<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5165</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260729">July 29, 2026</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> (for himself, <cosponsor name-id="S288">Ms. Murkowski</cosponsor>, and <cosponsor name-id="S408">Mr. Hickenlooper</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Office of Polar Programs of the National Science Foundation, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Operational Leadership in Arctic and Antarctic Research Act</short-title></quote> or the <quote><short-title>POLAR Act</short-title></quote>.</text></section><section id="id0a41d1d10d2841f4a2ecd0e4db344c7b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id3499dd22abe243b2a3a6fc0891c90e43"><enum>(1)</enum><header>Antarctica</header><text>The term <term>Antarctica</term> has the meaning given the term in section 3 of the Antarctic Conservation Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2402">16 U.S.C. 2402</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide68a6d652e6d437081fe99f31add6686"> <enum>(2)</enum> <header>Antarctic Treaty</header> <text>The term <term>Antarctic Treaty</term> means the Antarctic Treaty signed in Washington, DC, on December 1, 1959 (12 UST 794).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60488a6ce2b848a6978b4c6c03392040"><enum>(3)</enum><header>Arctic</header><text>The term <term>Arctic</term> has the meaning given the term in section 112 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddffb7d413f5641d29456cabeafab441c"><enum>(4)</enum><header>Assistant Director</header><text>The term <term>Assistant Director</term> means the Assistant Director responsible for the management of the Directorate appointed under section 6(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08ed24974fa842be9a0a756dd7bb462e"><enum>(5)</enum><header>Board</header><text>The term <term>Board</term> means the National Science Board.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc24c19423fcd47ab801748dba3781e40"><enum>(6)</enum><header display-inline="yes-display-inline">Director</header><text>The term <term>Director</term> means the Director of the Foundation.</text></paragraph><paragraph id="idf2a3af410d8c4a87ae1627a01aea390b"><enum>(7)</enum><header>Foundation</header><text>The term <term>Foundation</term> means the National Science Foundation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5da233a788844acfaaebd9060b3af809"><enum>(8)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id663230f679d246e8b1f6fa1df165d5aa"><enum>(9)</enum><header>Polar regions</header><text>The term <term>polar regions</term> means the Arctic and Antarctica.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75b621882b964c6686828e1207910213"><enum>(10)</enum><header>Polar research and development</header><text display-inline="yes-display-inline">The term <term>polar research and development</term> means basic and applied research, science, engineering, development, or experimentation conducted in, near, or related to, the polar regions.</text></paragraph><paragraph id="id4399ed8609c94a0d8380878578bf977f"><enum>(11)</enum><header>Workforce development</header><text>The term <term>workforce development</term> means science, technology, engineering, and mathematics education, training, and capacity-building to meet workforce demands in the polar regions.</text></paragraph></section><section id="id0d9b6936ca88430f85ed9dcdf3287030"><enum>3.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established within the Foundation the Directorate for Polar Programs (referred to in this Act as the <quote>Directorate</quote>) to advance polar research and development, education, workforce development, and research infrastructure to—</text><paragraph commented="no" display-inline="no-display-inline" id="id85050b2f25eb4cc7b9a34c05400bd6b9"><enum>(1)</enum><text display-inline="yes-display-inline">expand fundamental knowledge of polar systems and processes;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75844b96c4814227bd86febbafa7fdf0"><enum>(2)</enum><text display-inline="yes-display-inline">advance innovative solutions relating to the polar regions;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id243561715e05471baf22c956f3454163"><enum>(3)</enum><text display-inline="yes-display-inline">improve understanding of the interactions between the polar regions and global systems; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51730309b76447b9a88ffec13b19c335"><enum>(4)</enum><text display-inline="yes-display-inline">use the unique characteristics of the polar regions as a science-observing platform.