which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Federal working group for recycled plastic content traceability, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tracking Plastic Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb80345faa0554871a2234397f4bffacf"><enum>2.</enum><header>Federal working group for recycled plastic content traceability</header><subsection commented="no" display-inline="no-display-inline" id="id3019d6802b2a4c92bd3f764d117e0e72"><enum>(a)</enum><header>Establishment</header><text>There is established a Federal working group for recycled plastic content traceability (referred to in this section as the <term>Working Group</term>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb6a91f23dd904efa91e70c18bb053f09"><enum>(b)</enum><header>Members</header><paragraph commented="no" display-inline="no-display-inline" id="id6702a78077fa43efb9688a764e7dd34c"><enum>(1)</enum><header>In general</header><text>The Working Group shall be composed of the following members:</text><subparagraph commented="no" display-inline="no-display-inline" id="id9d1238142174490ab9deeb53947abf0e"><enum>(A)</enum><text display-inline="yes-display-inline">A representative of each of the following departments and agencies, to be designated by the head of the respective department or agency:</text><clause commented="no" display-inline="no-display-inline" id="id5dcf54a940eb44719220a1c03d8957d8"><enum>(i)</enum><text>The Environmental Protection Agency.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc3db1f906493495fbd1f900edf4b9439"><enum>(ii)</enum><text>The Federal Trade Commission.</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa47c3e5e389424fbd2c6bcdfa573a66"><enum>(iii)</enum><text>The Department of Agriculture.</text></clause><clause commented="no" display-inline="no-display-inline" id="id85e8febb81534a2ca1cbda992fed498f"><enum>(iv)</enum><text>The National Oceanic and Atmospheric Administration.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7364a1e18fc34e18aa0176e17ed5209d"><enum>(v)</enum><text>The Department of State.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf64ca9f067314737a6c127a2799fe0d4"><enum>(vi)</enum><text>The National Institute of Standards and Technology.</text></clause><clause commented="no" display-inline="no-display-inline" id="iddafaa5a26e334ec59b6617c4c57a2ed0"><enum>(vii)</enum><text>The National Laboratory of the Rockies.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d4fae30c0084702aec2000a20e2ed52"><enum>(B)</enum><text>1 or more representatives of each of the following, to be designated jointly by the Administrator of the Environmental Protection Agency and the Secretary of Commerce:</text><clause commented="no" display-inline="no-display-inline" id="ida5687f7d2327466b8f8547db70e096eb"><enum>(i)</enum><text>Institutions of higher education.</text></clause><clause commented="no" display-inline="no-display-inline" id="id82098fd3d02a4892a9e21a22c5f0738d"><enum>(ii)</enum><text>The National Academy of Sciences.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42e7522f39284fadb0c8a24d30b825d0"><enum>(2)</enum><header>Initial designations</header><text>The initial members of the Working Group shall be designated not later than 90 days after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb8048868298469fae1a1cdf3bda26d2"><enum>(3)</enum><header>Lead agencies</header><text>In carrying out the duties of the Working Group under subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddc5e3f2a3d9041a0a42d2b01260446e4"><enum>(A)</enum><text display-inline="yes-display-inline">the National Institute of Standards and Technology shall lead the Working Group with respect to developing recommendations for recycled plastic content traceability; and</text></subparagraph><subparagraph id="id8cc4ffae9ec74e53aca00b03502eda18"><enum>(B)</enum><text>the Environmental Protection Agency and the Department of Commerce shall jointly lead the Working Group with respect to all other duties described in that subsection.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida703695c4b9147afaa0ada2d9e5e3af5"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Working Group, in coordination with States, local governments, Indian Tribes, nonprofit organizations, material recovery facilities, plastic reclaimers using recycled content, and academic institutions, shall, using the National Recycling Strategy of the Environmental Protection Agency as a guide—</text><paragraph commented="no" display-inline="no-display-inline" id="id21e5ddd96ce04eeb997a2cd6e3ba1054"><enum>(1)</enum><text>develop recommendations to increase the use of post-consumer resin and, in developing those recommendations, consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1ae69b88a24046d1a3ea0932e122b546"><enum>(A)</enum><text display-inline="yes-display-inline">the necessary capacity of and improvements to domestic markets for the use of recycled plastics generated in the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id401a070927074f5da0d7446b0de1762a"><enum>(B)</enum><text>economic benefits of using post-consumer resin in recycling; and</text></subparagraph><subparagraph id="idd3a9b1e349a140238fdf68d697e2d807"><enum>(C)</enum><text>ways to monitor and measure the presence of toxic chemicals in post-consumer resin content; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ee83e92e2414fc9b659bd6628742727"><enum>(2)</enum><text display-inline="yes-display-inline">develop recommendations to improve the measurement, traceability, and reporting of recycled plastic content in applicable sectors of the economy, including the packaging, construction, infrastructure, and automotive sectors and, in developing those recommendations—</text><subparagraph commented="no" display-inline="no-display-inline" id="idddfce4ba64204758b983859f247b5e80"><enum>(A)</enum><text>develop and establish standardized measurements for data collection relating to recycled plastics, which shall, to the extent practicable, be consistent with international standards, such as the Australia National Framework for Recycled Content Traceability and standards used in North America and by other trading partners;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id087eef2c433d4e708df6563e03fd5de9"><enum>(B)</enum><text>describe a Federal recycled plastic content tracking system for the purpose of assisting in harmonizing State recycled plastic content requirements;</text></subparagraph><subparagraph id="id7cf8908826844349a0657b995c175da4"><enum>(C)</enum><text>consider ways to improve trade data clarity related to recycled plastic content traceability, including reevaluating plastic trade codes for recycled content; and</text></subparagraph><subparagraph id="id00f5091b2a114c52b25d8dd2e33a4fd6"><enum>(D)</enum><text>consider ways to improve traceability of plastic marine debris.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8203e6a473894ac3b7d268a7709a070c"><enum>(d)</enum><header>Report</header><text>The Working Group shall submit to Congress and make publicly available annual reports describing the activities of the Working Group during the previous year, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id4762e2e3ec964bd1b52d0fce30f44ca3"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of any recommendations developed or updated under subsection (c); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ba6770c7bcf44528ab2de791e5c0878"><enum>(2)</enum><text>a summary of any issues for which recommendations are being considered for development or updating under subsection (c).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide28fe3d8b87843168b7a8eee9151701f"><enum>(e)</enum><header>Termination</header><text>The Working Group shall terminate when the Working Group has fulfilled all duties of the Working Group under this Act, which shall be not later than the date that is 10 years after the date on which the Working Group is established.</text></subsection></section></legis-body></bill>
