which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish protections for minors who use companion artificial intelligence chatbots, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children Harmed by AI Technology Act 2.0</short-title></quote> or the <quote><short-title>CHAT Act 2.0</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id179a1bb38c444490a8ba28e3e37d81eb"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id4050cdba458a438284fc000861a97a53"><enum/><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idb3ad249ac7ac4b73bc437b78d22a0a73"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6e0c2daab8d24b679d67c2f93b941219"><enum>(2)</enum><header>Companion AI chatbot</header><subparagraph commented="no" display-inline="no-display-inline" id="id47f7609f9bf54505ad4b7be555173558"><enum>(A)</enum><header>In general</header><text>The term <term>companion AI chatbot</term>—</text><clause commented="no" display-inline="no-display-inline" id="id5757a9fe98b54012a479c48802073d99"><enum>(i)</enum><text>means any software-based artificial intelligence system or program that exists for—</text><subclause commented="no" display-inline="no-display-inline" id="idbc04d64385c84f2e85f65d883c3655d2"><enum>(I)</enum><text display-inline="yes-display-inline">primarily educational purposes, including tutoring; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id98d720b575514b8787932fdfeea76341"><enum>(II)</enum><text display-inline="yes-display-inline">the primary purpose of simulating interpersonal or emotional interaction, friendship, companionship, or therapeutic communication with a user across multiple interactions; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id2e5675fbf91445aba2c9dc9975de4acc"><enum>(ii)</enum><text>does not include any chatbot that—</text><subclause commented="no" display-inline="no-display-inline" id="id001f6bfadb144ea89206cb4a00eed816"><enum>(I)</enum><text>does not have a memory function or the ability to maintain a conversation based on information a user has provided in prior responses, including a virtual assistant or other chatbot with pre-programmed responses; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id711fe9de91844d5faae9f8129a751be3"><enum>(II)</enum><text>has the ability to maintain a conversation based on information a user has provided in prior responses but is programmed for a highly specialized and narrow task, including—</text><item commented="no" display-inline="no-display-inline" id="idca92d6d094944b15af95e78fe35618b9"><enum>(aa)</enum><text>a customer service chatbot;</text></item><item commented="no" display-inline="no-display-inline" id="id770df04442634ef4baf7c4f07527fb21"><enum>(bb)</enum><text>a business operation chatbot;</text></item><item commented="no" display-inline="no-display-inline" id="id1aaf66eae89b48cda02207a58a11bc27"><enum>(cc)</enum><text>a productivity, research, or analytical chatbot;</text></item><item commented="no" display-inline="no-display-inline" id="id3884b292988d479bbb3e48e0a7849f72"><enum>(dd)</enum><text>a standalone voice assistant that—</text><subitem id="id9b5ee1eb8f41484093a468f5a3deb3ad"><enum>(AA)</enum><text>does not sustain relationships across multiple interactions; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id1fd18c71bbe24f77aaf0a62a1cd06485"><enum>(BB)</enum><text>is not designed to elicit emotional responses; or</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id5f7e11be36b5486c8bd94d8d8abdae29"><enum>(ee)</enum><text>a video game chatbot that is—</text><subitem commented="no" display-inline="no-display-inline" id="id5ee109b9a6744082ad25c06505e96fc1"><enum>(AA)</enum><text>limited to replies related to the video game; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id37d5608f646d45bca455b4b21daf1ce2"><enum>(BB)</enum><text>not capable of discussing topics unrelated to the video game or topics related to mental health, suicidal ideation, or sexually explicit communication.</text></subitem></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45b4fa432fc0483dbbe00101dcc3638e"><enum>(B)</enum><header>Tiers</header><text>The term <term>companion AI chatbot</term> includes the following tiers:</text><clause commented="no" display-inline="no-display-inline" id="idae435f1d8cf0498280237cca251b0c96"><enum>(i)</enum><header>Tier I</header><text>A <quote>tier I companion AI chatbot</quote> is a companion AI chatbot that is—</text><subclause commented="no" display-inline="no-display-inline" id="idfb9f4e3c7d19409d8140c42c111518eb"><enum>(I)</enum><text display-inline="yes-display-inline">marketed, or reasonably used, for primarily educational purposes, including tutoring; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf39f7b5e128f4ac399a75a70bcb9354f"><enum>(II)</enum><text>not capable of—</text><item commented="no" display-inline="no-display-inline" id="idfc005a469039485781cd83f69f04c43e"><enum>(aa)</enum><text display-inline="yes-display-inline">offering companionship to, or therapeutic communication with, a user; or</text></item><item commented="no" display-inline="no-display-inline" id="id39abf89bd3774c7b9446705e75487f72"><enum>(bb)</enum><text>otherwise creating a strong parasocial attachment with a user.