<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5153</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260728">July 28, 2026</action-date><action-desc><sponsor name-id="S431">Mr. Curtis</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a quorum of Federal Trade Commissioners to undertake certain rulemaking and policymaking actions, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Trade Commission Governance Reform Act</short-title></quote>.</text></section><section id="idb31a3b8083044e78ac65aabb00ffc40b"><enum>2.</enum><header>Quorum for rulemaking and other Commission activities</header><subsection commented="no" display-inline="no-display-inline" id="id3799b23abce84a139b7930934af43270"><enum>(a)</enum><header>Amendment</header><text>The first section of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref>) is amended by striking the period in the penultimate sentence and inserting “, except that the Commission shall maintain a quorum of not fewer than 3 Commissioners before taking any Commission action that establishes, revises, or rescinds generally applicable policy, guidance, or interpretations concerning the administration or enforcement of any provision of law enforced by the Commission, including—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6777b88b4bab4a95b5f4dd6b78c2190d"><paragraph commented="no" display-inline="no-display-inline" id="ida3cc0dc740704f7c834b7587c7fb48eb"><enum>(1)</enum><text display-inline="yes-display-inline">initiating, advancing, rescinding, or completing any rulemaking proceeding, regardless of whether such rulemaking proceeding is conducted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, the Magnuson-Moss Warranty—Federal Trade Commission Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2301">15 U.S.C. 2301 et seq.</external-xref>), or any other statutory authority;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id773ab59c87bf4ee4be498f3c8f15d7aa"><enum>(2)</enum><text display-inline="yes-display-inline">adopting, amending, or rescinding any policy statement, interpretive rule, industry guide, or enforcement policy statement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1868eb4e667540f1956a5c6bacd1a92c"><enum>(3)</enum><text display-inline="yes-display-inline">adopting, amending, or rescinding any other formal Commission action that establishes, revises, or rescinds generally applicable policy, guidance, or interpretations concerning the administration or enforcement of any provision of law enforced by the Commission.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id87b9f5f52c8944c6b9fe2164347ee9f0"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on January 20, 2029.</text></subsection></section></legis-body></bill>
