which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote the use of accessible, seamless, intrastate data available through robust, secure, and tailored statewide longitudinal data systems, and for other purposes.</official-title></form><legis-body><section id="idb78e55462acd466aa08b1c1a930fb003" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reimagining Education and Skills through Unified Longitudinal Talent Systems (RESULTS) Act of 2026</short-title></quote>.</text></section><section id="id794ecbe7bae5472aa00669a07e81a823" section-type="subsequent-section"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph commented="no" display-inline="no-display-inline" id="id9822a8ad428f47fea2c9407cc5d25e3c"><enum>(1)</enum><text>to promote the use of accessible, seamless data available through robust, secure, and tailored statewide longitudinal data systems that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id65fe39837a8947b380de66487222983b"><enum>(A)</enum><text display-inline="yes-display-inline">protect privacy and confidentiality in accordance with applicable Federal and State privacy laws; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4f863e263ec4992970a33848cf658d5"><enum>(B)</enum><text display-inline="yes-display-inline">connect early childhood education, elementary school and secondary school, postsecondary education, adult education, workforce development, and employment outcomes data, in order to help State and local policymakers address emerging and longstanding cross-sector challenges and provide communities insights they need to make informed decisions about their education and workforce training options;</text></subparagraph></paragraph><paragraph id="id5553107c37ef429090b8d6facd0b0fa3"><enum>(2)</enum><text>to modernize section 208 of the Educational Technical Assistance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9607">20 U.S.C. 9607</external-xref>), as in effect on the day before the date of enactment on this Act, with a more flexible, consolidated source of funding that States can use to improve their statewide longitudinal data systems, including the infrastructure and capacity of those systems; and</text></paragraph><paragraph id="ide6b24f972f62434ab600dadcff7197bf"><enum>(3)</enum><text>to support more robust statewide longitudinal data systems in order to ensure consistency and compatibility of data elements, formats, and structures.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id04c70fed748747079da8a1e4711632e4"><enum>3.</enum><header>Grant program for statewide longitudinal data systems</header><text display-inline="no-display-inline">Section 208 of the Educational Technical Assistance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9607">20 U.S.C. 9607</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd533aca0dba3451d904fb12190503ccf"><section id="id8c7526a9803c48daad3cd8d8a8e3c199" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Grant program for statewide longitudinal data systems</header><subsection commented="no" display-inline="no-display-inline" id="id93099cdab33041a8b57edb851bb8122c"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd50ce9ba083643e4ab7efeeece465e3d"><enum>(1)</enum><header>ESEA definitions</header><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9031c069ee934f1ea013ebfdbd70a6b7"><enum>(2)</enum><header>Area career and technical education school</header><text>The term <term>area career and technical education school</term> has the meaning given such term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id043f537bfadc4ecab9df8d249e4d04a8"><enum>(3)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id66ae9de81df14fc79bad51f6a07d1eae"><enum>(A)</enum><text display-inline="yes-display-inline">the Governor of a State; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8475b8e7cd6748218c8ee300b6ef0378"><enum>(B)</enum><text display-inline="yes-display-inline">a State agency, data governance entity, or public sector organization that oversees the statewide longitudinal data system, provided that such entity is designated by the Governor to administer or coordinate activities under this section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide00e510b53884e069d1458b6eb82c1cf"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4355312fb8544cd3ba146457c0d1f6b9"><enum>(5)</enum><header display-inline="yes-display-inline">Statewide longitudinal data system</header><text>The term <term>statewide longitudinal data system</term> means a data system operated at the State level by an eligible entity that connects individual-level data from early childhood education, elementary school and secondary school, postsecondary education, adult education, workforce development, employment outcomes (including unemployment insurance wage records), and other data sources, as determined by the State, in a manner that—</text><subparagraph id="id0be39d7ad00649e896b563cc4f996aad"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idc2eab8aa65de4ba9a55b4101ceb26be1"><enum>(i)</enum><text>protects and promotes individual privacy and data security, in accordance with applicable Federal and State privacy laws, including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) and section 445 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>; commonly