BILL</legis-type><official-title>To establish requirements for patriotic observances in elementary and secondary schools of the District of Columbia.</official-title></form><legis-body><section id="id820756473deb4a7da89055b46240c626" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Loyalty, Engagement, Duty, and Gratitude in Education Act</short-title></quote> or the <quote><short-title>PLEDGE Act</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Patriotic observances in District of Columbia schools</header><subsection commented="no" display-inline="no-display-inline" id="id610a9fd2e61e491ca2952401aa2a6362"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>District of Columbia school</term> means an elementary school or secondary school in the District of Columbia.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide91cf8c579994785a3c56a995e2c6892"><enum>(b)</enum><header>Flag</header><text>Each District of Columbia school shall cause the flag of the United States of America to be displayed in each classroom during the hours of each school day.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb3f8cef51f9c446daa775971cdec71c3"><enum>(c)</enum><header display-inline="yes-display-inline">National anthem</header><text>When the national anthem is played in a District of Columbia school, each student or civilian shall stand at attention.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6f9a1ce44b984155ab6e3c918df41a26"><enum>(d)</enum><header>Pledge of allegiance</header><paragraph commented="no" display-inline="no-display-inline" id="id28f0fb56a8384d6a9b2f240f1e062b0a"><enum>(1)</enum><header display-inline="yes-display-inline">Manner of recitation</header><text>When the Pledge of Allegiance to the Flag (in this subsection referred to as the <term>Pledge</term>), <quote>I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all.</quote>, is recited in a District of Columbia school, each student shall recite the Pledge while standing with the right hand over the heart.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce3f680ccd634684b73feaa3b6505e03"><enum>(2)</enum><header>Daily recitation</header><text display-inline="yes-display-inline">The Pledge shall be recited at the beginning of the day in each District of Columbia school.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb80fe2b6b5284d50acc783f4aae40eea"><enum>(3)</enum><header>Opt-out with parental consent</header><subparagraph commented="no" display-inline="no-display-inline" id="idcd5a4757cfb843fa9660f1581dc6951d"><enum>(A)</enum><header display-inline="yes-display-inline">Notice to students</header><text display-inline="yes-display-inline">A District of Columbia school shall inform each student by a written notice published in the student handbook or a similar publication that the student has the right not to participate in reciting the Pledge, subject to the requirements of this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf9587d3d9b454ed39e47d7ff6dc321ed"><enum>(B)</enum><header>Written request from parent</header><text display-inline="yes-display-inline">Upon written request by the parent of a student, a District of Columbia school shall excuse the student from reciting the Pledge, including from standing and placing the right hand over the heart.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ab8076fb5fa4c639cb59a76815b1429"><enum>(4)</enum><header>No disruption or distraction</header><text display-inline="yes-display-inline">No student may make any display that disrupts or distracts other students who are reciting the Pledge in a District of Columbia school.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e575c954a4340baa19e184d4dee082c"><enum>(5)</enum><header>Accommodations</header><text display-inline="yes-display-inline">A District of Columbia school shall make a reasonable modification, under title II of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>), for any student who is unable to comply because of a disability (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)) with the procedures under this subsection.</text></paragraph></subsection></section></legis-body></bill>
