<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5189</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260730">July 30, 2026</action-date><action-desc><sponsor name-id="S361">Ms. Hirono</sponsor> (for herself, <cosponsor name-id="S386">Ms. Duckworth</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, <cosponsor name-id="S270">Mr. Schumer</cosponsor>, <cosponsor name-id="S428">Ms. Alsobrooks</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S402">Ms. Rosen</cosponsor>, <cosponsor name-id="S436">Ms. Slotkin</cosponsor>, <cosponsor name-id="S408">Mr. Hickenlooper</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S426">Mr. Kim</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S418">Mr. Fetterman</cosponsor>, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, <cosponsor name-id="S406">Mr. Kelly</cosponsor>, <cosponsor name-id="S427">Mr. Schiff</cosponsor>, and <cosponsor name-id="S354">Ms. Baldwin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, and the National Defense Authorization Act for Fiscal Year 1994, to codify and clarify gender neutral standards for members of certain Armed Forces, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H18AEB306B9434E5EBE04A049E7E2E835"><section section-type="section-one" id="H2B2FF59AFECB4C919AAB78531AA7C15F"><enum>1.</enum><header>Gender neutral standards in certain Armed Forces</header><subsection id="HA99DE954C0E741338BE55125968B1770"><enum>(a)</enum><header>Prohibition on exclusion of a member of certain Armed Forces from an assignment on the basis of gender</header><paragraph id="H246EA7DE89BE4969AC477D20E55A8C90"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 652 of title 10, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="HBC0718B80E314A328FD89D49E312D7C8"><section id="HE1C985FBE74E4E47A3B0EF99213104DA"><enum>652.</enum><header>Prohibition of exclusion from assignments on the basis of gender</header><subsection display-inline="no-display-inline" id="H28FA25E5A2E1450AB2872F6333FA4FC4"><enum>(a)</enum><header>Prohibition</header><text>A member of the Army, Navy, Marine Corps, Air Force, or Space Force may not be excluded from an occupational specialty, career field, or assignment on the basis of gender.</text></subsection><subsection id="HFAF7E62CC9EE455197631E0EAF91375C"><enum>(b)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Representatives an annual report that includes, with respect to the year preceding the date of the report, the following:</text><paragraph id="H16E669C36D224E659DC58F31F8568953"><enum>(1)</enum><text display-inline="yes-display-inline">Any change to an occupational standard, including a description of how such change predicts performance of actual, regular, and recurring duties of a military occupational specialty.</text></paragraph><paragraph id="H2CDADB101F7043FF81E655C9E0B1C6DA"><enum>(2)</enum><text display-inline="yes-display-inline">The number of members, disaggregated by military occupational specialty and gender, who were involuntarily reclassified or separated for a reason other than discipline or pursuant to a sentence of a court-martial.</text></paragraph><paragraph id="H535A4A2D004A47EF8DE343DFFA20EE1C"><enum>(3)</enum><text>The reasons for reclassifications or separations described in paragraph (2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HB65D93EAFE7B4E45ABFAE89E525A6BC5"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 8225 of title 10, United States Code, is repealed.</text></paragraph><paragraph id="H56F736AB328E4CEDB0C38680EA53FED3"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on September 30, 2026. The first report under subsection (b) of section 652 of such title, as amended by this section, shall be due on September 30, 2027.</text></paragraph></subsection><subsection id="H40509CA1EA654BC398DA3CD94DE386F6"> <enum>(b)</enum> <header>Gender-Neutral occupational standard for a military career designator: modernization; additional information to Congress To review a proposed change</header> <paragraph id="H8F826365D4A749AE94533CA525119057"> <enum>(1)</enum> <header>Modernization</header> <text display-inline="yes-display-inline">Section 543 of the National Defense Authorization Act for Fiscal Year 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/160">Public Law 103–160</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note) is amended—</text>
          <subparagraph id="H24224310BC9F44E3BB65D8F5CB1F8595">
            <enum>(A)</enum>
 <text>in subsection (a)—</text> <clause id="H6700A8D5001645AE9F966E1A821AC554"> <enum>(i)</enum> <text>in the matter preceding paragraph (1), by striking <quote>that is open to both male and female members of the Armed Forces</quote>; and</text>
            </clause>
            <clause id="HCEDAAA16553C47F9954796AFBF862D54">
              <enum>(ii)</enum>
 <text display-inline="yes-display-inline">in paragraph (3), by striking <quote>women in that occupational career field</quote> and inserting <quote>individuals in such occupational career field on the basis of gender</quote>;</text>
            </clause>
          </subparagraph>
          <subparagraph id="H23378B8AFB864D3CBD029DA02114DCE2">
            <enum>(B)</enum>
 <text>in subsection (b)—</text> <clause id="H4120EDF6F33E48BCB0B3B5DD1C4CEC31"> <enum>(i)</enum> <text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Specific Physical Requirements</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Occupational Performance Standards</header-in-text></quote>;</text>
            </clause>
            <clause id="HF9C62DD75BDC45078EA2A759984E5D67">
              <enum>(ii)</enum>
 <text>in paragraph (1)—</text> <subclause id="HADB3C004D3E248B1A0B586E967B690E0"> <enum>(I)</enum> <text>by striking <quote>physical</quote> both places it appears;</text>
