which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Arms Export Control Act to address third party transfers of certain defense articles for Ukraine, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fast Tracking European Investment in Ukraine’s Defense Act</short-title></quote>.</text></section><section id="ided5797321ab444e1bb1fe5ad052de391"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">As long as the Russian Federation continues to execute its brutal invasion of Ukraine, it is the policy of the United States—</text><paragraph commented="no" display-inline="no-display-inline" id="ida2a06d68dab34ade8d251b558e0af9e7"><enum>(1)</enum><text display-inline="yes-display-inline">to welcome long-term investment from allies and partners in the United States defense industrial base; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33a74987ccfb493ba012f92fc480a7b0"><enum>(2)</enum><text display-inline="yes-display-inline">to facilitate increased contributions from allies and partners to the defense of Ukraine.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6dcf509dfcc64f8fb66de2976aa185d6"><enum>3.</enum><header>Pre-approval for purchase and third party transfer of certain defense articles for Ukraine</header><text display-inline="no-display-inline">Section 3 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2b8ada638f3640cda24aeb39a2a5eba3"><subsection id="id77871BDD9D6A444F9CFD2AF5781482EB"><enum>(h)</enum><header>Purchase and third party transfer: Ukraine</header><paragraph id="id88bfe63cbe82447f8b0733d2b762aa1a"><enum>(1)</enum><header>In general</header><text>The transfer of defense articles sold by the United States under this Act shall be approved, and subsections (a), (b), and (d) shall not apply to such a transfer, if—</text><subparagraph commented="no" display-inline="no-display-inline" id="idff1be58a662c478f9467ec257ea98910"><enum>(A)</enum><text display-inline="yes-display-inline">the purchaser of the defense articles to be transferred is the government of a member country of the North Atlantic Treaty Organization, the Government of Australia, the Government of Japan, the Government of the Republic of Korea, the Government of Israel, or the Government of New Zealand;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2aafa5187224426a5364dbde0ee0774"><enum>(B)</enum><text display-inline="yes-display-inline">the recipient of the defense articles to be transferred is the Government of Ukraine;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7bf1b842030e4aa5a724fa054c7c1c7e"><enum>(C)</enum><text display-inline="yes-display-inline">the defense articles are 155mm artillery shells, 155mm Excalibur extended range artillery shells, High Mobility Artillery Rocket System (HIMARS) munitions, or Guided Multiple Launch Rocket System (GMLRS) munitions;</text></subparagraph><subparagraph id="id2883e8a2d19b4b74b781664a7f94cc23"><enum>(D)</enum><text>the Government of Ukraine has provided a commitment in writing to the United States Government, including to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives, that it will not transfer such defense articles, if not demilitarized, to any other foreign country or person without first obtaining the consent of the President; and</text></subparagraph><subparagraph id="idff3d958284a74db5bff8f31f3a347602"><enum>(E)</enum><text>the Government of Ukraine accepts title and physical custody of the transferred defense articles before December 31, 2030.</text></subparagraph></paragraph><paragraph id="id0c132f8111bb4857a4db866f44076b99"><enum>(2)</enum><header>Notice to Congress</header><text>Before a transfer of defense articles to the Government of Ukraine approved under paragraph (1) is made, the President shall promptly notify the Speaker of the House of Representatives, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Foreign Relations of the Senate of the intended transfer.</text></paragraph><paragraph id="id4871a11b2a0a4d77ab2bf8ba007e1c39"><enum>(3)</enum><header>Annual extension</header><text>Annually, the Secretary of State may extend the date in paragraph (1)(E) by one year until December 31, 2035, if, before such an extension, the Secretary certifies to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives that the Russian Federation is continuing to execute its invasion of Ukraine.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3755251d97644129bd156a1d1210559d"><enum>(4)</enum><header>Rules of construction</header><subparagraph commented="no" display-inline="no-display-inline" id="id6532c2ce02234b77ab9eccb12cca7270"><enum>(A)</enum><header display-inline="yes-display-inline">Selection of defense articles</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to limit—</text><clause commented="no" display-inline="no-display-inline" id="id0c8f1403be504b4299547ebfcd3ea2f9"><enum>(i)</enum><text display-inline="yes-display-inline">the type or quantity of defense articles that may be requested by, or transferred to, the Government of Ukraine; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3b420a70b93740f685a66a7ecdfc7a46"><enum>(ii)</enum><text>the timing of such requests or transfers.</text></clause></subparagraph><subparagraph id="idec66674ee35b41deb487a3ced227814e"><enum>(B)</enum><header>Retransfers</header><text>Any request by the Government of Ukraine to retransfer defense articles received by that Government under this Act remains subject to all relevant provisions of this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