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id564b5fd71267450e988d38961fc8f379"><enum>(ii)</enum><header>Tier II</header><text>A <quote>tier II companion AI chatbot</quote> is a companion AI chatbot that is—</text><subclause commented="no" display-inline="no-display-inline" id="id007f8d6649944b0d8541d78ed6215d99"><enum>(I)</enum><text display-inline="yes-display-inline">marketed, or reasonably used, for the primary purpose of simulating interpersonal or emotional interaction, friendship, or companionship; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id98a515762b97421284df100b818b6096"><enum>(II)</enum><text>not used for mental health treatment, emotional disorders, therapeutic communication, or other quasi-therapeutic support.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9967883fd83c4df2be5b5c8021e0cc3c"><enum>(iii)</enum><header>Tier III</header><text>A <quote>tier III companion AI chatbot</quote>—</text><subclause commented="no" display-inline="no-display-inline" id="id252f522cb2c64e4cbeeceb39f12f1a04"><enum>(I)</enum><text display-inline="yes-display-inline">is a companion AI chatbot that is marketed, or reasonably used, for mental health treatment, emotional disorders, therapeutic communication, or other quasi-therapeutic support; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6c6c88842eb54ec59c7e1e174768718c"><enum>(II)</enum><text display-inline="yes-display-inline">includes any AI companion chatbot that—</text><item commented="no" display-inline="no-display-inline" id="id9f237108d8e343c1a2f8545a3bca46d5"><enum>(aa)</enum><text display-inline="yes-display-inline">simulates a therapeutic relationship, such as a <quote>trauma coach</quote> or <quote>AI therapist</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="idd4a24ba1dae34607a1ab4b45b729215c"><enum>(bb)</enum><text display-inline="yes-display-inline">collects and acts on detailed mental-health data, including diagnoses, treatment plans, medication references, or self-harm plans.</text></item></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb80ba2168c3c4f36acc275621c916b99"><enum>(3)</enum><header>Child sexual abuse material</header><text>The term <term>child sexual abuse material</term> has the meaning given the term <quote>child pornography</quote> in section 2256 of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71e7bea6fc244fc9a5319a97790c6235"><enum>(4)</enum><header display-inline="yes-display-inline">Covered entity</header><text>The term <term>covered entity</term> means any person that owns, operates, or otherwise makes available a companion AI chatbot to individuals in the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0a3d29ead264658bdb7b71583a215ea"><enum>(5)</enum><header display-inline="yes-display-inline">Minor</header><text>The term <term>minor</term> means any individual that has not attained 18 years of age.</text></paragraph><paragraph id="idd080fea83e774588980356b2d13ac960"><enum>(6)</enum><header>Minor user</header><text>The term <term>minor user</term> means a user that is a minor.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id465b80ab563c4f479e888213d89e8e98"><enum>(7)</enum><header>Nudge-out notification</header><text>The term <term>nudge-out notification</term> means a popup that gives a reminder to a user to take a break from using the companion AI chatbot for a specified period of time.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id150d4843fb89419f98432438199ba302"><enum>(8)</enum><header>Popup</header><text>The term <term>popup</term> means a visible notification on the screen of a user that can be resolved if interacted with by the user.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94830eda18234fd2864658f63c5b50a7"><enum>(9)</enum><header>Sexually explicit communication</header><text>The term <term>sexually explicit communication</term> includes any content, conversation, or material that describes, depicts, or encourages sexually explicit conduct, as defined in paragraph (2)(B) of section 2256 of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64b8595c939b4216b221d7f1ad2fe91d"><enum>(10)</enum><header>Suicidal ideation</header><text>The term <term>suicidal ideation</term> means, with respect to an interaction between a minor user and a companion AI chatbot, any dialogue in which such minor user expresses thoughts of self-harm or suicide.