</text></paragraph></section><section id="id03f3cd1ad3a04e50a003fc0dbd0c38fb"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the Directorate are to—</text><paragraph id="id5be27fdb5d4a4782917d38517eeadf4a"><enum>(1)</enum><text>promote scientific polar research and development;</text></paragraph><paragraph id="id4709cfab9dbf4b6d81a830023088c410"><enum>(2)</enum><text>advance engineering, education, and workforce development in and about the polar regions;</text></paragraph><paragraph id="id7ecf2803d7b4483aaaa70123e25fa838"><enum>(3)</enum><text>facilitate access to the polar regions and work with the United States military and other Federal agencies to provide the necessary logistical support for research;</text></paragraph><paragraph id="id81ff1f6d00844a55a3280b5bef9792a1"><enum>(4)</enum><text>support research infrastructure, including permanent year-round research stations, numerous field camps across the polar regions, and research vessels operating around the polar regions;</text></paragraph><paragraph id="id943a257be429437b84e3b2f4f245ddac"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8a82fba756894f7b944f17e9b8eeb687"><enum>(A)</enum><text>manage and maintain the United States Antarctic Program at a level providing an active and influential presence in Antarctica designed to support the range of United States Antarctic interests, as determined by Presidential Memorandum 6646 (relating to United States Antarctic policy and programs), issued February 5, 1982; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbed31f0f2a8b44aba979c35a45dbf23d" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">support the commitment of the United States to the Antarctic Treaty;</text></subparagraph></paragraph><paragraph id="ideadf594600f84925b743b8f1cb39c9a5"><enum>(6)</enum><text>coordinate all United States science in Antarctica;</text></paragraph><paragraph id="id2740dc25b48e40b5a26ebaf407a6e043"><enum>(7)</enum><text>manage and maintain an active and influential presence in the Arctic to support the range of United States Arctic interests, as determined by appropriate national and international bodies, agreements, and policies;</text></paragraph><paragraph id="id6e9fffe66b6246f9afd5b9fdcd94f663" commented="no"><enum>(8)</enum><text>facilitate engagement with local and indigenous peoples in Arctic research, education, and outreach activities;</text></paragraph><paragraph id="idc3e467d3e52541c0ba7d5d91b36e7cf5" commented="no"><enum>(9)</enum><text>chair, or designate a representative to chair, the Interagency Arctic Research Policy Committee, in accordance with section 107 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4107">15 U.S.C. 4107</external-xref>); and</text></paragraph><paragraph id="ida0fec3c2c6ca4b15b2b0a46dd09f0460" commented="no"><enum>(10)</enum><text>facilitate research and infrastructure development in Greenland in accordance with the Agreement between the United States and Denmark Amending and Supplementing the Agreement of April 27, 1951, signed at Igaliku on August 6, 2004 (commonly known as the <quote>Igaliku Agreement</quote>), and the Agreement on Enhancing International Arctic Scientific Cooperation for work in the Arctic and Greenland, signed at Fairbanks, Alaska on May 11, 2017.</text></paragraph></section><section id="id6863a6fdb44d4cc9a89b781718df34a4"><enum>5.</enum><header>Activities</header><text display-inline="no-display-inline">Subject to the availability of appropriated funds, the Director, acting through the Directorate, shall achieve the purposes described in section 4 through the use of awards or authorities described in section 9 that—</text><paragraph id="id6eed6ef0d6b34c628d1f7be05bbe0251"><enum>(1)</enum><text>support creative and innovative polar research and development, education, and workforce development in the Arctic, including incorporating indigenous knowledge and co-production of knowledge with Indian Tribes, to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfb090762ab9147228a716b232708c1c4"><enum>(A)</enum><text display-inline="yes-display-inline">gain a better understanding of the Arctic’s biological, geophysical, chemical, and sociocultural processes and the interactions of ocean, land, atmosphere, biological, and human systems; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e343852ecd04ca08fc26be9e01ad1d0"><enum>(B)</enum><text display-inline="yes-display-inline">build capacity in the United States workforce for polar research and development;</text></subparagraph></paragraph><paragraph id="id7f461e18fc02499ca1b51ec034e17461"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7f3ac877fb994557ae316a4fbab17e40"><enum>(A)</enum><text>support infrastructure in the Arctic through coordination of logistics and facilities, including at field locations throughout the Arctic (including at least 1 location in Alaska) and an appropriate number of vessels capable of supporting and conducting Arctic research;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0ead04d9834418b830d97becf16f645" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">promote