which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 28, United States Code, to improve the maintenance, alteration, and construction of United States courthouses, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial Space and Facilities Management Effectiveness Act of 2026</short-title></quote>.</text></section><section id="idc6b6999e701b472d9ce3b33dfdc5ecea"><enum>2.</enum><header>Pilot program for transfer of certain judicial branch accommodations and authority of the Director</header><subsection commented="no" display-inline="no-display-inline" id="idd85850239bd442e99974870bf106a22b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/41">Chapter 41</external-xref> of title 28, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/28/604">section 604</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id41d6ea8cb6684f229a04b95189baee76"><section id="ide413d95b1ca44918978b03ba0c3052ae"><enum>604A.</enum><header>Pilot program for transfer of jurisdiction, custody, and control of certain judicial branch accommodations to the Director; authority of the Director</header><subsection id="id10a1c96df9f9486a8db1b5d7c3ce2a1d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id5e08b2cecc724199a5a14b2e28aa9360"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="idb99803dc8a32449b9036d86cacf92462"><enum>(2)</enum><header>Alter</header><text>The term <term>alter</term> includes—</text><subparagraph id="id4384f0d805c8479b874d03a40211d73c"><enum>(A)</enum><text>preliminary planning, engineering, architectural, legal, fiscal, and economic investigations and studies, conducting surveys, preparing designs, plans, working drawings, specifications, and procedures, and other similar actions necessary for the alteration of any space or facility; and</text></subparagraph><subparagraph id="id979375a8cf8b43bbb2459b8771096095"><enum>(B)</enum><text>repairing, remodeling, improving, extending, or making any other change in any space or facility.</text></subparagraph></paragraph><paragraph id="idf6de40fa6bae404dbba84ecfc91763b8"><enum>(3)</enum><header>Covered judicial district</header><text>The term <term>covered judicial district</term> means a judicial district in which the Director has identified real property under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7998d08574924729b448b76a81b86e9b"><enum>(4)</enum><header>Covered property</header><text>The term <term>covered property</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2b564fd2825a4da286829447a2c396f2"><enum>(A)</enum><text display-inline="yes-display-inline">any real property owned or leased by the United States, and any lease of real property made on behalf of the United States, that—</text><clause commented="no" display-inline="no-display-inline" id="idd0f7f6c4a0a8451e908f22cec3d601e7"><enum>(i)</enum><text display-inline="yes-display-inline">is located in a covered judicial district;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5dbf3ac5a7304124ba5d5581ef4ed1ca"><enum>(ii)</enum><text display-inline="yes-display-inline">contains court accommodations; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9307085a5dd044efbd8ca8682a21aa27"><enum>(iii)</enum><text display-inline="yes-display-inline">for which jurisdiction, custody, and control is transferred to the Director under subsection (i); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id347c8c63291d45c588b606ed980102fc"><enum>(B)</enum><text display-inline="yes-display-inline">the Thurgood Marshall Federal Judiciary Building.</text></subparagraph></paragraph><paragraph id="id0704a4099ea5495abfcb05050183f82e"><enum>(5)</enum><header>Construct</header><text>The term <term>construct</term> includes preliminary planning, engineering, architectural, legal, fiscal, and economic investigations and studies, conducting surveys, preparing designs, plans, working drawings, specifications, and procedures, and any other similar action necessary for the construction of any space or facility.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d48e44b8a7b41b79663f07a159d0e70"><enum>(6)</enum><header>Court accommodation</header><text>The term <term>court accommodation</term> includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="id18dcdd839bb8495b8851d9f775597331"><enum>(A)</enum><text display-inline="yes-display-inline">the chambers and courtrooms of the Judiciary (other than the Supreme Court of the United States); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1301bd6fe7448b19206c163d565213a"><enum>(B)</enum><text display-inline="yes-display-inline">accommodations for all court-related functions and for probation offices, pretrial service offices, Federal Public Defender Organizations, the United States Sentencing Commission, the Administrative Office of the United States Courts, the Federal Judicial Center, and any other administrative or clerical personnel associated with the Judiciary.</text></subparagraph></paragraph><paragraph id="ida5421e7e56164aa185faa738c695206f"><enum>(7)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Administrative Office of the United States Courts.</text></paragraph><paragraph id="idb09089a16c5a4f1dbd4b725498241380"><enum>(8)</enum><header>Facility; building</header><text>The terms <term>facility</term> or <term>building</term> mean any building or other structure, including its grounds, approaches, appurtenances, and parking spaces, or any part thereof.</text></paragraph><paragraph id="idccdabc91555c4556b5fed06123ef9cc5"> <enum>(9)</enum> <header>Federal agency; property</header> <text>The terms <term>Federal agency</term> and <term>property</term> have the meanings given the terms <term>federal agency</term> and <term>property</term>, respectively, in section 102 of title 40.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c10b3920898410bb0d51dbe3616ec85"><enum>(10)</enum><header>Public building</header><text>The term <term>public building</term> has the meaning given the term in section 3301(a) of title 40.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc735ac3b7e66440395e0608f260d3a92"><enum>(11)</enum><header>Space</header><text display-inline="yes-display-inline">The term <term>space</term> means any interest, whether fee simple or otherwise, in real property, including land, buildings, structures, or parts thereof.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06af7bea5e034cd98935c4ed9c00f910"><enum>(12)</enum><header>Space and Facilities Fund</header><text>The term <term>Space and Facilities Fund</term> means the Judicial Space and Facilities Management Fund established under subsection (l)(1)(A).</text></paragraph></subsection><subsection id="id588ff44179c04ffe9933291b1a3ce35f"><enum>(b)</enum><header>Identification of judicial districts for pilot program</header><text>The Director shall identify real property that is owned or leased by the Federal Government and that contains court accommodations in not more than 10 judicial districts for which jurisdiction, custody, and control shall be transferred to the Director in accordance with this section.</text></subsection><subsection id="id89e4fbcb65e0434497b4d247b8e549c2"><enum>(c)</enum><header>Authority of Director</header><text>The Director is authorized to establish a Judiciary Buildings Service under the direction of the Administrative Office of the United States Courts to—</text><paragraph id="ida3dea65ea1ff42b58cbb1a043705b8a2" commented="no"><enum>(1)</enum><text>acquire, by purchase, condemnation, donation, exchange, transfer, or otherwise, any space or facility located in a covered judicial district that the Director determines to be necessary for the provision of court accommodations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2fb536517b0404290e2e6e5436fc8d6"><enum>(2)</enum><text display-inline="yes-display-inline">manage and operate any space or facility described in paragraph (1);</text></paragraph><paragraph id="id6accd2edae9240d9a7a7ab3f4247cc61"><enum>(3)</enum><text>alter any space or facility that is acquired under the authority of this section as the Director determines is necessary for the provision of court accommodations;</text></paragraph><paragraph id="id9609f9d672ea40578aec1a1e161ab7b2"><enum>(4)</enum><text>acquire and exercise any option for the acquisition or lease of any land, or an interest in land, that is located in a covered judicial district as the Director determines is necessary for the provision of court accommodations;</text></paragraph><paragraph id="idd442d8bddc654ac2a694530a326f7318"><enum>(5)</enum><text>construct such