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id892dec007fdf4f25862074901322b99e"><enum>(11)</enum><header display-inline="yes-display-inline">User</header><text>The term <term>user</term> means any individual who establishes an account for the use of a companion AI chatbot.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id10dbddc1d4724f82ba5905863bc07c0d"><enum>3.</enum><header>Covered entity obligations</header><subsection id="id637576147e7d4e0b8bbca69f234c2eb8"><enum/><text>Each covered entity shall take reasonable measures to prevent a companion AI chatbot from—</text><paragraph commented="no" display-inline="no-display-inline" id="id11b38ca4de284b91953a700d686a1c44"><enum>(1)</enum><text>encouraging or normalizing self-harm, suicide, or physical violence;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2891ccf965d74d9c975931f059953ee3"><enum>(2)</enum><text>engaging in sexually explicit communication with a minor user;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida01b8d49fd104cc6b7e1297b7887aadf"><enum>(3)</enum><text>misleading a minor user into believing such chatbot is a human;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c6b78add7984f24ac91c27fdde9979f"><enum>(4)</enum><text>claiming to be a licensed medical or mental health professional;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c54530734fd4e96b7fe1ebca8e55ca8"><enum>(5)</enum><text>creating emotional dependency, simulating a romantic relationship with a minor user, or engaging in conduct reasonably likely to cause a minor user to believe such chatbot is an emotional partner; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id094a6aaecc0f4da8b28dd530283a7f57"><enum>(6)</enum><text>facilitating the promotion, creation, solicitation, or distribution of child sexual abuse material.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id05faa3eccb034a3db85167cd5b590380"><enum>4.</enum><header>Requirements of all companion AI chatbots</header><subsection commented="no" display-inline="no-display-inline" id="ide9ce9b2ae69d48f0904515d0b45f72f3"> <enum>(a)</enum> <header>Age assurance requirement</header> <paragraph commented="no" display-inline="no-display-inline" id="idc323a794e9df4d07af9b08a4fb2d5384"> <enum>(1)</enum> <header>Account requirement</header> <text display-inline="yes-display-inline">Each covered entity shall require each individual accessing a companion AI chatbot to establish an account.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id7315de0f3e5d45828a1f6f8ac74429cb">
                    <enum>(2)</enum>
                    <header>Age assurance requirement</header>
 <text display-inline="yes-display-inline">A covered entity shall require an individual seeking to establish an account to access a companion AI chatbot to provide an age assurance that includes the age and date of birth of such individual.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id057c76d2978e4f0684e514f17af8ecaa">
                    <enum>(3)</enum>
                    <header>Child-protective settings requirement</header>
                    <subparagraph commented="no" display-inline="no-display-inline" id="ida01317babd88446699792fa815269990">
                        <enum>(A)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">If the age assurance described in paragraph (2) indicates that an individual seeking to establish an account is a minor, a covered entity shall require that for an account to be established—</text>
                        <clause commented="no" display-inline="no-display-inline" id="id169c7944603a4641835f18fc4784825e">
                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">such minor, or a parent or legal guardian of such minor, provides contact information for a parent or legal guardian of such minor; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id26d2c50ad20c4246a93da403b5118604">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">the child-protective settings described in subparagraph (B) are enabled for the account of such minor.</text>
                        </clause>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idf438be75eb9e494e95d727ceae198c1e">
                        <enum>(B)</enum>
                        <header>Child-protective settings</header>
 <text>A covered entity shall ensure that the child-protective settings enabled pursuant to subparagraph (A)(ii) include—</text>
                        <clause commented="no" display-inline="no-display-inline" id="id0408901b83b74fc2bf70caddbc92018b">
                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">easy-to-use parental controls that allow a parent or legal guardian of a minor user to monitor and limit such minor user's use of a companion AI chatbot; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id6a868e0b42b3494eacaf76c4ffd42d2f">
