the State.</text></subparagraph><subparagraph id="HDD991D410BCE402CB640970455E0B049"><enum>(B)</enum><header>State fees</header><text>Nothing in this subsection may be construed to limit or regulate fees required by the State for State-sponsored nonimmigrants or employers of State-sponsored nonimmigrants.</text></subparagraph></paragraph><paragraph id="H7AF176CCC266408CBA510B9D7BD3AD0D"><enum>(18)</enum><header>Numerical limitations</header><subparagraph commented="no" id="H3B69DC65C2DF4023A5D5E15BC8367F52"><enum>(A)</enum><header>In general</header><text>The total number of aliens who may be issued visas or otherwise provided State-sponsored nonimmigrant status under this subsection during any fiscal year may not exceed the total number of visas computed under subparagraph (B).</text></subparagraph><subparagraph commented="no" id="H6CFA3EF8078842DAAA3AD05E61F85DFD"><enum>(B)</enum><header>Distribution</header><text>Subject to subparagraphs (C), (D), and (E), the number of State-sponsored nonimmigrant visas made available in a fiscal year to a State that participates in the State-sponsored nonimmigrant program shall be the sum of—</text><clause commented="no" id="HF75D4EBFE86644298FDDC0E1C20BEA54"><enum>(i)</enum><text>5,000;</text></clause><clause commented="no" id="H72230E5E23034A15A0497F0331C71249"><enum>(ii)</enum><text>the sum of the amounts computed under subparagraphs (C) and (D) in the most recently concluded year; and</text></clause><clause commented="no" id="H26BB890C83604B56A79367314B7A9EAC"><enum>(iii)</enum><text>the percentage of the total population in all States participating in the State-sponsored nonimmigrant program represented by the population of that State multiplied by the sum of—</text><subclause commented="no" id="HFFD3863E187B4912B15781F9CE6AB529"><enum>(I)</enum><text>245,000;</text></subclause><subclause commented="no" id="HF0FB2D4242D742EE82751A301286E370"><enum>(II)</enum><text>the number of nonparticipating States multiplied by 5,000; and</text></subclause><subclause commented="no" id="H315B8196734444CAACC987B06A876C9F"><enum>(III)</enum><text>the total number of visas available in the previous fiscal year that were revoked or not used.</text></subclause></clause></subparagraph><subparagraph id="H16244C5235F143EA98A5E7C0B780594A"><enum>(C)</enum><header>Economic growth</header><text>The amounts computed under subparagraphs (A) and (B) for the most recently concluded fiscal year shall be adjusted annually in proportion to the percentage increase or decrease in the Gross Domestic Product of the United States in the prior year, as determined by the Bureau of Economic Analysis of the Department of Commerce.</text></subparagraph><subparagraph id="H27BD84770AF443B2856FFAEAED418473"><enum>(D)</enum><header>Compliance</header><clause id="H9AD20A08D68947C9BBB1F00A45739327"><enum>(i)</enum><header>Increases</header><text>The number of State-sponsored nonimmigrant visas made available to a State under subparagraph (C) shall be increased by 10 percent compared to the most recently concluded fiscal year in each fiscal year immediately following a fiscal year in which fewer than 3 percent of the State-sponsored nonimmigrants sponsored by the State violated the terms and conditions of State-sponsored nonimmigrant status, as determined by the Inspector General of the Department of Homeland Security or the Comptroller General of the United States in the reports required under paragraph (13)(B).</text></clause><clause id="H0A22E5981FD7454EAB89F3605252D0A1"><enum>(ii)</enum><header>Decreases</header><text>The number of State-sponsored nonimmigrant visas made available to a State under subparagraph (C) shall be decreased by 50 percent in each fiscal year immediately following a fiscal year in which more than 3 percent of the State-sponsored nonimmigrants sponsored by the State violated the terms and conditions of State-sponsored nonimmigrant status, as determined by the Inspector General of the Department of Homeland Security or the Comptroller General of the United States in the reports required under paragraph (13)(B).</text></clause><clause id="H803F4D102D1C40C0B641CEAF641F944C"><enum>(iii)</enum><header>Suspension</header><text>State-sponsored nonimmigrant visas shall not be made available for a State during the 5-year period following 4 consecutive fiscal years in which more than 3 percent of the State-sponsored nonimmigrants sponsored by the State violated the terms and conditions of State-sponsored nonimmigrant status, as determined by the Inspector General of the Department of Homeland Security or the Comptroller General of the United States in the reports required under paragraph (13)(B).</text></clause></subparagraph><subparagraph id="H77A01D7FBB00498B8CAC59CAEBAA288A"><enum>(E)</enum><header>Principal aliens</header><clause id="H81BAD19AF0234663A264F1997AF794F0"><enum>(i)</enum><header>In general</header><text>The numerical limitations under this paragraph shall only apply to principal aliens being admitted to the United States from another country and not to aliens accompanying or following to join the principal alien under section 101(a)(15)(W)(ii) or aliens who were previously admitted.