facilities in a covered judicial district as the Director determines is necessary for the provision of court accommodations;</text></paragraph><paragraph id="idb3e9e1ca7a0743868385c8e571f8051d"><enum>(6)</enum><text>lease, or acquire and exercise any option for the acquisition of a lease, any space or facility located in a covered judicial district as the Director deems necessary for the provision of court accommodations and manage that lease;</text></paragraph><paragraph id="idaceda221b1e3454a88ea16b6cae3d3b0"><enum>(7)</enum><text>outlease space located in a covered property;</text></paragraph><paragraph id="ida197d0b686df45389a7b0baee9973c1c"><enum>(8)</enum><text>contract for utility services for covered properties;</text></paragraph><paragraph id="idf5b117a5ea6a4611b2eceb9c95b7cda7"><enum>(9)</enum><text>secure covered properties in coordination with the United States Marshals Service and the Federal Protective Service;</text></paragraph><paragraph id="id605ed6acbe304659ae7810958df6c38b"><enum>(10)</enum><text>for covered properties, provide by contract or otherwise for the provision of amenities, such as childcare, cafeterias, physical fitness centers, credit unions, and others, to serve tenants and, if appropriate, the public;</text></paragraph><paragraph id="id24f86121a3e945fca1b88e657bdafb8e"><enum>(11)</enum><text>pay rent and make repairs, alterations, and improvements under the terms of a lease for court accommodations in a covered property entered into by, or transferred to, the Director;</text></paragraph><paragraph id="idc3f58ad88ff640e799133b1646b3a1cb"><enum>(12)</enum><text>pay ground rent for buildings located in a covered judicial district that are owned by the Federal Government or occupied by Federal agencies, and pay rent in advance for leased property if required by law or if the Director determines that advance payment is in the interest of the Judiciary; and</text></paragraph><paragraph id="id024155e7f0424036bf4e6b90d9399586"><enum>(13)</enum><text>perform such other duties as necessary to implement this section.</text></paragraph></subsection><subsection id="id09a245f93e2f448dbdfa8b1342e332f2"><enum>(d)</enum><header>Delegation of authority</header><text>The Director may delegate any authority authorized by this section. The Director may authorize successive redelegation of authority as permitted by this section.</text></subsection><subsection id="idbb087834231b4dfd931b23a2c84c3cbc"><enum>(e)</enum><header>Architectural, engineering, and construction services</header><text>The Director is authorized to employ, by contract or otherwise, the services of architectural, engineering, and construction firms, corporations, or individuals, to the extent the Director may require such services for any space or facility authorized to be constructed or altered under this section.</text></subsection><subsection id="id28bcb68939624a70ba99f465363883dc"><enum>(f)</enum><header>Operation and maintenance</header><text>The Director is authorized to employ, by contract or otherwise, the services of corporations, firms, or individuals for the operation and maintenance of any building under the jurisdiction, custody, and control of the Director, to the extent the Director may require such services.</text></subsection><subsection id="id731f9b59cf63452b9ac3903da204df3d"><enum>(g)</enum><header>Construction</header><paragraph id="idfe4d08d637154c789ebc302bce1ce848"><enum>(1)</enum><header>Replacement of existing buildings</header><text>If the Director considers it to be in the best interest of the Judiciary to construct a new space or facility to take the place of an existing space or facility in a covered property, the Director may demolish the existing building and use the site on which it is located for the site of the proposed space or facility. If the Director believes that it is more advantageous to construct the space or facility on a different site in the same city, town, or other municipality, the Director may exchange the building and site, or the site, for another site, or may transfer the building and site.</text></paragraph><paragraph id="id068f65a5b5de4d06b55dc655215bf593"><enum>(2)</enum><header>Exchange or transfer of sites</header><text>If the Director determines that a site in a covered judicial district acquired for the construction of a space or facility is not suitable for that purpose, the Director may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4a7e607508a2408eb61c731b19bfa0fc"><enum>(A)</enum><text display-inline="yes-display-inline">exchange the site for another site in the covered judicial district; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d926cc5214148489fae469f7f44918a"><enum>(B)</enum><text display-inline="yes-display-inline">declare the site to be excess and transfer the site to the Administrator.</text></subparagraph></paragraph><paragraph id="id9cc5f20d1c1649678fec4b40021d5359"><enum>(3)</enum><header>Construction or alteration by contract or otherwise</header><text>The Administrator may carry out a construction or alteration authorized by this section by contract if the Director considers it to be most advantageous to the Government.</text></paragraph></subsection><subsection id="id7495751f83e343759d46fdc93a89b67e"><enum>(h)</enum><header>Leasing</header><paragraph commented="no" display-inline="no-display-inline" id="id0d8e1134242b41559487749dfad61138"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), a lease agreement under this section shall be on terms the Director considers to be in the best interest of the judicial branch and necessary for the accommodation of the Judiciary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd78c58c031ce43dfab08473c60de8ef4"><enum>(2)</enum><header>Limitations</header><subparagraph commented="no" display-inline="no-display-inline" id="id69c2dca623014f8695f31e3d7413bd48"><enum>(A)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">A lease agreement under this section may not bind the Government for more than 20 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fae72624d864a4084a4ddf97bbeba5e"><enum>(B)</enum><header>Obligation</header><text display-inline="yes-display-inline">The obligation of amounts for a lease under this section is limited to the current fiscal year for which payments are due, without regard to section 1341(a)(1)(B) of title 31.</text></subparagraph></paragraph></subsection><subsection id="idc8db1f6d95364d4fa78bd1fc8926d7a8"><enum>(i)</enum><header>Transfer of court accommodations</header><paragraph commented="no" display-inline="no-display-inline" id="idf2661226bc0346c5a37a6e2c08c133cc"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall not transfer, dispose of, or close any court accommodation located in a covered judicial district without obtaining the prior consent of the Director.</text></paragraph><paragraph id="ide04e008d5e7a416e888fe8d52bb3fca8"><enum>(2)</enum><header>Transfer</header><subparagraph commented="no" display-inline="no-display-inline" id="id57b60c29cdca40b2815d9de4d3ffce03"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Upon request of the Director, and consistent with the implementation provisions under section 5 of the <short-title>Judicial Space and Facilities Management Effectiveness Act of 2026</short-title>, the Administrator shall transfer to the Director the jurisdiction, custody, and control of any requested real property owned or leased by the United States, and any lease of real property made on behalf of the United States, that is located in a covered judicial district, is occupied by the judicial branch, and is critical to the constitutional mission of the Judiciary.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id016d4676f6674e4e8afde810c3a87f7a"><enum>(B)</enum><header>Terms</header><text display-inline="yes-display-inline">With respect to any transfer under subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="idea9bf9f37a7b48f796d885c22e160a83"><enum>(i)</enum><text display-inline="yes-display-inline">the transfer shall be nonreimbursable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2a6a13b908054b859479e976d3af3c29"><enum>(ii)</enum><text display-inline="yes-display-inline">after completion of the transfer, the Director shall be responsible for performing all building functions for the applicable real property and to pay the costs of performing such building functions instead of paying rent for that space to the Administrator.</text></clause></subparagraph></paragraph></subsection><subsection id="id90d4998ec5b849d5ad7e7fae4f0e8c78"> <enum>(j)</enum> <header>Request for space or services To be provided by the Administrator</header> <paragraph id="idfd64475841a34980bff7f613e919c3b3" commented="no"> <enum>(1)</enum> <header>In general</header> <text>The Director may request that the Administrator provide, acquire, or maintain in a covered judicial district such court accommodations as may be required by the Judiciary. Upon such a request of the Director, the Administrator shall provide and maintain such court accommodations.</text>