the development and sustainment of infrastructure, long-term observational systems, and research capabilities in the Arctic to advance polar research and development, education, environmental prediction, national strategic interests, and workforce development in the Arctic; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idbf9c38edc0684fd0b6258d74cf28de0c"><enum>(C)</enum><text display-inline="yes-display-inline">support long-term Arctic observing, monitoring, and data collection systems, including atmospheric, oceanic, terrestrial, cryospheric, and permafrost observing networks, necessary to improve forecasting, infrastructure resilience, navigation safety, national security awareness, and the understanding of Earth system processes;</text></subparagraph></paragraph><paragraph id="id593a1baf702949a191be419a29d09d9e"><enum>(3)</enum><text>advance cutting-edge polar research and development, education, and workforce development that—</text><subparagraph id="id31f08fa26bee41ffa7db248358667b74"><enum>(A)</enum><text>improves understanding of interactions among the polar regions and global systems;</text></subparagraph><subparagraph id="idf3f1d26bc2964d1bb7abeff4fa1d9598"><enum>(B)</enum><text>expands fundamental knowledge of the systems, biota, and processes of the polar regions;</text></subparagraph><subparagraph id="idcc4d69270f7d4061b3978aa132058bbe"><enum>(C)</enum><text>utilizes the unique characteristics of the polar regions as a science-observing platform;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb75f9e0c425843b3a1ba36128d6f5e59"><enum>(D)</enum><text display-inline="yes-display-inline">builds capacity in the United States workforce for polar research and development; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida346459d52dc49708687d0b6a960bfb2"><enum>(E)</enum><text>improves collaborations among research institutions;</text></subparagraph></paragraph><paragraph id="idf4eb8d0c9fb8469a851583fb4dd15c68"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idd7e1cd32c4e74d0c81cd5170366b0058"><enum>(A)</enum><text>provide the operational and logistical platform for the United States to conduct world-class science in Antarctica and maintain an active and influential presence on the continent; and</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id6532bc303b084a379c528c0857188f35"><enum>(B)</enum><text>coordinate with, and, as needed and on a cost-reimbursable basis, draw upon the logistical support capabilities of, Federal, military, and commercial partners working together to execute a supply chain to provide personnel with everything needed to live, work, and conduct science in the polar regions, including air operations, maritime support, and land capabilities;</text></subparagraph></paragraph><paragraph id="id31e3e0c45ffe45f8a16fd1713933468e"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id63514dc349a14ccdb4b4358e38aa1289"><enum>(A)</enum><text>advance polar region safety and health through activities such as industrial hygiene and safety activities and oversight of the occupational health and medical system for programs in polar regions to ensure public health and improvement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd2c2fea01da6427bbfa83559f68fdae2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">support a streamlining of safety initiatives in polar regions; and</text></subparagraph></paragraph><paragraph id="idd41b9bb57ad340ee80a499eb3e72d6c8"><enum>(6)</enum><text>support the interest of the United States in the Arctic and Antarctica through representation, active engagement, and performing other duties in accordance with relevant national and international bodies, treaties, and agreements.</text></paragraph></section><section id="idc7f53821db264ff4bcf2dad54bafc192"><enum>6.</enum><header>Assistant Director</header><subsection id="idc09be970e40b43fd9e9e0e88a7942c5d"><enum>(a)</enum><header>In general</header><text>The Director shall appoint an Assistant Director responsible for the management of the Directorate in the same manner as other assistant directors of the Foundation are appointed.</text></subsection><subsection id="id44c581af2e824945b8eabe25ba30e19f"><enum>(b)</enum><header>Qualifications</header><text>The Assistant Director shall be an individual who, by reason of professional background and experience, is specially qualified to—</text><paragraph id="idef3ee7445ac744248d62c705b0117775"><enum>(1)</enum><text>advise the Director on all matters pertaining to polar research and development; and</text></paragraph><paragraph id="id9ed4329d619944e887eb30d5f6052b7a"><enum>(2)</enum><text>develop and implement the necessary policies and procedures to promote polar research and development across the Foundation and carry out the responsibilities under subsection (c).