which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a study of AI-enabled toys and development of a joint action plan regarding the marketing and sale of AI-enabled toys.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children's Artificial Intelligence Toy Safety Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idc0412212ed214ff8956a7e77717648b2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idd94f49d023d643dab82ff20ff9a6accc"><enum>(1)</enum><header>AI-enabled toy</header><text>The term <term>AI-enabled toy</term> means any toy equipped with artificial intelligence designed to engage in two-way interaction with a user.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida17a702ea85a4902a9bfac80d0dccd5b"><enum>(2)</enum><header display-inline="yes-display-inline">Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph id="id0dfd44159b1d4bb091be1479c95ea306"><enum>(3)</enum><header>Artificial intelligence chatbot</header><text>The term <term>artificial intelligence chatbot</term> means artificial intelligence that, in an open-ended natural-language or multimodal manner—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0675bac075d74e42951182d8305a9857"><enum>(A)</enum><text display-inline="yes-display-inline">accepts user input;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85b065758ff2481081db5d3b11835587"><enum>(B)</enum><text display-inline="yes-display-inline">engages in interactive conversations with a user; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f848d0a4a454b778e334ddbb0c28d40"><enum>(C)</enum><text>provides outputs that are not—</text><clause commented="no" display-inline="no-display-inline" id="id4aa7ec6b1bdf45908edf2451caf8f736"><enum>(i)</enum><text display-inline="yes-display-inline">pre-determined or scripted; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id314b4c6863ed47fab30aa1dfb84ce7e6"><enum>(ii)</enum><text>limited to contextualized replies or to a narrow, specified purpose, such as—</text><subclause commented="no" display-inline="no-display-inline" id="id57ea0a865ba4428f9baa55b425722673"><enum>(I)</enum><text display-inline="yes-display-inline">customer service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide9e379b50bef41a69bbbe53f76c3a040"><enum>(II)</enum><text display-inline="yes-display-inline">any operational purpose of a business;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc411f6c359c24b769b6364154639bd13"><enum>(III)</enum><text display-inline="yes-display-inline">productivity and analysis related to source information;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4a7d65d99a714817bfed585bc88ac862"><enum>(IV)</enum><text display-inline="yes-display-inline">internal research; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida5f2703f1821496b8f9852013f8ffa4e"><enum>(V)</enum><text display-inline="yes-display-inline">technical assistance.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a54088325344b83b2eaad2638c273fb"><enum>(4)</enum><header>Child</header><text>The term <term>child</term> means an individual under 14 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0fccbe7d08343afb48cfc9637c695b2"><enum>(5)</enum><header>Developer</header><text>The term <term>developer</term> means any person who designs, creates, programs, maintains, or assumes responsibility for artificial intelligence intended for use by consumers.</text></paragraph><paragraph id="id0e3b20ad18954dfeb43609ce2a1086cc"><enum>(6)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> has the meaning given such term in section 3 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85cce0f5096b46f091d6f22c842b7246"><enum>(7)</enum><header>Toy</header><text>The term <term>toy</term> has the meaning given the term <term>children's toy</term> in section 108(g)(1) of the Consumer Product Safety Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/2057c">15 U.S.C. 2057c(g)(1)</external-xref>).</text></paragraph></section><section id="id3520cc4f6dc544919763b2f3e689fc5a"><enum>3.</enum><header>Study</header><text display-inline="no-display-inline">The National Academies of Sciences, Engineering, and Medicine shall conduct a study regarding AI-enabled toys that assesses—</text><paragraph commented="no" display-inline="no-display-inline" id="idfa87ff4d44074f0e986504f83b7367dc"><enum>(1)</enum><text>the risk of injury (including physical, mental, emotional, and social injury) to children in different stages of development from AI-enabled toys and artificial intelligence chatbots;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3542b13b6c564c789c79d45f0f3a6930"><enum>(2)</enum><text>educational outcomes resulting from using AI-enabled toys outside of an educational setting;</text></paragraph><paragraph id="idc0c262c1ae8040d5921d3bc7d315fc5c"><enum>(3)</enum><text>the adoption and utilization of parental controls on AI-enabled toys by consumers;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id085546560599449986530a6f4c488214"><enum>(4)</enum><text>the legal and ethical boundaries of marketing artificial intelligence chatbots and AI-enabled toys to children;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3bc70eff6304c1881c8aee082019188"><enum>(5)</enum><text>whether any evidence relating to the potential risks to children posed by AI-enabled toys warrants temporarily suspending the marketing and sale of such toys to children;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54a232e366cb43cebb3a7fc29464b7e5"><enum>(6)</enum><text display-inline="yes-display-inline">actions that Congress, Federal agencies, developers, and manufacturers can take to protect children from any risks and harms associated with AI-enabled toys; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7ce21bc29d44e6d913777968349b726"><enum>(7)</enum><text>any other issue regarding AI-enabled toys the National Academies of Sciences, Engineering, and Medicine determines to be appropriate.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idd075891b7ea0496bab68a2bfc9447bd9"><enum>4.</enum><header>Joint action plan</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Federal Trade Commission and the Consumer Product Safety Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Education and Workforce of the House of Representatives a joint action plan to improve the safety of AI-enabled toys, which shall contain—</text><paragraph commented="no" display-inline="no-display-inline" id="idcd71a68e031b48c89114d3fc8ef9eecd"><enum>(1)</enum><text display-inline="yes-display-inline">recommendations regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf43a2c7eba0d426c99b8a1004d20d9ad"><enum>(A)</enum><text display-inline="yes-display-inline">legislation or administrative action;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd6193539c6e04a5a832898e091c85a93"><enum>(B)</enum><text display-inline="yes-display-inline">any requirements for disclosing to consumers when artificial intelligence has been integrated into a toy; and</text></subparagraph><subparagraph id="id9ba4de14c16448929fcdca8993903c3b"><enum>(C)</enum><text>regulations regarding voluntary or enforceable marketing standards, voluntary or enforceable safety guidelines, periodic independent review of AI-enabled toys, or permanent or temporary prohibitions on the sale of AI-enabled toys for the purpose of protecting public health or safety; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf403a6dd20fc4d78a658b41ccc8709f7"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any consumer and public education initiatives regarding AI-enabled toys that the Federal Trade Commission and Consumer Product Safety Commission plan to undertake.</text></paragraph></section></legis-body></bill>