              </paragraph>
              <paragraph id="id0af19caea362477d990179ee543ca620">
                <enum>(2)</enum>
                <header>Multitenant facilities</header>
 <text>If court accommodations are provided under this subsection by the Administrator in a multitenant facility, the Administrator shall give priority to providing court accommodations in contiguous space.</text>
              </paragraph>
              <paragraph id="ida4007636518c4f43aebfb0a4dfd918fc">
                <enum>(3)</enum>
                <header>Alterations</header>
 <text>Consistent with regulatory requirements and leasing responsibilities of the General Services Administration, the Administrator shall endeavor to provide such reasonable alterations to court accommodations provided under this subsection as shall be requested and financed by the Director.</text>
              </paragraph>
              <paragraph id="ida3bb1c1e32b44d56b4d2f37dd038be83">
                <enum>(4)</enum>
                <header>Transfer</header>
 <text>The Director may transfer jurisdiction, custody, and control or leasehold interest of any space or facility acquired by the Director to the Administrator for the provision or maintenance of court accommodations.</text>
              </paragraph>
              <paragraph id="id4da2d68e4c174f78a899a7ae6f3da530">
                <enum>(5)</enum>
                <header>Disposal</header>
 <text>The Director may identify and transfer to the Administrator for disposal, pursuant to section 542 of title 40, any real property under the jurisdiction, custody, and control of the Director, as the Director determines necessary.</text>
              </paragraph>
              <paragraph id="idb543ded4a1e74ba19bcd924477011800">
                <enum>(6)</enum>
                <header>Funding requests</header>
 <text>The Administrator shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfb4ba325c6c34a7fa8b92c619d85ba12"> <enum>(A)</enum> <text display-inline="yes-display-inline">provide the Director, on a nonreimbursable basis, information requested by the Director that assists the Director in the development of funding requests by the Director, including information regarding prospectus-level repair and alteration projects; and</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id4890b878d3ad44bfa4c12346e7024472">
                  <enum>(B)</enum>
 <text display-inline="yes-display-inline">with respect to a project for which the Director does not request funds, request funds in accordance with otherwise applicable law.</text>
                </subparagraph>
              </paragraph>
              <paragraph id="id52da3f8fe19248139f745a6d5dc08dbb">
                <enum>(7)</enum>
                <header>Operation and management</header>
 <text>For real property for which jurisdiction, custody, and control is transferred to the Director under this section, the Administrator shall provide secure access to systems, databases, and information used to operate and manage the real property, including building automation and control systems, real property inventories and data, personal property inventories and data, work order management systems, document archives, drawings, studies, and contracting files.</text>
              </paragraph>
 </subsection><subsection id="id22d0312a3df642d0bca9496979e79444"><enum>(k)</enum><header>Approval of proposed projects by Congress</header><paragraph id="id9f93257ed0374fbaafb1036878b5113b"><enum>(1)</enum><header>Resolutions required before appropriations may be made</header><subparagraph commented="no" display-inline="no-display-inline" id="id3ca751f06d094092a30fea5d97600286"><enum>(A)</enum><header>Construction, purchase, and acquisition</header><text display-inline="yes-display-inline">No appropriation shall be used to construct, purchase, or acquire any space or facility located in a covered judicial district that is to be used as a court accommodation and which involves a total expenditure in excess of $10,000,000, adjusted annually for inflation, if such construction, purchase, or acquisition has not been approved by resolutions adopted by the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph><subparagraph id="id8524e14c65e243ac9f77c58e907d028f"><enum>(B)</enum><header>Alteration</header><text>No appropriation shall be used to alter any space or facility, or part thereof, that is located in a covered judicial district and which is under lease by the Director if the cost of such alteration would exceed $5,000,000, adjusted annually for inflation, unless such alteration has been approved by resolutions adopted by the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1fa665a4a363473c92c6d103f202c403"><enum>(C)</enum><header>Transmission to Congress of prospectus</header><text display-inline="yes-display-inline">For the purpose of securing consideration for such approval, the Director shall transmit to the Congress a prospectus of the proposed construction, purchase, acquisition, or alteration, including the items set forth in paragraph (3) of this subsection that are relevant to the proposal.</text></subparagraph></paragraph><paragraph id="id395611d575664e43913ea871644568b3"><enum>(2)</enum><header>Lease resolutions required before appropriations may be made</header><subparagraph commented="no" display-inline="no-display-inline" id="idd889abcdb591435cab6f64c43f84eff2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>No appropriation shall be used to lease any space or facility for a permanent court accommodation that is located in a covered judicial district and which involves an average annual expenditure in excess of $10,000,000, adjusted annually for inflation, if such lease has not been approved by resolutions adopted by the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19896dc6372b49d1856c618713b54777"><enum>(B)</enum><header>Transmission to Congress of prospectus and statement</header><text display-inline="yes-display-inline">For the purpose of securing consideration for such approval, the Director shall transmit to the Congress—</text><clause commented="no" display-inline="no-display-inline" id="id41d4ecfeaa32476c87b653a8c7c63e7b"><enum>(i)</enum><text display-inline="yes-display-inline">a prospectus of the proposed space or facility including the items set forth in paragraph (3) of this subsection that are relevant to the proposal; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5838969c7754219a14fe3b3e501835c"><enum>(ii)</enum><text display-inline="yes-display-inline">a written statement by the Director setting forth the reasons why leasing such space or facility is necessary to meet requirements which cannot be met in public buildings.</text></clause></subparagraph></paragraph><paragraph id="idad91241ab717423ca154fb0297d97128"><enum>(3)</enum><header>Transmission to Congress of prospectus of proposed project</header><text>To secure consideration for the approval referred to in paragraph (1) or (2) of this subsection, the Director shall transmit to Congress a prospectus of the proposed space or facility, including—</text><subparagraph id="id8548b6a553eb4fb885fba69a1ca2ac0c"><enum>(A)</enum><text>a brief description of the space or facility to be constructed, altered, purchased, or acquired or the space to be leased;</text></subparagraph><subparagraph id="id7d1f1efffbca43d4b6ed905bca0bb148"><enum>(B)</enum><text>the location of the space or facility to be leased and an estimate of the maximum cost to the Federal Government of the facility to be constructed, altered, purchased, or acquired, or the space to be leased;</text></subparagraph><subparagraph id="id6d8469eac68e487790015c5d55cdb362"><enum>(C)</enum><text>a comprehensive plan for providing space for all officers and employees of the judicial branch in the locality of the proposed facility or the space to be leased, having due regard for suitable space which may continue to be available in existing Federal Government-owned or occupied buildings, especially