</text></paragraph></subsection><subsection id="idbdf659ce3cf84d6ebbc3d1879453de06"><enum>(c)</enum><header>Responsibilities</header><text>The responsibilities of the Assistant Director shall include—</text><paragraph id="id0511aef5281e457a9e86b77734e6843d"><enum>(1)</enum><text>advising the Director on all matters pertaining to polar research and development;</text></paragraph><paragraph id="idfdd6225b16fa4659946f8881811ab12b"><enum>(2)</enum><text>approving all new programs within the Directorate;</text></paragraph><paragraph id="id1d9493beb8eb4725923115365b9af9a3"><enum>(3)</enum><text>coordinating polar research and development, infrastructure planning, observational systems, logistics, and operational support across Federal agencies, including the Department of Defense, the National Oceanic and Atmospheric Administration, the Department of Energy, the National Aeronautics and Space Administration, the Coast Guard, and other relevant agencies;</text></paragraph><paragraph id="id2e67bd1312594afab4146a2c0936dccf"><enum>(4)</enum><text>coordinating polar research and development with partner countries;</text></paragraph><paragraph id="id778d9bcd144943ec9bed59316afd195b"><enum>(5)</enum><text>developing and implementing merit-review models and mechanisms for selecting and providing awards for polar research and development at different scales, from individual investigator awards to large multi-institution collaborations;</text></paragraph><paragraph id="id5c3e41ab592f4a4fabf6ebcac4410735"><enum>(6)</enum><text>assessing the success of the programs of the Directorate;</text></paragraph><paragraph id="idfe6be765bc7c4e04aaff668f34ac608e"><enum>(7)</enum><text>administering awards to achieve the purposes described in section 4;</text></paragraph><paragraph id="idca89bbb030f943c8a146e41fbc5226e3"><enum>(8)</enum><text>providing regular briefings to the Board on the status of polar regions infrastructure and the alignment of awards under section 9 with the focus areas identified under section 8; and</text></paragraph><paragraph id="id40c512c7a89c4a0e95b36fe239920cc3"><enum>(9)</enum><text>performing other such duties pertaining to such purposes as are required by the Director.</text></paragraph></subsection><subsection id="id5600f122044246279063ce6b00e0c297"><enum>(d)</enum><header>Relationship</header><text>The Assistant Director shall report to the Director.</text></subsection><subsection id="idf22f86d1527d406ea362551c86f008a4"><enum>(e)</enum><header>Relationship to other programs</header><text>No other directorate within the Foundation shall report to the Assistant Director.</text></subsection></section><section id="idc855b5dd578242f4893c8054d9852bfc"><enum>7.</enum><header>Advisory committee</header><subsection id="id5811b6e3e0534cd9aed451221967048a"><enum>(a)</enum><header>In general</header><text>In accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code, the Director shall establish an advisory committee (referred to in this section as the <quote>advisory committee</quote>) to assess, and make recommendations regarding, the activities carried out under this Act.</text></subsection><subsection id="id6bc45db3615d4329b5b931b8e3737fe3"><enum>(b)</enum><header>Membership</header><text>The members of the advisory committee shall—</text><paragraph id="id565fc91fabcb475383d91762e5e98271"><enum>(1)</enum><text>be individuals with relevant experience or expertise, including educators, academic subject matter experts, individuals from industry and national labs, members of Indian Tribes, representatives of civil society, and representatives of other nongovernmental organizations; and</text></paragraph><paragraph id="id772b13e7c0814fe1b9dde82dacc11a21"><enum>(2)</enum><text>consist of not less than 10 members broadly representative of stakeholders.</text></paragraph></subsection><subsection id="idf58e87203b974ec29e1e4100a4a7ba05"><enum>(c)</enum><header>Responsibilities</header><text>The responsibilities of the advisory committee shall include—</text><paragraph id="ida236941f9d024d2eac252b6a74c7494e"><enum>(1)</enum><text>reviewing and advising on activities carried out under this Act;</text></paragraph><paragraph id="idbf16c5054e594e7c99c58d9b1303a1bb"><enum>(2)</enum><text>proposing strategies for fulfilling the purposes described in section 4;</text></paragraph><paragraph id="ida9b30c6bcb6649c09a02113062919a6c"><enum>(3)</enum><text>proposing potential areas of research relevant to polar challenges; and</text></paragraph><paragraph id="id6338d1e79289453a9e0912f9b2276b7e"><enum>(4)</enum><text>other relevant duties, as determined by the Director.</text></paragraph></subsection></section><section id="id101a6a47424247d5bce7c8d438b5c7aa"><enum>8.