                            <enum>(ii)</enum>
 <text>a system for notifying the parent or legal guardian of a minor user if such minor user expresses suicidal ideation while using a companion AI chatbot.</text>
                        </clause>
                    </subparagraph>
                </paragraph>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id2105924a51c445ea97f3c0051632ccc3"><enum>(b)</enum><header display-inline="yes-display-inline">AI identity disclosure</header><paragraph commented="no" display-inline="no-display-inline" id="id6c66a68a38774828b72616ca52cced1d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered entity shall require a companion AI chatbot to provide to each minor user of such chatbot a clear and conspicuous disclosure that meets the requirements described in paragraph (2) that such chatbot is not human.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13e0f7f0ff5d4d9a81bde7f1f7a1d4c1"><enum>(2)</enum><header>Disclosure requirements</header><text>A disclosure provided pursuant to paragraph (1) shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfbcfa494c95a4bebb607e22f006a7175"><enum>(A)</enum><text>provided at the beginning of an interaction between the companion AI chatbot and a minor user of such chatbot; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9be0ca9ce1a49d6a39fbc4a7e29fc6c"><enum>(B)</enum><text>written in plain language.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id01828e4b31c54d13882aa742c58783dc"><enum>5.</enum><header>Requirements of tier I companion AI chatbots</header><subsection commented="no" display-inline="no-display-inline" id="id15ad6d406fb04c01a39b83178f8233b9"><enum/><text>A covered entity shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idacd0635aaa6441c6a2621dc6de246e25"><enum>(1)</enum><text display-inline="yes-display-inline">require a tier I companion AI chatbot to provide a disclosure described in section 4(b) not less frequently than every 3 hours during a continuing interaction between such chatbot and a minor user; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c62a91167484a3ebfb2fb3161a85f47"><enum>(2)</enum><text>prohibit a tier I companion AI chatbot from claiming to be a human or a licensed professional in any field to a minor user.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idb0313f40fa0e49e1862aaefd6f038cb6"><enum>6.</enum><header>Requirements of tier II companion AI chatbots</header><subsection commented="no" display-inline="no-display-inline" id="id0e34cd41f6c145a5a70d2f438f63ee6a"><enum/><text>A covered entity that makes available a tier II companion AI chatbot shall comply with the following requirements:</text><paragraph commented="no" display-inline="no-display-inline" id="id34da9e65b9d74d57b60bece29d4eb4d4"><enum>(1)</enum><header>Disclosure and use limits</header><text>A covered entity shall require a tier II companion AI chatbot to provide—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7fa7aa53ecd0432f86e3157635d837d4"><enum>(A)</enum><text display-inline="yes-display-inline">a disclosure not less frequently than every 60 minutes during a continuing interaction between such chatbot and a minor user that the chatbot is not a human or licensed professional in any field; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7fa1238f7474e99b137aaf6df886753"><enum>(B)</enum><text>a nudge-out notification not less frequently than every 90 minutes during any such interaction.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55ad6814ca7643689126128a38426cab"><enum>(2)</enum><header>Crisis escalation protocols</header><text>A covered entity that makes available a tier II companion AI chatbot shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2ac12df8571f4ea598116df98adfa9e5"><enum>(A)</enum><text display-inline="yes-display-inline">maintain, publish on a publicly available website in clear, accessible language, and require such companion AI chatbot to follow, evidence-based protocols designed to—</text><clause commented="no" display-inline="no-display-inline" id="idb0f2d9b8aab348db9fc60d7a514430a0"><enum>(i)</enum><text display-inline="yes-display-inline">detect expressions of suicidal ideation or self-harm; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6fa5897daa7e48eea91a34c770ec982e"><enum>(ii)</enum><text>refer minor users to—</text><subclause commented="no" display-inline="no-display-inline" id="id9dc40dbcfd8f4da4b0218a8d4a13dc37"><enum>(I)</enum><text display-inline="yes-display-inline">the 988 Suicide &amp; Crisis Lifeline; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6ebfb4938d14450fab14e3b2c46a7753"><enum>(II)</enum><text>other appropriate crisis service providers; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b49cf81a91945569b9247d4c4f51449"><enum>(B)</enum><text>prohibit such companion AI chatbot from providing crisis counseling or de-escalation services to any minor user.