those buildings that enhance the architectural, historical, social, cultural, and economic environment of the locality;</text></subparagraph><subparagraph id="id57703897736047d8b64aa726a7786954"><enum>(D)</enum><text>with respect to any project for the construction, alteration, or acquisition of any facility, a statement by the Director that suitable alternative space already owned or leased by the Federal Government in proximity to the location chosen for such court accommodation is not available and that suitable rental space is not available at a price commensurate with that to be afforded through the proposed action;</text></subparagraph><subparagraph id="ida44ede4f70ee450ab36c75da6879359c"><enum>(E)</enum><text>a statement of rents and other housing costs currently being paid by the Federal Government for Federal agencies to be housed in the facility to be constructed, altered, or acquired, or the space to be leased;</text></subparagraph><subparagraph id="id15024e18b4774d5a9122ad239e778938"><enum>(F)</enum><text>with respect to any prospectus for the construction, alteration, or acquisition of any facility or space to be leased, an estimate of the future energy performance of the facility or space and a specific description of the use of energy efficient and renewable energy systems, including photovoltaic systems, in carrying out the project;</text></subparagraph><subparagraph id="iddf8bbfad836d43abbbb911733bda8a06"><enum>(G)</enum><text>a statement of how the proposed project is consistent with the standards and criteria developed under section 11(b) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>; 130 Stat. 1468);</text></subparagraph><subparagraph id="id5033ac8054a44b79948effbac38aa61d"><enum>(H)</enum><text>information on any space occupied by the judicial branch in the geographical area of the proposed facility, including uses, any proposed consolidations, and, if not proposed to be consolidated, a justification for such determination; and</text></subparagraph><subparagraph id="id26a886f2a7d2401babdd8b6711f288af"> <enum>(I)</enum> <text>a statement by the Director of whether the facility needs of the judicial branch for the proposed space to be leased were formerly met by a federally owned building, including any building identified for disposal or sale.</text>
 </subparagraph></paragraph><paragraph id="id286a74cd99074475b79726ffee2b1984"><enum>(4)</enum><header>Increase of estimated maximum cost</header><text>The estimated maximum cost of any project approved under this subsection as set forth in any prospectus may be increased by an amount equal to any percentage increase, as determined by the Director, in construction or alteration costs from the date the prospectus is transmitted to Congress. The increase authorized by this paragraph may not exceed 10 percent of the estimated maximum cost. The Director shall notify, in writing, the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives of any increase of more than 5 percent of an estimated maximum cost or of any increase or decrease in the scope or size of a project of 5 or more percent. Such notification shall include an explanation regarding any such increase or decrease. The scope or size of a project shall not increase or decrease by more than 10 percent unless an amended prospectus is submitted and approved pursuant to this section.</text></paragraph><paragraph id="id127755c3ff8f4a359718d11cb814ca7d"><enum>(5)</enum><header>Rescissions of approval</header><text>If an appropriation is not made within 1 year after the date a project for construction, purchase, alteration, or acquisition is approved under paragraph (1), the Committee on Environment and Public Works of the Senate or the Committee on Transportation and Infrastructure of the House of Representatives by resolution may rescind its approval before an appropriation is made.</text></paragraph><paragraph id="id4be8356f1e8e4141b731ed7fac8c7ec8"><enum>(6)</enum><header>Emergency leases by the Director</header><text>The Director may enter into emergency leases during any period declared by the President to require emergency leasing authority. An emergency lease may not be for more than 180 days without approval of a prospectus for the lease in accordance with paragraph (2).</text></paragraph><paragraph id="id1810e028c6284a2f80f1fa1451ee9f17"><enum>(7)</enum><header>Minimum performance requirements for leased space</header><text>With respect to space to be leased, the Director shall include, to the maximum extent practicable, minimum performance requirements requiring energy efficiency and the use of renewable energy.</text></paragraph><paragraph id="idf7495a7d18d04aa19e9387165cfe56cb"><enum>(8)</enum><header>Dollar amount adjustment</header><text>The Director annually may adjust any dollar amount referred to in this section to reflect a percentage increase or decrease in construction costs during the prior calendar year, as determined by the composite index of construction costs of the Department of Commerce. Any adjustment shall be expeditiously reported to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></paragraph><paragraph id="id1d9d201eed9a4879b5d59dbcb8ce5a54"><enum>(9)</enum><header>Notification requirement</header><text>For each project approved under this subsection, the Director shall notify, in writing, the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives of any project milestones that are accomplished, including—</text><subparagraph id="ideda13a3c4a6141919636a80a836c0ce8"><enum>(A)</enum><text>the solicitation and award of design and construction services;</text></subparagraph><subparagraph id="id0c9be3860e0d48cf8e49b5f5c8493b71"><enum>(B)</enum><text>the completion of any actions required for the project pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="id16d18150a6774ca380722b62fda98b64"><enum>(C)</enum><text>any ceremonies for the beginning or completion of the project;</text></subparagraph><subparagraph id="id6ef7c60201cc4730b02179622f94878a"><enum>(D)</enum><text>a naming ceremony for the project; and</text></subparagraph><subparagraph id="id440671ab7f604f78be1e3f4e4da1f620"><enum>(E)</enum><text>the completion of the project.</text></subparagraph></paragraph><paragraph id="idaddeb4ed78fb40a8b1d69a2dee3b59dc"><enum>(10)</enum><header>Expiration of committee resolutions</header><text>Unless a lease is awarded or a construction, purchase, alteration, repair, design, or acquisition project is initiated on or before the date that is 5 years after the resolution of approval is adopted by the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate pursuant to paragraph (1) or (2), as applicable, the resolutions shall be deemed expired.</text></paragraph></subsection><subsection id="ide483e682c2144906a3f1e043c5a7dbc3"><enum>(l)</enum><header>Judicial Space and Facilities Management Fund</header><paragraph id="id75f18108c9eb4fcf8df0571e9fafe154"><enum>(1)</enum><header>Fund</header><subparagraph commented="no" display-inline="no-display-inline" id="id2eb1362dc7a34066b204568aa1e15bb7"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Judicial Space and Facilities Management Fund</quote>.</text></subparagraph><subparagraph id="id28666324130f43d98c3fe08f926e2611"><enum>(B)</enum><header>Deposits</header><text>There shall be deposited in the Space and Facilities Fund the following:</text><clause id="idc2efc9c524894f64b6f30f48c6825e0f"><enum>(i)</enum><text>Amounts appropriated to the Judiciary in annual appropriations Acts that are available for the activities described in paragraph (3), in such amounts as determined by the Director.</text></clause><clause id="id52e045d90719480587815ba1937246c0"><enum>(ii)</enum><text>Advances or reimbursements from any entity in the judicial branch for the activities and services described in paragraph (3).</text></clause><clause id="idea6315cd85824501a680ec4a4f7ac54e"><enum>(iii)</enum><text>Advances and reimbursements obtained pursuant to subsection (m) of this section and section 6506(a) of title 40.</text></clause><clause id="id8ee56d24e50445d499d7bd6934c3ebd4"><enum>(iv)</enum><text>Such other funds as Congress may appropriate to the Space and Facilities Fund from time to time, including funds appropriated for projects approved pursuant to subsection (k).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf67713c8e01848bba91e06474dfa0883"><enum>(C)</enum><header>Availability</header><text>Amounts deposited in the Space and Facilities Fund shall be available until expended for the purposes set forth in this subsection.