which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to remove carbon dioxide directly from ambient air or seawater, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD6731F85E22F4F44A7BACB28FBBC8105"><section section-type="section-one" id="H8EC3231F79AD44B597ACA6BCD117F992"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carbon Dioxide Removal Leadership Act of 2026</short-title></quote>.</text></section><section id="id6ef2abbe4cb84b2a84adf1d2415eccf1"><enum>2.</enum><header>Federal requirement to remove carbon dioxide</header><subsection id="id946577f06e084aff9cfcfbffb83369f3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idf2e327ad02d4414586e1ddfa656c4bde"><enum>(1)</enum><header>Eligible technology</header><subparagraph id="id1963946383d047f88879342c00124e85"><enum>(A)</enum><header>In general</header><text>The term <term>eligible technology</term> means any equipment, technique, or technology, as determined by the Secretary, that—</text><clause id="id87c2847c4f2644a794a8dae96a0463d2"><enum>(i)</enum><text>was placed into service after January 1, 2022; and</text></clause><clause id="idb46ce59ee40f44b2a09d9dbf0a9616b9"><enum>(ii)</enum><text>removes carbon dioxide directly from ambient air or seawater.</text></clause></subparagraph><subparagraph id="id2fde9de63c2a403194c2783c061f7212"><enum>(B)</enum><header>Exclusion</header><text>The term <term>eligible technology</term> does not include any equipment, technique, or technology that—</text><clause id="id4a806421cfaf410cb3b8c61e8b50408d"><enum>(i)</enum><text>removes carbon dioxide that is deliberately released from naturally occurring subsurface springs;</text></clause><clause id="id17ad9d9dc1ee4a9e80b3727a3805909c"><enum>(ii)</enum><text>removes carbon dioxide using natural photosynthesis, except as provided in subparagraph (C); or</text></clause><clause id="idfc14d790e3144c8082a50ca3f70f0119"><enum>(iii)</enum><text>uses captured carbon dioxide in enhanced oil recovery.</text></clause></subparagraph><subparagraph id="idda2d21d292254cce95e19be38e965602"><enum>(C)</enum><header>Expansion of eligible technology</header><text>Notwithstanding subparagraph (B)(ii), any equipment, technique, or technology that removes carbon dioxide using gasification, pyrolysis, or sequestration of solid, nonhazardous, and cellulosic waste materials may be included in the term <quote>eligible technology</quote> if the Secretary, by rule—</text><clause id="idff4461e4a5424927ae78ddea022f2229"><enum>(i)</enum><text>determines that an entity that carries out a removal project under this section is able—</text><subclause commented="no" display-inline="no-display-inline" id="ida6d626168a9940a3bd5f41bf14f0b9f2"><enum>(I)</enum><text display-inline="yes-display-inline">to adequately measure, monitor, report, and verify the quantity of greenhouse gas emissions (including direct emissions and significant indirect emissions), removed using that equipment, technique, or technology; and</text></subclause><subclause id="id8d935b6046ce4d40ac084f9c70f4c953"><enum>(II)</enum><text>to adequately mitigate the environmental impacts (including impacts on biodiversity, land use, and air and water quality) associated with that equipment, technique, or technology; and</text></subclause></clause><clause id="idf3adc1d7e68046c096b1810f32856f66"><enum>(ii)</enum><text>requires that entity to carry out the activities described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="id319350d23eaf41ecbe2dfbf239c61dc3"><enum>(2)</enum><header>Lifecycle basis</header><text>The term <term>lifecycle basis</term> means the net sum of all greenhouse gas emissions (using mass values for all greenhouse gases that are adjusted to account for their relative global warming potential, as determined by the Secretary in consultation with the Administrator of the Environmental Protection Agency) associated with carbon dioxide removal activity from cradle to grave, including any emissions associated with—</text><subparagraph id="id1bbc2a5389374e31bfa57b29fa4a29d3"><enum>(A)</enum><text>energy and feedstock inputs in the carbon dioxide removal activity, including inputs in the distribution and transportation of carbon dioxide;</text></subparagraph><subparagraph id="id1037a1ec62f841fdb8dfc8a3e829d78c"><enum>(B)</enum><text>indirect effects, such as land-use change, as scientifically justified;</text></subparagraph><subparagraph id="id9bc4f021cbe842409b88b4c9da57171f"><enum>(C)</enum><text>the carbon dioxide removal process;</text></subparagraph><subparagraph id="id3e06d0901b394be79f9faafce92919de"><enum>(D)</enum><text>carbon dioxide transport and storage, including any leakage, use, and disposal of any materials or products associated with that transport and storage; and</text></subparagraph><subparagraph id="id7cc75d50b58a49319aec7a90350a62f3"><enum>(E)</enum><text>embodied emissions of the equipment used in the carbon dioxide removal activity.