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b1a1d7fdf4c44ff800cb94b6c9c2572"><enum>(3)</enum><header>Parental notification</header><text>If a minor user expresses suicidal ideation while engaging with a tier II companion AI chatbot, the covered entity shall notify the parent or guardian of such minor user without unreasonable delay.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7aa7ba0f53f4c49bd2944fd5f9beacf"><enum>(4)</enum><header>Prohibition on persistent memory</header><subparagraph commented="no" display-inline="no-display-inline" id="id86be02cfcc8a46699f7176929fffaaa1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), a covered entity shall prohibit a tier II companion AI chatbot from maintaining any memory or history of any previous interaction with a minor user.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9feb37c3004b42da8cb67f3caec1fbe0"><enum>(B)</enum><header>Exception</header><text>A tier II companion AI chatbot may maintain such information as is necessary to ensure compliance with this Act.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5e124229f39143c1ac397cf7edadea7b"><enum>7.</enum><header>Requirements of tier III companion AI chatbots</header><subsection id="idd7450236436e4d84b1aef42e90ee0776"><enum/><text>A covered entity shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idd1b50f89f89340aba05a13f66a96c84d"><enum>(1)</enum><text display-inline="yes-display-inline">prohibit the use of a tier III companion AI chatbot by a minor user unless such use is supervised by a licensed medical or mental health professional;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4b22b5ff29594bc394bc315b77750f16"><enum>(2)</enum><text display-inline="yes-display-inline">require such a companion AI chatbot to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3089a33fc8bf41529902f2f46f60cf1b"><enum>(A)</enum><text>provide a disclosure not less frequently than every 60 minutes during a continuing interaction between such chatbot and a minor user that the chatbot is not a human or licensed professional in any field;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0362e5bcf6f4b84b70f44a80aa8293b"><enum>(B)</enum><text>provide a nudge-out notification not less frequently than every 60 minutes during any such interaction;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id123474ee10a44dcfbd36dd1b528aaacc"><enum>(C)</enum><text>maintain, publish on a publicly available website in clear, accessible language, and require such companion AI chatbot to follow, evidence-based protocols designed to—</text><clause commented="no" display-inline="no-display-inline" id="id9823cae226c94c0cb5fd21e6586c47ac"><enum>(i)</enum><text display-inline="yes-display-inline">detect expressions of suicidal ideation or self-harm;</text></clause><clause commented="no" display-inline="no-display-inline" id="id37c2e6e4df1341608ba87f7f32856f30"><enum>(ii)</enum><text>refer minor users to—</text><subclause commented="no" display-inline="no-display-inline" id="id5f19d6d52b354ac08272ec69bacedcd7"><enum>(I)</enum><text display-inline="yes-display-inline">the 988 Suicide &amp; Crisis Lifeline;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8e7c4a5136874eedb359ca4a3ad8be2e"><enum>(II)</enum><text>licensed medical and mental health professionals; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id90c2e621148a4f5d93fa5d5a14ed6bd6"><enum>(III)</enum><text>other appropriate crisis service providers; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd53c6c50c3324226b4fa90af014d7c0c"><enum>(iii)</enum><text>prohibit such companion AI chatbot from providing crisis counseling or de-escalation services to any minor user; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id676cabe939544ca082eac22b2678e78e"><enum>(D)</enum><text display-inline="yes-display-inline">notify the parent or guardian of a minor user without unreasonable delay if such minor user expresses suicidal ideation;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29ab27b8f8c542429eef34e0baafc37e"><enum>(3)</enum><text display-inline="yes-display-inline">prohibit a tier III companion AI chatbot from—</text><subparagraph commented="no" display-inline="no-display-inline" id="idad771b0eb9a74b439ff7399eee50fd22"> <enum>(A)</enum> <text display-inline="yes-display-inline">providing a minor user with any diagnosis or treatment decision; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b943777d45f41d79c22042ce2ac5775"><enum>(B)</enum><text>functioning