</text></subparagraph></paragraph><paragraph id="idf5cae8b50c9942d7afb9fcf3d2c59f8f"><enum>(2)</enum><header>Transfer of deposits</header><text>The Director—</text><subparagraph commented="no" display-inline="no-display-inline" id="id16708d0bac2d4dc180dafa48ac72fae1"><enum>(A)</enum><text display-inline="yes-display-inline">may transfer not more than $1,000,000 in a fiscal year from the Space and Facilities Fund into the fund or account from which the funds were originally appropriated; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9821120ed2f485a8a57d660e88ba92c"><enum>(B)</enum><text display-inline="yes-display-inline">if, not later than 15 days before the date of the transfer, the Director provides notice to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives, may transfer more than $1,000,000 in a fiscal year from the Space and Facilities Fund into the fund or account from which the funds were originally appropriated.</text></subparagraph></paragraph><paragraph id="id570fd68c6b4c4e98917e766fb6d91619"><enum>(3)</enum><header>Use of the Space and Facilities Fund</header><text>The Space and Facilities Fund shall be available for the acquisition, alteration, construction, and management of space and facilities and related activities, including—</text><subparagraph id="id9444fe4f3e9f42e4abd8b527c7211f28"><enum>(A)</enum><text>the acquisition of space and facilities for court accommodations in a covered judicial district;</text></subparagraph><subparagraph id="ida8f1a0611f1e4f708e1b3b1bcf0de710"><enum>(B)</enum><text>the lease of space or facilities for court accommodations in a covered judicial district;</text></subparagraph><subparagraph id="idad9cfeb0536b470485d1500f20ad21a7"><enum>(C)</enum><text>the construction or alteration of facilities under the jurisdiction, custody, and control of the Director;</text></subparagraph><subparagraph id="ide651a42dc949479db520c1866172d0c0"><enum>(D)</enum><text>the maintenance of space under the jurisdiction, custody, and control of the Director;</text></subparagraph><subparagraph id="id23271e089cbb473db264024df9898068"><enum>(E)</enum><text>the management, overhead costs, and information technology requirements associated with the acquisition, construction, lease, maintenance, or management of space under the jurisdiction, custody, and control of the Director; and</text></subparagraph><subparagraph id="idbce63f68a3fa415192e2eb3ae4dddb77"><enum>(F)</enum><text>the provision of furniture, fixtures, and equipment.</text></subparagraph></paragraph><paragraph id="id3c13dafcd9c14acdb76095e01ea86be6"><enum>(4)</enum><header>Reimbursement of the General Services Administration</header><text>Amounts deposited into the Space and Facilities Fund shall also be available for rent and reimbursement to the General Services Administration for court accommodations provided, altered, or maintained by the General Services Administration.</text></paragraph><paragraph id="id2f52c93ff9454d5f98f6da779bbf51fd"><enum>(5)</enum><header>Plan for meeting space and facilities management needs</header><text>The Director shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide56ccf6787c846019107cddbf851017d"><enum>(A)</enum><text display-inline="yes-display-inline">develop and annually revise, with the approval of the Judicial Conference of the United States, a long-range plan for meeting the space and facilities management needs of the activities funded under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3bdc52f93a7c407a812384b8590514e0"><enum>(B)</enum><text display-inline="yes-display-inline">submit each plan under subparagraph (A) to—</text><clause commented="no" display-inline="no-display-inline" id="id2167d2591d644f969bfbb8adc403642c"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Appropriations and the Committee on Environment and Public Works of the Senate; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3c17b517328a4464b5c5a47a5836304c"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Appropriations and the Committee on Transportation and Infrastructure of the House of Representatives.</text></clause></subparagraph></paragraph><paragraph id="idae38679cc74f4268b415470cf7a15e97"><enum>(6)</enum><header>Quarterly reporting</header><text>Not later than 90 days after the end of each fiscal quarter, beginning with the first fiscal quarter in which the transfer of jurisdiction, custody, and control of any real property or lease takes place under this section, the Director shall submit to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives a report on expenditure activity of the Judiciary Buildings Service for the fiscal quarter that includes—</text><subparagraph id="id1e8cf95ee2f049b39519c70d74efbe84"><enum>(A)</enum><text>any amounts deposited in the Space and Facilities Fund during the fiscal quarter and cumulatively during the most recent fiscal year;</text></subparagraph><subparagraph id="id05f63c04341b40c58c7b5c56e89744c4"><enum>(B)</enum><text>any amounts obligated from the Space and Facilities Fund during the fiscal quarter and cumulatively during the most recent fiscal year, including amounts used for—</text><clause id="iddd1e6e5b03094100a6917736f8a35cc9"><enum>(i)</enum><text>rent and reimbursements to the General Services Administration under subsection (l)(4);</text></clause><clause id="idd4e50a21a66d49a484e5041c2da9a882"><enum>(ii)</enum><text>operating costs for facilities transferred to the Director under subsection (i);</text></clause><clause id="idf5ba24122e134ad7af4d1482e9d4402d"><enum>(iii)</enum><text>leasing costs for leases executed or assumed by the Director;</text></clause><clause id="ide03fdbc974884df48aecaac1734fe14f"><enum>(iv)</enum><text>management and administrative costs resulting from the execution of authority under this section; and</text></clause><clause id="id5c80650989ee4aeeb51e19dc6bc3aeef"><enum>(v)</enum><text>capital costs for facilities transferred to the Director under subsection (i); and</text></clause></subparagraph><subparagraph id="idcdeac2dd34c24030b64569c9d3f2fdf0"><enum>(C)</enum><text>a list of each capital expenditure project for which the total expenditure or cost exceeded the applicable threshold under subsection (k)(1), including—</text><clause id="idf7fa793454ea489193a82ab65c8c57e9"><enum>(i)</enum><text>a description of the project, including milestones reached during the fiscal quarter;</text></clause><clause id="idd3810bc9eb1c46628a508cb0b0cd1096"><enum>(ii)</enum><text>the total cost estimate of the project, including an explanation of any diversion from a previously reported estimate;</text></clause><clause id="idc25eab7865e04f85bc7a27fe14281611"><enum>(iii)</enum><text>the expected date of completion, including an explanation of any delay from previous reporting; and</text></clause><clause id="idd082e43a493d4d8a826b274d06e5e409"><enum>(iv)</enum><text>obligations for the project—</text><subclause commented="no" display-inline="no-display-inline" id="ide8613744914945ccb7dd889f32b5de50"><enum>(I)</enum><text display-inline="yes-display-inline">during the fiscal quarter;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb86e73826984481884ce81cfc09489d1"><enum>(II)</enum><text display-inline="yes-display-inline">cumulatively during the most recent fiscal year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id16b0e178032a43a78e018ce2aa7133c8"><enum>(III)</enum><text display-inline="yes-display-inline">cumulatively overall.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idf5da3a737bcb49a497e442cf41cf9c25"><enum>(m)</enum><header>Use of space and facilities</header><paragraph id="ide0e52fd576e4448d849851058d8c2579"><enum>(1)</enum><header>Excess space</header><text>The Director is authorized to make available excess space in all facilities under the jurisdiction, custody, and control of the Director to entities not in the judicial branch on a reimbursable or nonreimbursable basis, as determined appropriate by the Director.</text></paragraph><paragraph id="idb6a4e5b341b3462db5ba219da9c3d843"><enum>(2)</enum><header>Federal agencies</header><subparagraph commented="no" display-inline="no-display-inline" id="id39d8f10cb1dd4808a2b82d963fc5e75f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Director is authorized to charge Federal agencies, and Federal agencies are authorized to pay, by advance or reimbursement, a reasonable rate for administering the space and other improvements (including the cost of operation, maintenance, rehabilitation, security, administrative overhead, and structural, mechanical, and domestic care) furnished to Federal agencies.