</text></subparagraph></paragraph><paragraph id="idc1d01c335db842ed97f870558bd7b7b1"><enum>(3)</enum><header>Remove</header><text>The term <term>remove</term>, with respect to carbon dioxide, means to extract carbon dioxide from the atmosphere by—</text><subparagraph id="ida2d59807fbb54e04b58edd8d71866fcc"><enum>(A)</enum><text>capturing carbon dioxide using eligible technology; and</text></subparagraph><subparagraph id="idb86b1f937d7f4e57acac6b2573ba2e60"><enum>(B)</enum><text>durably storing, on a timescale equivalent to geologic storage, that captured carbon dioxide—</text><clause id="id39d11f59ebf1485bb343bfbeca79c06e"><enum>(i)</enum><text>pursuant to a permit issued under part C of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h">42 U.S.C. 300h et seq.</external-xref>) for a Class V or Class VI injection well (as described in section 144.6 of title 40, Code of Federal Regulations (or successor regulations));</text></clause><clause id="idaae0c07a0e5e469588a9daaa0516247e"><enum>(ii)</enum><text>in building materials and mineralized carbon materials; or</text></clause><clause id="id68fab7fe56204b0ba78b0121772b698d"><enum>(iii)</enum><text>using other durable storage methods, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="idacb4ba8ff1fa40e18dd0b53131b09621"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="id0bae1fa97b7b478bafac5b5362f44aef"><enum>(5)</enum><header>Small removal project</header><text>The term <term>small removal project</term> means a project for the removal of carbon dioxide that removes not more than 5 percent of the net metric tons of carbon dioxide required to be removed under subsection (b) for the applicable fiscal year.</text></paragraph></subsection><subsection id="idc5b0f30dcbd14e90997c52a57fa8bc9f"><enum>(b)</enum><header>Required quantities</header><text>The Secretary shall, to the extent economically feasible as determined under subsection (c), remove—</text><paragraph id="id2273fd19bdd140cb9279be1d4e787992"><enum>(1)</enum><text>50,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2026 and 2027;</text></paragraph><paragraph id="idad85cc8b9a2c440195f9d4ec5117a9c5"><enum>(2)</enum><text>500,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2028 through 2030;</text></paragraph><paragraph id="id797fbd0a260f4332879e74bda72bacdd"><enum>(3)</enum><text>5,000,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2031 through 2035; and</text></paragraph><paragraph id="id775eea8e3e18429ab59baed4f6db704e"><enum>(4)</enum><text>10,000,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for fiscal year 2036 and each fiscal year thereafter.</text></paragraph></subsection><subsection id="id006c8a6c7a584f3abb4b438c1f93da4a"><enum>(c)</enum><header>Economic feasibility</header><paragraph id="id73d56f356f4e46c5b0878e167e74d469"><enum>(1)</enum><header>In general</header><text>The removal of carbon dioxide under subsection (b) shall be considered economically feasible if that removal can be accomplished or, in the case of a contract under subsection (i), purchased—</text><subparagraph id="id70f737ec7b39484985e511449a79aff4"><enum>(A)</enum><text>for each of fiscal years 2026 and 2027, at a price per metric ton of carbon dioxide of not more than $750 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="id97b8a50064024ef292a5965028dee959"><enum>(B)</enum><text>for each of fiscal years 2028 through 2030, at a price per metric ton of carbon dioxide of not more than $500 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="id5c925379b62841f3a0c9f2c1e43791df"><enum>(C)</enum><text>for each of fiscal years 2031 through 2033, at a price per metric ton of carbon dioxide of not more than $300 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="id4332fcf0684842358d597c3b9f0fb1e5"><enum>(D)</enum><text>for each of fiscal years 2034 through 2036, at a price per metric ton of carbon dioxide of not more than $200 (which the Secretary may adjust for inflation); and</text></subparagraph><subparagraph id="idfe300d0370904e54a9074d52655a19ce"><enum>(E)</enum><text>for fiscal year 2037 and each fiscal year thereafter, at a price per metric ton of carbon dioxide of not more than $150 (which the Secretary may adjust for inflation).