</text></clause><clause id="H369FFB216CCD475895DE7CE123FEFBA6"><enum>(ii)</enum><header>State exclusion</header><text>The Secretary may not grant a visa or nonimmigrant status to an alien who is not the principal alien sponsored by a State if the State request that no such aliens be admitted.</text></clause></subparagraph></paragraph><paragraph id="HD4F99F861CC34EA0B4D177B958D05EF9"><enum>(19)</enum><header>Admissibility determination</header><subparagraph id="H07681626EC234C46A892CD3FF0200AC2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">At the request of a State that participates in the State-based nonimmigrant program, the Secretary shall waive the grounds of inadmissibility under subparagraphs (A), (B), (C), and (G) of section 212(a)(6), paragraphs (7) and (9) of section 212(a), and sections 240B(d)(1)(B) and 241(a)(5) and the grounds of deportability under subparagraphs (A) through (D) of section 237(a)(1) and section 237(a)(3) on behalf of an alien described in subparagraph (B).</text></subparagraph><subparagraph id="H483AF537B89346FDA940749D31113507"><enum>(B)</enum><header>Aliens described</header><text>An alien described in this subparagraph is an alien who—</text><clause id="HAF3638FC12B34573A6F98408E5A6FC63"><enum>(i)</enum><text>was physically present in the United States on December 31, 2016;</text></clause><clause id="H18B1744A34E84EC7BF00E5726343DEB5"><enum>(ii)</enum><text>is sponsored by a State under the State-based nonimmigrant program;</text></clause><clause id="H8D713930C933476F83E6F4C10C4AA76D"><enum>(iii)</enum><text>otherwise meets the requirements of State-based nonimmigrant status under paragraph (5); and</text></clause><clause id="H7FBA2F78A88F46B8B72FEC1ECA00F895"><enum>(iv)</enum><text>fulfills the requirements under paragraph (20).</text></clause></subparagraph><subparagraph id="HA284E35A13BA45CAA2FE5763D23DCBDA"><enum>(C)</enum><header>Savings provision</header><text>Nothing in this paragraph may be construed to exempt an alien described in subparagraph (B) or exempt a State from the numerical limitation under paragraph (18).</text></subparagraph></paragraph><paragraph id="HA1F1CF94FE18428C9C86D291C775D6F2"><enum>(20)</enum><header>Requirements</header><subparagraph id="HAEAD5C7ABC554EDB9A0E002736D79BF6"><enum>(A)</enum><header>Application</header><text>An alien may apply to the Secretary for a waiver of inadmissibility or deportability under paragraph (19)(A) concurrently with an application for a visa or State-sponsored nonimmigrant status under section 101(a)(15)(W).</text></subparagraph><subparagraph id="HD1122363C9B64F0685FEA4C2A13425B3"><enum>(B)</enum><header>Evidence of presence or employment</header><clause id="H338F73277B0541339588EECD01D80A6F"><enum>(i)</enum><header>Conclusive documents</header><text>An alien may conclusively demonstrate presence in the United States in compliance with paragraph (19)(B)(i) by submitting records demonstrating such presence that have been maintained by the Social Security Administration, the Internal Revenue Service, or any other Federal, State, or local government agency or educational institution.</text></clause><clause id="H8C6A0B233A194268BF104A6B92DC7461"><enum>(ii)</enum><header>Other documents</header><text>An alien who is unable to submit a document described in subparagraph (A) may satisfy the requirements under this section by submitting at least 3 other types of reliable documents that provide evidence of presence, employment, or study in the United States, including—</text><subclause id="HD364EF9F23324612A5A0180F90F12343"><enum>(I)</enum><text>bank or remittance records;</text></subclause><subclause id="H963FAEFBD579499CBA93E3D97528EE41"><enum>(II)</enum><text>business or employer records;</text></subclause><subclause id="HECF075F2C1D84680ABB1F6DFE48F5273"><enum>(III)</enum><text>records of any organization that assists workers in employment;</text></subclause><subclause id="H7C31A7CCDF4E464B8DBF045B54376B7C"><enum>(IV)</enum><text>education records; and</text></subclause><subclause id="H8668C1C64A2D43F1977D926ED56B739E"><enum>(V)</enum><text>deeds, mortgages, or contracts to which the alien has been a party.</text></subclause></clause></subparagraph><subparagraph id="HD9B7791575D248E09AB3D664153897BC"><enum>(C)</enum><header>Fees</header><clause id="H35BEECD4C8A24FA7A90886317BD5B63E"><enum>(i)</enum><header>In general</header><text>An alien submitting an application pursuant to subparagraph (A) shall pay a fee in an amount determined by the Secretary to be necessary to cover the cost of adjudicating the application and reviewing the application for fraud.</text></clause><clause id="H549C984626334F8283C7F5883966C348"><enum>(ii)</enum><header>Penalty</header><text>In addition to the fee under clause (i), an alien seeking a waiver under paragraph (19) shall pay a penalty of not less than $1,000, which shall be deposited into the general fund of the Treasury of the United States after the approval of the application under subparagraph (A).