known as the <quote>Protection of Pupil Rights Amendment</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id7b423894151f4e3ea520f3db26dd97e5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">increases data transparency; and</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idd79a051dc4f34f3cba67774e9f27b4dd"><enum>(iii)</enum><text display-inline="yes-display-inline">minimizes reporting burden; and</text></clause></subparagraph><subparagraph id="id814e8b7e7a544fb3872fe07d726f0425"><enum>(B)</enum><text>enhances the ability of the public, researchers, policymakers, practitioners, and States to efficiently and accurately access, manage, analyze, and use data to inform decision-making and improve educational and employment opportunities and outcomes, including academic achievement, postsecondary education access and completion, and labor market outcomes.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c0da21f08f24e9999e0b6f30ca88543"><enum>(b)</enum><header>Grants authorized</header><paragraph commented="no" display-inline="no-display-inline" id="id4e1a80d756ac46d283dc89999ed66459"> <enum>(1)</enum> <header display-inline="yes-display-inline">In General</header> <text>The Secretary, acting through the Director of the Institute of Education Sciences and in consultation with the Secretary of Labor, shall award grants, on a competitive basis, to eligible entities to enable those eligible entities to create, modernize, and improve the State's statewide longitudinal data system in accordance with this section.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07e22b41f62744a18498d0dcb59ebe78"><enum>(2)</enum><header>Determination of funding level</header><text display-inline="yes-display-inline">In determining the amount of a grant awarded under this section, the Secretary shall consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3e1427a6581b4773b10dfef0943c70ab"><enum>(A)</enum><text display-inline="yes-display-inline">the size and geographic diversity of the State represented by the eligible entity as compared to all States receiving a grant under this section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4acf9fea180d498cba0c79d0ec2791a6"><enum>(B)</enum><text display-inline="yes-display-inline">the potential direct and demonstrative impact of the State's proposed activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24a9dd11697641389debbd1138e9748f"><enum>(C)</enum><text display-inline="yes-display-inline">the technical quality of the proposed activity, including peer review of the proposal.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id098f1b041cf74c2eb2c4a54aaf808351"><enum>(3)</enum><header>Applications</header><text>An eligible entity that desires a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id73e088548e69412880bdbf01736c8785"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the development and modernization plan for the statewide longitudinal data system, which shall—</text><clause commented="no" display-inline="no-display-inline" id="ideef18f01e3464ec9977bf9dfd11d2583"><enum>(i)</enum><text display-inline="yes-display-inline">identify the State data needs and demonstrate a comprehensive strategy for infrastructure and capacity to meet those needs;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9d8f2346b6be432e89c9bdfe2ccff9f4"><enum>(ii)</enum><text>include a learning agenda identifying priority policy and program questions the statewide longitudinal data system will be used to answer, or if a statewide longitudinal data system has not published a learning agenda, include a plan to develop such a learning agenda and policies to ensure regular review of that learning agenda;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfaab857a93cf41ce886a25e7b2e7ca3c"><enum>(iii)</enum><text display-inline="yes-display-inline">include a plan to conduct periodic capacity assessments of the State's ability to use the statewide longitudinal data system to generate actionable evidence of what works to improve academic and workforce outcomes, and to develop capacity within the State for such use;</text></clause><clause commented="no" display-inline="no-display-inline" id="id45229d78db824833b0f8afe0f0867c41"><enum>(iv)</enum><text display-inline="yes-display-inline">designate cross-agency roles (such as a chief data officer, chief evaluation officer, or chief privacy officer) to coordinate evidence-building activities and facilitate access for qualified researchers, including those external to the State, under appropriate privacy and security protections;</text></clause><clause id="id42454a38e99649eb8ea84daef57e2169"><enum>(v)</enum><text>ensure the availability of data through interactive resources containing education-to-employment statistics and open datasets containing aggregate statistics that the public can access and download;</text></clause><clause id="id8c233e172bbf43f7a3922f5174f4276c"><enum>(vi)</enum><text>describe the methods and procedures the eligible entity will use to ensure the security and privacy of the collection, storage, and use of the data involved in the statewide longitudinal data system in accordance with all applicable Federal and State privacy laws, including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) and section 445 