</text></subparagraph></paragraph><paragraph id="idf9d235a920ac472ebc3da886c15c7f38"><enum>(2)</enum><header>Inclusion of measurement, monitoring, reporting, and verification costs</header><text>In determining whether the removal of carbon dioxide is considered economically feasible under paragraph (1), the price for such removal shall include costs paid to an independent third party for the measurement, monitoring, reporting, and verification required under subsection (g)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id152e0fc046d842e78f6bc557b2bfca82"><enum>(3)</enum><header>Multiyear contracts</header><text>The removal of carbon dioxide carried out pursuant to a contract entered into under subsection (i) that is a multiyear contract shall be considered economically feasible if such removal can be accomplished at the applicable dollar amount for the first fiscal year of the contract, as provided in paragraph (1), through the entire length of the contract.</text></paragraph></subsection><subsection id="idf509f810863f49e19163a067267c7431"><enum>(d)</enum><header>Timing</header><text>For each fiscal year, the Secretary shall remove the quantity of carbon dioxide required under subsection (b) for that fiscal year not later than 3 years after the beginning of that fiscal year.</text></subsection><subsection id="id149ee8225d474176809dd715042b16a7"> <enum>(e)</enum> <header>Small removal project set-Aside</header> <text>To the extent practicable, at least 20 percent of the net metric tons of carbon dioxide required to be removed under subsection (b) for each of fiscal years 2026 through 2035 shall be removed through small removal projects.</text>
 </subsection><subsection id="id1d7a18453705462299801a0506a34d27"><enum>(f)</enum><header>Federal assistance</header><text>Funds received pursuant to a contract entered into under subsection (i) shall not be considered Federal assistance or otherwise affect eligibility for any Federal assistance, including a tax incentive.</text></subsection><subsection id="id31e801da04454b79bb468a4784aa5954"><enum>(g)</enum><header>Measurement, monitoring, reporting, and verification</header><paragraph id="id7fa8beda2a33432784ba60615568f5da"><enum>(1)</enum><header>In general</header><text>The Secretary, or an entity with which the Secretary enters into a contract under subsection (i), shall enter into a contract with an independent third party to measure, monitor, report, and verify the net metric tons of carbon dioxide that the Secretary or the entity, as applicable, removes for purposes of this section.</text></paragraph><paragraph id="id63f08146f55d48ab88a8838778445e57"><enum>(2)</enum><header>Standards</header><subparagraph commented="no" display-inline="no-display-inline" id="id9f9bc3dfea664a628dc33424b186c12d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Environmental Protection Agency, the Secretary of Agriculture, the Director of the National Institute of Standards and Technology, and other relevant Federal agencies, as determined by the Secretary, shall establish standards for methods of measuring, monitoring, reporting, and verifying the net metric tons of carbon dioxide removed pursuant to this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd2a51500e824af493cdffcb8a31f033"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The standards established under subparagraph (A) shall—</text><clause id="idc44a711cab2c47b08bcb07e14b919b29"><enum>(i)</enum><text>require the use of best available practices used by similar carbon dioxide removal projects;</text></clause><clause id="idfc4e250bf4e74b4db9e486fff9a29c0c"><enum>(ii)</enum><text>ensure safe, effective, and efficient removal of carbon dioxide;</text></clause><clause id="id28ab45b38cd24a72ab9899ba63927012"><enum>(iii)</enum><text>ensure additionality, durability, and net-negativity of carbon dioxide removal;</text></clause><clause id="id4bb00bc912fd42de829a6660d5989bb2"><enum>(iv)</enum><text>include criteria to determine whether the storage of captured carbon dioxide is durable;</text></clause><clause id="id832eb5a40ea4495da8ce3e410a757974"><enum>(v)</enum><text>ensure scientifically rigorous and transparent methods for measurement, monitoring, reporting, and verifying under paragraph (1); and</text></clause><clause id="id5c52a92f023c46329d52cab8ee634db0"><enum>(vi)</enum><text>be regularly reviewed and, as necessary, updated to account for scientific and technological advancements.