</enum><header>Focus areas</header><subsection id="id6ca73b7ef0214155b7076bb4d9b77525"><enum>(a)</enum><header>In general</header><text>In consultation with the Assistant Director, the Board, and the advisory committee established under section 7, the Director shall identify, and annually review and update as appropriate, a list of—</text><paragraph id="idc9a6d1b91d6042a1915facbb114fa3ff"><enum>(1)</enum><text>polar research and development, education, and workforce development investment priorities under this Act; and</text></paragraph><paragraph id="idcaf60d85afe64d1e9ecc139596863cad"><enum>(2)</enum><text>necessary infrastructure and logistical support needed to appropriately carry out polar research and development, education, and workforce development under this Act.</text></paragraph></subsection><subsection id="idd84993211dd244e9a0aa3404a2bd8ff2"><enum>(b)</enum><header>Initial focus of polar regions research and infrastructure investments</header><text>The initial focus of polar regions research and infrastructure investments shall be—</text><paragraph id="id1925c38bf34e492fa85f6764c45fa518"><enum>(1)</enum><text>research and associated research infrastructure investments that maintain, strengthen, and enhance the ability of the United States to observe, understand, and predict the physical, biological, geologic, and socioeconomic processes and interacting systems of the Arctic to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd077a9e380bf4ab6adcb193d7fc24dc9"> <enum>(A)</enum> <text display-inline="yes-display-inline">protect and advance the interests of the United States and ensure prosperity of the United States Arctic residents;</text>
 </subparagraph><subparagraph id="id877ca1716ced4626bb08c4a37e1e14fb"><enum>(B)</enum><text>strengthen Alaska's role as the primary Arctic research, logistics, operations, and workforce development hub for the United States; and</text></subparagraph><subparagraph id="idab0638c8d04342369c02f8b87922a65e"><enum>(C)</enum><text>strengthen existing associated research, research infrastructure, and workforce development in other States and territories;</text></subparagraph></paragraph><paragraph id="id433d38b5c71c410e9ff443f1f053bab4"><enum>(2)</enum><text>research and associated research infrastructure investments that maintain, strengthen, and enhance the ability of the United States to observe, understand, and predict the physical, biological, geologic, and socioeconomic processes and interacting systems of Antarctica to protect and advance the interests of the United States under the Antarctic Treaty;</text></paragraph><paragraph id="id31a1167675cc4813b492c640073b6fb7"><enum>(3)</enum><text>polar research and development that ensures the uncontested navigation and strategic utilization by the United States of the Arctic; and</text></paragraph><paragraph id="id266198224fb44d16b03c6059c4488a8d"><enum>(4)</enum><text>polar research and development that ensures the United States dominance in Antarctica under the Antarctic Treaty.</text></paragraph></subsection></section><section id="id6809953337a14653a000c44e11999f51"><enum>9.</enum><header>Awards and authorities</header><subsection id="id17601971de8d4edbac53000dd412f638"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director may carry out the activities described in section 5—</text><paragraph commented="no" display-inline="no-display-inline" id="id7efdf5e1b69345929066cfe05da00ee9"><enum>(1)</enum><text display-inline="yes-display-inline">by awarding or entering into grants, cooperative agreements, fellowships, scholarships, or infrastructure awards under subsection (b); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id324f6e8829f34d9e9d8f09c3a32d91fc"><enum>(2)</enum><text display-inline="yes-display-inline">by exercising, for purposes of this Act, any of the authorities provided to the Foundation under the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1861">42 U.S.C. 1861 et seq.</external-xref>) for the purposes of that Act.</text></paragraph></subsection><subsection id="id6d749a89cc014fd2a38c957cf6ebd1d7"><enum>(b)</enum><header>Awards</header><paragraph commented="no" display-inline="no-display-inline" id="id7c3289520f754de698ee8149334d3c7b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>From amounts made available for the Directorate and on a competitive basis, the Director shall make awards described in subsection (a)(1) for polar research and development, education and workforce development, infrastructure, and logistical support that carry out the activities described in section 5 by advancing polar research and development, education and workforce development, infrastructure, and logistical investments that are aligned with the focus areas identified under section 8.