</text></clause></subparagraph><subparagraph id="H19052A740A2346DAA0991EC38993F04C"><enum>(D)</enum><header>Criminal penalty</header><clause id="H86257DAF8F06406D89A808D83F1816DB"><enum>(i)</enum><header>Violation</header><text>It shall be unlawful for any person to knowingly—</text><subclause id="H7D5226D36621431C8FAB9AF20B2CDF8E"><enum>(I)</enum><text>file, or assist in filing, an application under this paragraph if such application—</text><item id="H04BAC18E7EBE40FB96FF89A6DC20CEA4"><enum>(aa)</enum><text>falsifies, misrepresents, conceals, or covers up a material fact;</text></item><item id="HD23EE8A372724BA39B03DD92F1C2216F"><enum>(bb)</enum><text>makes any false, fictitious, or fraudulent statements or representations; or</text></item><item id="H48941771D8C24330B06FBA7C659BE198"><enum>(cc)</enum><text>makes or uses any false writing or document knowing the same to contain any false, fictitious, or fraudulent statement or entry; or</text></item></subclause><subclause id="HE1D566B5E5D44F57B87ED702CE122044"><enum>(II)</enum><text>create or supply a false writing or document for use in making such an application.</text></subclause></clause><clause id="H414EBD17D92040B3B8C0013E678B4D50"><enum>(ii)</enum><header>Penalty</header><text>Any person who violates clause (i) shall be fined in accordance with title 18, United States Code, imprisoned not more than 5 years, or both.</text></clause><clause id="H383EE74B0A7A43139ABA25D6DB4D9650"><enum>(iii)</enum><header>Inadmissibility</header><text>An alien who is convicted of violating clause (i) shall be considered to be inadmissible to the United States on the ground described in section 212(a)(6)(C)(i) and shall be subject to immediate removal from the United States.</text></clause></subparagraph><subparagraph id="HB8DCD10DDD0F465FAD5D620626A1A0BF"><enum>(E)</enum><header>Fraud prevention program</header><text>The Secretary and the Attorney General shall jointly develop an administrative program to prevent fraud with respect to applications submitted under this paragraph that provides for—</text><clause id="HEB63E64A49BE447BA3538A9A330F9732"><enum>(i)</enum><text>fraud prevention training for administrative adjudicators;</text></clause><clause id="H810DEB6389514A7E9786DD3994B279D0"><enum>(ii)</enum><text>the regular audit of pending and approved applications for examples and patterns of fraud or abuse;</text></clause><clause id="H2E71C2C1604A4AEB871706D5EE573494"><enum>(iii)</enum><text>the receipt and evaluation of reports of fraud or abuse;</text></clause><clause id="HCD393E049E46483CB27F6AAE48780044"><enum>(iv)</enum><text>the identification of deficiencies in administrative practice or procedure that encourage fraud or abuse;</text></clause><clause id="H64A51F33331B427699899EC1B6F58478"><enum>(v)</enum><text>the remedy of any identified deficiencies; and</text></clause><clause id="H9BE55DBAB3A642B39A0C4CF628F5192A"><enum>(vi)</enum><text>the referral of cases of identified or suspected fraud or other misconduct for investigation.</text></clause></subparagraph><subparagraph id="H64BE5A8F6FFE4E4887CACA72A194E641"><enum>(F)</enum><header>Ineligible aliens</header><clause id="H4411775E7C514FBFB9C624E8C2F234E2"><enum>(i)</enum><header>Removal authorized</header><text>Except as provided in clause (ii), if the Secretary makes a final determination to deny an application under this subsection, the Secretary shall place the applicant in removal proceedings to which the alien would otherwise be subject.</text></clause><clause id="HF002E0DD8AE342078DD1B422AF58FF06"><enum>(ii)</enum><header>Aliens with prior orders</header><text>If the final determination to deny an application under this subsection concerns an alien with an existing order of exclusion, deportation, removal, or voluntary departure from the United States, such order shall be enforced to the same extent as if such application had not been made.</text></clause></subparagraph><subparagraph id="HD2DB375034944ABB88757B04CC276826"><enum>(G)</enum><header>Employment records</header><text>Copies of employment records or other evidence of employment provided by an alien or by an alien’s employer in support of an alien’s application under this subsection may not be used in a civil or criminal prosecution or investigation of that employer under section 247A or the tax laws of the United States for the prior unlawful employment of such alien, regardless of the adjudication of such application or reconsideration by the Secretary of such alien’s prima facie eligibility determination. Employers that provide unauthorized aliens with copies of employment records or other evidence of employment pursuant to an application under this title shall not be subject to civil and criminal liability pursuant to such section 274A for employing such unauthorized aliens. The protections for employers and aliens shall not apply if the aliens or employers submit employment records that are deemed to be fraudulent.