which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XI, XIX, and XXI of the Social Security Act with respect to screening for childhood-onset fluency disorders, and to require coverage of certain speech therapy services under Medicaid and CHIP.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE5C8358E542C449A8D95B27539A8D586"><section section-type="section-one" id="H0611B357D47A44218C5B19F26F04E828"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kidd’s Stuttering Act</short-title></quote>.</text></section><section id="H0BF81565C3D6426FAF365CFC720E9232"><enum>2.</enum><header>Expanding screening and requiring coverage of certain speech therapy services under Medicaid and CHIP</header><subsection id="H9A5FAC19B8A94511A859D3932560D0F8"><enum>(a)</enum><header>Inclusion of screening for stuttering and speech fluency in core set of child health quality measures</header><text display-inline="yes-display-inline">Section 1139A(b)(5) of the Social Security Act (42 U.S.C. 1320b–9a(b)(5)) is amended—</text><paragraph id="H511AFA3DC1E6413D8DFA9D659092C914"><enum>(1)</enum><text>by striking <quote>Beginning no later than</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA6093076B0CE4B5FBF6818FDCA381A13"><subparagraph id="H46E1B61BB11B41F3BBDD3B633B1BDD7C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning no later than</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0393D6CFE02347B4BE6F79D5EA193FFF"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H233118DD752F44BB8E0CDA37D9C111D1"><subparagraph id="H614A383FA55943ADA51008BBAA200F8C"><enum>(B)</enum><header>Screening for stuttering and speech fluency</header><clause id="HB1E3D205E83644DF995D4B8FE755A949"><enum>(i)</enum><header>In general</header><text>Not later than January 1, 2028, the Secretary shall publish changes to the core measures described in subsection (a) to include measures of screening for childhood-onset fluency disorders, including stuttering, for children who have attained the age of 2 (and have not attained the age of 6).</text></clause><clause commented="no" id="H8E3280DC3920405C91F258D326DD8300"><enum>(ii)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall publish the changes required by clause (i) at the same time and in the same manner as the relevant annual recommended changes required under subparagraph (A).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2973E227386940C5985EDEFA7A70D0C5"><enum>(b)</enum><header>Required screening for stuttering and speech fluency in Medicaid well-Child visits</header><text display-inline="yes-display-inline">Section 1905(r)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(r)(1)(B)</external-xref>) is amended—</text><paragraph id="H2075655D66AE4AEAB684391EA31E29FD"><enum>(1)</enum><text>in clause (iv), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HB686D0186EA24A1F9309982B7EC293B8"><enum>(2)</enum><text>in clause (v), by striking the period at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="HEA58210FEBD7413C86491964712C261D"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H68E54A58F1DA43CABC314F1B69FE5982"><clause id="HFA91C870BCE4427CA6233F1DB43FAC60"><enum>(vi)</enum><text display-inline="yes-display-inline">beginning January 1, 2029, for children who have attained the age of 2 (and have not attained the age of 6), screening for childhood-onset fluency disorders, including stuttering.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1E0254F87D7C405BAD51914820556D87"><enum>(c)</enum><header>Required coverage of certain speech therapy services</header><paragraph id="HD3A8B04B7FAF4F57844777474676B4C7"><enum>(1)</enum><header>Medicaid</header><text>Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended—</text><subparagraph id="H2F973E6D17BB4E02B9DAACD965A23C88"><enum>(A)</enum><text>in section 1902(a)—</text><clause id="HBE3991BBFD32499BB280463602555D10"><enum>(i)</enum><text>in paragraph (10)(A), by striking <quote>and (30)</quote> and inserting <quote>(30), and (32)</quote>;</text></clause><clause id="HDDD4ECAA74C84AB1A266B863AEDE04D7"><enum>(ii)</enum><text>in paragraph (89), by striking <quote>and</quote> at the end;</text></clause><clause id="H2E3D8C6A45AB42FEA9EE618F27420A41"><enum>(iii)</enum><text>in paragraph (90)(C), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H42B81C78141E4AF2B7D11B8C1DF7FFD6"><enum>(iv)</enum><text>by inserting after paragraph (90) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H77D8B5D0A9EC4137849C291AA2CE1F07"><paragraph id="H2B9B3B6A580947D7B4D3DA482ECC1D6B"><enum>(91)</enum><text display-inline="yes-display-inline">provide that the treatment limitations applicable to specified speech therapy services (as defined in section 1905(ll)) are no more restrictive than the treatment limitations applicable to any speech therapy services for the treatment of expressive language disorder, receptive language disorder, mixed expressive and receptive language disorder, or articulation, for which medical assistance is provided under the State plan (or waiver of such plan).