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>; commonly known as the <quote>Protection of Pupil Rights Amendment</quote>);</text></clause><clause id="idbb8bc557249a4648b80ad32a4f5e9aad"><enum>(vii)</enum><text>describe how the eligible entity will ensure interoperability of de-identified data, including through the use of structured, open, linked, interoperable, and durable (SOLID) data formats; and</text></clause><clause id="id6e4cbda78b604335b8a71a8c633584d9"><enum>(viii)</enum><text>include a detailed budget;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84f32f7bad20419f99b24d852d4bdcf5"><enum>(B)</enum><text>a description of the expected outcomes and outputs that will result from the activities described in the proposed plan;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id201226a8919d4f94928bf11b133239b1"><enum>(C)</enum><text>the Federal performance reporting requirements the statewide longitudinal data system will support and how such efforts will reduce administrative burden and duplication of effort;</text></subparagraph><subparagraph id="idd72b06217f7847ffb40fb1c0927b6427"><enum>(D)</enum><text>the manner in which the modernized statewide longitudinal data system will be used to improve transparency in relation to, among other things, program quality, education and career outcomes and opportunities, labor market trends, and changes to job skills needed to obtain employment, including for in-demand jobs; and</text></subparagraph><subparagraph id="id1fa4f5e55d0146648526542ce9249cda"><enum>(E)</enum><text>the extent to which the modernized statewide longitudinal data system will be used to enhance collaboration with the end-users of education, workforce, and labor market data as outlined in subsection (c)(2)(F).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id953d6be0ff4c455a913ca69cfb3abff5"><enum>(4)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">A grant awarded under this section may be for a period of not more than 4 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb4f5f2f8f5874384b0e4d51a23698c76"><enum>(5)</enum><header>Supplement, not supplant</header><text display-inline="yes-display-inline">Funds made available under this section shall be used to supplement, and not supplant, other Federal, State, or local funds used for development of State data systems.</text></paragraph></subsection><subsection id="id3650c35bd42342a09afba39f7277a4ce"><enum>(c)</enum><header>Uses of funds</header><paragraph commented="no" display-inline="no-display-inline" id="id2d4da6af61bc42799741b1fb2a86e206"><enum>(1)</enum><header display-inline="yes-display-inline">Requirements for data systems</header><subparagraph commented="no" display-inline="no-display-inline" id="id7a9fb410cfc54f52895532d576f40aa7"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">Grants under this section shall be used to support statewide longitudinal data systems that meet the following requirements:</text><clause commented="no" display-inline="no-display-inline" id="id2da610636dfa4f48894f1e3feaefdba8"><enum>(i)</enum><text display-inline="yes-display-inline">At a minimum, include, or seek to include, and integrate individual level and administrative data from—</text><subclause commented="no" display-inline="no-display-inline" id="iddbba4c054bbb4d3e8df7bffe1d3d4360"><enum>(I)</enum><text display-inline="yes-display-inline">public early childhood education, public elementary schools and secondary schools, public institutions of higher education, and public area career and technical education schools;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4eb3cf87715549c6ad2149bbb1ee6db6"> <enum>(II)</enum> <text display-inline="yes-display-inline">workforce programs funded through the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101 et seq.</external-xref>), including education and training providers receiving such funding through State or local funding streams, programs for which an individual may be eligible to receive a Workforce Pell Grant under section 401(k) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a(k)</external-xref>), and apprenticeships registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>); and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id6faf2e2d55284caf9f5d0e4d032d3919"><enum>(III)</enum><text display-inline="yes-display-inline">unemployment insurance and other statewide data sources with access to labor market outcomes or wage record data, in accordance with privacy and data security requirements of the State.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida300931cfe40469e87a0c5debe75031f"><enum>(ii)</enum><text>Are able to, or seek to, disaggregate data by race, ethnicity, socio-economic status, age, disability status, and gender across the levels of early childhood education, elementary and secondary education, postsecondary education, and the workforce.</text></clause><clause id="idf266efd0acec4ca4866422c46374aaec"><enum>(iii)</enum><text>Protect student privacy consistent with all applicable Federal and State privacy laws, including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) and section 445 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>; commonly known as the <quote>Protection of Pupil Rights Amendment</quote>).