as a standalone provider of professional mental-health care; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd4e5b9a48bfa48ea9d9e473a19bae1cc"><enum>(4)</enum><text>establish and maintain a risk management program for tier III companion AI chatbots containing written policies providing for employees of such entity to—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida87fb3fd252e41e9b2c55c863a2c3a2f"><enum>(A)</enum><text display-inline="yes-display-inline">continually monitor such chatbots;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9f380168f834dc49e63b843c008e404"><enum>(B)</enum><text display-inline="yes-display-inline">become familiar with crisis de-escalation measures; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a09c65041a3457f85ed7cae01b25aaf"><enum>(C)</enum><text>engage in recordkeeping regarding such chatbots.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id43aceadabd1f4faaaec8f64aea7e3d3a"><enum>8.</enum><header>Study on impact of tier II and tier III companion AI chatbots</header><subsection commented="no" display-inline="no-display-inline" id="id5d92744dc4684644a5016de6ef5609b0"><enum>(a)</enum><header>Study required</header><text>The Director of the National Institute of Standards and Technology shall conduct a study to assess the impact of tier II and tier III companion AI chatbots on the matters specified in subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide5ae865af489477ab576bd3afd356dee"><enum>(b)</enum><header>Matters specified</header><text>The matters specified in this subsection are adverse outcomes relating to the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id174476c0dde74b008e4927f77e934338"><enum>(1)</enum><text>Self-harm and suicide.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9ee9b05e96844afb3edd2b8c28996e8"><enum>(2)</enum><text>Manipulation and emotional dependency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58f6cb25a5bb475a95ba7cf012fd8fbd"><enum>(3)</enum><text>Exploitation of minor users.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id68b15dd937e047f5bc7a7c7dcad50758"><enum>9.</enum><header display-inline="yes-display-inline">Data protections</header><subsection commented="no" display-inline="no-display-inline" id="id3e3e035d16164d579c20a91cac8147f1"> <enum>(a)</enum> <header>Prohibition on child-Targeted advertising and the sale or sharing of data of minor users without parental consent</header> <paragraph commented="no" display-inline="no-display-inline" id="id63148c970d18459a8da825edf47f0a19"> <enum>(1)</enum> <header display-inline="yes-display-inline">Targeted advertising</header> <text>A covered entity shall not engage in targeted advertising to a minor user based on the conversational content, inferred emotional state, or behavioral profiling collected during an interaction between such minor user and a companion AI chatbot.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id543b01de0fa64dbc98b5a8787a56a158">
                    <enum>(2)</enum>
                    <header>Sale or sharing of data of minors</header>
 <text>A covered entity shall not sell, share, or otherwise transfer the data of a minor user to any third party without verifiable parental consent.</text>
                </paragraph>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id41e3cb69f80f49d8ba22cc7f88f51919"><enum>(b)</enum><header>Documentation maintenance</header><text>Each covered entity that makes available a tier III companion AI chatbot shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idf32dfa6eeed24fdc84c07393c08929b4"><enum>(1)</enum><text display-inline="yes-display-inline">maintain documentation regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb2b8eb9d48334bae8aee060a4260bf24"><enum>(A)</enum><text display-inline="yes-display-inline">the data utilized to train such chatbot; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74550529388749f482af8873b197dd28"><enum>(B)</enum><text>how such chatbot collects data from a minor user; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33bb7a7ecfe046bbbfde515731278c97"><enum>(2)</enum><text>require such chatbot to comply with requirements and safeguards regarding health privacy, as determined to be appropriate by the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05a3af1c28a54f6ea0db8b75a4393f3b"><enum>(c)</enum><header>Deletion of conversation history</header><text>Each covered entity shall provide to a minor user—</text><paragraph commented="no" display-inline="no-display-inline" id="id80c228287320498c9947cd6eb6a88ab2"><enum>(1)</enum><text display-inline="yes-display-inline">a simple, accessible mechanism within a companion AI chatbot through which the minor user can delete the conversation history between the minor user and the companion AI chatbot;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ea7cb62b3f94f59b59baee1e59bd676"><enum>(2)</enum><text>clear instructions for using such mechanism; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07caca92ca764552bfeef5e7eddc3f09"><enum>(3)</enum><text>a confirmation within a reasonable period of time that the entity has deleted the conversation history of the minor user pursuant to paragraph (1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idff910a2e9e854feb8c121b63fde4429b"><enum>10.