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50418c5f340c4011bcbd60215f87c8cb"><enum>(3)</enum><header>Independent third parties</header><text>An independent third party entering into a contract under paragraph (1) shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcaca978e8d924258bf7a656bf933abfa"><enum>(A)</enum><text display-inline="yes-display-inline">in compliance with the standards established under paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5dc106ec9e634de8b929f3b6b77d6909"><enum>(B)</enum><text>subject to oversight by the Secretary.</text></subparagraph></paragraph><paragraph id="idc3629be84bdc41e193b4aa7a26e590fa"><enum>(4)</enum><header>Prohibition on double counting</header><text>Carbon dioxide that is removed for the purpose of complying with any other greenhouse gas emissions management program, including any foreign, Federal, State, local, or private greenhouse gas emissions management program, as determined by the Secretary, may not be considered removed under subsection (b) for purposes of meeting the requirements of that subsection.</text></paragraph></subsection><subsection id="id870837064afc4e6598400cf121830eee"><enum>(h)</enum><header>Priorities</header><text>In carrying out removal projects pursuant to subsection (b), the Secretary shall give priority to projects based on the degree to which the project—</text><paragraph id="id0682c20e695d4fdbace7f797a8d0aa33"><enum>(1)</enum><text>minimizes the quantity of greenhouse gas emissions released by carrying out the project;</text></paragraph><paragraph id="idfcb90c3302824f79ac2e53569a423323"><enum>(2)</enum><text>supports the commercialization of innovative removal technologies that demonstrate—</text><subparagraph id="idb921630e54b94da7b74a7d74b9a4a1dd"><enum>(A)</enum><text>near-term and long-term cost competitiveness relative to similar technologies; and</text></subparagraph><subparagraph id="id064f24cdd8cc4352a5807d937690be78"><enum>(B)</enum><text>a potential to achieve the economic feasibility requirements established under subsection (c);</text></subparagraph></paragraph><paragraph id="id3c6b69c5e9eb42418a78f80bbc93fdba"><enum>(3)</enum><text>increases the diversity of commercially available eligible technologies;</text></paragraph><paragraph id="id77e4cd1566d842f8a8ffc5d45b8f0c52"><enum>(4)</enum><text>provides for domestic job creation, with a further preference for establishing partnerships with labor organizations, small businesses, minority-owned businesses, and women-owned businesses across value chains;</text></paragraph><paragraph id="id4b43a426e6f341bbacafe2b38b00a5d3"><enum>(5)</enum><text>sources supply chain materials domestically;</text></paragraph><paragraph id="id6407879b80f340cd85f2af771e06b541"><enum>(6)</enum><text>results in economic development or economic diversification in regions or localities that have historically generated significant economic activity from the production, processing, transportation, or combustion of fossil fuels, including through the use of coal mines, fossil fuel-fired electricity generating units, and petroleum refining facilities;</text></paragraph><paragraph id="id1610fced4b674fd7a496725066d76f7c"><enum>(7)</enum><text>quantifies and mitigates risks from carbon dioxide removal activities on, and provides measurable co-benefits to, nearby communities and residents, the environment, agriculture, and public health, including by—</text><subparagraph id="id84e006cea1aa4c09891c1b88df4f6cd3"><enum>(A)</enum><text>improving local air quality, water quality, and soil quality;</text></subparagraph><subparagraph id="id2163093055304086ab4b029b080df273"><enum>(B)</enum><text>minimizing land, water, and energy footprints; and</text></subparagraph><subparagraph id="idc60baef7c7c6494a9216cb92a0f80506"><enum>(C)</enum><text>using zero-emission energy, to the maximum extent practicable; and</text></subparagraph></paragraph><paragraph id="id880685c05947459f9de7e227eafc31f9"><enum>(8)</enum><text>includes robust public engagement and community benefits, including the use of enforceable community benefits agreements.</text></paragraph></subsection><subsection id="id92c80d7ef3ed4238b81322b795d5ebfa"><enum>(i)</enum><header>Contracts</header><paragraph id="id06ad75eec0414404ab927bac4ae1d65c"><enum>(1)</enum><header>In general</header><text>The Secretary may, using a transparent and competitive process, enter into 1 or more contracts to meet the requirements of subsection (b).