</text></subparagraph><subparagraph id="id6c5d664f899e4a73b750141608a2d19a"><enum>(B)</enum><header>Amount</header><text>Charges under subparagraph (A) shall cover the full cost incurred by the Director for the furnishing of such space or other improvements including a charge for the depreciation and future capital upgrades and replacements.</text></subparagraph></paragraph><paragraph id="ida4cb5ee1def14513ad2eaa5cbbbf1bab"><enum>(3)</enum><header>Outleased space</header><text>The Director is authorized to charge a reasonable rate for outleased space, with the amount to be determined by the Director and the entity.</text></paragraph></subsection><subsection id="id11667105904e4293940296d17f551164"><enum>(n)</enum><header>Reimbursement of Administrator</header><text>The Director shall pay rent and reimburse the Administrator for court accommodations provided or maintained by the General Services Administration at rates to be negotiated with the Director, but in no case shall such rates exceed the actual costs incurred by the General Services Administration for the provision of the court accommodation.</text></subsection><subsection id="idacb42c543a06431887027fee6ff8b30d"><enum>(o)</enum><header>Audit requirements</header><paragraph commented="no" display-inline="no-display-inline" id="idb3ae38a0869348169887094a0871f4a2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Director shall audit the vouchers and transactions of the Space and Facilities Fund annually.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida50a54a3f02740798053765f98a01ae0"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">An audit described in paragraph (1) shall be performed by an independent certified public accounting firm.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6bae9c235b4149d0baff5522984a6850"><enum>(3)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">Not later than 30 days after the results of an audit described in paragraph (1) are issued, the Director shall submit to Congress a report regarding the audit.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1fd9dbe74784cb7ba6de113c5924d43"><enum>(4)</enum><header>Access for Federal agencies</header><text display-inline="yes-display-inline">Upon request by a Federal agency occupying space within a property under the jurisdiction, custody, and control of the Director, the Director shall provide access to the audit reports described in paragraph (1) relating to the property.</text></paragraph></subsection><subsection id="idfb459990496248c4aa6c31f4092bcbb3"><enum>(p)</enum><header>Federal regulatory requirements</header><text>If the Director acquires, constructs, leases, alters, or maintains any court accommodations, whether by contract or otherwise, the Director shall comply with statutory and regulatory provisions which are applicable to all public buildings or which otherwise are applicable to all Federal agencies, including the judicial branch.</text></subsection><subsection id="id2105274632f34039b9f491f4a250e70a"><enum>(q)</enum><header>Judicial conference of the United States supervision and direction</header><text>The Director shall administer all authorities under this section under the supervision and direction of the Judicial Conference of the United States.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2c47993da7d245f5abc85d8741b2550c"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/41">chapter 41</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/604">section 604</external-xref> the following:</text><quoted-block style="USC" id="idab8ede05-7e37-41c4-8b37-c223c76784aa"><toc><toc-entry level="section" idref="ide413d95b1ca44918978b03ba0c3052ae">604A. and</quote>; and</text></subparagraph><subparagraph id="id46bbeed5eb7c424292e278c9307a9a5f"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51b8dc9764f749048009e956be7445c8"><paragraph id="id6b876a99efa149aa892c77edce2044fb"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Administrative Office of the United States Courts or the designee of the Director, except that when there is a vacancy in the office of the Director, the Acting Director or, in the absence of the Acting Director, the Deputy Director shall be deemed to be the Director for purposes of this chapter until the vacancy is filled.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idfaa5f889ccf14c4b992b318114734304"><enum>(2)</enum><text>in section 6502—</text><subparagraph commented="no" display-inline="no-display-inline" id="id880fbb895fd147f0af88d176e17c835b"><enum>(A)</enum><text>by striking subsection (b)(2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8b79d093c5424c5382339d220ec73928"><paragraph commented="no" display-inline="no-display-inline" id="id65471e5d51174e7bb4a59fb2b16184fe"><enum>(2)</enum><header>Building</header><text display-inline="yes-display-inline">Title to the Building and other improvements constructed on Squares 721 and 722 remains in the Federal Government.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41af3af6ad6c4ed6ac217808b175da19"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsection (g) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9c8a61a378d748e08552010c67843229"><subsection id="idc57bf38a8a5a450b92cd83637f100ef0"><enum>(g)</enum><header>Accounting system</header><text>The Director shall maintain an accounting system for operation and maintenance of the Building and other improvements which will allow accurate projections of the dates and cost of major repairs, improvements, reconstructions, and replacements of the Building and improvements and other capital expenditures on the Building and improvements.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2e4bd7ff48aa469d837bbceef049f77b"><enum>(3)</enum><text>by striking sections 6503 and 6504;</text></paragraph><paragraph id="idc1233476edde4f9c806b0e5928e5b084"><enum>(4)</enum><text>by redesignating section 6505 as section 6503;</text></paragraph><paragraph id="idb3b9ffdf600a40b3854d4bce5e344c8b"><enum>(5)</enum><text>in section 6503, as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2d83960ad79e4b74b4867ffee1b851d5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id364928149a9947c8b43aadad6108e971"><subsection id="idb3f32a943843498b9afe4e3627c67230"><enum>(a)</enum><header>Transfer of jurisdiction</header><paragraph commented="no" display-inline="no-display-inline" id="ide68a82b4f6714b32a932fb0a644b01d7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Effective on the date that is 181 days after the date of enactment of the <short-title>Judicial Space and Facilities Management Effectiveness Act of 2026</short-title>, the jurisdiction, custody, and control of the Thurgood Marshall Federal Judiciary Building shall be transferred to the Director.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6cb583b36f574f138ee0d8bf63571831"><enum>(2)</enum><header>Terms</header><text display-inline="yes-display-inline">The transfer under paragraph (1) shall be nonreimbursable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd33e12086caa4a458d9b20a8d3611165"><enum>(3)</enum><header>Responsibility</header><text display-inline="yes-display-inline">After completion of the transfer under paragraph (1), the Director shall be responsible for performing all building functions relating to the Thurgood Marshall Federal Judiciary Building and to pay the costs thereof.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idb7676d4126b94aaf996e186f6fdc099e"><enum>(B)</enum><text>in subsection (b), by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc3f909eecbce4630ab710c1c918f12ba"><paragraph id="ide05b4e70d77f4f6696e88f787ac8616b"><enum>(3)</enum><header>Reimbursement</header><text>The Director shall transfer from the Judicial Space and Facilities Management Fund established under section 604A(l) of title 28 amounts necessary to reimburse the United States Capitol Police for expenses incurred in providing exterior security under this subsection. The Capitol Police may accept amounts the Director transfers under this paragraph. Those amounts shall be credited to the appropriation account charged by the Capitol Police in carrying out security duties.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4cb0fbc0b314443599f139102a925b5a"><enum>(6)</enum><text>by redesignating section 6506 as section 6504;</text></paragraph><paragraph id="idcaaf0abc2894403a9ac28f909f2f19ec"><enum>(7)</enum><text>in section 6504, as so redesignated, by striking subsections (a) through (f), and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id821eaabea6a640e48a3dd0f3f910dbcd"><subsection id="id037dc86b75384d978363a3a908dc76f9"><enum>(a)</enum><header>Priority</header><paragraph id="id85fb374eaddc4401860b08473deb4a31"><enum>(1)</enum><header>Judicial branch</header><text>Subject to this section, the Director may make available to the judicial branch of the Federal Government all space in the Thurgood Marshall Federal Judiciary Building and other improvements constructed under this chapter.</text></paragraph><paragraph id="id1e06e373c99c4513a68bbf6fe2529b2a"> <enum>(2)</enum> <header>Other Federal governmental entities</header> <text>The Director may make available, on a reimbursable basis, to Federal Government entities which are not part of the judicial branch, and which are not staff of Members of Congress or congressional committees, any space in the Building and other improvements that the Director decides are not needed by the judicial branch.</text>