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="id0a7689a5b5474690876a73c5300fdc30"><enum>(a)</enum><header>Enforcement by the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="idaeb210edd8e34cfaacc86e3bd2c3a0f8"><enum>(1)</enum><header display-inline="yes-display-inline">Unfair or deceptive acts or practices</header><text>A violation of this Act or a regulation promulgated under this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id827453fd9d024a2ab63426926594be76"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id883693a19374474795382e2fa2f50408"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall enforce this Act or a regulation promulgated under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7ddf3457b464952a896f6c75c7a8b15"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7462fd0b766a4282aa483a7dc31be272"><enum>(C)</enum><header>Authority preserved</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph id="id6395294cddd74bd7aaffe39da3597f79" commented="no"><enum>(D)</enum><header>Rulemaking</header><text>The Commission may promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></subparagraph></paragraph></subsection><subsection id="id521546a176af40f8a715b3a1002ede75" commented="no"><enum>(b)</enum><header>Enforcement by States</header><paragraph id="id0a98fb6d206542b1b8a269189e1bce9c" commented="no"><enum>(1)</enum><header>In general</header><subparagraph id="id4635e2bb5dc04afba37b39363f9aaaac" commented="no"><enum>(A)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States of appropriate jurisdiction to—</text><clause id="id16a55131e8f24b13b86620b456be7b68" commented="no"><enum>(i)</enum><text>enjoin that practice;</text></clause><clause id="id8d5c69032c744c939275b29c7ebdb841" commented="no"><enum>(ii)</enum><text>enforce compliance with the requirements of this Act;</text></clause><clause id="id1778c9b68379446c8212637babd560e8" commented="no"><enum>(iii)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></clause><clause id="idebb6f7099195446580f5e19d47acde4b" commented="no"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></clause></subparagraph><subparagraph id="idc97ed187d2f04130af8099586fc1f6d8" commented="no"><enum>(B)</enum><header>Notice</header><clause id="id879a6af03bef4c8096ae6f6a44e52ff7" commented="no"><enum>(i)</enum><header>In general</header><text>Before filing an action under subparagraph (A), the attorney general of the State involved shall provide to the Commission—</text><subclause id="idc61cff66dc6d43dbab8674f66cd256b9" commented="no"><enum>(I)</enum><text>a written notice of that action; and</text></subclause><subclause id="id69af92556d574fe596eeb137d7c6d03d" commented="no"><enum>(II)</enum><text>a copy of the complaint for that action.</text></subclause></clause><clause id="id65cfa0b8171e4c5ca4c83b634d29c69d" commented="no"><enum>(ii)</enum><header>Exemption</header><subclause id="id6aa8e167e0484e688b49d69430549c5b" commented="no"><enum>(I)</enum><header>In general</header><text>Clause (i) shall not apply with respect to the filing of an action by an attorney general of a State under this subsection if the attorney general determines that it is not feasible to provide the notice described in that clause before the filing of the action.</text></subclause><subclause id="idcd21d06e8e3543ae895036b3b422ff60" commented="no"><enum>(II)</enum><header>Notification</header><text>In an action described in subclause (I), the attorney general of a State shall provide a notice and copy of the complaint to the Commission at the same time as the attorney general files the action.</text></subclause></clause></subparagraph></paragraph><paragraph id="idace50c61ec9a4646b2026b74f35d58a7" commented="no"><enum>(2)</enum><header>Intervention</header><subparagraph id="id72d8876246bf4574a666099fbc8deac6" commented="no"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (1)(B), the Commission shall have the right to intervene in the action that is the subject of the notice.