</text></clause><clause id="id1968eb0c90d54eea9385f6ffdc1600aa"><enum>(iv)</enum><text>Are governed through an interagency governance structure involving all agency data contributors and established through statute, regulation, intergovernmental agreement, or other formal legal structure.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ebc053471fe47ee8c3385cce0be5ec5"><enum>(B)</enum><header>Permissible elements</header><text>Data systems supported under this section may include other data systems, such as—</text><clause commented="no" display-inline="no-display-inline" id="idf102ba1ca89d461cb5636929418d3c27"><enum>(i)</enum><text display-inline="yes-display-inline">juvenile justice and child welfare data systems;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6974e55b584b4d37b38f1fd0762d4a53"><enum>(ii)</enum><text display-inline="yes-display-inline">data systems relating to private early childhood education, private elementary schools and secondary schools, private institutions of higher education, and private area career and technical education schools;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf01aef93fa1e42f29d37db8cf1e85f7c"><enum>(iii)</enum><text display-inline="yes-display-inline">health records;</text></clause><clause commented="no" display-inline="no-display-inline" id="id01d019b53fb7446e8383784d9310b48c"><enum>(iv)</enum><text display-inline="yes-display-inline">correctional systems;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc26b5ddcc2d24b82bbf5e397a9c94059"><enum>(v)</enum><text display-inline="yes-display-inline">work-based, workplace, and employer-provided training records; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id353e397f0d7e4703bca8f4591c20d0d4"><enum>(vi)</enum><text display-inline="yes-display-inline">other data systems determined appropriate by the eligible entity.</text></clause></subparagraph></paragraph><paragraph id="id0224f314ac004e99b62ca970d719d9a8"><enum>(2)</enum><header>Additional uses of funds</header><text display-inline="yes-display-inline">In addition to supporting statewide longitudinal data systems in accordance with paragraph (1), eligible entities receiving a grant under this section shall use grant funds to carry out one or more of the following activities:</text><subparagraph id="id5d3f0e7cfb2e4196a01d0e3d743aa592"><enum>(A)</enum><header>Data governance</header><text>Activities such as—</text><clause id="id40be2e4d5def46e2a1b6a4776d4ac185"><enum>(i)</enum><text>supporting the implementation of statewide data governance structures that include, at a minimum, all State agencies that contribute data to the statewide longitudinal data system, the director of the statewide longitudinal data system, a data governance director, and public stakeholders;</text></clause><clause id="idd9b41866846f4033a9ab5d5a3671e0a9"><enum>(ii)</enum><text>funding a Chief Data Office or Chief Evaluation Officer; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc49a904da90e4b338fbec9a06a611e11"><enum>(iii)</enum><text display-inline="yes-display-inline">funding a Chief Privacy Officer and capacity for legal expertise on de-identification, risk management, and data sharing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3d53df7ea2ec48b38b8675a2acb4e4b4"> <enum>(B)</enum> <header>Accountability and reporting</header> <text>Establishing the policies and processes to use the statewide longitudinal data system as the primary infrastructure for meeting existing Federal education and workforce accountability and performance reporting requirements (such as requirements under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>)), (including the Workforce Pell Grant program under section 401(k) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a(k)</external-xref>), the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>), the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>), the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101 et seq.</external-xref>), the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>), section 6(d)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(d)(4)</external-xref>), and the temporary assistance for needy families program established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>)).</text>
 </subparagraph><subparagraph id="id9cfd4f0c4190415e97fc749a1a8565f5"><enum>(C)</enum><header>Accessibility of data</header><text>Facilitating access, as appropriate and in accordance with applicable data privacy laws, to the data within the statewide longitudinal data system for students, parents, workers, employers, researchers, State and local policymakers, schools, workforce training program providers, community nonprofit organizations, and others, by carrying out activities such as—</text><clause commented="no" display-inline="no-display-inline" id="id65179b8ae3a24879a2ccf119bca23e3c"><enum>(i)</enum><text display-inline="yes-display-inline">creating data dashboards, public data portals, open aggregate datasets, and reports that can be queried and have de-identified information that can be sorted and aggregated in different ways for public consumption;</text></clause><clause commented="no" display-inline="no-display-inline" id="id107d45c72afc4143bd2ef3f4749fc6af"><enum>(ii)</enum><text display-inline="yes-display-inline">creating one-way, secure data portals