              </subclause>

                <enum>(II)</enum>
 <text>by inserting <quote>, based on a scientifically rigorous process,</quote> after <quote>determines</quote>;</text>
              </subclause>

                <enum>(III)</enum>
 <text>by inserting <quote>technical, tactical, cognitive, or physical abilities, including</quote> before <quote>muscular strength</quote>; and</text>
              </subclause>
              <subclause id="H6DB84983CF664607B6162CFF2C1726C6">
                <enum>(IV)</enum>
 <text>by striking <quote>(in the case of a career designator that is open to both male and female members of the Armed Forces)</quote>; and</text>
              </subclause>
            </clause>
            <clause id="H0236C1E03CAB49EBA000C8384FAF5EAA">
              <enum>(iii)</enum>
 <text display-inline="yes-display-inline">in paragraph (2)—</text> <subclause id="HC24B35F23E974D4F988FB0801CF8C89E"> <enum>(I)</enum> <text>by inserting <quote>not shorter than 18 months</quote> after <quote>a reasonable period</quote>; and</text>
              </subclause>
              <subclause id="HE250A151FF1D41C7B4CDE6F232EA4786">
                <enum>(II)</enum>
 <text>by inserting <quote>that are based on input from health care providers and researchers of the Department of Defense</quote> after <quote>prescribed by the Secretary</quote>; and</text>
              </subclause>
            </clause>
          </subparagraph>
          <subparagraph id="HCCE88582F6E542A7A22B010DDF00F8B9">
            <enum>(C)</enum>
 <text display-inline="yes-display-inline">in subsection (c), by striking <quote>female members of the Armed Forces</quote> and inserting <quote>members of the Armed Forces, of any gender,</quote>.</text>
          </subparagraph>
        </paragraph>
        <paragraph id="H7375ABD44A9040BAB1FE0DA1F001D59F">
          <enum>(2)</enum>
          <header>Information to Congress</header>
 <text display-inline="yes-display-inline">Such section is further amended, in subsection (c)—</text>
          <subparagraph id="H682C472CFA4949FCB411673103F87F12">
            <enum>(A)</enum>
 <text>by striking <quote>are expected to</quote> and inserting <quote>may</quote>;</text>
          </subparagraph>
          <subparagraph id="HEC2B6FF084F643A796F1F5D33BB7A9D0">
            <enum>(B)</enum>
 <text>by striking <quote>Congress</quote> and inserting <quote>the congressional defense committees</quote>;</text>
          </subparagraph>
          <subparagraph id="HDC7A0234C9F3404684EDAABD527F399D">
            <enum>(C)</enum>
 <text>by striking <quote>change and the justification and rationale</quote> and inserting <quote>proposed change, the estimated costs, the justification (including the relevant research and data that the Secretary reviewed and relied upon before making such proposal), and rationale</quote>; and</text>
          </subparagraph>
          <subparagraph id="H9442838EB77249E4B646E5B80C1E4C1A">
            <enum>(D)</enum>
 <text>by striking <quote>60-day period</quote> and inserting <quote>180-day period</quote>.</text>
          </subparagraph>
        </paragraph>
 </subsection><subsection id="id5cb5536628f24a72a9a2d5e32f7bb9fe"><enum>(c)</enum><header>Submission of the review of operational effectiveness of army and marine corps ground combat units</header><paragraph id="idcc67e8f455c6492cbb063f4e2753962c"><enum>(1)</enum><header>Submission of unredacted version</header><text>Not later than 7 days after it is completed, the Secretary of Defense shall provide to Congress the full, unredacted review of operational effectiveness of Army and Marine Corps ground combat units that is the subject of the memorandum issued by the Under Secretary of Defense for Personnel and Readiness on December 18, 2025, relating to <quote>Review of the Operational Effectiveness of Army and Marine Corps Ground Combat Units,</quote> and which was reassigned to the Johns Hopkins University Applied Physics Laboratory.</text></paragraph><paragraph id="id5fb1ae7bc6c846e19ec7c45bb0512955"><enum>(2)</enum><header>Briefing</header><text>Not later than 30 days after submitting the review under paragraph (1), the Secretary of Defense shall provide a briefing to the Committees on Armed Services of the Senate and the House of Representatives. The briefing shall include the full, unredacted findings of the review and report methodology.</text></paragraph><paragraph id="idbd4daf91f2c04835b2e1848e29731f2b"><enum>(3)</enum><header>Preliminary findings and information</header><text>The Secretary of Defense shall provide to Congress any preliminary findings, methodology, and information delivered by the Institute for Defense Analyses to the Department of Defense related to the study required under paragraph (1) before the study’s reassignment to the Johns Hopkins University Applied Physics Laboratory.</text></paragraph><paragraph id="id55acb4bd6703497383754246c237edb0"><enum>(4)</enum><header>Comptroller General review</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the congressional defense committees a report reviewing—</text><subparagraph id="idb1c1feffe30240df9326a2ff6cde0469"><enum>(A)</enum><text>the review provided to Congress under paragraph (1); and</text></subparagraph><subparagraph id="id6ce1cbfd381940b6bd8ce6523ce36105"><enum>(B)</enum><text>any actions taken by the Department of Defense in response to the review.</text></subparagraph></paragraph></subsection><subsection id="id3c4b758d01c041aeb086fde0f53df606"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on September 30, 2026. The first report under subsection (b) of section 652 of title 10, United States Code, as amended by this section, shall be due on September 30, 2027.</text></subsection></section></legis-body></bill>