 </paragraph><paragraph id="id3117b4d1f8054e698bc5460f92870434"><enum>(3)</enum><header>Other persons</header><text>If any space remains, the Director may sublease it to any person, pursuant to subsection (d).</text></paragraph></subsection><subsection id="idd6401aa6c3204b14ae863cfba5f7d9c1"><enum>(b)</enum><header>Space for judicial branch and other Federal Governmental entities</header><text>Space made available under paragraph (1) or (2) of subsection (a) is subject to—</text><paragraph id="idaf9e38cb6e1048779d68b05a486c937c"><enum>(1)</enum><text>terms and conditions necessary to carry out the objectives of this chapter; and</text></paragraph><paragraph id="idaae3323ae7954d0889887a178ad9cd0d"><enum>(2)</enum><text>reimbursement at an appropriate rental rate established by the Director based on square foot of occupiable space plus an amount necessary to pay each year for the cost of administering the Building and other improvements (including the cost of operation, maintenance, rehabilitation, security, administrative overhead, and structural, mechanical, and domestic care) that is attributable to the space, with the amount to be determined by the Director and, in the case of any Federal Governmental entity not a part of the judicial branch, the entity.</text></paragraph></subsection><subsection id="id2f61b07b62874a67a0e3b9d0a8fa20ea"><enum>(c)</enum><header>Space for judicial branch</header><paragraph id="idc6ec53d843c84ccdb97bb5dd4c4ffeca"><enum>(1)</enum><header>In general</header><text>The Director may assign space made available to the judicial branch under subsection (a)(1) among offices of the judicial branch as the Director considers appropriate.</text></paragraph><paragraph id="id05e2d421c9304b3cb556313525caaf64"><enum>(2)</enum><header>Vacating occupied space</header><text>When the Chief Justice notifies the Director that the judicial branch requires additional space in the Building and other improvements, the Director shall accommodate those requirements within 90 days after the date of the notification, except that if the space was made available to the Administrator of General Services, it shall be vacated expeditiously by not later than a date the Chief Justice and the Director agree on.</text></paragraph><paragraph id="idb3a29f28e9f34ee7aa79c1981b3e3ca7"><enum>(3)</enum><header>Unoccupied space</header><text>The Chief Justice has the right of first refusal to use unoccupied space in the Building to meet the needs of the judicial branch.</text></paragraph></subsection><subsection id="id482bc9d236f647a385fefaad2b5674e2"><enum>(d)</enum><header>Outleased space</header><paragraph id="idadd79cc429d84499b94880f917ff3dc1"><enum>(1)</enum><header>Rental rate</header><text>Space outleased by the Director under subsection (a)(3) is subject to reimbursement at a reasonable rate, with the amount to be determined by the Director and the entity.</text></paragraph><paragraph id="id8b1cfd9eb4f24e93a8743100042cb6b3"><enum>(2)</enum><header>Collection of rent</header><text>The Director shall collect, and lessees are authorized to pay, rent for space outleased under paragraph (3) of subsection (a).</text></paragraph></subsection><subsection id="id4ee4f4e6d7744414bb9a0344a8d123cd"><enum>(e)</enum><header>Deposit of rent and reimbursements</header><text>Amounts received under subsection (a)(3) (including lease payments and reimbursements) shall be deposited into the Judicial Space and Facilities Management Fund established under section 604A(l) of title 28.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idfdf98b5e8f6c450b97a0291bcb2be8fe"><enum>(8)</enum><text>by striking section 6507.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6de8dbabb80f481a8a0b1ef2f22d92b5"><enum>(b)</enum><header>Conforming amendments</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/65">chapter 65</external-xref> of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5089526d87704408b0ba6514ceb002ea"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item relating to section 6501 and inserting the following:</text><quoted-block style="USC" id="ida2052e1a-99d0-46d7-8a92-bbdf083f1a0b"><toc><toc-entry level="section">6501.  </subsection></section><section id="idc88db241781345f9b4b1d147c0b952e7" commented="no"><enum>5.</enum><header>Implementation of Act</header><subsection id="idf7192dbae256489b831e132ccb809a8c" commented="no"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id9884e36a208a4b80b255e612bdb08f7d"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administration</term> means the General Services Administration;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbf69990a84e47c08ac7ae7cf20c36e2"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means the Administrator of General Services;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided4d7ed1d01341569a3aa95d4cbfc7c0"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>court accommodation</term> has the meaning given that term in section 604A(a) of title 28, United States Code, as added by this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe11416452a040adb0b57aa57a4c4185"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Administrative Office of the United States Courts.</text></paragraph></subsection><subsection id="id926530103cf24ab0ad722d7dd2b900a9"><enum>(b)</enum><header>Implementation in general</header><text>To ensure the orderly transition of buildings from the Administration to the Administrative Office of the United States Courts, the Director is authorized to withhold from funds appropriated for the payment of rent to the Administration by the Director such sums as are necessary to implement the Judiciary Buildings Service.</text></subsection><subsection id="id4f10bf08908149e2a4f7e20cc0c64351"><enum>(c)</enum><header>Initial transfer of properties</header><paragraph commented="no" display-inline="no-display-inline" id="idabc025b4f4904d838f3d6a194d9e7c9f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>On and after the date of enactment of this Act, the Director may request that the Administrator transfer from the Administration to the Director jurisdiction, custody, and control of any real property or lease housing court accommodations in a judicial district identified under section 604A(b) of title 28, United States Code, as added by section 2 of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4fbe875f901348cc8223649e726bbb45"><enum>(2)</enum><header>Transfer</header><text display-inline="yes-display-inline">Not later than 90 days after a request by the Director to transfer jurisdiction, custody, and control of any real property or lease under paragraph (1), or such other date as is agreed to by the Director and the Administrator, the Administrator shall transfer the property or lease to the Director.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48fb3f11131f49c39b70cc8af4433cf8"><enum>(3)</enum><header>Information</header><text display-inline="yes-display-inline">For any real property or lease being transferred to the Director, the Administrator shall provide to the Director essential information required for the transfer of building management, including detailed operating costs, shell costs, budget projections, planned and ongoing projects, condition assessments, drawings, operational procedures, warranties, rental rates for each tenant, occupancy data, agreements, and ongoing contracts.</text></paragraph></subsection><subsection id="id10e519bff958480eb0cb3897c91f19db"><enum>(d)</enum><header>Report and plan</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Director shall submit to the Committee on Environment and Public Works and the Committee on Appropriations of the Senate and the Committee on Transportation and Infrastructure and the Committee on Appropriations of the House of Representatives a report—</text><paragraph commented="no" display-inline="no-display-inline" id="idf1a6927362324330bb81db9dd97c1949"><enum>(1)</enum><text display-inline="yes-display-inline">discussing the implementation and execution of real property authority for the real property and leases transferred under section 604A of title 28, United States Code, as added by section 2 of this Act, including—</text><subparagraph id="id26126066004448119434dd01d0785d06"><enum>(A)</enum><text>the number of leases signed;</text></subparagraph><subparagraph id="id2120186c1d1b4d9fa256ebdd9b6c7f2b"><enum>(B)</enum><text>the number of leases terminated;</text></subparagraph><subparagraph id="id9bd68d49e0584b919ff27bebae0d68f1"><enum>(C)</enum><text>the total number of leased spaces;</text></subparagraph><subparagraph id="id45191b22236b4f97817f8a04390ab753"> <enum>(D)</enum> <text>the amount of square footage leased;</text>