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HC411CFE065FD4612A208AEE045A385F0"><enum>(B)</enum><text>in section 1905—</text><clause id="H4AD04508BB58417BB7878B702CCF41D3"><enum>(i)</enum><text>in subsection (a)—</text><subclause id="H81610BEA937A4C5283688FFF8F1D05E1"><enum>(I)</enum><text>in paragraph (31), by striking <quote>and</quote> at the end;</text></subclause><subclause id="H7D409E1F53F64C3BAE297FA56744D597"><enum>(II)</enum><text>by redesignating paragraph (32) as paragraph (33); and</text></subclause><subclause id="HFF7D5C4DFBCF4254AD67C668210F39BA"><enum>(III)</enum><text>by inserting after paragraph (31) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3D96640FA81C4F16A03109D3420A1ACC"><paragraph id="HC8B179E276FE430F83B0EAA77DF98E5D"><enum>(32)</enum><text display-inline="yes-display-inline">beginning on January 1, 2029, specified speech therapy services (as defined in subsection (ll)); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="HE94CD0FD23E84DE3A7C8537993D47D46"><enum>(ii)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDBB6E8B56EF9479AAAA424EC39A20647"><subsection id="HD2B6F8B3DB7041B08DBBD63B81268915"><enum>(ll)</enum><header>Specified speech therapy services</header><text>For purposes of subsection (a)(32), the term <term>specified speech therapy services</term>—</text><paragraph id="H234964926A274FF6BFC64FD41C804FAB"><enum>(1)</enum><text>means speech therapy services for the treatment of childhood-onset fluency disorders, including stuttering, provided to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id85160ba0abea4178ae2552bc4bd68124"><enum>(A)</enum><text display-inline="yes-display-inline">individuals who have not attained 21 years of age; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5bbfd340b6f341d78d646a2c3d371e2f"><enum>(B)</enum><text display-inline="yes-display-inline">individuals described in section 1902(a)(10)(A)(i)(IX); and</text></subparagraph></paragraph><paragraph id="H37F90306DA2F40B89318D5E4105EE9F1"><enum>(2)</enum><text>includes such services delivered through real-time, audio and video telecommunications technology.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb0ed8bd00074e60a747cf2614c4ab7a"><enum>(C)</enum><text>in section 1932(b), by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d2ef171465b48ebaca6436090157e2f"><paragraph id="id29252c19e7f34bdab0e3f978e22c92e3" commented="no"><enum>(9)</enum><header>Parity in coverage of speech therapy services</header><text>A medicaid managed care organization, prepaid inpatient health plan (as defined by the Secretary), prepaid ambulatory health plan (as defined by the Secretary), and, when appropriate, primary care case management entity (as defined by the Secretary) with a contract with a State that provides for coverage of specified speech therapy services (as such term is defined in section 1905(ll)) shall establish procedures to ensure compliance with the requirements of section 1902(a)(91).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc75b51d20887415fb70176257935b75e"><enum>(D)</enum><text>in section 1937(b)—</text><clause commented="no" display-inline="no-display-inline" id="id29ed26970dfd443d9e5e456b467d6d0c"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>paragraphs (5) and (6)</quote> and inserting <quote>the succeeding provisions of this subsection</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id91c32ef6762442bb882c0d6b1667cee7"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb2e4be4bc867436ab46d8f986cd7401c"><paragraph commented="no" display-inline="no-display-inline" id="id237f8dcc6bb84f61ac2b1023ed758026"><enum>(9)</enum><header>Coverage of specified speech therapy services</header><text>Notwithstanding the previous provisions of this section, a State may not provide for medical assistance through enrollment of an individual with benchmark coverage or benchmark-equivalent coverage under this section unless the individual has access, through such coverage or otherwise, to specified speech therapy services (as defined in section 1905(ll)) that are provided in accordance with the requirements of section 1902(a)(91).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HC450A6AAD9F444D5A8F6A6CDF689E07D"><enum>(2)</enum><header>CHIP</header><subparagraph id="H22645326E0464C47B79EBF614183809A"><enum>(A)</enum><header>In general</header><text>Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD39DA90EA14B4561A80E3B2D05A03068"><paragraph id="HC4EF2ACE50764BF7903A757AC252F16E"><enum>(13)</enum><header>Required coverage of certain speech therapy services</header><text display-inline="yes-display-inline">Beginning January 1, 2029, the child health assistance provided to a targeted low-income child and, in the case of a State that elects to provide pregnancy-related assistance pursuant to section 2112, the pregnancy-related assistance provided for a targeted low-income pregnant woman (as such terms are defined for purposes of such section) shall include coverage of specified speech therapy services (as such term is defined in section 1905(ll)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE08223B83627484B8EE96CE1744D616B"><enum>(B)</enum><header>Treatment parity</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text><clause id="H90D99684D8AD4E63A00D6247B977520E"><enum>(i)</enum><text>by redesignating subparagraphs (I) through (W) as subparagraphs (J) through (X), respectively; and</text></clause><clause id="HD5034D99CA0143A2A5220C17ABF91A20"><enum>(ii)</enum><text>by inserting after subparagraph (H) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC90A7A560DFA407E9EEFF4BA06109D27"><subparagraph id="HC1BC9F8093B34937A40A08B589486516"><enum>(I)</enum><text display-inline="yes-display-inline">Section 1902(a)(91) (relating to parity in coverage of speech therapy services).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