that allow schools, institutions of higher education, and workforce training providers (defined as providers under section 122(a)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3152">29 U.S.C. 3152(a)(2)</external-xref>)) to access outcomes data for their students or program participants for a set period of time;</text></clause><clause commented="no" display-inline="no-display-inline" id="id351997cf92c14042a92438299e670b2c"><enum>(iii)</enum><text display-inline="yes-display-inline">creating individual student dashboards with personally identifiable information that parents, counselors, and teachers can access through a secure portal to assist in identifying whether students are on-track for graduation and planning for college and careers after graduation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id75e1b49fef284a1db1c5d116ed01bf01"><enum>(iv)</enum><text>developing policies, processes, and protocols that allow State agencies, alone or in partnership with public or private nonprofit institutions of higher education or nonprofit research organizations, to conduct research related to topics such as student academic outcomes, postsecondary and workforce training program quality, earnings outcomes of education and workforce training program participants, and high-quality career pathways and trajectories.</text></clause></subparagraph><subparagraph id="id2c9148ea087949efbc10e089218cf786"><enum>(D)</enum><header>Expanding datasets and formats</header><text>Supporting a partnership between the eligible entity and State educational agencies, institutions of higher education, State workforce agencies, workforce training providers, or employers, in order to—</text><clause commented="no" display-inline="no-display-inline" id="id6be38ac05aaf4f8bb891bad09cd06ce4"><enum>(i)</enum><text display-inline="yes-display-inline">enhance State unemployment insurance systems to collect additional data on jobs and employment, including at a minimum, job titles or occupation codes;</text></clause><clause commented="no" display-inline="no-display-inline" id="idae9e816b9af54bb4afb7b5644fbd95b7"><enum>(ii)</enum><text display-inline="yes-display-inline">expand the data collection systems of postsecondary educational institutions to include data from private postsecondary educational institutions and data on all types of program offerings, whether offered for credit or noncredit; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idca6689d172d7476ebd76a391e051177b"><enum>(iii)</enum><text>expand the adoption and use of structured, open, linked, interoperable, and durable (SOLID) data formats on knowledge, skills, and abilities represented through credentials, occupational job descriptions, and learning assertions, including through the development of a talent marketplace, tools and services designed to help learners and workers make informed decisions, or an interstate data sharing agreement.</text></clause></subparagraph><subparagraph id="id063363331ec840f6958feae6295db347"><enum>(E)</enum><header>Multistate data collaborative</header><text>Participating in, and contributing data to, a multi-State data collaborative, including efforts that provide participating States the ability to better understand and support—</text><clause id="id1610708c7c2e4c1da935f87b5a1898b6"><enum>(i)</enum><text>earnings and employment outcomes of individuals who work out-of-State;</text></clause><clause id="id810034e849b84d94b11ca9a763aa7f70"><enum>(ii)</enum><text>interstate earnings and employment trends;</text></clause><clause id="id60bb5c7597ac4244a8c1947bb98e7d18"><enum>(iii)</enum><text>standards-based jobs and employment data including, at a minimum, job titles or occupation codes; and</text></clause><clause id="id6499ccca536b47088a08c7bb591b6234"><enum>(iv)</enum><text>multistate open source data infrastructure and the development and maintenance of collaboratively managed software that supports cost-efficient and advanced data systems within or across States.</text></clause></subparagraph><subparagraph id="ida4878df7ee614eb69b0071ec0895ff22"><enum>(F)</enum><header>Enhancing collaboration</header><text>Enhancing collaboration with private sector education, workforce, and labor market data entities and the end-users of workforce and labor market data, including individuals, employers, economic development agencies, researchers, and nonprofit external providers working in partnership with public or private nonprofit institutions of higher education to—</text><clause commented="no" display-inline="no-display-inline" id="id8bc61a982f9141b78e838f2e6b15fa3e"><enum>(i)</enum><text display-inline="yes-display-inline">improve the presentation and availability of workforce outcome data as it pertains to degree and credential attainment and student success for education and training providers, with a goal of improving the timeliness, relevance, and accessibility of such data, including through pilot projects; and</text></clause><clause id="idc9e8de1c5d3747b785cd3193f1822b67"><enum>(ii)</enum><text>provide training to public elementary schools and secondary schools, public nonprofit institutions of higher education, workforce training providers, and community-based organizations on interpreting data.