 </subparagraph><subparagraph id="id7e0b857e8c0d4832b9a3da2758153f75"><enum>(E)</enum><text>the amount of square footage occupied;</text></subparagraph><subparagraph id="id8eca5ef788614b94b1763099ddaf9f47"><enum>(F)</enum><text>the amount of vacant leased space;</text></subparagraph><subparagraph id="ide394fc412f9847f0982376f19ca68bde"><enum>(G)</enum><text>the number of buildings owned;</text></subparagraph><subparagraph id="id2252160d5c9c4d439bb466a8418aa15f"><enum>(H)</enum><text>top customers by square feet and annual rent;</text></subparagraph><subparagraph id="id8d13c909c6e64ecf9432216c8d0bda9f"><enum>(I)</enum><text>completed new construction, major repair, and alteration projects; and</text></subparagraph><subparagraph id="idb4e67dcb694045c9b77fc6a37d5cd933"><enum>(J)</enum><text>financial indicators that measure and analyze space utilization, operating costs per square foot, cost-avoidance due to building disposals and lease termination, and, to the extent that the Administrator provides relevant building data to the Director, deferred maintenance liabilities; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2b1e5671a024f498ff370f05f8c7b8a"><enum>(2)</enum><text display-inline="yes-display-inline">providing information regarding a plan and proposed timeline for the orderly transfer of properties or leases in addition to the real property and leases transferred under section 604A of title 28, United States Code, as added by section 2 of this Act.</text></paragraph></subsection></section><section id="id280a97af17b94118a68d05d6b6cb4ea2"><enum>6.</enum><header>GAO report on the Judiciary buildings service</header><subsection id="id301337a690734efb8a5099f98a97765c"><enum>(a)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Comptroller General of the United States shall—</text><paragraph id="id8e078758aa294f2398e9d40bb988224b"><enum>(1)</enum><text>conduct a review of the actions taken by the Director of the Administrative Office of the United States Courts (in this section referred to as the <term>Director</term>) under this Act and the amendments made by this Act; and</text></paragraph><paragraph id="ideb83585a864b473bad0aba678dc1a5dc"><enum>(2)</enum><text>submit to Congress a report on the review conducted under paragraph (1), which shall include a description of—</text><subparagraph id="id51734a695d654a6bbd9dfad5f689e9b8"><enum>(A)</enum><text>the operation, procurement, and contracting processes of the Judiciary Buildings Service;</text></subparagraph><subparagraph id="ide093f62ef46946adaeacae6d8a9a2144"><enum>(B)</enum><text>contracts awarded by the Judiciary Buildings Service;</text></subparagraph><subparagraph id="id9270defdf4184bd4961daf824c676c39"><enum>(C)</enum><text>any instances of waste, fraud, abuse, or mismanagement by the Judiciary Buildings Service; and</text></subparagraph><subparagraph id="idbe33be9088174917897adcb110dfca7f"><enum>(D)</enum><text>the vouchers, transactions, and use of the Judicial Space and Facilities Management Fund established under 604A(l)(1)(A) of title 28, United States Code, as added by this Act.</text></subparagraph></paragraph></subsection><subsection id="idf0fbf2a60e2e4792a4e167f43d800073"><enum>(b)</enum><header>Access</header><text>For real property for which jurisdiction, custody, and control is transferred to the Director under this Act and the amendments made by this Act, the Director shall, upon the request of the Comptroller General of the United States, provide secure access to systems, databases, and information used to operate and manage the real property, including building automation and control systems, real property inventories and data, personal property inventories and data, work order management systems, document archives, drawings, studies, and contracting files.</text></subsection></section><section id="id7165fca61eb94d67838d2a72b47d3310"><enum>7.</enum><header>Sunset</header><subsection commented="no" display-inline="no-display-inline" id="idb7b3b0be912548f9826f4f28075517e2"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id2517164039ce4fffaadb5fab3c484b01"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means the Administrator of General Services; and</text></paragraph><paragraph id="id50448b4b6611465e965a7a694dba72c3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Administrative Office of the United States Courts.</text></paragraph></subsection><subsection id="idb69fb1aba37a46dda2015a7e572b3dba"><enum>(b)</enum><header>Sunset of transfer authority of Director</header><text display-inline="yes-display-inline">The authority of the Director under section 604A of title 28, United States Code, as added by section 2 of this Act, to request the transfer of jurisdiction, custody, and control of real property and leases from the Administrator shall cease to have effect on the date that is 7 years after the date of enactment of this Act.</text></subsection><subsection id="id65d9f2eba91f46d69392193d314f7beb"><enum>(c)</enum><header>Orderly transfer of assets back to GSA</header><paragraph commented="no" display-inline="no-display-inline" id="id387eb5237f1f44b8b2dfbb3466785237"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>On the date that is 10 years after the date of enactment of this Act, the Director and the Administrator shall begin an orderly transfer back to the Administrator of the real property and leases previously transferred to the Director under the authority described in subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c7a3cb6dc6d42a0ae62e93529453b6b"><enum>(2)</enum><header>Sunset of remaining authority of Director</header><text display-inline="yes-display-inline">On the date on which the Administrator certifies to Congress that all the real property and leases described in paragraph (1) have been transferred back to the Administrator, the remaining authority of the Director under this Act and the amendments made by this Act shall cease to have effect.</text></paragraph></subsection><subsection id="idd7882d7c22494c90bb177a4787c2704b"><enum>(d)</enum><header>Repeal</header><text>Effective on the date that is 15 years after the date of enactment of this Act, this Act is repealed, and each provision of law amended by this Act is amended to read as it read on the day before the date of enactment of this Act.</text></subsection></section><section id="id62f38ea8a42f449fb2e2e91f9517c4ad"><enum>8.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that, if the Judiciary proves to be successful in managing real property and leases for which jurisdiction, custody, and control are transferred under section 604A of title 28, United States Code, as added by section 2 of this Act, the extension of real property authority over additional facilities housing the Judiciary should be considered to ensure that the administration of justice is not negatively impacted by deficient facilities.</text></section><section id="idb74f740ce1ff4946ba06638ea072ece2"><enum>9.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of any such provision or amendment to any person or circumstance, is held invalid, the validity of the remainder of this Act and the amendments made by this Act, and the application of such provision or amendment to any other person or circumstance shall not be affected thereby.</text></section></legis-body></bill>
