which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that for purposes of Federal nondiscrimination requirements applicable to education programs or activities receiving Federal financial assistance, discrimination prohibited under title IX of the Education Amendments of 1972 is based on the biological reality of sex.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H80E8C5093BB24BA7A35FBB0EFFFF7A43"><section section-type="section-one" id="H9E280B32FCF84BEE863C508AE2184B77"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Title IX Clarification Act of 2026</short-title></quote>.</text></section><section id="H47256910061648E7B93B66A427DA3BEA"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 901(c) of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681(c)</external-xref>) is amended—</text><paragraph id="H35EFBF0452594E9A8FAA6434FFD0F579"><enum>(1)</enum><text>by striking <quote>title an educational institution</quote> and inserting the following:</text><quoted-block style="OLC" id="H883AF5754469418ABBAB117360AB6C02"><text display-inline="no-display-inline">title—</text><paragraph id="HF8333165FB9F4338874971E777154E02"><enum>(1)</enum><text>the term <quote>educational institution</quote></text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H626BE1B76ED14EB5A68D679C98D353B1"><enum>(2)</enum><text>by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H737AFE7005574603A401CFB6B4268CC2"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3b9ab801089348ef80babe67b68f62a5"><paragraph id="ida27b570edb7540abb56772d091c05313" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>sex</term> refers to an individual’s biologically determined sex, as either male or female;</text></paragraph><paragraph id="id1372717405174c58ad80cb4814c46270"><enum>(3)</enum><text>the term <term>female</term>, when used with respect to a natural person, means an individual who naturally has, had, will have, or would have, but for a congenital anomaly, historical accident, or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes the large gamete (ova) for fertilization; and</text></paragraph><paragraph id="idefdf983689b7493aadba7afa82bcd349"><enum>(4)</enum><text>the term <term>male</term>, when used with respect to a natural person, means an individual who naturally has, had, will have, or would have, but for a congenital anomaly, historical accident, or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes the small gamete (sperm) for fertilization.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H74A452693C914080A8A33EC2CF8BCAEE"><enum>3.</enum><header>Effective date; application of amendments</header><subsection id="H14962E676FC64776B38261578083DD51"><enum>(a)</enum><header>Effective date</header><text>Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect on the date of enactment of this Act.</text></subsection><subsection id="H653A5396C59741F6A9B2CDFACE76F95D"><enum>(b)</enum><header>Application of amendments</header><text>The amendments made by this Act shall apply with respect to education programs and activities for which Federal financial assistance is received on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