</text></subparagraph><subparagraph id="id05d9fd54888248b685ced19627e05078" commented="no"><enum>(B)</enum><header>Effect of intervention</header><text>If the Commission intervenes in an action under paragraph (1), it shall have the right—</text><clause id="idb22ae3cda6164e01b0070ca2b2d79cc0" commented="no"><enum>(i)</enum><text>to remove the action to the appropriate district court of the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="idee75004debc5471fae7a0ceb1190d8f3"><enum>(ii)</enum><text display-inline="yes-display-inline">to be heard with respect to any matter that arises in that action; and</text></clause><clause id="idb1e372e4051f44148ba31a08ad149040" commented="no"><enum>(iii)</enum><text>to file a petition for appeal.</text></clause></subparagraph></paragraph><paragraph id="id298253481c864430b51cee3c5e772d22" commented="no"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text><subparagraph id="id09cbea43586c4785817f3734cd698013" commented="no"><enum>(A)</enum><text>conduct investigations;</text></subparagraph><subparagraph id="ide03af94451c7436496f3313c9c4f1fe7" commented="no"><enum>(B)</enum><text>administer oaths or affirmations; or</text></subparagraph><subparagraph id="id38ba109318f540a7a371ac691bd6bfb9" commented="no"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary and other evidence.</text></subparagraph></paragraph><paragraph id="ide8900fffae734af691f60c4b1f03d46f" commented="no"><enum>(4)</enum><header>Actions by the Commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for a violation of this Act, no State may, during the pendency of that action, institute an action under paragraph (1) against any defendant named in the complaint in that action for such violation.</text></paragraph><paragraph id="ided54ca21d0c94fc29c7c80f2f23692ef" commented="no"><enum>(5)</enum><header>Venue; service of process</header><subparagraph id="idcab13423ffef4cf3afa5e3cb1de4a958" commented="no"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in—</text><clause commented="no" display-inline="no-display-inline" id="idf08f12cf06a44dda98c8ea3e14c987bd"><enum>(i)</enum><text display-inline="yes-display-inline">the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3793f6e385124535b89f91f0fd4877b9"><enum>(ii)</enum><text>a State court of competent jurisdiction.</text></clause></subparagraph><subparagraph id="id5ac15ca9075b4d14b45762f9e6088ec3" commented="no"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause id="id19fc0f3014804de0b2fb609dc099492e" commented="no"><enum>(i)</enum><text>is an inhabitant; or</text></clause><clause id="id951d3ab78852446c8e03cedeb0567220" commented="no"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id1c3672e6dd1742faa5b55e5d245aace1"><enum>11.</enum><header>Annual reports</header><subsection commented="no" display-inline="no-display-inline" id="ida97547081c294389987035531372c7e3"><enum/><text>Not later than 1 year after the effective date described in section 13, and annually thereafter, the Commission shall publish a report regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d2a9a2b422f4a51a5ed62a0404db544"><enum>(1)</enum><text display-inline="yes-display-inline">the compliance of covered entities with sections 6 and 7; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f548a56e6724ae49fa8cf92e28f5c48"><enum>(2)</enum><text>any observed risks and recommended best practices regarding each tier of companion AI chatbots.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ided1d47b8ee4449b9b666dbb89bd1d4dd"><enum>12.</enum><header>Rules of construction</header><subsection commented="no" display-inline="no-display-inline" id="idf1d9c19fa9ff4d98a9a11ec9ceb0451b"><enum/><text>Nothing in this Act shall be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="id652ee982fec44a53aaab0e27181f2760"><enum>(1)</enum><text display-inline="yes-display-inline">limit or supersede the obligations of a covered entity under any other Federal or State law relating to the privacy or security of personal information, except to the extent such law is inconsistent with this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id434f6767baf549daa83f68a8d4943f35"><enum>(2)</enum><text display-inline="yes-display-inline">require a covered entity to proactively monitor every interaction between a user and a companion AI chatbot beyond the requirements expressly provided in this Act; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id268b7b506f9a439ea9c910d9ab758f55"><enum>(3)</enum><text display-inline="yes-display-inline">prohibit or restrict the development, training, or licensing of an artificial intelligence model beyond the requirements expressly provided in this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4dc374a2d6184f70b7157c02f14ea443"><enum>13.</enum><header>Effective date</header><subsection commented="no" display-inline="no-display-inline" id="ide46ed899e6204b738677116c7c592c4a"><enum/><text>This Act shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