</text></paragraph><paragraph id="idf2913ef4dc4d4a1594a7d2d9b9ccf57c"><enum>(2)</enum><header>Duration</header><text>The duration of a contract entered into under paragraph (1) shall not exceed 15 years.</text></paragraph><paragraph id="id807b3e7e213f40d09b12d2e52e4ee9f0"><enum>(3)</enum><header>Limitation</header><text>To the extent that there is a sufficient number of entities capable of removing carbon dioxide in accordance with this section under a contract entered into paragraph (1), the Secretary shall ensure that no singular entity is responsible for removing more than 25 percent of the net metric tons of carbon dioxide required to be removed under subsection (b) in any fiscal year.</text></paragraph></subsection><subsection id="idba45e8a80c934cd98f5bcc32c625b860"><enum>(j)</enum><header>Report</header><text>Not later than January 1, 2029, and every 2 years thereafter, the Secretary shall submit to Congress, and make publicly available, a report that describes the progress made in carrying out the requirements of this section, including, with respect to the period covered by the report—</text><paragraph id="id9a12068ee1ad45daa9d51c65b15d65bc"><enum>(1)</enum><text>the quantities of removed carbon dioxide verified under subsection (g)(1) and the name of each independent third party that provided that verified quantity;</text></paragraph><paragraph id="id7c893a7341e74a81b57a789d441167e0"><enum>(2)</enum><text>the total price, and price per metric ton, of removing carbon dioxide for each applicable fiscal year as required under subsection (b);</text></paragraph><paragraph id="id5769d03661cb4f9f9aaf9b979f0b199f"><enum>(3)</enum><text>each technology category, the amount of energy, and each storage mechanism used to remove carbon dioxide for the applicable fiscal year as required under subsection (b);</text></paragraph><paragraph id="id465b21469a65469ba5f689be0aa6b731"><enum>(4)</enum><text>each location where carbon dioxide was removed for the applicable fiscal year as required under subsection (b);</text></paragraph><paragraph id="id6fc239e80e3945858bee8748bfb025d3"><enum>(5)</enum><text>the standards established under subsection (g)(2);</text></paragraph><paragraph id="id8c0b668b1d284e33987f2a2f1ad70b9c"><enum>(6)</enum><text>an assessment of how the quantities of carbon dioxide removed under this section have affected nearby communities and residents, the environment, agriculture, and public health;</text></paragraph><paragraph id="idcd2f65154d794168b22a6cd1f15d401e"><enum>(7)</enum><text>information on any potential labor impacts and job creation resulting from carrying out the requirements of subsection (b); and</text></paragraph><paragraph id="idd5c39b070dd347f7a33d1fee39d88a19"><enum>(8)</enum><text>an explanation of how the Secretary prioritized projects under subsection (h).</text></paragraph></subsection><subsection id="idc0a83589572d4ee48fe4b29310e867c5"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><section id="id2b280f72695240d6b809b3d28a220450"><enum>3.</enum><header>Study on the long-term future of Federal carbon dioxide removal management</header><subsection commented="no" display-inline="no-display-inline" id="ida4e3534b855c49df94984b024a1b201c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy, in consultation with the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Environmental Protection Agency, the Secretary of Agriculture, and other relevant Federal agencies, as determined by the Secretary of Energy, shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that evaluates and makes recommendations for potential program design elements and financing options for a Federal carbon dioxide removal offtake program that can be scaled to achieve carbon dioxide removal from the atmosphere and the oceans at a gigaton scale annually by 2050.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc13aedbcafc548c9aa3165f4c3b26609"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report under subsection (a) shall include consideration of potential management and organizational structures for the program described in that subsection, including—</text><paragraph id="id570add354c514f20bd5c8c31ba8565d4"><enum>(1)</enum><text>a government-sponsored enterprise;</text></paragraph><paragraph id="id3c93aed54b304f32b04f9e246fb88077"><enum>(2)</enum><text>a government corporation;</text></paragraph><paragraph id="id45e77e3fb53c4e0d8818e680b9448c80"><enum>(3)</enum><text>a program office within the Department of Energy or another Federal agency;