</text></subparagraph><subparagraph id="HCCA30F0060F54CA09EBEA21DCE9C130E"><enum>(H)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to limit the authority of a State to require additional monetary penalties, other evidence of physical presence, or any other requirement for aliens described in paragraph (19)(B) to participate in the State-based nonimmigrant program in such State.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6DFD949F0D6B463C88F19734E9E3D524"><enum>(b)</enum><header>Judicial review</header><text>Section 242(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1252">8 U.S.C. 1252(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4AD48E1D336B4ECD87E952BEA2167EAB"><subparagraph id="HB82E0C4767EA43429327E7DE9D3AA64C"><enum>(E)</enum><header>Judicial review of certain eligibility determinations</header><text>If an alien’s application under section 214(s)(20) is denied or revoked, judicial review—</text><clause commented="no" display-inline="no-display-inline" id="id19a78802a6c34bb8ba67ce96154ccc10"><enum>(i)</enum><text display-inline="yes-display-inline">shall be instituted in the United States District Court for the District of Columbia; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a463b7306af4cb2a7d89066f7cb68b3"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be limited to determinations of the constitutionality of section 214(s), or any regulations implemented pursuant to such section.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF8EF0256D26949AC9EE1934991D0804E"><enum>(c)</enum><header>Nonimmigrants with approved immigrant petitions</header><text>Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended—</text><paragraph id="HE09F3B16BB244545AB848E2584824091"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H9C1C9C2B44894B51B9C38FDEDE7884C7"><enum>(A)</enum><text>by striking <quote>if (1) the alien</quote> and inserting the following: “if—</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBDABB773D4A246E087797A8C97C3D483"><paragraph id="H7C4DF85910D64C4D85FDE0BBAAF36E73"><enum>(1)</enum><text>the alien</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7B2EE227D85F4992BDF0106B339AED95"><enum>(B)</enum><text>by striking <quote>adjustment, (2) the alien</quote> and inserting the following: “adjustment;</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFCE79B45ADC14DE5917ED0DA72EFE50C"><paragraph id="HA853BA17733B4903B51C8B2D182E0019"><enum>(2)</enum><text>the alien</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEF99181F6C804E018792E05391C74FF4"><enum>(C)</enum><text>by striking <quote>residence, and (3) an immigrant visa</quote> and inserting the following: “residence; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAAD2E14D5ED14CD099519A581B845485"><paragraph id="HA7466F9F81674ABB8AE7048800BBD5FC"><enum>(3)</enum><text>an immigrant visa</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF3C5DEC4FD534B5DB97B3384348E3F3E"><enum>(D)</enum><text>in paragraph (3), by striking <quote>him at the time his application is filed</quote> and inserting <quote>the alien at the time the alien’s application is adjudicated</quote>; and</text></subparagraph></paragraph><paragraph id="H9F75F63AE8C346589CB0A961ABC31F49"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0C789D75486944E986B54A9A5E61643C"><subsection id="HC4E1825E5F2742D48A96459E2E4CF937"><enum>(o)</enum><header>Adjustment of status application after an approved immigrant petition</header><paragraph id="H32FAC1F9A75946499D21EAAB2EE24E48"><enum>(1)</enum><header>Application</header><text>An alien who has an approved immigrant petition may file an adjustment of status application under subsection (a), which shall remain pending until a visa number becomes available.</text></paragraph><paragraph id="H0CCE24395CDE40D6A843CB11A3E96963"><enum>(2)</enum><header>Status</header><text>An alien who has properly filed an adjustment of status application pursuant to subsection (a) shall, throughout the pendency of such application—</text><subparagraph id="H127F4B31C43E4E109C7755DBC0723EE1"><enum>(A)</enum><text>have a lawful status and be considered lawfully present for purposes of section 212; and</text></subparagraph><subparagraph id="HB5DAE3F635ED43A38E14524233B19309"><enum>(B)</enum><text>following a biometric background check, be eligible for employment and travel authorization incident to such status.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H2E7B03B63C0D4A25BF812531CB392380"><enum>4.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of Labor and the Attorney General, shall promulgate regulations to carry out and implement the State-sponsored nonimmigrant program authorized under section 214(s) of the Immigration and Nationality Act, as added by section 3 of this Act.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id42d7b33b53fb4c0591db6de305015114"><enum>5.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the first day of the first fiscal year that begins after the date of the enactment of this Act.</text></section></legis-body></bill>
