which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require employers seeking a permanent labor certification classification for the hiring of foreign workers to pay a fee of at least $10,000, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Hiring Transparency Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id6b131783318c48e6ac9c87ef76179d4d"><enum>2.</enum><header display-inline="yes-display-inline">Permanent labor certification fee</header><text display-inline="no-display-inline">Section 281 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id84fb0bb80da741fd894b8b85daffe2a3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section header and inserting <quote><header-in-text style="OLC" level="section">Visa fees</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcec71bc4ef0440b7aa595fbbb9923fb1"><enum>(2)</enum><text>by striking <quote>The fees for</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8add4f8dd1994536b2d5f2a842874ccf"><subsection commented="no" display-inline="no-display-inline" id="idd65673a907dd43d1b19bdda873e43cb1"><enum>(a)</enum><header>Nonimmigrant visa fees</header><paragraph commented="no" display-inline="no-display-inline" id="idd1b909fc516349dd823b277f33a1d06d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The fees for</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a8fd512e0d243bd9ecd51e79b154e02"><enum>(3)</enum><text>by striking the semicolon after <quote>residents</quote> and inserting a period;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68f2ffcd218240a2b0987172071cc4dd"><enum>(4)</enum><text>by striking <quote><italic>Provided</italic>, That nonresident visas</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1b00d7104ec44713941d8f0752c122b9"><paragraph commented="no" display-inline="no-display-inline" id="idf9399529a9604b72b33b4080694397b6"><enum>(2)</enum><header>Fee waivers</header><text>Nonresident visas</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef3d37b4a48b4459a0de00ec1893a3a6"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide12b003928484f409206bc808a55e805"><subsection id="idf4dd7c668f374bbcbd3caa8ac47ed78c"><enum>(b)</enum><header>Permanent labor certification fee</header><paragraph commented="no" display-inline="no-display-inline" id="idce625f78603747638b494c717a69b46a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other fee authorized by law, the Secretary of Labor shall require the payment of a fee, in an amount equal to the amount specified paragraphs (2) and (3), from any employer who files an Application for Permanent Employment Certification (Form ETA 9089) or any successor form, or any substantially similar application designated by the Secretary that requires recruitment to determine the availability of able, willing, qualified, and available United States workers, at the time such application is filed.</text></paragraph><paragraph id="id1ac9f694eda94c8f962054007fc78048"><enum>(2)</enum><header>Initial amount</header><text>During fiscal year 2027, the amount specified in this paragraph shall be the greater of—</text><subparagraph id="id9344b9e1a8224cb3b16204b790d2001b"><enum>(A)</enum><text>$10,000; or</text></subparagraph><subparagraph id="id74d64972006948b0b30438547a112a85"><enum>(B)</enum><text>such amount as the Secretary may establish, by rule.</text></subparagraph></paragraph><paragraph id="idcea48b2ac09342cdbb2189fe5f9eff8e"><enum>(3)</enum><header>Annual adjustments for inflation</header><text>During fiscal year 2028, and during each subsequent fiscal year, the amount specified in this paragraph shall be equal to the sum of—</text><subparagraph id="id8e8c58c864f940ad9a15ca0ad504bacb"><enum>(A)</enum><text>the amount of the fee required under this subsection for the most recently concluded fiscal year; and</text></subparagraph><subparagraph id="ida8f25940bb7d4ff1b00bb8c7a94e002d"><enum>(B)</enum><text>the product resulting from the multiplication of the amount referred to in subparagraph (A) by the percentage (if any) by which the Consumer Price Index for All Urban Consumers for the month of July preceding the date on which such adjustment takes effect exceeds the Consumer Price Index for All Urban Consumers for the same month of the preceding calendar year, rounded to the next lowest multiple of $10.</text></subparagraph></paragraph><paragraph id="idf9f41410a4334a57b53c5046da80c992"><enum>(4)</enum><header>PERM fee account</header><subparagraph id="id7a2000fe2dc9499790667c8666718a80"><enum>(A)</enum><header>Establishment</header><text>There is established in the general fund of the Treasury a separate account, which shall be known as the <quote>PERM Fee Account</quote> (referred to in this paragraph as the <quote>Account</quote>).</text></subparagraph><subparagraph id="id196a9e1190614cf2bb0425f3bbe4795c"><enum>(B)</enum><header>Deposits</header><text>Of the fees received under this subsection in a given fiscal year from employers filing applications for permanent employment certification—</text><clause id="id855f2125f6294e68a92dc57c95407b2d"><enum>(i)</enum><text>50 percent shall be deposited into the Account; and</text></clause><clause id="id4240f611b0ac497b82211a0f0c2a9ff4"><enum>(ii)</enum><text>50 percent shall be deposited into the general fund of the Treasury.</text></clause></subparagraph><subparagraph id="id30bb16dd68004d729cdc9c84acdab173"><enum>(C)</enum><header>Use of account funds</header><text>Of the fees deposited into the Account in a given fiscal year—</text><clause id="ide0d5f408e5ed4ddebe980f56bc25a96e"><enum>(i)</enum><text>50 percent shall be made available to the Secretary of Labor to expend without further appropriation; and</text></clause><clause id="id7fa66a1121e2434281435532788f571d"><enum>(ii)</enum><text>50 percent shall be made available to the Director of the Office of Personnel Management to expend without further appropriation to upgrade and maintain the capabilities of the USAJOBS website or any successor platform to host job advertisements and process job applications in order to facilitate labor market testing.</text></clause></subparagraph></paragraph><paragraph id="id8e4841d1baab42759d0a6b6de024e75b"><enum>(5)</enum><header>No fee waiver</header><text>Fees required to be paid under this subsection may not be waived or reduced.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