</text></clause></subparagraph><subparagraph id="id52b0ebbf79384612a1eca27082360dbf"><enum>(G)</enum><header>Data security and privacy</header><text>Ensuring data security and the protection of an individual’s data privacy, including—</text><clause id="ide4afbbd67a5c427fb0951dace87ca5ae"><enum>(i)</enum><text>defining policies or guidelines for data collection, storage, sharing, analysis, and use that ensure compliance with relevant Federal and State privacy and security laws (including regulations);</text></clause><clause id="ide81365c026744eab96247f35342e21ad"><enum>(ii)</enum><text>reviewing policies and procedures on how the eligible entity will adhere to all applicable Federal and State privacy laws and protections, including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) and section 445 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>; commonly known as the <quote>Protection of Pupil Rights Amendment</quote>), in the building, maintenance, and use of their statewide longitudinal data systems; and</text></clause><clause id="id413ff9a61e3946349da009a2197407c7"><enum>(iii)</enum><text>providing privacy and cybersecurity training for individuals that interact with personally identifiable information to ensure compliance with all applicable Federal and State privacy laws.</text></clause></subparagraph><subparagraph id="id05f480a0bece4b1d920446694a94b2d6"><enum>(H)</enum><header>Artificial intelligence</header><text>Exploring evidence-based, innovative, and secure methods of leveraging artificial intelligence in conjunction with a statewide longitudinal data system while complying with all applicable Federal and State privacy laws and the National Institute of Standards and Technology’s Artificial Intelligence Risk Management Framework.</text></subparagraph><subparagraph id="idcd081a7861ee4c88b862076718027b61"><enum>(I)</enum><header>Replication and adoption</header><text>Accelerating the replication and adoption of data systems, projects, products, or practices already in use in one or more other States.</text></subparagraph><subparagraph id="id9750da8f4d26482a83d0aa249a835d99"><enum>(J)</enum><header>Staff capacity</header><text>Improving State and local staff capacity to understand, use, and analyze data to improve decision-making, educational achievement, and education and workforce outcomes.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idae863c68a11d400ba741fa3d1556be8b"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the conclusion of the grant period, each eligible entity that receives a grant under this section shall submit a report to the Secretary on the activities supported through the grant.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id453543c76db043c6ad29e356b9308c62"><enum>(e)</enum><header>Authorization of appropriations; funding awards</header><paragraph commented="no" display-inline="no-display-inline" id="id642c61cd9d2b4422a3780b9a4b3776c3"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section such sums as may be necessary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96233118f48845c69f936639d61b6656"><enum>(2)</enum><header>Funding awards</header><text display-inline="yes-display-inline">The Secretary shall award to each State an amount as required under the applicable provisions of this Act on the date such funds become available for obligation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idff136df4bcfa4ab69385db7d45b4c8e3"><enum>4.</enum><header>Access to national directory of new hires</header><text display-inline="no-display-inline">Section 116(i) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(i)</external-xref>) is amended—</text><paragraph id="idffeb7efeb4774fe5973f84c1ab0c7c2c" commented="no"><enum>(1)</enum><text>in paragraph (2), by inserting <quote>, and may use information provided from the National Directory of New Hires in accordance with section 453(j)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(j)(8)</external-xref>)</quote> after <quote>State law</quote>;</text></paragraph><paragraph id="idd2bba26fbdbc4ce280dd466c467f4f6b" commented="no"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81c6449e8b094fb0a154408aac416e0b"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f9d71a7c7414b94bcd19093d3d582fc"><paragraph id="id729127e5bb194353b652b2d3c98d214c"><enum>(3)</enum><header>Designated entity</header><text>The Governor shall designate a State agency (or appropriate State entity) to assist in carrying out the performance reporting requirements for core programs and eligible providers of training services. The designated State agency (or appropriate State entity) shall be responsible for—</text><subparagraph id="idd447787da53642978a07957a07894366"><enum>(A)</enum><text>facilitating data matches using quarterly wage record information, including wage record information made available by other States, to measure employment and earnings outcomes;</text></subparagraph><subparagraph id="id91768f01c5cf43b6acc21fd65091806e"><enum>(B)</enum><text>data validation and reliability, as described in subsection (d)(5); and</text></subparagraph><subparagraph id="id17a4d003573d40029682b7a648ec6996"><enum>(C)</enum><text>protection against disaggregation that would violate applicable privacy standards, as described in subsection (d)(6)(C).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