</text></paragraph><paragraph id="ide08687d6c6bc48e2978a5a06520c46f8"><enum>(2)</enum><header>Recipients</header><text>Recipients of awards under this subsection may include, as determined appropriate by the Director—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9382cee33b4742529c3af318d02dc5a8"><enum>(A)</enum><text display-inline="yes-display-inline">institutions of higher education (as such term is defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idacb67551dc6c4a99aee12d6ac4979378"><enum>(B)</enum><text display-inline="yes-display-inline">research institutions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2b4e46bc97de41febb71919094c1f8de"><enum>(C)</enum><text display-inline="yes-display-inline">nonprofit organizations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id926e0e34ab554ebfa56258dcdc0442cc"><enum>(D)</enum><text display-inline="yes-display-inline">private sector entities;</text></subparagraph><subparagraph id="id25983096e8704e7e9292ad21b82863a9"><enum>(E)</enum><text>Indian Tribes;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16d23e8e993347f2b38429895e03c8c4"><enum>(F)</enum><text>consortia; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9cf89d967a94159ac3bad734684436d"><enum>(G)</enum><text display-inline="yes-display-inline">other entities that the Director determines further the purposes of this Act.</text></subparagraph></paragraph><paragraph id="id628810db885b4d75be4e6a3c16bdd614"><enum>(3)</enum><header>Metrics</header><text>The Director may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idead40e936aae4fb6842ac8b0646bf5ee"><enum>(A)</enum><text display-inline="yes-display-inline">set metrics, including goals and deadlines, for awards made under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2383b634e5a4a5887fa38517f9f37d4"><enum>(B)</enum><text display-inline="yes-display-inline">use such metrics to determine whether an award recipient shall be eligible for continued or additional funding.</text></subparagraph></paragraph></subsection></section><section id="id93c673def5344e4491a19754428f5e0b"><enum>10.</enum><header>Reporting</header><subsection id="ide9868381777e474c9188804cce748f5f"><enum>(a)</enum><header>In general</header><text>The Director, in consultation with other Federal agencies, as appropriate, shall prepare and submit an annual report to Congress describing—</text><paragraph id="idc5c1e3e6c9c743dc84ed0eae47c1168d"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id643b705833b64b9b953dbd3e2e2020d6"><enum>(A)</enum><text>the focus areas identified under section 8, for the period covered by the report, for polar research and development, education, workforce development, infrastructure investments, and logistical support in the polar regions; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id872dbcd08fdd40b6a7879412345d9911" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the rationale for their identification;</text></subparagraph></paragraph><paragraph id="id4d32dd42b6a34347aa0994f36be7382b"><enum>(2)</enum><text>potential future investments needed to advance polar research and development, education, workforce development, infrastructure, and logistical support in the polar regions; and</text></paragraph><paragraph id="id12266f66ed48430f952b12c9a01b3cbe"><enum>(3)</enum><text>the role of the Foundation in advancing the interests of the United States in polar regions.</text></paragraph></subsection><subsection id="idee571fb0209f425a8882fe68143294c7"><enum>(b)</enum><header>Detailed description</header><text>For each fiscal year, the Director, in coordination with the Director of the Office of Management and Budget, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id6b4f462fa70446cb868c5f8bcc561da0"><enum>(1)</enum><text display-inline="yes-display-inline">submit, as part of the annual budget requests to Congress, a detailed description of the activities to be funded under this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda669dfa8c6d49bbaaaf61790e360f20"><enum>(2)</enum><text display-inline="yes-display-inline">include, at a minimum, separate budget lines for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3ff5de79ff84443a9d8639091d492f01"><enum>(A)</enum><text display-inline="yes-display-inline">Arctic research as described in section 5(1);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e866eeb962c46ceb878f1fa48394c57"><enum>(B)</enum><text display-inline="yes-display-inline">Arctic infrastructure as described in section 5(2);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf10f912d9e974656b4baf2f24879d35b"><enum>(C)</enum><text display-inline="yes-display-inline">Arctic research as described in section 5(3);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id044ea68391bf4d7b9789af591f172f37"><enum>(D)</enum><text display-inline="yes-display-inline">Antarctica research as described in section 5(3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id831c8ac5dead4b33ade3eb5d8dc1c18f"><enum>(E)</enum><text display-inline="yes-display-inline">Antarctica infrastructure as described in section 5(4).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
